HE BLEW LIVE IN CARMEL AND DOWNSIZE AND WILL BE IN CARMEL AND HAVE AN OPTION FOR THAT. THE SITE DOES NOT CURRENTLY HAVE ANY TREE PRESERVATION IN PLACE. THIS IS THE COMPREHENSIVE LANDING FOR THIS PAREA OF THE COMMUNITY THAT IS CURRENTLY A POLICY OF THE CITY OF CARMEL. IT IDENTIFIES THE AREA IN BLUE AS A FUTURE COMMERCIAL. STAFF IDENTIFIED THIS IN THE STAFF REPORT SO IF YOU READ THE STAFF REPORT BEARS MEMBERS OF THE PUBLIC WHO REVIEW THE STAFF REPORT AND SEE THAT IT IDENTIFIES PARCELS OFF OF 196 STREET OF BEING PARCELS THAT ARE CONSIDERED FOR FUTRE COMMERCIAL DEVELOPMENT. IF YOU ARE FAMILIAR WITH THIS THERE'S APPROXIMATELY 300 UNIT APARTMENT COMPLEX TITLED THE EDGE THAT'S BEING DEVELOPED ON THE SOUTH SIDE OF 96 STREET. IF YOU'VE GONE BY THEIR YOU CAN SEE CONCRETE AND STEEL GOING UP FOR THREE AND FOUR STORY BUILDINGS ON THE SOUTH SIDE OF ONE HER 45TH ST. PROXIMALLY 300 UNITS WHICH IS TWICE THE DENSITY THAT IS PROPOSED FOR THIS DEVELOPMENT AND INDICATED WITH THE DENSITY IT IS MODERATE TO THE MODERATE DENSITY IS SUPPORTED BY STAFF YOUR PROFESSIONAL PLANNING STAFF IS PREPARED TO REPORT TO YOU. STAFF LEAVES IT'S AN APPROPRIATE TRANSITION FROM 96 STREET WHICH IS THEIR VIEW NOT MINE AND STAFF REPORT IDENTIFIED THAT IT HAS A COMMERCIAL CHARACTER ALONG SEGMENT OF 96 STREET FROM WESTFIELD BOULEVARD OVER TO KEYSTONE. AGAIN, THAT'S MY OBSERVATION BASED ON WHAT'S IN THE CURRENT THINNING DOCUMENT THAT THE CITY HAS NOT THE EDITORIAL ON WHAT IS PRESENT IN THAT VICINITY TODAY. ESTRICH BELIEVES THIS PROPOSAL OF A MODERN INTENSITY WOULD BE A GOOD TRANSITION ALONG 96 STREET. WORK WITH STAFF. WE HAVE RECEIVED INPUT FROM THE PUBLIC AND I THINK THERE'S COMMENTS ABOUT THE INTERACTION AND WHAT WE HAVE DONE OR WHAT ESTRICH HAS DONE HE REACHED OUT TO PAT RICE INITIALLY AT THE REQUEST OF STAFF BECAUSE PAT HAD PREVIOUSLY BEEN ON THE PLANNING COMMISSION AND TO CLINT REACHED OUT TO HER AND THEY HAD A MEETING IN THE NEIGHBOR'S PROPERTY IMMEDIATELY ADJACENT OF WILD CHERRY LANE A FEW WEEKS AGO AND IN ADDITION TO THAT HAD A NEIGHBORHOOD MEETING A COUPLE OF WEEKS AGO AT THE TOWNSHIP FOR THE BUILDING AT COLLEGE AND 106 STREET. WE NOTIFIED EVERYBODY THAT WE SENT NOTICE OUT TO THAT IT IS A TRADITIONAL PROCESS THE PLANNING COMMISSION HAS IN PLACE. THIS RADIUS BETWEEN SOCIAL MEDIA AND OTHER AVENUES WE FEEL LIKE THERE IS A GOOD MESSAGE OUT THERE FOR THE PEOPLE THAT ARE INTERESTED IN THE PRODUCT AND THEY WOULD HAVE AN OPPORTUNITY TO PARTICIPATE. JUST A COUPLE OTHER ITEMS WITH REGARDS TO TREE PRESERVATION, STAFF HAS SUGGESTED MODIFICATION TO THE PLAN THAT [00:45:03] WOULD ENHANCE SPACE AND REQUIRE 15 PERCENT TO RESERVATION IN THE PLAN BUT LARGER AREAS THAT ARE SHOWN TODAY THE STAFF HAS REQUESTED A FEW OTHER ITEMS THAT ARE IDENTIFIED IN THE STAFF REPORT. A NOTE WAS MADE ABOUT AN EXISTING PLAT. WILD CHERRY CORNER IS AN UNRECORDED PLAT FROM THE 1950S. SEVERAL OF THE PROPERTIES THAT THE ORIGINAL OWNER TRANSFER TITLE TO CAME WITH THESE RESTRICTIONS AND THERE WAS A NOTE IN THE WRITTEN COMMUNICATION TO THE PLANNING COMMISSION THAT THOSE DEED RESTRICTIONS WOULD PREVENT DEVELOPMENT OF THE PROPERTY AS PROPOSED ALTHOUGH BE AT THOSE DEED RESTRICTIONS WEREN'T ATTACHED TO THIS PROPERTY TO THE OWNER WHATEVER REASON WHEN THEY TRANSFER THE TITLE TO OTHER PROPERTIES IN THE VICINITY DID NOT TRANSFER A TITLE TO THIS PROPERTY DUE TO DEED RESTRICTIONS THAT ARE OUT THERE. THERE IS A SUB AREA PLAN FOR 96 STREET AND WESTFIELD BOULEVARD THAT WENT THROUGH THE PUBLIC PROCESS IN 2009. IT ALLOWS FOR EMPLOYMENT USES ALONG THIS SECTION 95TH ST. AND CALLS FOR PRESERVATION AND INSTALLATION OF TREE CANOPY. IT TALKS ABOUT BUFFERING STABLE NEIGHBORHOODS FROM REDEVELOPMENT AND UTILIZING TRADITIONAL LAND USES AND FORMS TO SOFTEN IMPACTS OF POTENTIALLY LARGE-SCALE OFFICE DEVELOPMENT SOUTH OF 96 STREET. THIS IS A LONG-TERM VISION FOR THE AREA NORTH AND WEST OF THE SITE THE COMP PLAN ALSO CALLS FOR EMPLOYMENT USES ALONG 96 STREET ABOUT 2 TO 3 PROPERTIES DEEP EAST OF THE SITE IS EXISTED COMMERCIAL AREA SOUTH OF THE INDIANAPOLIS PLAN OF OFFICE AND COMMERCIAL. WE BELIEVE THAT THEY SUPPORT THE PD REZONE. IF THEIR SENSITIVITY TO ADJACENT AREAS AND APPROPRIATE TRANSMISSIONS WITH REASONABLE TREE PRESERVATION WE BELIEVE TOWNHOMES COULD BE A GOOD FIT FOR THE SITE IF AS IT WOULD KEEP A RESIDENTIAL USE IN THE AREA INSTEAD OF A COMMERCIAL USE OR OFFICE USE AND IT OFFERS A MODERATE DENSITY DEVELOPMENT THAT IS ONLY THREE STORIES. HOWEVER, APPROPRIATE TRANSITIONS AND TREE PRESERVATION WILL BE IMPORTANT TO ENSURE SENSITIVITY TO ADJACENT SINGLE-FAMILY HOMES. NOW GETTING INTO THE PUD AND SITE PLAN. AS IT STATED THE PROPOSED TOWNHOMES ARE LOCATED ALSO TO 96 STREET WHICH WILL ALLOW THE PARKING TO BE BEHIND. THE UNITS IN EACH BUILDING ARE STAGGERED PROVIDING A NICE VARIATION ALONG THE STREETSCAPE. PEDESTRIAN CONNECTIVITY WILL BE PROVIDED BY ADDING A SIDEWALK ALONG WILD CHERRY LANE AS WELL AS A PATH AROUND HAVERSTICK AND THIS WOULD BE TRANSFERRED TO THEIR PORTION OF THE STREET THEY WOULD NOT EXTEND IT OFF OF THEIR PROPERTY BUT FOR THEIR MISSION THEY WOULD INSTALL THE SIDEWALK AND PATH. THE PUD INCLUDES ARCHITECTURE CHARACTER TO BE TOWNHOMES AND REQUIRES ALL STRUCTURES TO BE DEVELOPED IN SUBSTANTIAL COMPLIANCE WITH THAT IMAGERY SUBJECT TO A DLS APPROVAL. THIS MEANS THAT WHAT WE HAVE SEEN IN THIS BEAUTY IS WHAT WE CAN EXPECT TO BE BUILT AND AGAIN THEY WOULD NEED TO COME BACK WITH A DEVELOPMENT PLAN ADL APPROVAL. FOUNDATION PLANTINGS ENTRIES WILL BE REQUIRED. A 15 FOOT BUFFER YARD AND TREE PRESERVATION AREA IS PROPOSED ALONG THE NORTHERN PERIMETER AND STAFF HAS ASKED FOR THE AMOUNT OF TREE PRESERVATION TO BE INCREASED. IT'S OUR BELIEF THAT IT'S UNREASONABLE TO ASK FOR ALL THE TREES TO BE PRESERVED AS THIS IS A FULLY WOODED SITE WHOEVER IT SEEMS ONLY A SMALL AMOUNT ARE PROPOSED TO BE PRESERVED TODAY. WE WOULD LIKE TO SEE A LARGER WIDER AREA OF TREE PRESERVATION THAT WOULD SAVE MORE TREES AND IMPROVE THE HEALTH OF THE TREES IN THOSE AREAS. WE CONTINUE TO REVIEW THE PUD AND WORK WITH THE PETITIONER ON ALL THE REVIEW COMMENTS AS IT MOVES ON TO THE COMMITTEE. WE DO HAVE MANY [00:50:11] OUTSTANDING COMMENTS ON THE PUD AND I LISTED A FEW IN THE DEPARTMENT REPORT AND I WANTED TO CLARIFY ONE OF THOSE IN REGARDS TO WILD CHERRY LANE. IT IS CITY POLICY THAT ANYTIME THERE IS A NEW DEVELOPMENT WE ASKED THE RIGHT-OF-WAY TO BE DEDICATED ALONG THAT PORTION OF THE STREET. WE HAVE ASKED FOR WILD CHERRY LANE TO DEDICATE THEIR 28 FOOT HALF BUT AGAIN THAT'S JUST FOR THEIR SEGMENT OF THE STREET IT WOULD NOT BE FOR ALL OF WILD CHERRY LANE TODAY JUST FOR THE PART THAT THEY OWN ALONG THIS PROPERTY. IN CARMEL WE DON'T HAVE ROAD IMPACT FEES INSTEAD WE ASKED DEVELOPERS TO GIVE A PORTION OF THE STREET AND DO IMPROVEMENTS ON THEIR SEGMENT OF THE STREET AS SEEN ON THE CITY'S TRANSPORTATION PLAN. WE HAVE DONE THAT BY CREATING DRY DETENTION INSTEAD OF SUBSTANTIAL UNDERGROUND DETENTION THAT WAS REQUIRED OR OUR SITE PLAN REQUIRED. THIS STILL HAS A SMALL AMOUNT OF UNDERGROUND RETENTION BUT THE PREVIOUS ONE I SHOWED THE ONLY DETENTION WAS UNDERGROUND. WHAT WE HAVE BEEN WORKING TOWARDS IS FINDING THAT THIS WOULD REMOVE A BUILDING THAT WOULD BE AT THIS PROPERTY AND THEN AT THIS PROPERTY AS WELL IN WHICH WE UNDERSTAND THAT IT WAS A CERTAINLY MAJOR ISSUE OF THE PEOPLE WHO SPOKE. THIS HOLDS A WIDER BUFFER TO THE NORTH SIDE AND ACTUALLY FROM HERE TO HERE IT IS A SUBSTANTIAL BUILDING BECAUSE THE CLOSEST BUILDING WOULD NOT BE UNTIL HERE. >> THAT IS A STEP IN THE RIGHT DIRECTION FOR SURE. WITH ME TONIGHT IS JOHN MCKENZIE THE PRESIDENT AND OWNER OF MCKINSEY COLLECTIONS WHO IS BUILDING THE TOWNHOMES THAT YOU ARE REVIEWING AND HOPEFULLY APPROVING TONIGHT. AS EVERYONE SAID THE LOCATION OF OUR SITE IS THE NORTHWEST CORNER OF 116TH AND SPRINGVILLE. WE ARE IMMEDIATELY SOUTH OF THE JACKSON'S GRANT COMMUNITY AND YOU CAN SEE ON THE MAP IT IS THE AREA THAT IS SURROUNDED IN GREEN. WE ARE HERE TONIGHT SEEKING A DP LDL US APPROVAL OF THE 52 TOWNHOMES AND THE CLUBHOUSE AMENITY. THE SITE PLAN SHOWS THE OVERALL SITE TODAY WE ARE LOOKING AT THE 83 ACRE SITE IS SECTION NUMBER 2 IDENTIFIED BY THE BLUE BUILDINGS WHICH ARE THE TOWNHOMES AND THE RED BUILDING WHICH IS THE CLUBHOUSE FACILITY. IN TRYING TO STAY BRIEF TONIGHT I AM GOING TO SHOW YOU NEW DOCUMENTS THAT WERE PREPARED AND PRESENTED TO THE RESIDENTIAL COMMITTEE AS OPPOSED TO GOING BACK TO THE ORIGINAL LAYOUT. WE DIDN'T HAVE A LOT OF QUESTIONS SO I DON'T HAVE THE CLUBHOUSE IN HERE OR THE LANDSCAPING SO THOSE ADDITIONAL QUESTIONS ON THAT I'LL TRY TO ANSWER THEM WITHOUT EXHIBIT. THE FIRST EXHIBIT I HAVE TODAY IS A FIVE UNIT COLOR RENDERING OF THE TOWNHOMES. THIS WAS NOT PROVIDED IN THE EARLIER PRESENTATION WE ONLY HAD THE THREE UNIT BUILDING SHOWING. IT DID NOT HAVE AS MANY COLOR VARIATIONS SO IT SHOWS A VARIETY OF COLORS. IT WAS ONE OF THE REQUESTS WE WERE ASKING FOR. NEXT IS THE REAR ELEVATION OF THE BUILDINGS. THE MAIN THING TO SEE ON THIS IS WE HAVE A ONE-STORY BRICK WRAPPED ON THE FULL REAR OF THE BUILDING AND WE ADDED SOME ADDITIONAL WINDOWS TO THE SECOND STORY WHICH ARE HERE. THIS WAS ORIGINALLY MORE OF A BLANK WALL AND I CAN SHOW YOU THIS IS THE ORIGINAL SUBMITTAL WHERE YOU CAN SEE THE BLANK WALL IN THE SECOND STORY AND WE [02:10:02] HAD HESITATED TO PUT WINDOWS IN THEIR BECAUSE THAT IS A BEDROOM AND IT IS OUR DESIGNATED BED WALL BUT JOHN TOOK A LOOK AT IT AND DETERMINED HE COULD PUT A COUPLE WINDOWS ON BOTH SIDES SO WE DID ADD THOSE WINDOWS ON THE END UNIT AND IT GOT RID OF THOSE TWO BARE SPOTS THAT WERE SHOWN. NEXT ARE THE SIDE VIEW ELEVATIONS. WE GOT BRICK MASONRY ON TWO FLOORS OF THE SIDE ELEVATION WITH A LOT OF WINDOWS BEING IS A BOWL. THE NEXT ONE SHOWS A DIFFERENT VERY COMPARABLE LOOK JUST A DIFFERENT BRICK SELECTION WHICH WE WILL GET INTO THE FIVE DIFFERENT COLOR PALETTES THAT WERE PROVIDED DURING COMMITTEE AS WELL. THE NEXT TWO SLIDES ARE VERY SIMILAR. THEY ARE AGAIN A FOUR UNIT BUILDING. IT SHOWS A LITTLE MORE DETAIL BECAUSE THE BUILDING IS A BIT LARGER BEING LESS WHEN UNIT THAT IS VERY COMPARABLE. IT DOES SHOW SOME OF THE CHANGES AND IT WILL SHOW UP BETTER ON A SLIDE THAT ALL SHOW SHORTLY BUT WE WERE ASKED TO DO VARIATIONS ACROSS THE FRONT OF THE BUILDINGS AND WE DID THAT BY CHANGING UP THE DOORS. YOU HAVE A WIDER DOOR YOU DON'T SEE THE DOOR ON THIS PARTICULAR SIDE VIEW SOCIAL ANOTHER VIEW THAT'S GOING TO DO THAT. WE HAVE A NICE VIEW OF THE HIP ROOF AND IT HAS CHANGED UP IN SOME OTHER LOCATIONS BUT THESE WINDOWS HERE ARE WIDER THAN THESE WINDOWS. WINDOWS HERE ARE THREE UNIT. WE DID MAKE SOME CHANGES TO THAT AND AGAIN THIS IS TO THE REAR OF THE FOUR UNIT BUILDING. AND THIS IS A STRAIGHT ON FRONT VIEW OF THE A3 UNIT BUILDING AND IT DOES SHOW A LITTLE BIT WHAT ARE SOME OF THE CHANGES THAT WERE MADE. YOU CAN SEE ON THE FAR RIGHT THE DOUBLE DOOR THAT WAS PRETTY PROMINENT IN THE GREENS VERSUS THE DOUBLE DOOR WHICH IS A DIFFERENT LAYOUT. IT DOES NOT HAVE THE TRIM AND IT APPEARS TO HAVE A DIFFERENT LOOK. ON THE FAR LEFT THERE IS THE ACTUAL DOOR WITH THE SKYLIGHT. THE WINDOWS YOU'VE GOT TRIPLE WINDOWS HERE DOUBLE WINDOWS HERE AND BIGGER DOUBLE WINDOWS HERE. WE TRIED TO REVISE THE WINDOWS AND THE DOORS AS WELL AS WE HAVE REVISED THE ROOFING ABOVE THE FRONT PORCHES. THIS ONE HAS A HIP ROOF AND IN THE MIDDLE UNIT WE HAVE LOWERED DOWN THE ROOF LINE SO THE GUTTER BOARD IS LOWER AND PROVIDED DIFFERENT LOOK ON THE MIDDLE UNIT AND ON THE FAR LEFT THERE IS MORE OF THE TYPICAL SHED ROOF. AGAIN WE'VE GOT A LOT OF DIFFERENT THINGS GOING ON WHICH WERE REQUESTED BY STAFF TO TRY TO WAKE UP THAT FRONT ELEVATION AND MAKE THE UNITS THEMSELVES APPEAR TO BE MORE UNIQUE. THIS IS THE REAR OF THE SAME THREE UNIT BUILDING. I WILL MENTION THAT ON THIS ONE THE SIDE ELEVATION, ONE OF THE THINGS THAT SHOWS UP ON BOTH SIDES IS A PUNCH OUT WINDOW. THIS WAS ONE OF THE LAST CHANGES MADE AND WE ADDED A PUNCH OUT WINDOW TO WAKE UP THAT LONG VIEW ON THE SIDE ELEVATION IN THE DINING ROOM OF THE TOWNHOME. THE SAME THING SHOWS ON THE OTHER AND THE PUNCH OUT WINDOW AND ON THE REAR ELEVATION YOU CAN PROBABLY SEE IT BETTER, THOSE FOR WINDOWS THAT WERE ADDED ON THE BEDROOM WALL UP THERE I THINK IT SHOWS THE ANGLED LOOK THAT WE HAD ON THAT COLOR ELEVATION IT MADE THEM LOOK LARGER THAN WHAT THEY ARE THAT THEY WILL BE 18 INCH WINDOWS ON BOTH SIDES OF THE BEDROOM LEAVING AMPLE SPACE FOR A KING SIZE BED BETWEEN THE WINDOWS. THEN WE MOVE ON TO THE COLOR PALETTE. WE ORIGINALLY OFFERED THREE COLOR PALETTE BECAUSE WE WERE SHOWING ONLY THE THREE UNIT BUILDING AT THAT TIME WHEN WE INTRODUCE THE FIVE UNIT BUILDING WE WERE ASKED TO PROVIDE A FOURTH AND FIFTH COLOR PALETTE. I WILL GO THROUGH ALL FIVE QUICKLY. YOU WILL NOTICE THE BRICKS WILL CHANGE AND THE SIDE THE MAIN BODY OF THE HOME THE SIDING COLOR WHICH IS APPEAR CHANGES YOU WILL NOTICE THAT THE BLACK FOX WHICH IS THE TRIM COLOR WILL REMAIN CONSISTENT. WE'VE GOT A LITTLE BIT OF CONSISTENCY ON THE TIES THAT KEEPS THE UNITS TOGETHER. THAT'S UNIT NUMBER 1. THIS IS UNIT NUMBER 2 ON THIS ONE WE WOULD ACTUALLY USE BLACK FOX AS BOTH THE BODY COLOR AND TRIM COLOR. THIS IS UNIT THREE. THIS IS A LITTLE LIGHTER BRICK AND A GRAYISH BODY AND THEN NUMBER 4 IS A DARKER BRICK WITH A DARKER PEWTER COLLAR ON THE SIDING AND UNIT FIVE A LITTLE BIT OF A DIFFERENT COLORATION OF THE BRICK AND THE BODY OF THE HOME. [02:15:05] THE NEXT HOUSE ALL FIVE IN IT'S HARD TO DIAL THEM IN BUT WE CAN PROVIDE THOSE COLORS IN YOUR PACKET AND IF YOU LAY IT OUT I THANK YOU WILL SEE THAT WE HAVE A NICE VARIETY OF COLOR IN THE DIFFERENT PALETTE THAT ARE BEING PROVIDED FOR THE FIVE DIFFERENT TOWNHOMES. THE NEXT SLIDE IS A LANDSCAPING PLAN FOR THE TOWNHOMES AND IN THE ORIGINAL SUBMITTAL OF TREES WE APOLOGIZE FOR THAT AND WE APOLOGIZE FOR THAT. WE HAVE AMPLE FOR THE PUD BUT IN ADDITION WE WILL ADD AND MAKE SURE THERE'S A TREE ON THE REAR CORNER ON EVERY BUILDING WHETHER IT IS A THREE, FOUR OR FIVE UNIT BUILDING WILL BE ADDITION OF A TREE WITH STREET TREES OUT FRONT AS WE WILL THEN, THIS IS A THREE UNIT BUILDING AND WE WILL CONTINUE TO ADD ADDITIONAL TREES ACROSS THE FRONT TO MAKE SURE IT MEETS THE PUD ON THAT. AS PART OF THAT DISCUSSION ONE THING THAT WE DISCOVERED IT APPEARED THAT HE WAS SHORT OF LANDSCAPING AND IF YOU LOOKED AT THE OVERALL SITE PLAN A LOT OF THE BUILDINGS ARE VERY CLOSE IN HERE. WHAT WE ENDED UP DOING WAS WE IDENTIFIED ON THIS PARTICULAR PLANT YOU CAN SEE THE ASTERIX NEXT TO SEVERAL OF THE BUILDINGS AND THIS WAS THE BUILDING THAT WAS DETERMINED TO HAVE A HIGHER VISIBILITY ON THE SIDE OF THE UNIT. SO, WE HAVE COMMITTED TO DO SEVEN ADDITIONAL SHRUBS ALONG THE SIDES OF THESE UNITS AND BUILDINGS AND IN ADDITION TO THAT YOU WILL HAVE THE STREET TREES OUT IN FRONT SO THE SHRUBBERY WILL PROVIDE A NICE OFFERING ON THE LOWER VIEW AS YOU DRIVE BY IN THE STREET TREES WILL PROVIDE THE BUFFERING OR THE UPPER VIEW OF THOSE BUILDINGS. THERE'S A LOT OF DISCUSSION IN THE FIRST PLANNING COMMISSION ABOUT PARKING AND I FELT THAT THE BEST WAY TO DO THAT WAS TOUGH TO READ. WE HAVE A COPY OF IT IN THE PACKET. WE FELT THE BEST WAY TO DO THAT IS TO DO A PARKING SUMMARY AND TO DO THAT WE REVIEWED THE JACKS THIS GRANT VILLAGE PUD AND WE DETERMINED WHAT WAS REQUIRED FOR THE PUD AND WE CAME UP WITH 210 SPACES BEING REQUIRED. AS YOU LOOK AT THE SAME DETAIL HOW MANY PARKING SPACES CAN BE PROVIDED AND WE ARE PROVIDING 283 PARKING SPACES. IN ADDITION TO THAT WE HAVE NOT COUNTED ON STREET PARKING AND WE GO BACK TO THE SITE PLAN AND THERE IS SOME ON STREET PARKING IN ASSUMING IT'S ONLY ON ONE SIDE OF THE STREET WE WOULD PROBABLY BE HERE AS WELL AS OUT IN FRONT OF THE TOWNHOMES HERE AND OUT IN FRONT OF THE TOWNHOMES HERE. WE'VE COMPLETED THAT AS WELL AS ALL OF THE NIGHT SINGLE-FAMILY HOMES WHICH HAVE TWO-CAR GARAGES AND A 25 FOOT WELDING SETBACK. THEY WOULD HAVE ADDITIONAL DRIVEWAYS AND THEY ARE NOT INCLUDED IN THE CALCULATION EITHER. THAT WOULD BE AMPLE PARKING THROUGHOUT. AS PART OF THE DISCUSSION WE STARTED TALKING ABOUT PARKING IN THE ALLEYS AND IT WAS DETERMINED IT WAS PROBABLY NOT BEST FOR A SMOOTH FLOW AND NOT HAVING THE CONGESTION IN THE ALLEY TO NOT HAVE THIS. WE COMMITTED TO HAVE THOSE NO PARKING SIGNS THROUGHOUT THE ALLEYS. AND FINALLY AT THE PLANNING COMMISSION THERE WAS A LOT OF DISCUSSION ABOUT THE TREE PRESERVATION EASEMENTS AND SOME OF THE PROBLEMS THAT WE HAD AT JACKSON'S RANCH AND UNBEKNOWN TO LARRY MOON WHO DID THE DEVELOPMENT ON JUNE 21 PRESENTATION AND I WAS NOT PRESENT FOR THAT, ACTUALLY, I WAS IN CANADA FISHING, I APOLOGIZE. LARRY WAS UNAWARE THAT I HAD ACTUALLY BEEN WORKING WITH DARREN'S AND SUBMIT TOBER OF LAST YEAR ON THIS TREE PRESERVATION ISSUE. THERE'S A LOT OF WORK BEING DONE. WE WENT BACK TO THE FAIRGROUND COMMITTEE AND WE IDENTIFIED WHAT WE THOUGHT WAS THE EIGHT WORST VIOLATORS WE PROCEEDED TO CORRESPOND WITH THEM AND THAT CORRESPONDENCE INCLUDED A FIRST LETTER THAT WENT TO EACH HOMEOWNER IN A SECOND LETTER WHICH WAS A REGISTERED LETTER AND ALL OF THIS WAS IN DISCUSSION WITH DARREN MINTON. ALL OF THAT OCCURRED PRIOR TO THE JUNE HEARING DATE. AND AFTER THAT DATE IN DISCUSSION WITH THE COMMITTEE IT WAS GREAT THAT WE HAD DONE A LOT OF MUNICATION AND WE ACTUALLY HAD IN THE TIME IDENTIFY THE NIGHT HOMEOWNER AND OF THE NINE WE HAD THREE COMPLIANT AND SIX NONCOMPLIANT. IT WAS A CHALLENGE TO THE MUNICATION. LET'S START [02:20:07] GETTING RESULTS. WHAT WE DID WAS GO BACK TO THE COMMITTEE THE GROUNDS COMMITTEE AND WE TRIED TO DEVELOP A PLAN TO GET A LITTLE TOUGHER AND GET COMPLIANCE OUT OF THE HOMEOWNERS. THE FIRST STEP OF THAT WAS TO DEVELOP A LETTER THAT LAID OUT WHAT WE WERE GOING TO DO AS A HOMEOWNERS ASSOCIATION TO THE SECOND STEP WAS DAN WAGONER WHO WAS ON THE GROUNDS COMMITTEE AND THE HOMEOWNER THERE. HE AND I WENT AND KNOCKED ON ALL THE DOORS OF THE HOMEOWNERS WITH NONCOMPLIANT ISSUES AND WE HANDED THEM THE THIRD LETTER THAT IDENTIFY THE STEPS THAT WE WERE GOING TO BE TAKING AND WE TALK TO EACH HOMEOWNER AND WE EXPLAINED THAT THIS HAD A LITTLE MORE TEETH TO IT AND THIS IS WHAT WOULD HAPPEN. THEN WE BACK DOWN AND WE SAID LOOK, WE REALLY WANT TO SEE COMPLIANT. AS NEIGHBOR TO NEIGHBOR AND HOMEOWNER TO HOMEOWNER YOU ENCROACHED IN A COMMON AREA THAT IS NOT YOUR PROPERTY IT'S THE HOMEOWNER PROPERTY AND WE NEED TO GET OFF OF IT. A LOT OF THESE ARE MOWING ISSUES AND WE NEED TO QUIT MOWING. WHAT WE HAVE DONE AS A HOMEOWNERS ASSOCIATION AND AS A DEVELOPER, FIRST, WE CAME IN AND IDENTIFIED THE CORNERS OF THESE LOCATIONS WE COULD IDENTIFY THE PROPERTY LINE AND WE HAVE SINCE GONE IN LAST WEEK AND INSTALLED THESE TREE PRESERVATION SIGNS. THIS WAS PROVIDED BY DARREN AND IS THE SAME SIGN THAT CARMEL USES AND ITS MANY OF THEM BEHIND THE HOMES ARE NONCOMPLIANT. IT HELPS TO IDENTIFY THIS IS WHERE YOU HAVE TO STOP MOWING AND EVERYTHING IN FRONT OF IT YOU HAVE TO LET IT GO. THERE ARE A FEW HOMEOWNERS WHO HAD HARDSCAPE ISSUES IN THE TREE PRESERVATION EASEMENT AND THOSE HAVE TO COME OUT AS WELL. THAT WAS TAKEN AND LAID OUT IN THE LETTER. AFTER THE INSTALLATION OF THE SIGNS IN 30 DAYS WE WILL GO BACK AND INSPECT AGAIN. IF THEY HAVE NOT STARTED TO GET COMPLIANCE WHICH EVERY HOMEOWNER HAS SAID THAT THEY WILL, WE WILL TAKE TOUGHER STEPS WHERE WE ACTUALLY GO IN AND INSTALL A FENCE BACK BEHIND THE PROPERTY. IF THEY HAVE NOT GOTTEN THE HARDSCAPE OUT WE WILL TAKE THOSE OUT AT OUR EXPENSE AND TURN IT AROUND AND INVOICE THEM BACK INTO THE SPECIAL ASSESSMENT. TRYING TO GET HARDER WERE TRYING TO GET COMPLIANCE AND THE ONE HOMEOWNER THAT WAS THE WORST COMPLIANT I'M HAPPY TO SAY HAS MADE SIGNIFICANT STEPS IN GETTING ALL THE HARDSCAPE DOWN. HE HASN'T GOT THE WALKOUT YET BUT HE SAID HE'D GET THAT DONE. I THINK WE'VE HAD SOME GREAT STEPS MOVING FORWARD IN THIS AREA AND THEN TO FINISH IT OFF GETTING BACK TO JACKSON'S GRAND VILLAGE THAT'S ALL IN JACKSON'S GRANT VILLAGE. WE HAVE COMMITTED TO INSTALL THREE SIGNS IF YOU LOOK AT THE RED DOTS THIS IS THE TOWNHOME BUILDING HERE WE'VE GOT ONE IN THE BACK OF THE TOWNHOME ONE IN THE FRONT OF THE TOWNHOME AND THEN ONE WHICH WOULD BE IN THE FUTURE SECTION OF THE RETAIL COMPONENT OF JACKSON GRAND VILLAGE. IF YOU SLIP OVER TO THE RESIDENTIAL SIDE WE GOT THREE LOTS RIGHT HERE THAT BACKUP TO A TREE PRESERVATION AREA AND DARREN HE TYPICALLY SAYS HE PUT A SIGN ON THE CORNERS OF THE LOT. WE GOT TO SIGNS COMING IN HERE TO PROPERLY IDENTIFY THE TREE PRESERVATION EASEMENT BEHIND THE RESIDENTIAL LOTS. THESE ARE A PROACTIVE STEP WHICH WE DID NOT DO INITIALLY WITH JACKSON'S GRANT SO WERE TRYING TO LEARN FROM OUR MISTAKES AND GET A BETTER JOB DONE. WITH THAT I THINK IT'S EVERYTHING WE'VE COVERED THROUGH THE COMMITTEE.
