[(SU) Irsay Pond Special Use.]
CONCERNS? >> NOTHING TO REPORT.
>> THAT WILL LEAD TO THE PUBLIC HEARINGS PORTION OF TONIGHT MEETING. THE FIRST ITEM HAS GUN TABLED TO NOVEMBER 28TH. NEXT ITEM IS IRSAY POND SPECIAL USE. THE APPLICANT SEEKS THE FOLLOWING SPECIAL USE APPROVAL FOR A MAN-MADE POND. THIS IS DOCKET NUMBER PZ-2022-00180SU. UDO SECTION 2.03.
SPECIAL USE AROFFICIAL LAKE OR POND.
NOT PLATTED. THE SITE IS LOCATED JUST WEST OF 11700 CLAY CENTER ROAD AND IS ZONED S1 RESIDENCE. FILED BY BRIAN BROWN OF STOEPPELWERTH AND ASSOCIATES, INCORPORATED.
MR. BROWN IS REPRESENTING HERE TONIGHT.
CAN YOU RISE AND GO TO MICROPHONE AND STATE YOUR NAME. TURN ON YOUR MICROPHONE,
I REPRESENT IRSAY POND. >> DO YOU HAVE A PRESENTATION YOU WOULD LIKE TO MAKE?
I THINK EVERYTHING HAS BEEN SUBMITTED.
I THINK EVERYTHING HAS BEEN SUBMITTED.
IF YOU HAVE ANY QUESTIONS FEEL FREE TO ASK.
I'M HERE TO ANSWER ANYTHING. >> THIS IS A PUBLIC HEARING.
IS THERE ANYONE HERE TONIGHT WHO WISHES TO SPEAK EITHER IN FAVOR OF OR AGAINST THIS PETITION INDICATE BY RAISING YOUR HAND PLEASE. SEEING NONE WE'LL HAVE THE
DEPARTMENT REPORT. >> THANK YOU.
THE PETITIONER SPEAKS SPECIAL USE APPROVAL FOR A MANMADE POND. IT WILL BE ABOUT THREE ACRES IN SIZE AND IT WILL BE FOR PRIVATE USE ONLY.
THE PETITIONER IS GOING THROUGH TECHNICAL REVIEW WITH THE TECHNICAL ADVISORY COMMITTEE TO ADDRESS THE REQUIREMENTS FOR GRADING AND DRAINING AND THINGS LIKE THAT. THEY HAVE STATED THEY WILL PROVIDE LANDSCAPE PLAN WITH TREES AND LANDSCAPING AROUND THE POND. AND THEN REGARDING COMPLIANCE WITH THE TRANSPORTATION PLAN, THEY WILL BE PAYING FOR WHAT IT WOULD COST -- PAYING FOR WHAT IT WOULD COST TO CONSTRUCT THEIR SEGMENT OF THE MULTIUSE PATH AND THEN IN LIEU OF DEDICATING ACTUAL STREET RIGHT-OF-WAY, THEY THE OWNER WOULD LIKE TO PROVIDE AN EASEMENT FOR THE STREET RATHER THAN THE STREET RIGHT-OF-WAY. AND WE ARE OKAY WITH THAT AS AN ALTERNATIVE. WE RECOMMEND POSITIVE APPROVAL WITH THE CONDITIONS OF ADDRESSING THE REMAINING TECH REVIEW COMMENTS, AS WELL AS FINALIZING THE EASEMENT FOR THE STREET. THANK YOU.
>> THANK YOU. I WILL CLOSE THE PUBLIC HEARING NOW. MEMBERS OF THE BOARD, ARE THERE ANY QUESTIONS OR CONCERNS?
>> YES? >> WOULD THE DEDICATION OR AND OR THE NONREVERTING THOROUGHFARE BEFORE FOR THE
[00:05:10]
CLAY EXPOSURE? >> FOR THE SOUTHERN PORTION OF THE PARCEL ONLY. THAT'S ONLY WHAT TOUCHES THE
PUBLIC STREET. >> MONTE, CAN YOU POINT THAT
>> WE GOT SEVERAL PARCELS. ALL OWNED BY THE PETITIONER.
WE WANT TO BE CLEAR WHAT SECTION WE'RE TALKING ABOUT.
>> THIS SECTION RIGHT HERE. GOES RIGHT DOWN TO ABOUT RIGHT THERE. AND THAT'S THE EXACT PARCEL WHERE THE POND WOULD BE LOCATED, EVEN THOUGH THERE'S
SEVERAL CONTIGUOUS PARCELS. >> YES, SIR.
>> OKAY. CAN'T REALLY SEE IT THERE.
OKAY. THE PARCEL WHERE THE POND IS LOCATED, IS LAND LOCKED. DOESN'T HAVE FRONTAGE.
>> YEAH. WE WERE TOLD THAT THE PARCEL EVEN THOUGH THERE'S THAT YELLOW LINE IN BETWEEN THOSE TWO PARCELS THEY ARE POINTING AT.
IT'S ONE BIG PARCEL. AND IT HAS SOMETHING TO DO WITH THE COUNTY, THE TAX PARCEL.
I THINK BRIAN CAN EXPLAIN A LITTLE BIT FURTHER.
I'M BRIAN BROWN WITH STOEPPELWERTH AND ASSOCIATES. THE LINES THAT RUNS VERTICAL RIGHT HERE IS A SECTION LINE.
IF YOU NOTICE ALL OF THE PARCELS HERE AND HERE THEY OWN THIS HERE. FOR TAX PURPOSES, IT IS SEPARATED ACROSS THOSE SECTIONS.
IT'S A SINGLE PIECE OF PLATTED LAND THAT HAS FRONTAGE ON 160TH STREET HERE.
>> AND THE CITY IS OKAY WITH CONTRIBUTION BEING CALCULATED ONLY FOR THAT NARROWER PARCEL.
AND NOT GOING OVER TO THE ROUNDABOUT TO THE CORNER LOT
AT 116TH AND CLAY CENTER? >> CORRECT.
>> AND THEN RUNNING UP CLAY CENTER.
>> THAT WOULD BE A SEPARATE PARCEL.
NOT PART OF THIS PETITION . >> ANYONE ELSE?
>> I WILL MAKE A MOTION TO APPROVE DOCKET NUMBER
>> IT'S BEEN MOVED AND SECONDED THAT WE APPROVE DOCKET NUMBER PZ-2022-00180SU.
WITH CONDITION OF ADDRESSING ALL REMAINING TACK REVIEW COMMENTS. AND WITH THE ADOPTION OF THE FINDINGS OF FACT SUBMITTED BY I THE PETITIONER.
>> THERE WAS ONE CONDITION, ADDITIONAL CONDITION
MENTIONED BY STAFF. >> FINALIZED EASEMENT
>> EASEMENT CREATION. >> IS THAT ALL RIGHT WITH
YOU? >> AMEND MY MOTION, TO APPROVE DOCKET PZ-2022-00180SU TO INCLUDE THE FINDINGS OF FACT HERE, ADDRESSING ALL REMAINING TACK REVIEW COMMENTS AS WELL AS FINALIZING THE EASEMENT
OF DEDICATION. >> SECOND OKAY WITH THAT?
>> SECOND. >> IT'S BEEN MOVED AND SECONDED WE APPROVE DOCKET PZ-2022-00180SU.
WITH THE CONDITION OF ADDRESSING ALL REMAINING TACK REVIEW COMMENTS WITH THE ADOPTION FINDINGS OF FACT SUBMITTED BY I THE PETITIONER AS WELL AS AMENDING THE EASEMENT DEDICATION.
ALL THOSE IN FAVOR OF THE MOTION SAY "AYE."
[(V) McPherson Duplexes Floor Area Variances.]
OKAY. NEXT ITEM ON THE AGENDA MCPHERSON DUPLEXES FLOOR AREA VARIANCES.THE APPLICANT SEEKS TO FOLLOWING DEVELOPMENT STANDARD VARIANCE APPROVAL FOR THREE DUPLEXES.
THIS IS DOCKET NUMBER PZ-2022-00183V, UDO SECTION 2.12. MINIMUM 800 SQUARE FEET
[00:10:03]
GROUND FLOOR AREA FOR TWO FAMILY DWELLINGS ALL OTHER USES REQUIRED. 525 SQUARE FEET REQUESTED.THE SITE IS LOCATED AT 1040 EAST 108TH STREET.
HOME PLACE SUBDIVISION SECTION 1, LOTS 221-223.
ZONED R3 RESIDENCE. FILED BY DAVID KLAIN ON BEHALF OF BRASON PROPERTIES, LLC.
GOOD EVENING MR. KLAIN. >> YOU MAY PROCEED.
>> I'M DAVID KLAIN WITH DB KLAIN CONSTRUCTION.
WE ARE LOCATED IN CARMEL. WE BEEN DEVELOPING IN CARMEL AREA FOR 29 YEAR. RESIDENTIAL AND COMMERCIAL DEVELOPMENTS. AS YOU MENTIONED WE ARE SEEKING TO REDEVELOP THE SITE.
THE SITE CURRENTLY HAS HOME THAT'S 75 YEARS OLD THAT WE PLAN TO DEMOLISH AND THEN DEVELOP INTO THREE LOTS THAT WERE ORIGINALLY PART OF THE ORIGINAL PLAT THERE.
THE VARIANCE WE'RE SEEKING IS FOR THE SQUARE FOOTAGE REQUIREMENT FOR TWO STORY. AS YOU MENTIONED 100 SQUARE FEET. WE LOOK TO GET APPROVAL FOR THE MAIN FLOOR SQUARE FOOTAGE TO B-525 MINIMUM FOR TWO-STORY UNIT. THE REASON BEHIND IT IS SIZE AND SQUARE FOOTAGE OF THE CURRENT UDO REQUIRES DRIVES UP THE TO-STORY UNIT TO A SIZE OF HOME THAT BECOMES LARGER THAN WHAT WE FEEL IS ACHIEVABLE FOR THE REASONABLY PRICED HOUSING IN THE AREA.
THE GOAL TO KEEP IT AND BASICALLY THIS THE VARIANCE.
OUR GOAL IS TO HAVE FOCUS ON ARCHITECTURE WITH THE ABILITY TO CREATE SOME CHARACTER AND DESIGN STILL WITHIN THAT AREA. AND WE WILL CONTINUE TO BE QUITE A BIT OF REDEVELOPMENT IN THAT GENERAL AREA OVER THE YEARS. WE WOULD LIKE TO HOPEFULLY BE A PART OF THAT SPARK. IF YOU HAVE ANY QUESTIONS, PLEASE LESS US KNOW. THIS IS A PUBLIC HEARING.
THE PUBLIC HEARING IS NOW OPEN.
IS THERE ANYONE HERE TONIGHT WHO WISHES TO SPEAK EITHER IN FAVOR OF OR AGAINST THIS PETITION?
>> RAISE YOUR HAND, PLEASE. >> WOULD YOU STEP UP TO THE FRONT MICROPHONE, INTRODUCE YOURSELF AND THE AREA OF CARMEL IN WHICH YOU RESIDE AND THEN YOU MAY BEGIN.
>> IS THERE A CAMERA OR ANYTHING ELSE HERE?
>> THIS IS FOR YOU. SIR, IF YOU COULD INTRODUCE
YOURSELF, PLEASE. >> OKAY MY NAMES THE CHARLES BREVARD. LIVE ON 160TH CORNELL.
IT'S A DUPLEX, RENTAL. WE JUST BOUGHT A HOUSE IN CARMEL. THE ONLY QUESTION THAT I DON'T -- I'M NOT QUESTIONING THE SIZE OR ANYTHING.
I'M HAPPY WITH THAT. IT'S GREAT TO SEE BUILDING COME IN AND INCREASE THE VALUE OF THE PROPERTYINGS.
THE ONLY CONCERN THAT I HAVE -- IT'S SO HARD TO SEE.
THE ONLY CONCERN I HAVE THE DRAINAGE.
AND THE PROBLEM WITH THE DRAINAGE -- HOPING YOU CAN SEE IT. OKAY.
RIGHT HERE YOU CAN SEE THIS FLOODING ALONG THE FENCE LINE THIS FENCE LINE HAS BEEN REMOVED, WHICH IS THEN YOU HAVE THIS DRAINAGE. IN THE SPRING WE'RE HOLDING A TON OF WATER HERE. THE PROBLEM WITH THAT IS AFTER THE RAIN IT SETS ANYWHERE FROM 12 TO 32 DAYS.
IT'S JUST SOMING WET. WHAT WE GET IS A BUNCH OF MOSQUITOES AND INFESTATION. IT'S NOT A PLEASANT DAY.
WHAT I DID WAS AFTER I BOUGHT THIS PROPERTY THREE YEARS AGO WE INSTALLED DRAINAGE TILE FROM HERE TO HERE AND BROUGHT IT TO THE DRAINAGE TILE THAT'S OUT BY THE ROAD. AND IT SOLVED THE PROBLEM 90 WE WOULD SAY 89% OF THE PROBLEM IS GONE.
MY DOG LOVES IT. IF YOU LOOK BEHIND BENGIE.
[00:15:02]
YOU SEE THIS RAISED AREA. THAT'S THE CULPRIT.WHAT THAT RAISED AREA WAS A GROUP OF TREES -- THIS AREA
USED TO BE A SWAMP. >> THERE'S A GROUP OF TREES THERE THAT GREW UP WHEN THEY GREW THEY RAISED GROUND.
IT CREATE DAM SEPARATES THE TWO SIDES.
THE I'M ASKING THE DEVELOPER TAKE AND BRING AND JUST CREATE A SWALE AND TAKE THAT DAM OUT AND ALLOW THE WATER TO FLOW ACROSS THE BACK TO THAT AREA.
THEY WILL HAVE MOVING EQUIPMENT FOR DIRT AND WHATEVER THERE ON SITE. IT'S NOT GOING TO TAKE MUCH.
BECAUSE THERE'S -- ONCE YOU GET TO MY PROPERTY LINE, YOU WILL SEE THAT IT'S -- THERE'S A NICE SWALE THAT I'VE CREATED HERE. I HAND DUG THIS.
WHY THE FENCE WAS THERE. BACK IN HERE IS WHERE THE CULPRIT IS. IT'S ACTUALLY THE SECOND AND THIRD LOT FROM THE CORNER OF THE ROAD.
WHAT WE GET INTO TOO WHERE THE CENTER LOT WILL BE.
IT'S THE HUMP. AND THEN YOU GOT THE LOT BESIDE IT WHICH IS LOWER. THEN WHERE I AM AT THAT DRAINS. THAT'S MY ONLY PROPOSAL.
I'M ASKING THAT WE MOVE SOME DIRT AROUND AND CREATE A SWALE SO WE DON'T HOLD WATER WITH THREE NEW HOUSES WITH ROOF SQUARE FOOTAGE. THE DRIVEWAYS ALL THAT WILL ADD ADDITIONAL SURFACE WATER.
AND THEN WE. THAT'S ALL I GOT.
>> THANK YOU, SIR. >> IS THERE ANYTHING ELSE THAT WISHES TO SPEAK TO THIS PETITION?
>> HEARING NONE, DAVID, DO YOU WANT TO RESPOND TO THAT?
>> YES, PLEASE. >> THANK YOU FOR BRINGING THAT TO MY ATTENTION. ONE OF THE THINGS JUST FROM REASSURANCE STANDPOINT, OBVIOUSLY WE'VE DONE -- TOPO SURVEY ON THE PROPERTY. ALL THE HOUSES WILL BE SET TO GRADE. TO ALLOW FOR ADEQUATE FLOW ACROSS THE SIDE, BACK AND FRONT OF THE PROPERTIES AS IT SHOULD. CURRENTLY THOSE LOTS SIT ALTHOUGH FROM THE STREET. AS HE MENTIONED, THIS IS THE HIGH POINT, BUT FRANKLY ALL THIS AREA SITS MUCH LOWER.
THESE PADS WILL BE BUILT UP TO GRADE AS THEY SHOULD BE IN A TYPICAL DEVELOPMENT THAT WOULD ALLOW FOR DRAINAGE TO GROW ACROSS AND WE'LL HAVE A SWALE THAT RUNS BACK THROUGH THE BACK AND ALSO ACROSS THE FRONT THE BEST WE CAN FOR DRAINAGE. THAT ALL DRAINS TO THAT BACK CORNER AS HE MENTIONED. IT'S HARD TO SEE.
I DON'T KNOW WHY MY DRAWING IS BLURRED LIKE THAT.
ULTIMATELY WE'LL DEFINITELY ADDRESS THAT WITH THE SURVEYS AND THE PLOT PLANS THAT WE PUT TOGETHER THAT WE WILL SUBMIT THROUGH CARMEL AND THROUGH THE BUILDING
>> ABSOLUTELY. >> DEPARTMENT REPORT?
>> THANK YOU. THE PLANNING DEPARTMENT IS SUPPORTEDTIVE OF THIS VARIANCE REQUEST.
WE ALSO HAVE ASKED THE PETITIONER TO WORK WITH COUNTY AS FAR AS IT'S CURRENTLY 3 PLATTED LOTS.
BUT IT SHOWS AS ONE BIG TAX PARCEL.
WE ASKED THEM TO WORK WITH THE COUNTY SO THEY MATCH UP WITH THE THREE PLATTED LOTS. WE WOULD LIKE THAT AS CONDITION OF APPROVAL. BUT WE DO RECOMMEND APPROVAL ALONG WITH THE ADOPTION OF THE FINDINGS OF FACT.
THANK YOU. >>CHAIR: THANK YOU.
WITH THAT, THE PUBLIC HEARING IS NOW CLOSED.
MEMBERS OF THE BOARD, ANY QUESTIONS OR CONCERNS?
>> ANGIE, JUST SO WE HAVE A CLEAR UNDERSTANDING OF THIS.
BEFORE THE PERMITS CAN BE PULLED THE PETITIONER HAS TO WHAT? UNIFY THOSE LOTS? INTO ONE OR GET THE COUNTY TO RECOGNIZE THAT IT'S
ACTUALLY ONE LOT? >> IT'S ACTUALLY THREE PLATTED LOTS. IT'S SHOWN AS ONE TAX PARCEL. WE WOULD JUST LIKE THREE ESSENTIALLY THREE TAX PARCELS TO BE CREATED TO MATCH UP WITH THE CURRENT THREE PLATTED LOTS.
>> BEFORE YOU CAN GET A PERMIT.
IS THAT A LONG DRAWN OUT PROCESS.
DO YOU KNOW? >> I THINK IT'S A PRETTY FAST PROCESS. I THINK DEFINITELY WE'LL HAVE THAT AS PART OF THE BUILDING PERMIT REVIEW PROCESS. THAT IT HAS ITS OWN TAX
PARCEL. >> YOU UNDERSTAND THAT?
>> YEAH. IT'S VERY SIMPLE AND NOT A
PROBLEM AT ALL. >> THERE WILL BE THREE ADDRESSES AND ASSIGNED TO TAX PARCEL AS WELL.
>> JUST SO YOU UNDERSTAND. I APPRECIATE THAT.
THANK YOU. >>>>CHAIR: ANYONE ELSE?
>> SEEING NONE IS THERE A MOTION?
>> MOVE TO APPROVE DOCKET PZ-2022-00183V SUBJECT TO OR WITH THE CONDITION THAT PETITIONER WORK WITH THE
COUNTY ON THE REPLATING. >> SECOND.
[00:20:03]
>> MOVED AND SECONDED THAT WE APPROVE DOCKET PZ-2022-001893V. WITH THE UNDERSTANDING THAT THE TAX PARCELS NEED TO BE AMENDED TO REFLECT THE SHAPES OF THREE CURRENTLY PLATTED LOTS.
WITH THE ADOPTION OF THE FINDINGS OF FACT AND WITH PETITIONER TO WORK WITH THE COUNTY ON THIS.
ALL THOSE IN FAVOR OF THE MOTION INDICATE BY SAYING
>> IT'S BEEN APPROVED. THANK YOU VERY MUCH FOR YOUR TIME. I APPRECIATE IT.
>> OKAY. COULD YOU PLEASE SETTLE
[(UV, V) Pennwood Indoor Commercial Recreational Facility.]
DOWN. WE CAN MOVE FORWARD HERE.NEXT ITEM ON THE AGENDA PENNWOOD INDOOR COMMERCIAL RECREATIONAL FACILITY. THE APPLICANT SEEKS THE FOLLOWING USE VARIANCE AND DEVELOPMENT STANDARD VARIANCE APPROVALS. THESE ARE UNDER DOCKET NUMBER PZ-2022-00185UV. UDO SECTION 2.25.
AND APPENDIX A.07. COMMERCIAL RECREATIONAL FACILITY, INDOOR, NOT ALLOWED, USE VARIANCE REQUESTED AND DOCKET NUMBER PZ-2022-00186V.
UDO SECTION 5.30. 162 PARKING SPACES REQUIRED.
122 REQUESTED. THE SITE LOCATED AT 11565 PENNSYLVANIA STREET AND IS ZONED B5/BUSINESS AND WEST HOME PLACE COMMERCIAL CORRIDOR-HIGH INTENSITY.
FILED BY KEVIN BUCHHEIL OF KRIEG DEVAULT LLP ON BEHALF OF SCB HOME OFFICE, LLC. CAN I ASK HOW MANY OF YOU WISH TO SPEAK EITHER IN FAVOR OF OUR AGAINST THIS
PETITION? >> THERE'S ONE, TWO, THREE, PEOPLE. THE REASON I ASK IS THAT THERE'S FOR REMONEY STRAITORS, 15-MINUTE TIME LIMIT ON THIS. I'M ASSUMING ONE PERSON WILL SPEAK FOR THE GROUP. I'M ASSUMING THIS.
>> THAT WAY WILL ALLOW PEOPLE ENOUGH TIME TO SPEAK.
WITH THAT, KEVIN YOU HAVE 15 MINUTES TO MAKE YOUR PRESENTATION. IF YOU COULD INTRODUCE
YOURSELF AND PROCEED. >> THANK YOU.
>> MR. >> WITH ME TONIGHT IS MR. STEVEN WODNER AND COMPANY AND FRIENDS.
WE ARE HERE TO ASK FOR COUPLE OF THINGS TONIGHT.
11565 PENNSYLVANIA STREET LOCATED TOWN EAST SIDE OF PENNSYLVANIA AVENUE. 650 SEAT SOUTH OF EAST 116TH STREET. 3.76 ACRE PARCEL INCLUDES OFFICE BUILDING, INCLUDING SPACE FOR THE PETITIONER'S HEADQUARTERS AND SHARED PARKING FOR THIS PROPOSAL AND THAT OFFICE BUILDING. THE MOST RECENT APPROVAL ON THIS SITE WAS FOR THREE SINGLE STORY OFFICE BUILDING. THE FIRST OF WHICH IS CONSTRUCTED AND OCCUPIED. OCCUPYING THE SAME GENERAL BUILDING FOOTPRINT THIS PROPOSAL WILL REPLACE THE OTHER TWO OFFICE BUILDING WITH SINGLE TWO-STORY FOOTPRINT FOR RECREATIONAL FACILITY SPECIFICALLY FOR PICKLE BALL. THE BUILDING WILL INCLUDE EIGHT COURTS EVENLY SPLIT ON EACH SIDE LOCATED TWO-LEVEL SECTION OF BUILDING. FIRST FLOOR OF THE CENTER SECTION WILL INCLUDE THE ENTRY AND LOCKER ROOMS. WHILE THE SECOND FLOOR WILL INCLUDE FOOD SERVICE AND VIEWING OVERLOOKS FOR THE COURTS ON BOTH SIDES OF THAT CENTER SECTION. THE INDOOR COMMERCIAL RECREATIONAL FACILITY REQUIRES A USE VARIANCE UNDER THE CURRENT ZONING. INDOOR COMMERCIAL RECREATIONAL FACILITIES OF THE SIZE OF THE PROPOSED BUILDING UNDER THE UDO REQUIRE 126 PARKING SPACES.
WICH IS FAR MORE THAN IT WOULD BE REQUIRED FOR THE PROPOSED PICKLE BALL FACILITY AT FULL CAPACITY.
UNDER THE UDO, THE SITE INCLUDING EXISTING OFFICE BUILDING REQUIRES 162 PARKING SPACES.
THE SITE DEVELOPMENT PLAN SHOWS 122 PARKING SPACE.
[00:25:03]
THE DEVELOPMENT STANDARD VARIANCE IS BEING REQUESTED.THE PARKING ANALYSIS IS UNDER TAB FIVE IF YOU HAVE ANY QUESTIONS, I CAN GO THROUGH THAT WITH YOU AS YOU DESIRE. EVEN WITH THE APPROVE PARKING VARIANCE THE SITE WILL STILL PROVIDE MOORPARKING THAN IS ANTICIPATED TO BE NECESSARY FOR THE FULL USE AT FULL CAPACITY.
ARCHITECTURE OF THE BUILDING DESIGNED TO COMPLIMENT THE EXISTING OFFICE BUILDING IN MATERIALS AND EARTH TONE COLOR SCHEME AND FULL DEVELOPMENT PLANS WILL BE FILED WITH THE CITY FOR REVIEW FOLLOWING BOARD APPROVAL OF BOTH VARIANCES. SINCE THE DEPARTMENT REPORT TO THE BOARD WAS PUBLIC BLUSHED.
WE BELIEVE ALL COMMENTS RELATED TO THE BOARD ACTION HAVE BEEN ADDRESSED. AND IF THERE ARE ANY REMAINING TECH COMMENTS TO BE ADDRESSED THOSE WILL BE ADDRESSED UNDER THE NEXT ZONING APPROVAL PROCESS
POSSIBLY DEFEND PETITIONER. >> PARAPHRASING THE USE FINDING OF FACT. THE VERY SOFT OFFICE MARKET IMPOSES AN UNNECESSARY HARDSHIP FOR THE USE AND DEVELOPMENT OF THIS SITE FOR OFFICE.
THE PROPOSED USE WILL PROVIDE HIGH DEMAND AMENITY FOR THE NEIGHBORHOOD BOTH COMMERCIAL AND RESIDENTIAL.
THE PROPOSED USE FALLS WITHIN THE RANGE OF LAND USE INTENSITY FOR PERMITTED AND SPECIAL USES IN THE B-5 DISTRICT. AND DOES NOT RUN COUNTER TO THE PURPOSES OF THE UDO. OUR PROPERTY IN THE GENERAL -- OTHER PROPERTY IN THE GENERAL AREA WILL NOT BE SUBSTANTIALLY ADVERSELY EFFECTED BY THE PROPOSED USE BECAUSE THE BUILDING WILL HAVE 60 ARCHITECTURE AND PATRON ACTIVITY WILL BE DIRECTED AWAY FROM THE NEARBY RESIDENTIAL AREAS. THE RECENT GLOBAL PANDEMIC CAUSED SEISMIC SHIFT IN THE OFFICE MARKET GENERALLY.
AND HAS NEGATIVELY IMPACTED TENANT PROSPECTS FOR THE PREVIOUSLY APPROVED OFFICE BUILDING AT THIS LOCATE.
THE PROPOSED USE SERVES TO SUPPORT THE COMPREHENSIVE PLAN POLICIES BY OFFERING EMPLOYMENT OPPORTUNITY AND RECREATIONAL AMENITY FOR THE CITY.
THE DEVELOPMENT FINDINGS OF FACT ALLOWING FOR FEWER REQUIRED PARKING SPACES ASSOCIATE SWD PROPOSED USE WILL NOT RUN COUNTER TO PURPOSES UDO BECAUSE THE BUILDING AREA DEDICATED TO EACH PATRON IS FAR GREATER THAN FOR OTHERED NONCOURT RECREATIONAL USES AND THE PROVIDED PARKING WILL STILL EXCEED THE ANTICIPATED DEMAND AT FULL PICKLE BALL OPERATIONS.
AREA PROPERTY WILL NOT BE NEGATIVELY IMPAIRED BECAUSE SUFFICIENT ON SITE PARKING WILL BE AVAILABLE.
THE ONE-SIZE FITS ALL FOR INDOOR RECREATIONAL FACILITY IT DOESN'T ANTICIPATE THE LOWER PARKING DEMAND FOR THE PROPOSED USE. AS OF TODAY, NOTICE OF PUBLIC HEARING GENERATED 28 LETTERS FROM INTERESTED PARTIES. 20 OF THOSE -- 27 OF THOSE WERE IN SUPPORT OF THE USE AND ONE OUTLINED THE FOLLOWING CONCERNS. I'LL ADDRESS THOSE
INDIVIDUALLY. >> FIRST CONCERN IS THE PARKING TO -- THE PARKING LOT GATE AT WASHINGTON BOULEVARD SHOULD REMAIN CLOSED.
DETER PATRONS FROM PARKING IN THE RESIDENTIAL NEIGHBORHOOD. THE GATE WILL REMAIN AS A LOCKED EMERGENCY ONLY ACCESS POINT.
THAT WILL NOT CHANGE. THE PARKING LOT IS AGAIN EXPECTED TO ACCOMMODATE PICKLE BALLPARKING NEEDS.
AND WHILE THE PETITIONER CAN'T CONTROL WHERE PICKLE BALL PATRONS MIGHT PARK. PATRONS WILL BE DISCOURAGED FROM PARKING IN THE RESIDENTIAL NEIGHBORHOOD.
SECOND CONCERN WAS ABOUT THE LOCATION OF THE DUMPSTER PAD AND HVAC EQUIPMENT. THE PRIOR APPROVAL INCLUDED A SECOND DUMPSTER LOCATION NEAR THE NORTHEAST CORNER OF THE SITE NEAR THE EMERGENCY ACCESS POINT.
THAT'S NOT GOING TO CHANGE. AND THE HVAC UNITS WILL BE DESIGNED FOR THE ROOFTOP OF THE PROPOSED BUILDING AS WAS DONE WITH THE EXISTING OFFICE BUILDING.
THIRD CONCERN ABOUT REORIENTING THE BUILDING 90 DEGREES. IF WE WERE TO DO THAT, IT WOULD POSSIBLY ELEVATE THE IMPACT TO THE SITE.
BUT WHAT WE ARE PROPOSING IS TO USE THE NEARLY IDENTICAL FOOTPRINT FROM THE PRIOR APPROVAL FOR THIS USE AND ESSENTIALLY THE SAME IMPACT TO THE AREA.
FOURTH CONCERN ABOUT MAINTAINING THE CURRENT TREE AND SHRUB BARRIER. ALONG THE WEST SIDE OF WASHINGTON BOULEVARD AND THE PROPERTY LINES EAST PARCEL,
[00:30:02]
THERE'S A REALLY NICE STAND OF BARRIER.THAT WILL NOT CHANGE. LAST CONCERN ABOUT THE IMPACT OF SOCIAL NATURE OF PICKLE BALL AND ADDING POTENTIAL TOURNAMENT TO THE NEIGHBORHOOD.
PICKLE BALL TOURNAMENT MAY BE ORGANIZED FOR THIS FACILITY. THE PARKING LOT AGAIN IS EXPECTED TO MEET DEMAND DURING RECREATIONAL PLAY AND TOURNAMENT. PARKING IN RESIDENTIAL NEIGHBORHOODS, WHILE NOT EXPECTED WILL BE DISCOURAGED OF OUR PATRONS. SOUNDS RELATED TO PATRON ACTIVITY IN THE PARKING LOT ARE NOT ANTICIPATED TO BE DISRUPTIVE TO BUSINESS OR RESIDENTIAL USES IN THE AREA. AND THEN IT SHOULD BE NOTED THAT THE -- THESE COMMENTS WERE COMING BASED ON THE RIDER'S EXPERIENCE OF OUTDOOR PICKLE BALL COURTS IN FLORIDA WHERE THEY ARE OUTDOOR PLAYING SEASON IS A LOT LONGER. IN CLOSING ON BEHALF OF THE PETITIONER WE RESPECTFULLY RESPECT APPROVAL FOR INDOOR COMMERCIAL RECREATIONAL FACI FACILITY AND REDUCED PARKING.
EACH BASED ON THE SUBMITTED FINDINGS OF FACT.
AT THIS POINT FOR THOSE WHO ARE NOT GOING TO SPEAK AND IN SUPPORT OF THIS PETITION, IF YOU COULD STAND FOR JUST
TO SHOW YOUR SUPPORT. >> THANK YOU VERY MUCH.
I WILL STAND DOWN FOR ANY QUESTIONS THAT YOU MAY HAVE.
>> THANK YOU. THIS IS A PUBLIC HEARING.
AND THE PUBLIC HEARING IS NOW OPEN SO THOSE INDIVIDUALS WHO RAISED THEIR HAND WHO WISH TO SPEAK IF YOU COULD APPROACH YOUR LEFT SIDE OF THE ROOM.
LINE UP. AND APPROACH THE MICROPHONE.
INTRODUCE YOURSELF AND THE AREA OF THE COMMUNITY IN
WHICH YOU RESIDE. >> YOU MAY BEGIN.
>> GOOD EVENING. I'M JOHN MURPHY.
I'M THE CHIEF OPERATIONS OFFICER FOR POLICE AND FIREMEN'S INSURANCE ON THE CORNER.
WE'VE BEEN IN THAT PARCEL SINCE 1994.
I LIKE TO SAY THAT SBC HAS BEEN WONDERFUL NEIGHBORS.
ANY ISSUES THAT WE'VE HAD HAVE BEEN DEALT WITH VERY QUICKLY AND VERY THOROUGHLY. WE DON'T HAVE A PROBLEM WITH OUR NEIGHBORS. THE QUESTION I HAVE THE ABOUT THE PARKING. I DON'T KNOW IF YOU CAN SEE FROM UP HERE THIS IS OUR BUILDING HERE.
AND THERE IS ACCESS TO OUR PARKING FROM THE OTHER PARCELS. DEPENDING ON HOW BIG THE TOURNAMENTS ARE, AND WHAT THE NORMAL OCCUPANCY IS, WHICH I DON'T HAVE THAT INFORMATION, WE'RE CONCERNED THAT IN THIS PREDOMINANTLY OFFICE USE NEIGHBORHOOD WE'RE GOING TO HAVE TRAFFIC AFTER HOURS.
WE'RE MOSTLY OPEN 8:00 TO 4:00.
SOMETIMES I LEAVE AT 7:00 OR 8:00.
WE'RE A LITTLE BIT CONCERNED ABOUT THE EXTRA TRAFFIC.
WE CERTAINLY WOULDN'T WANT ANYONE ABUSING OUR PROPERTY IN ANY WAY. WE RECENTLY HAD AN ACT OF VANDALISM THAT COST US $160,000.
WE'RE STILL WORKING TO RESOLVE THAT NOW.
I DON'T POINT AT SBC CAUSING THAT.
BUT THE OF EIGHTED HOURS IS CONCERN FOR US AS WELL AS THE PARKING. WE JUST PUT 40 TO $50,000 INTO THE PATIO. WE CERTAINLY WOULDN'T WANT TO HAVE THAT ABUSED EITHER. ANY OF THE LANDSCAPING OR
ANY OF THAT KIND OF THING. >> THOSE ARE OUR CONCERNS.
I'M NOT SURE IF WE COULD GET AN IDEA.
I'M NOT AGAINST PICKLE BALL. I COME FROM A BACKGROUND OF MANAGING ICE RINKS. AND I'M AWARE THAT IT'S NOT JUST THE PEOPLE ON THE ICE THAT ARE IN THE PARKING LOT OR IN THE BUILDING, BUT IT'S THE PEOPLE WHO JUST FINISHED. THAT MIGHT BE HAVING A SANDWICH OR COCKTAIL UPSTAIRS.
THE PEOPLE GOING ON TO THE COURTS.
[00:35:01]
THOSE ARE OUR CONCERNS. I DON'T KNOW IF THERE'S A DISCUSSION. THAT'S PREDOMINANTLY WHAT I WANT TO SAY THE SAFETY OF THE BUILDING IS OUR CONCERN.>> THANK YOU MR. MURPHY. >> I'M MARK CANNON.
I LIVE IN HAMILTON COUNTY AND MAINTAIN A LAW PRACTICE IN CARMEL FOR THE LAST APPROXIMATELY 10 YEARS.
I GUESS I WAS REPRESENTING THE PICKLE BALL COMMUNITY, NOT AS THEIR ATTORNEY, BUT JUST AS A PICKLE BALL PLAYER. I WAS ONE OF I THINK 26 OR 28 PEOPLE THAT SENT E-MAILS IN SUPPORT OF THE PETITION.
PICKLE BALL -- I WILL BE BRIEF.
PICKLE BALL IS THE FASTEST GROWING SUPPORT IN THE UNITED STATES FOR THE LAST THREE YEARS.
AS OF LAST YEAR ALMOST 5 MILLION PEOPLE PLAY PICKLE BALL. AND AT THE CURRENT GROWTH RATE THAT SHOULD DOUBLE WITHIN THE NEXT 3-4 YEARS.
THERE'S A GREAT DEMAND FOR FACILITIES TO PLAY PICKLE BALL. I DO WANT TO THANK THE CITY OF CARMEL THIS PAST SUMMER. WE'VE ADDED TWO OUTDOOR PICKLE BALL COURTS THAT GET A LOT OF PLAY.
WITH THE GROWTH IN THE SPORT THERE'S A BIG DEMAND FOR INDOOR FACILITIES. RIGHT NOW WE SHARE FACILITIES WITH TENNIS COURTS, TENNIS COURTS AND IT'S VERY DIFFICULT TO FIND COURT TIME.
CARMEL -- ONE OF THE REASON CARMEL IS CONSISTENTLY RATED AS ONE OF THE NUMBER ONE CITIES IN THE UNITED STATES IS BECAUSE THEY FOCUS ON HEALTH LIVING.
WE HAVE THE TRAILS AND MONAN CENTER.
AND THE TWO RECENT ADDITIONS TO PICKLE BALL COURTS.
I REPRESENT NOT JUST MYSELF BUT A LOT OF PICKLE BALL PLAYERS THAT ARE VERY EXCITED ABOUT THE FACILITY.
WE KNOW IT WILL GET A LOT OF USE.
WE'RE A GREAT, COMMITTED GROUP OF PEOPLE.
VERY TIGHT KNIT. AND WE WOULD LOVE TO SUPPORT THIS FACILITY. THANK YOU.
>> THANK YOU. [APPLAUSE] ONE OTHER PERSON THAT WISHES TO SPEAK?
>> FOLKS, I ASK YOU REFRAIN FROM OUTBURST, PLEASE.
GO RIGHT AHEAD AND INTRO DO YOU SEE YOURSELF AND THE AREA OF THE COMMUNITY OF WHICH YOU RESIDE.
I'M RICK. I RESIDE IN INDIANA.
BORN AND RAISED IN CARMEL. COACH OF MIDDLE SCHOOL TEAM.
COACHED A LOT OF PICKLE BALL PLAYER YOUNG AND OLD.
WHAT I'VE SEEN THIS SPORT DO FOR PEOPLE OF ALL AGES IT'S UNBELIEVABLE. I WANT TO LET YOU KNOW THAT THIS IS A HAPPY COMMUNITY. THIS A COMMUNITY THAT BASICALLY PEOPLE THAT HAVE DISABILITIES, ISSUES, WITH PHYSICAL MOVEMENTS, THIS IS SPORTS KIDS INTERACT WITH GRANDPARENTS. IT'S PHENOMENAL.
SEEING THIS ALL OVER THE COUNTRY I WAS IN SAN ANTONIO LAST WEEK AT CHICKEN AND PICKLE FACILITY.
IT'S AMAZING. YOU SEE ALL THESE MASSES OF PEOPLE PLAYING GAME. IT'S EASY TO LEARN.
THIS IS SOMETHING THAT WILL BE AMAZING FOR THE COMMUNITY. I STRONGLY RECOMMEND THAT.
I KNOW SEVERAL FOLKS WITH CARDIAC ISSUE THAT HAVE IMPROVED MEDICAL REPORT HAVE PLAYED PICKLE BALL.
THAT'S HUGE. MY BROTHER WAS A FIREFIGHTER FOR CARMEL AND HE WAS EMT. YOU KNOW WE'VE SEEN ALL KINDS OF ISSUE WITH THE FOLKS THAT HOW SPORTS CAN HELP YOU KNOW PRESERVE THEIR LIFE.
I STRONGLY RECOMMEND THIS. WASN'T PLANNING ON SPEAKING.
I LOVE THESE PEOPLE. THIS SPORT IS GREAT FOR THE COMMUNITY. I HOPE YOU ALLOW IT TO TOWN.
THANK YOU. >> DEPARTMENT REPORT.
>> THANK YOU. THE PETITIONER DID A GREAT JOB OF EXPLAINING THE VARIANCE REQUEST.
WE WON'T ADD ON TO THAT. THE USE VARIANCE DID GO THROUGH REVIEW BY THE TECHNICAL ADVISORY COMMITTEE. -- IT'S BEING REVIEWS FOR UTILITY, DRAINAGE, LIFE SAFETY ISSUES.
THINGS LIKE THAT. REGARDING THE NOISE, WE DID ASK THE PETITIONER TO ADDRESS THE POTENTIAL NOISE ISSUE. THERE ARE OVER HEAD GARAGE DOOR ELEMENT WHERE THE DOORS CAN BE OPEN IN A NICE WEATHER, WE DID ASK THEM ABOUT THAT THEY DID LET US KNOW THAT THEY WOULD BE COMPLYING WITH THE NOISE REGULATION OF THE CARMEL CITY CODE IF BY CHANCE
[00:40:03]
THERE'S A VIOLATION WITH THAT.THAT WOULD BE THE POLICE DEPARTMENT THAT WOULD ISSUE A CITATION JUST FOR YOUR INFORMATION ON THAT.
BUT OVERALL THE PLANNING DEPARTMENT IS SUPPORTIVE OF THE USE VARIANCE AND VARIANCE REQUEST.
AND WE WOULD RECOMMEND APPROVAL OF IT ADDRESSING ANY REMAINING TECHNICAL ADVISORY REVIEW COMMENT AND ADOPTION OF THE FINDINGS OF FACT.
WITH THAT THE PUBLIC HEARING IS NOW CLOSED.
MEMBERS -- >> I BELIEVE THE PETITIONER ENTITLED TO FIVE-MINUTE REBUTTAL SINCE THERE'S
ISSUES RAISED. >> YOU ARE CORRECT.
VERY GOOD. FEEL FREE TO RESPOND.
>> THANK YOU. I APPRECIATE THE COMMENTS TO NIGHT. MR. MURPHY WE WERE UNAWARE OF THE BUILDING DAMAGE TO THE BEST OF MY KNOWLEDGE.
AND WE UNDERSTAND YOUR CONCERNS ABOUT PARKING NOT FALLING OVER ON TO YOUR PRIVATE PROPERTY TO THE NORTH. I'M NOT SURE WHAT THE FIX IS. BUT WE WOULD APPRECIATE AN OPPORTUNITY TO MEET WITH YOU TO DISCUSS HOW WE RESOLVE THAT TO YOUR SATISFACTION. I THINK IT'S PRETTY EASY FIX. AND YOU'VE GOT A WILLING PARTNER. WE WOULD LIKE TO ADDRESS THAT. OFF THE RECORD, IF YOU WILL.
TO FIGURE OUT WHAT'S THE BEST PATH FORWARD THERE.
WE ACCEPT STAFF'S CONDITIONS APPROVAL.
AND AGAIN, REQUEST APPROVAL OF OUR TWO PETITIONS
MEMBERS OF THE BOARD, ANY QUESTIONS OR CONCERNS?
>> YES. >> I HAVE -- I'M SORRY.
>> KEVIN, THANKS FOR GETTING AHEAD OF THE CONCERNS AND THE LETTERS. THERE'S 28 LETTERS THE ONE THAT HAD CONCERNS YOU GOT AHEAD OF THAT.
APPRECIATE YOUR WILLINGNESS TO WORK WITH NEIGHBORS TO GET THROUGH THE ISSUES. IT SEEMS TO ME THERE'S PLENTY OF PARKING WITH 122. WHY DON'T YOU HELP ME CONFIRM MY UNDERSTANDING. THERE'S 36 PLAYERS.
EVEN IF THERE WERE 36 PEOPLE WAITING, AND ANOTHER 36 PEOPLE WAITING, AND THEY ALL DROVE SEPARATELY.
YOU -- YOU'RE STILL WAY UNDER THE 122 SPACES.
>> THAT'S CORRECT. >> I'VE LEARNED A LOT ABOUT PICKLE BALL OVER THE LAST COUPLE OF WEEKS.
I DON'T PRETEND TO KNOW IT ALL.
I BELIEVE MAXIMUM CAPACITY EACH COURT CAN ACCOMMODATE FOUR PLAYERS. TIME EIGHT COURTS.
THAT'S 32. IF THEY ALL DRIVE INDIVIDUALLY THAT'S 32. PLUS A COUPLE FOR STAFF AND WHOEVER IS PART OF THE BUILDING ENVIRONMENT.
THERE ARE 122 PLACES PARKING SPACE ON THE SITE PLAN FOR THIS. INCLUDING THE REQUIRED AMOUNT FOR THE ADJACENT OFFICE BUILDING.
DURING THE DAY THERE'S ABOUT 2 AND A HALF TIMES COURT CAPACITY PARKING. 2 AND A HALF TIMES 32.
SPACES THAT ARE AVAILABLE IN THAT PARKING LOT TAKING OUT THAT PORTION FOR THE OFFICE BUILDING.
AFTER HOURS, AND ON WEEKENDS, IT CAN SPREAD OUT INTO THE OFFICE BUILDING. WE ANTICIPATE TO NEED FOR ANYTHING TO FLOW OUTSIDE OF OUR PROPERTY.
CERTAINLY NOT TO THE NORTH AND WE WILL WORK WITH MR. MURPHY ON THAT. CERTAINLY NOT INTO THE NEIGHBORHOOD. I CAN'T IMAGINE THIS COMMUNITY TREATING THE NEIGHBORHOOD IN THAT FAST.
WE DON'T EXPECT IT. IF IT BECOMES A PROBLEM AND BROUGHT TO OUR ATTENTION. WE WILL MAKE A MENTION THAT TO THE MEMBERS AS THEY COME IN FOR THEIR PLAY TIME ON THE COURTS. EXCELLENT.
THANKS. >> I'VE GOT A COUPLE OF QUESTIONS, AS WELL KEVIN. ON SLIDE NINE, IT SHOWS AN ELEVATION AND SAYS WEST ELEVATION.
I DON'T KNOW IF YOU HAVE THAT.
BUT I DON'T THINK THAT'S ACCURATE; IS IT?
>> IN OTHER WORDS, THE BUILDING -- THE LENGTH IS GOING TO BE GOING NORTH AND SOUTH.
THERE ARE -- I'M NOT SURE WHICH ONE YOU ARE LOOKING AT. DO YOU HAVE THE BOOKLET FROM
FRONT OF YOU. >> YOU DON'T HAVE THE
PAGE 2. I THINK THAT'S A NORTH OR A SOUTH. ON THAT PARTICULAR SLIDE DISREGARD THAT ELEVATION. IT JUST HAPPENED TO BE ON
[00:45:02]
THE PAGE AND I SHOULD HAVE WHITED IT OUT.FOR THE ELEVATION IF YOU TURN TO THE SECOND PAGE THERE. THEY ARE CORRECTLY IDENTIFIED TOWARD THEIR CARDINAL DIRECTION.
>> AND A LINK TO THE BUILDING IS NORTH AND SOUTH
>> AND THE DOORS OPEN ON WHICH ONE?
>> THE NORTH AND SOUTH. >> DOORS WILL OPEN EITHER
>> IS THERE ANY PLANS ON THE SOUTH SIDE TO PUT ANY RECREATIONAL AREAS ALONG THAT POND?
>> I DON'T THINK THERE'S ROOM.
THE POND IS COVERED BY AN EASEMENT.
THE DRAINAGE EASEMENT. THAT DRAINAGE AREA GENERALLY HAS BEEN MUCH DISCUSSED AND CALCULATIONS OVER WHAT WE CAN AND CANNOT DO. I DON'T THINK THERE'S ANY ROOM TO PUT ANYTHING ON THE SOUTH SIDE OF THE BUILDING
BETWEEN IT AND POND >> I SAW SOME DOORS GOING OUT THAT WAY. I WAS CURIOUS.
THE HOURS OF OPERATION? >> I'M NOT SURE THAT WE'VE GOTTEN THAT FAR INTO THE OPERATIONAL PLAN FOR THE PICKLE BALL. DO WE ANY? WE DON'T KNOW AT THIS POINT. IF THAT BECOMES A PROBLEM FOR VIOLATION OF THE NOISE, ORNANCE OF THE CITY, THEN IT WOULD CERTAINLY BE ADDRESSED.
SOONER RATHER THAN LATER. >> THAT'S MY CONCERN.
I KNOW OUR NEIGHBORHOOD HAS PUT IN A PICKLE BALL COURT.
IT'S USED ALL THE TIME. PEOPLE LOVE IT.
BUT THE PEOPLE CLOSE TO IT AND ADJACENT TO IT THEY HEAR THAT NOISE CONSTANTLY ALL THE TIME.
IF YOU WILL OPEN DOORS UP, PARTICULARLY SAY AFTER 8:00 P.M. AT NIGHT. YOU ARE FACING SOUTH.
YOU ARE NOT FACING TOWARD THE NEIGHBORHOOD.
BUT I THINK YOU HAVE TO BE CONSCIOUS OF THAT.
I KNOW IT HAS BROUGHT UP SOME PROBLEMS IN OTHER
AREAS. >> YOU'RE ABSOLUTELY RIGHT.
THE DIFFERENCE BETWEEN THE OUTDOOR AND INDOOR.
WE DO HAVE A STRUCTURE THAT WILL CONTAIN AND DEFLECT MOST OF THE SOUNDS GENERATED INSIDE THE BUILDING FROM THE RESIDENTIAL NEIGHBORHOOD. EVEN IF THE DOORS ARE OPEN.
ONE OF THE FUN FACTS I LEARNED ABOUT PICKLE BALL IS THAT MOST OF THE NOISE THAT IS GENERATED GOES IN THE DIRECTION OF THE COURT. HITTING BALL ACROSS THE NET, THAT'S THE GENERATION AND PROJECTION OF SOUND.
ALL OF THOSE COURTS ARE ORIENTED NORTH TO SOUTH, DOORS ARE ON THE NORTH AND SOUTH SIDE IF THE DOORS HAPPEN TO BE OPEN THAT NOISZ WOULD BE AGAIN PROJECTED OUT THE NORTH AND SOUTH. NOT DEFLECTED TO THE
NEIGHBORHOOD TO THE EAST. >> THAT'S WHY I WONDER ABOUT
>> THANK YOU. >> YOU'RE WELCOME.
>> KEVIN, THE MATH ON THE PARKING THE MATH WORKS WITH 32 PLAYERS AT A TIME EVEN ALLOWING FOR TRANSITION AT QUARTER STILL THE HOUR AND TEN MINUTES PAST THE HOUR DOUBLING THAT. BUT THE PLANS ALSO SHOW A CLUB LEVEL ON THE MEZZANINE AS SHOWN HERE.
20 TABLES OF FOUR PLUS TEN MORE SEATS AT THE BAR.
SO THERE'S SEATING FOR 88 PATRONS JUST ON THE MEZZANINE LEVEL AS WELL. MAYBE SOME OF THOSE PEOPLE ARE THE PEOPLE IN YOU KNOW LEAVING THE COURT COMING TO THE COURT BUT THERE'S CAPACITY HERE FOR AS MANY AS 120 PEOPLE NOT COUNTING EMPLOYEES AND OFFICIALS.
WHEN THERE'S A TOURNAMENT. SO MY QUESTION, 80% OF THE TIME, I THINK THIS WORKS FROM PARKING STANDPOINT.
WHEN THERE'S A TOURNAMENT ONE THAT'S A WEEKEND THAT HELPS. BUT IS THERE A POSSIBILITY OF ANY KIND OF PARKING AGREEMENT WITH THE OFFICE SPACES ACROSS PENNSYLVANIA STREET FOR THAT OVERFLOW SO THAT WE KNOW THERE'S A SOLUTION POTENTIAL SOLUTION THAT IS NOT PARKING ON WASHINGTON BOULEVARD WHEN
THERE ARE LARGE WEEKEND >> I DON'T HAVE AN ANSWER - FOR LAST QUESTION. MAYBE IT EXIST.
WE CAN EXPLORE THAT. THE PICKLE BALL FACILITIES INTENDED TO BE RUN AS A CLUB.
IT WILL BE MEMBERSHIP BASED. AND THE PEOPLE THAT WOULD ORDINARILY BE USING THE FOOD SERVICE LEVEL ON THE SECOND FLOOR, WOULD BE MEMBERS AND THEIR GUESTS.
I MIGHT BE FINISHING PLAY OR AWAITING PLAY.
I THINK THE 88 SEATS ARE GENEROUS AMOUNT.
I'M NOT GOING TO SAY THEY WILL NEVER BE FILLED.
YOUR CONCERN ABOUT WHAT IF IS NOTED.
AND IF PARKING OUTSIDE OF OUR BOUNDS BECOMES A
[00:50:03]
PROBLEM, WE WILL CERTAINLY RADDRESS THAT ISSUE.>> I THINK THAT'S THE ISSUE IS I APPRECIATE YOUR WILLINGNESS TO WORK WITH FIREMENS AND THE CITY, OBVIOUSLY, CAN DO WHAT IT NEEDS TO DO TO PROTECT
WASHINGTON BOULEVARD. >> ABSOLUTELY.
IF THIS EXCEEDS LIKE I THINK IT WILL SUCCEED.
THE FORESIGHT WILL HELP ON THAT ISSUE.
>> I WILL BE A GOOD PROBLEM. I'M CERTAIN WE CAN ADDRESS
IT. >> AND THAT IS SUBJECT TO THE PETITIONER ADDRESSING ALL REMAINING TACK REVIEW COMMENTS. AND WITH THE ADOPTION OF THE FINDING OF FACTS SENT IN BY PETITIONER.
>> SECOND. >> IT'S BEEN MOVED AND SECONDED WE APPROVAL DOCKET PZ-2022-00185UV.
AND PZ-2022-00186V. WITH THE PETITIONER ADDRESSING ALL REMAINING TACK REVIEW COMMENTS AND WITH ADOPTION OF FINDINGS OF FACT SUBMITTED BY THE PETITIONER. ALL THOSE IN FAVOR OF DOCKET NUMBER PZ-2022-00185UV SAY "AYE."
>> ANY OPPOSED. >> ALL THOSE IF FAVOR DOCKET
PZ-2022-00186V, SAY "AYE." >> ANY OPPOSED.
>> THANK YOU VERY MUCH FOR YOUR TIME.
>> THANK YOU. IS THERE ANY OTHER BUSINESS TO COME BEFORE THE BOARD TONIGHT? SEEING NONE, WITHOUT OBJECTION THIS
