[5. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS]

NEXT UP, WE HAVE RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS. I BELIEVE WE HAVE A PROCLAMATION THAT COUNCILOR GREEN WILL READ FOR THE HEALTH FOR HUMANITY

YOGATHON. >> WHEREAS, YOGA IS AN ANCIENT HINDU PRACTICE DEVELOPED THOUSANDS OF YEARS AGO IN THE INDIAN SUBCONTINENT AND SUN SALUTATION IS A TRADITIONAL YOGA PRACTICE COMBINING A SEQUENCE OF POSTURES WITH BREATHING EXERCISES; AND WHEREAS HHS IS A NONPROFITABLE, CHARITABLE

[00:05:04]

ORGANIZATION WITH OVER 235 BRANCHES IN 164 CITIES AND IN 34 STATES, INCLUDING FIVE BRANCHES IN THE STATE OF INDIANA.

AND COMMUNITY SERVICE ACTIVITIES SUCH AS FOOD DRIVES PROVIDING HOT MEALS TO SHELTERS AND OTHER SERVICE ACTIVITIES IN SEVERAL CITIES ACROSS INDIANA; AND WHEREAS HHS IS ORGANIZING THE ANNUAL HEALTH FOR HUMANITY YOGATHON WITH THE GOAL OF HAVING OVER 10,000 INDIVIDUAL PARTICIPANTS PRACTICE TO PROMOTE THE SPIRITUAL, MENTAL, AND PHYSICAL WELL-BEING OF ALL MEMBERS OF THE COMMUNITY. ; WHEREAS, YOGA ENTHUSIASTS AND COMMUNITY ORGANIZATIONS ARE PARTICIPATING IN THE HHS HEALTH FOR HUMANITY YOGATHON; AND WHEREAS, AS THE STIP OF CARMEL HEREBY RECOGNIZES HHS FOR ORGANIZING THE ANNUAL HEALTH FOR HUMANITY YOGATHON TO PROMOTE THE SPIRITUAL, MENTAL, AND PHYSICAL WELL-BEING OF ALL MEMBERS OF THE COMMUNITY.

NOW, THEREFORE, I, JAMES BRAINARD, MAYOR PROCLAIM IT AS YOGATHON DAY IN THE CITY OF CARMEL, INDIANA.

>> THANK YOU, COUNSELOR GREEN. WE HAVE SOMEONE FROM THE ORGANIZATION WHO WOULD LIKE TO SPEAK FOR A COUPLE OF MINUTES.

SO, IF YOU WOULD APPROACH THE PODIUM.

AND THE MICROSOFT AND THE MICROPHONE IS ON, SO YOU SHOULD BE GOOD TO GO.

DEAR CARMEL CITY COUNCIL MEMBERS AND HONORABLE MAYOR, MY NAME IS -- I'M A HINDU AMERICAN. I'M HEAR TO TALK ABOUT HEALTH FOR HUMANITY YOGATHON WHICH IS AN ANNUAL INITIATIVE.

THIS YOGATHON IS THE YEAR'S FIRST AMONG THE LIST OF INITIATIVES. SOME OTHER NOTABLE INITIATIVES UNDERTAKEN BY HHS ARE UNIVERSAL ONENESS DAY IN WHICH WE HONOR THE SERVICE HONORED BY CIVIC LEADERS, POLICE AND FIRE DEPARTMENTS. A FOOD DRIVE DURING THE MONTH OF DIWALI. THEY COLLECTED FOOD TO ALLEVIATE HUNGER WITHIN OUR COMMUNITY. HEALTH FOR HUMANITY YOGATHON IS A 16-DAY EVENT STARTING JANUARY 14TH TO THE 29TH TO CREATIVE AWARENESS ABOUT YOGA IN ACHIEVING A HEALTHY BODY, MIND, AND SPIRIT OF ANY PRACTITIONER REGARDLESS OF LEVEL OF EXPERIENCE. THIS EVENT INTEGRATES AN EASY BREATHING TECHNIQUE AND A 10-STEP MOVEMENT TO PROVIDE HEALTH BENEFITS. I WOULD LIKE TO BRING TO YOUR ATTENTION SOME NOTABLE ACHIEVEMENTS AND INITIATIVES OF THIS YOGATHON. IN 2022, THEY PERFORMED ONE MILLION SUN SALUTATIONS THROUGHOUT THE UNITED STATES IN THE DAILY EXERCISE ROUTINE. YOGA AS AN INITIATIVE IN SCHOOLS HAS TREMENDOUS VALUE FOR THE INDIVIDUAL IN TERMS OF SELF-EFFICACY AND ALSO IMPROVES THE QUALITY OF SCHOOL AS A WHOLE. THERE'S A GROWING POPULARITY OF YOGA AS A CULTURE WITHIN MANY SCHOOLS IN THE UNITED STATES BECAUSE SCHOOLS HAVE BEGUN TO REALIZE THE POSITIVE EFFECT ON MENTAL STATES, DAILY PERFORMANCE AND IN THE SOCIAL SKILLS OF THEIR STUDENTS. 19,000 STUDENTS HAVE PARTICIPATED IN THIS YOGATHON LAST YEAR.

HHS HAS REACHED OUT TO CARMEL-CLAY SCHOOLS AND OFFERED TO CONDUCT A YOGATHON WORKSHOP FOR THEIR STUDENTS.

HHS WOULD LIKE TO THANK THE MAYOR FOR THE EIGHTH-CONSECUTIVE PROCLAMATION DECLARING YOGATHON DAY.

>> ALL RIGHT. I BELIEVE THEY WOULD LIKE A PHOTO WITH THE COUNCIL, SO IF YOU'D KIND OF SQUEEZE IN.

[00:10:18]

>> THANK YOU SO MUCH. APPRECIATE IT.

>> NEXT UP, WE HAVE RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL, ALSO KNOWN AS OUR BLUE CARD SESSION.

WE HAVE JUST ONE BLUE CARD SPEAKER, JOHN BABCOCK.

SO, JOHN, IF YOU WOULD APPROACH THE PODIUM.

I'M SORRY. OVER THERE.

WELL, UM, YOU FILLED OUT A BLUE CARD.

YOU CAN SPEAK FOR WHATEVER YOU'D LIKE FOR UP TO THREE MINUTES.

OR YOU CAN WAIT UNTIL THE PUBLIC HEARING.

YOU'D PREFER TO DO THAT? OKAY.

WE'LL HOLD THAT, THEN. OKAY.

NUMBER SEVEN, COUNCIL AND MAYORAL COMMENCE AND

[8. CONSENT AGENDA]

OBSERVATIONS. ALL RIGHT.

WE'LL MOVE ON TO THE CONSENT AGENDA.

APPROVAL OF MINUTES FROM THE DECEMBER 19TH, 2022 REGULAR MEETING AND THE DECEMBER 30TH, 2022 SPECIAL MEETING, AND THEN WE HAVE GENERAL CLAIMS IN THE AMOUNT OF $1,295,377.AND WIRE

TRANSFERS IN THE AMOUNT OF... >> MOVE TO APPROVE.

SECOND. ANY DISCUSSION? ALL RIGHT. JACOB.

>> COUNCILOR GREEN? [VOTE]

>> 8-0. >> ALL RIGHT.

NUMBER NINE, WE HAVE NO ACTION ON MAYORAL VETOS.

[10. COMMITTEE REPORTS]

NUMBER 10, REPORTS. FINANCE, UTILITIES AND RULES COMMITTEE. PRESIDENT WORRELL.

>> THANK YOU, VICE PRESIDENT CAMPBELL.

THE FINANCE COMMITTEE DID MEET PRIOR TO COUNCIL THIS MORNING AND WORKING ON RESOLUTION WHICH IS A DEFEASANCE TO PAY IN FULL, OUTSTANDING 2013 REDEVELOPMENT DISTRICTS WONDER.

THERE WAS DISCUSSION WHEN THIS WAS INTRODUCED ABOUT THE ABILITY TO PAY. WE HEARD FROM OUR MUNICIPAL FINANCIAL ADVISER, AS WELL AS BOND COUNCIL WHO IS HERE WITH US TONIGHT IF ANYONE HAS ANY QUESTIONS.

WE ALSO HEARD FROM -- TOGETHER, THERE WAS QUESTIONS REGARDING WHY THE REPAYMENT SCHEDULE AND THE RESERVES, AND HOW ALL THAT WORKED. SO, THAT WAS DISCUSSED IN DETAIL, AND THE COMMITTEE VOTED TO RETURN THIS TO FULL COUNCIL WITH POSITIVE RECOMMENDATION 3-0.

>> ALL RIGHT. THANK YOU.

NEXT IS LAND USE AND SPECIAL STUDIES COMMITTEE.

[11. OTHER REPORTS – (at the first meeting of the month specified below)]

WE HAVE NOT MET. UM, OTHER REPORTS.

THE CARMEL REDEVELOPMENT COMMISSION.

GOOD EVENING. CARMEL REDEVELOPMENT DIRECTOR.

IN LIEU OF THE REGULAR REPORT TODAY, I WANTED TO HIGHLIGHT SOMETHING THAT THE REDEVELOPMENT COMMISSION HAS BEEN WORKING ON.

IN CONJUNCTION WITH NANCY HECHT'S COMMUNITY RELATIONS DEPARTMENT, WE HAVE PUT TOGETHER A NEW BUSINESS EXPANSION

[00:15:04]

RETENTION WEBSITE. IT CAN BE FOUND AT CHOOSECARMELIN.COM AND I WOULD JUST LIKE TO HIGHLIGHT A COUPLE OF THINGS ABOUT THIS WEBSITE. THIS IS FOR -- THIS WEBSITE IS ESSENTIALLY -- IT SERVES TWO FUNCTIONS.

IT -- IT HELPS BUSINESSES THAT ARE LOOKING TO LOCATE WITHIN THE CITY OF CARMEL. IT HELPS THEM NAVIGATE AND HELPS SELL OUR CITY. AND IT ALSO HIGHLIGHTS SOMETHING THAT I THINK WE'VE BEEN MISSING FOR A LONG TIME, WHICH IS IT ALLOWS PEOPLE TO SEE ALL REDEVELOPMENT PROCESS CURRENT AND PAST. AND I'LL JUST HIGHLIGHT THAT REAL QUICK. IF YOU GO TO THE REDEVELOPMENT PROJECTS TAB, EVERY PROJECT THAT IS CURRENTLY UNDER CONSTRUCTION AND EVERY PROJECT FROM THE PAST IS ABLE TO -- IT IS HERE FOR EVERYONE WHO WANTS TO CHECK IT OUT.

SO, JUST FOR EXAMPLE, IF YOU CLICK ON ANY OF THESE, YOU GET A VISUAL ABOUT WHAT EACH PROJECT IS, YOU GET A DESCRIPTION OF THE PROJECT, INCLUDING HOW TIF WAS USED.

I MEAN, PART OF THIS WEBSITE IS AN EDUCATIONAL COMPONENT.

PEOPLE OFTEN ASK HOW TIF WORKS, HOW TIF WAS USED TO MAKE SOME OF THESE PROJECTS HAPPEN, AND MY FAVORITE PART IS ALWAYS A LOT OF BEFORE-AND-AFTER SHOTS. SO, EVERY SINGLE PROJECT THAT THE REDEVELOPMENT COMMISSION HAS WORKED ON IS NOW ABLE TO BE VIEWED. SO, ANYTIME ANYONE ASKS, WHICH I'M SURE WE ALL GET, HEY, WHAT'S THAT? WHAT'S THAT UNDER CONSTRUCTION? WHAT'S THAT GOING ON? YOU CAN JUST SEND THEM TO CHOOSECARMELIN.COM AND EACH PROJECT IS DESCRIBED, THERE'S INFORMATION WITH VIDEOS AND PICTURES RELATED TO EACH PROJECT, INCLUDING THESE BEFORE-AND-AFTER SHOTS. SO, I KNOW THAT THAT'S SOMETHING I GET ASKED A LOT. HEY, WHAT'S THIS GOING TO BE? AND I THINK, AS OUR CITY KEEPS GROWING, PEOPLE WANT TO KNOW TRULY, YOU KNOW, WHAT -- WHAT -- WHAT USED TO BE HERE BEFORE, AND HOW HOW THESE PROJECTED ENHANCED OUR CITY? YOU CAN GO TO ANY PROJECT TAB AND YOU CAN SEE WHAT WAS THERE BEFORE EACH PROJECT WAS DONE AND KIND OF SEE THE EVOLUTION FROM INITIAL DESIGNS TO PROJECTS BEING BUILT.

SO, EVERY PROJECT, EVERY SINGLE TIF PROJECT THAT THE REDEVELOPMENT COMMISSION HAS WORKED ON CAN BE FOUND HERE.

I THINK THIS ADDS A LOT OF TRANSPARENCY AND ENHANCES THE TRANSPARENCY. THIS IS A LANDING PAGE THAT A LOT OF SITE SELECTORS LOOK FOR. WE'RE ABLE TO PROVIDE STATS IMMEDIATELY, UP TO THE MINUTE STATS THAT COMPANIES, CEOS, SITE SELECTORS LOOK FOR WHEN THEY'RE LOOKING AT -- AT CARMEL.

IN ADDITION, IT ALSO HAS A SERIES OF VIDEOS FOR EVERYONE TO VIEW AND HOW TAX INCREMENT FINANCE WORKS.

AND SO, I HOPE THIS CAN BE -- THIS WORKS SEAMLESSLY WITH THE MAIN CITY PAGE. IF YOU'RE ON THE MAIN CITY WEBSITE AND YOU WANT TO LEARN ABOUT SOME PROJECTS, OR YOU WANT TO LEARN HOW TIF WORKS, OR IF THERE'S A CEO THAT'S LOOKING TO LOCATE IN THE CITY OF CARMEL, THIS WEBSITE HIGHLIGHTS ALL THE GREAT THINGS ABOUT CARMEL IN ONE EASY PLACE.

IT LINKS TO A LOT OF DIFFERENT PLACES, BUT IT PUTS ALL THIS INFORMATION ALL IN ONE SPOT, TEACHES PEOPLE ABOUT TIF.

IT HAS A PROPERTY SEARCH FUNCTION, AND, OBVIOUSLY, MY FAVORITE PART ARE ALL THE DIFFERENT REDEVELOPMENT PROJECTS BEING WORKED ON. SO, IF YOU'RE WONDERING WHAT IS GOING ON NORTH OF THE KROGER ON RANGELINE, THIS IS WHERE YOU'RE ABLE TO FIND WHAT IT WAS BEFORE AND WHAT IT'S GOING TO LOOK LIKE. THIS IS SOMETHING WE'VE BEEN WORKING ON FOR ABOUT A YEAR, AND IT'S REALLY EXCITING TO BE ABLE TO SHARE THAT WITH YOU. WITH THAT, I'M HAPPY TO ANSWER ANY QUESTIONS ABOUT THIS WEBSITE OR ANYTHING ELSE GOING ON REDEVELOPMENT-WISE IN THE CITY. COUNSELOR AASEN.

>> THANK YOU. UM, SO, FIRST OFF, KUDOS FOR THIS. THIS IS SOMETHING THAT I THINK A LOT OF PEOPLE WANT TO KNOW WHY TO CHOOSE CARMEL.

JUST TO ADD TO THE IDEA, I KNOW WE'VE GOT QUITE A FEW PEOPLE WHO

[00:20:08]

CAN MAYBE GET THIS IN PLACE IN THE FUTURE, I'D LOVE TO SEE SOMETHING FOR SMALL BUSINESSES, MOM-AND-POPS, IF THEY ARE SAYING, HEY, I'D LOVE TO OPEN A BUSINESS IN CARMEL, UM, I KNOW THEY CAN CONTACT A COMMERCIAL REALTOR, BUT IT CAN BE OVERWHELMING, WHICH NEIGHBORHOOD? WHAT IS THE BEST FIT? WILL THERE BE PARKING AVAILABLE FOR MY SITE? ALL THOSE QUESTIONS THAT SMALL MOM-AND-POP BUSINESSES HAVE WHEN THEY COME TO THE AREA.

I'VE TRIED TO DIRECT THEM. IT WOULD BE GREAT TO MAYBE INTEGRATE SOME OF THAT INFORMATION FOR THOSE THAT AREN'T JUST GIANT OFFICES. WE LOVE THE GIANT OFFICES.

WE ARE HAPPY TO HAVE THEM IN CARMEL, SO THIS IS NOTHING AGAINST THAT. BUT IN ADDITION TO THAT, MAYBE HAVE SOMETHING FOR THE SMALLER BUSINESSES, TOO, TO BE ABLE TO NAVIGATE THOSE RESOURCES AS WELL.

>> UNDERSTANDS. I'LL TALK TO DIRECTOR HECHT ABOUT THAT, AND I WILL HIGHLIGHT THE PROPERTY SEARCH FUNCTION THAT LETS ANY -- ANYBODY KNOW WHAT PROPERTIES ARE LISTED, EITHER FOR SALE OR FOR LEASE IN THE CITY AS WELL.

>> FANTASTIC. >> COUNCILOR GREEN.

>> YEAH, I JUST WANTED TO FOLLOW UP WITH COUNCILLOR AASEN.

I STUMBLED INTO THE WEBSITE TODAY.

IT HAD A LOT OF INFORMATION ON THERE.

I WAS TRYING TO FIGURE OUT, WHERE THE HECK DID THIS COME FROM? YEAH, I WAS IMPRESSED, LOTS OF GOOD INFORMATION AND IS A REAL STRONG MOVE TOWARDS MORE

TRANSPARENCY, SO APPRECIATE IT. >> THANK YOU, COUNCILOR.

>> THIS IS TERRIFIC. IT'S A GREAT TOOL THAT I THINK WILL GO A LONG WAY FOR TRANSPARENCY PURPOSES, BUT ALSO AS A TOOL TO ATTRACT HEADQUARTERS AND ALSO HOPEFULLY

YOUNG TALENT. >> ALL RIGHT.

>> THANK YOU. >> NEXT UP, WE HAVE THE CARMEL HISTORIC PRESERVATION COMMISSION.

>> GOOD EVENING, COUNCILORS. MARK WITH THE CARMEL HISTORIC PRESERVATION COMMISSION. WE DISTRIBUTED A REPORT.

THIS HAS BEEN, HONESTLY, KIND OF A QUIETER QUARTER, THE LAST QUARTER OF 2022 FOR THE COMMISSION.

WE DID DO SOME FACADE GRANT CLOSEOUTS WITH SOME PROPERTY OWNERS THAT HAD RECEIVED THOSE THROUGHOUT THE COURSE OF 2022.

UM, ONE OF THE MORE INTERESTING PROJECTS THAT WE SORT OF BEGAN WAS CONVERSATIONS WITH THE HAMILTON COUNTY PARKS DEPARTMENT ABOUT THE WILLIAMS HOUSE, WHICH IS THE HISTORIC FARMHOUSE THAT IS IN COXALL GARDENS. THEY ARE INTERESTED IN RERE REHABILITATING THE STRUCTURE AND IN DISCUSSIONS FOR FUNDING. ALSO, LOOKING AT LISTING THE HOUSE ON THE NATIONAL REGISTER OF HISTORIC PLACES.

THAT NOMINATION WILL HAVE TO COME THROUGH THE COMMISSION, AND ALSO POTENTIALLY TALKING ABOUT LOCAL DESIGNATION OR PROTECTION OF THE STRUCTURE THROUGH THE COMMISSION AND THE COUNCIL.

SO, THAT WOULD BE COMING DOWN THE ROAD.

FORTUNATELY, THERE WEREN'T ANY DEMOLITION REVIEWS FOR THE STAFF TO DO IN THIS QUARTER, SO WE APPRECIATED THAT.

I'M SURE THERE'S MORE COMING FOR 2023 BUT WE'RE GOOD NOW.

SO, ANY QUESTIONS? >> VERY GOOD.

ANY QUESTIONS? OKAY.

NO? THANK YOU VERY MUCH.

[12. OLD BUSINESS]

>> THANK YOU. ALL RIGHT.

WE'RE MOVING ON TO NUMBER 12, OLD BUSINESS.

THE FOURTH READING OF ORDINANCE D-2657-22.

(READING ORDINANCE). THIS WAS ASSIGNED TO A COMMITTEE OF THE WHOLE WHERE IT REMAINS, AND THIS ORDINANCE AMENDS THE DEFINITION OF PUBLIC ART AND CLARIFIES THAT THE ONLY PERMANENT PUBLIC ART ACQUISITIONS WILL BE SUBJECT TO REVIEW BY THE CARMEL PUBLIC ART ADVISORY COMMITTEE.

RESOLUTION CC-12-19-22-01. (READING ORDINANCE).

[00:25:10]

AS HE REPORTED, THIS COMES BACK TO COUNCIL WITH A 3-0 FAVORABLE RECOMMENDATION. SO, COUNCIL, ANY QUESTIONS, DISCUSSION? OR A MOTION?

MOVE TO APPROVE. >> SECOND.

>> ANY DISCUSSION? ALL RIGHT.

JACOB. (VOTING).

[13. PUBLIC HEARINGS - A portion of this item is unavailable ]

>> 8-0. >> OKAY.

13 IS PUBLIC HEARINGS. SECOND READING OF ORDIORDINANCE D-2656-22.

(READING ORDINANCE D-2656-22). THIS WAS INTRODUCED AND HELD OVER FOR A PUBLIC HEARING, AND, UM, THIS VACATES THE SURPLUS RIGHT-OF-WAY THAT IS NEEDED FOR THE OLD MERIDIAN AND MAIN

REDEVELOPMENT PROJECT. >> GOOD EVENING.

AS WE STATED AT THE LAST MEETING, WE HAD ASKED YOU TO TABLE THIS BECAUSE WE NEEDED TO CLARIFY THE EXHIBIT.

THE REAL PROPERTY DESCRIPTION WAS INCORRECT.

THERE HAD BEEN A MISTAKE AT THE COUNTY.

WE RECTIFIED THAT AT THE LAST MEETING.

IT'S NOW CLASSIFIED AS RIGHT-OF-WAY, AS IT SHOULD HAVE BEEN BACK IN 2004. I SENT THE REVISED EXHIBIT OVER TO JACOB. IT SHOULD BE IN YOUR PACKETS, AND THAT'S THE ONLY CHANGE FROM A WHAT WAS SUBMITTED PRIOR TO THE COUNCIL AS AN EXHIBIT. THIS WAS AREA THAT WAS SURPLUS TO THE ROUNDABOUT PROJECT ON OLD MERIDIAN AND MAIN STREET SEVERAL YEARS AGO. THE PATH IS IS ON THE NORTHEAST CORNER. THERE'S A LOT OF AREA THAT JUST ISN'T NEEDED BY THE CITY AND NEEDS TO BE USED FOR THE

REDEVELOPMENT PROJECT. >> ALL RIGHT.

QUESTIONS FROM COUNCIL BEFORE I OPEN THE PUBLIC HEARING? OKAY. THANK YOU, JOHN.

ALL RIGHT. I AM OPENING THE PUBLIC HEARING AT 6:28. IF YOU'D LIKE TO SPEAK FOR OR AGAINST THIS ISSUE, PLEASE APPROACH THE PODIUM.

SEEING NONE, I'M CLOSING THE PUBLIC HEARING AND WOULD

ENTERTAIN A MOTION. >> MOVE TO APPROVE.

>> SECOND. >> ANY DISCUSSION?

>> ALL RIGHT. JACOB? (VOTING).

>> 8-0. >> ALL RIGHT.

13B IS THE FIRST READING OF ORDINANCE Z-679-22.

(READING ORDINANCE). >> MOVE TO INTRODUCE.

>> SECOND. >> COUNCILOR RIDER.

THIS ESTABLISHES AN AMENDMENT TO THE LEGACY PLANNED UNIT DISTRICT. WHICH AMENDMENT SHAB REFERRED TO AS 2022 LEGACY PUD AMENDMENT ORIONS.

(READING ORDINANCE). THIS COMES BACK FROM -- -- THE EXPANDING THE URBAN RESIDENTIAL USE BLOCK, REMOVING THE PROPOSED RESIDENTIAL AREA FROM THE EXISTING AMENITY USE AREA, WHILE PROVIDING ADDITIONAL AMENITIES TO SERVE THIS SPACE.

THE PROPOSED SITE PLAN IS SHOWN HERE.

THE COMMUNITY WILL BE A HORIZONTALLY MIXED-USE RESIDENTIAL DEVELOPMENT COMPROMISED OF APPROXIMATELY 230 SINGLE-FAMILY ATTACHED AND DETACHED RENTAL HOMES AND 120

[00:30:03]

APARTMENTS IN THREE BUILDINGS ADJACENT TO COMMUNITY DRIVE.

ALL COTTAGES AND AMENITIES OCCUPYING THE MAJORITY OF THE SITE WILL PROVIDE A TRANSITION FROM EAST TO WEST IN THE INTENSITY OF DEVELOPMENT WITH NON-RESIDENTIAL USES ONLY IN THE AREA NEAREST COMMUNITY DRIVE TODAY.

IN ADDITION TO THE RESIDENTIAL COMPONENT, THE SITE INCLUDES APPROXIMATELY TWO ACRES, WHICH IS AN OUTPARCEL AT THE CORNER OF COMMUNITY DRIVE AND 146TH STREET.

FROM A SITE LAYOUT. THE COMMUNITY WILL CONTINUE THE EXISTING AND PLANNED STREET NETWORK INCLUDING LARSON DRIVE AND JAMES DEAN DRIVE NORTH TO SOUTH AND HOPEWELL PARKWAY EAST TO WEST WHICH PARALLELS 146TH STREET.

AS PART OF THE REVIEW PROCESS, THE APPLICANT MADE SIGNIFICANT PROJECT MODIFICATIONS AND ENHANCEMENTS.

THEY INCLUDE BUT ARE NOT LIMITED TO ADDITIONAL LANDSCAPING ALONG THE WESTERN PERIMETER, ENHANCING THE BUFFER ADJACENT TO THE RIDGE AT LEGACY, REQUIREMENTS FOR ADDITIONAL COMMERCIAL SPACE WHERE ALONG COMMUNITY DRIVE AND REQUIRING DOG DNA TESTING AS PART OF LEASE AGREEMENTS TO CONTROL AND MONITOR ANIMAL WASTE COLLECTION THROUGHOUT THE SITE. PROVISIONS TO ADDRESS THE CONTROLLING DEVELOPER'S REQUIREMENTS AND OBLIGATIONS TO PROVIDE ENFORCEMENT IN PLACE SO THAT THE PRODUCT WE'RE SHOWING YOU THIS EVENING THIS IS APPROVED WHICH THE PLANNING COMMISSION IS THE PRODUCT THAT MAYBE MAINTAINED OVER TIME.

AS ILLUSTRATED HERE, THERE ARE HOME RENDERINGS WHICH ARE INCLUDED IN THE AMENDMENT. THESE ARE PHOTOGRAPHIC EXAMPLES.

THEY WILL FEATURE FRONT PORCHES AND PATIOS.

THE DWELLINGS ON THE REAL ESTATE SHALL BE IN COMPLIANCE WITH THE CHARACTER, IMAGERY INCLUDED WITHIN THE AMENDMENT, THE VARI VARIETY OF EXTERIOR MATERIALS, METAL ROOF AND NUMEROUS WINDOWS ON ALL ELEVATIONS.

IN CONCLUSION, THE APPLICANT HAS WORKED DILIGENTLY TO ADDRESS ALL THE COMMENTS WHICH WERE RECEIVED BY THE PLANNING COMMISSION, NOT ONLY FROM STAFF, THE PUBLIC, AS WELL AS THE PLANNING COMMISSION, WHICH DID RESULT IN THE UNANIMOUS FAVORABLE RECOMMENDATION FACTORED ED -- FORWARDED AND REQUEST FIRST READING AND FORWARDS OF THE MATTER.

WITH THAT, I'LL CONCLUDE. >> THANK YOU.

QUESTIONS FROM COUNCIL? THIS WILL BE GOING TO COMMITTEE.

BUT ANY INITIAL QUESTIONS? >> MAY I?

>> COUNCILOR RIDER. >> YEAH, I JUST WANTED TO POINT SOMETHING OUT, AND THEY'RE GOING TO SMILE WHEN I SAY THIS.

AND THIS IS NOT GIVING THE COUNCIL POETIC LICENSE TO ASK FOR ANYTHING THAT I WANT, BUT THIS MIGHT BE THE FIRST PROJECT IN 15 YEARS THAT LITERALLY ASKED FOR EVERYTHING WE ASKED FOR.

YOU KEPT SAYING YES. I'M NOT GIVING POETIC LICENSE FOR PEOPLE TO ASK FOR CRAZY THINGS.

THEY WERE ALL REASONABLE THINGS. BUT YOU WERE THAT EASY TO WORK WITH. WE APPRECIATE THAT.

>> JUST ONE COMMENT AFTER, YOU KNOW -- FIRST OF ALL, I'D LIKE TO ECHO COUNCILLOR RIDER'S COMMENT ABOUT BEING EASY TO WORK WITH. THE PROJECT TEAM HAS BEEN FANTASTIC. THE ONE OUTSTANDING COMMENT THAT KEEPS COMING UP WITH MY DISTRICT IS THEY WOULD STILL LIKE TO SEE A RESURRECTION IN -- REDUCTION IN UNITS.

THAT'S THE ONE THING THAT SEEMS TO BE JUST HANGING OUT THERE, THEY FOUGHT PRETTY HARD TO REDUCE THE NUMBER OF UNITS, AND IT'S GOING TO BACK UP. I JUST WANTED TO MAKE YOU AWARE OF THAT BEFORE WE COME TO COMMITTEE.

>> YEAH. WE CAN REVIEW THAT.

THE -- THE, UM, AS -- AS -- AS A MATTER OF FACT, THIS IS ACTUALLY A RESURRECTION IN THE NUMBER OF UNITS.

WE'RE TRANSFERRING WHAT COULD HAVE OTHERWISE BEEN DEVELOPED AS LOTS INTO THIS DEVELOPMENT. 153 APARTMENTS COULD BE DEVELOPED ON THE REAL ESTATE IN ADDITION TO LOFTS, AS MANY AS 160, PERMITTING 315 QUEDWELLING UNITS.

WE'RE MODIFYING IT TO ALLOW THIS PROPOSAL WITH THIS DEVELOPMENT AND THESE QUALITIES WITH A MAXIMUM OF 250.

SO, IN FACT, THERE'S A RESURRECTION IN DWELLING UNIT, BUT THERE'S A SHIFTS FROM LOFTS AND WHAT WOULD OTHERWISE POTENTIALLY BE SINGLE FAMILY INTO THIS PROPOSAL.

UM, THERE'S INFORMATION THAT WE PROVIDED THE COUNCIL IN OUR

[00:35:01]

INFORMATIONAL SUBMITTAL THAT RELATES TO THAT, AND WE'D BE GLAD TO DIG INTO IT AT THE COMMITTEE.

THANK YOU. >> COUNCILOR US AEN.

>> THANK YOU JUST ONE THING. JOHN, YOU JUST TOUCHED ON IT.

WHEN WE GET TO COMMITTEE, MAYBE WE CAN GET INTO IT A LITTLE BIT MORE. WHAT WAS AVAILABLE BY RIGHT BEFOREHAND AND WHAT'S CHANGED NOW.

BECAUSE I KNOW WE'VE ALL HAVE GOTTEN MANY, MANY EMAILS OVER THE LAST FEW MONTHS ABOUT THIS PROJECT.

AND, AS I'VE LEARNED MORE ABOUT IT, I'VE LEARNED THAT SOME OF THE REQUESTS FROM SOME OF THE PEOPLE THAT ARE EMAILING ARE THINGS THAT WOULD ALREADY HAVE BEEN ALLOWED REGARDLESS OF WHETHER THIS PROJECT CAME FORWARD.

SO, WHETHER NOW OR -- OR LAND USE, JUST TALK A LITTLE BIT ABOUT WHAT WAS ALREADY ALLOWED BY RIGHT AND WHAT WE ARE

ACTUALLY CHANGING. >> WE'LL BE PREPARED TO DO THAT.

>> OKAY. >> ALL RIGHT.

NO FURTHER QUESTIONS. SO, I WILL OPEN THE PUBLIC HEARING AT 6:38. AND IF YOU'D LIKE TO SPEAK FOR OR AGAINST, PLEASE APPROACH THE PODIUM.

YOU'LL HAVE THREE MINUTES TO SPEAK, AND WHEN THE LIGHT TURNS YELLOW, THEN YOU HAVE 30 SECONDS LEFT.

SO, JUST STATE YOUR NAME AND IF YOU'RE A RESIDENT OF CARMEL.

YOU DON'T HAVE TO GIVE YOUR ADDRESS.

>> I'M JOHN BABCOCK. I DO LIVE IN CARMEL.

I WOULD LIKE TO EXPRESS CAUTION AND CAREFUL, TARGETED WORDING OF THE APPROVAL OF THIS BILL TO GRANT AMENDMENT FOR THE LEGACY PUD. THE COUNCIL HAS ALREADY CRACKED THE DOOR ON A MAJOR RUN ON RENTAL APARTMENT PROPERTY, AND IF THE COUNCIL'S NOT CAREFUL HOW YOU WORD THE APPROVAL OF THIS BILL TO RENT AMENDMENT, THE COUNCIL WILL BE OPENING PANDORA'S BOX ON OTHER PUDS AROUND THE CITY FOR YEARS TO COME. AND, UM, I CANNOT STRESS ENOUGH TO THIS COUNCIL THE NEED FOR RESPONSIBLE DEVELOPMENT AND PROTECTING THE CITY AND NOT CONTINUING TO SELL OUT YOUR CONSTITUENTS. PERHAPS A COUNCIL INITIATIVE TO PURSUE AFFORDABLE, NEW HOME HOME CONSTRUCTION OUGHT TO BE IN ORDER FOR 2023. THANK YOU.

>> ALL RIGHT. ANYONE ELSE? SEEING NO ONE ELSE, I AM CLOSING THE PUBLIC HEARING AT 6:39:30.

AND WOULD YOU LIKE TO SPEAK IN RESPONSE OR DO YOU WANT WAIT TILL COMMITTEE? EITHER ONE.

YOU HAVE THE MICROPHONE IF YOU'D LIKE.

>> THAT APPEARS APPROPRIATE UNLESS THERE'S ANY ADDITIONAL QUESTIONS COUNCIL WOULD HAVE BEFORE COMMITTEE.

>> NO. I THINK THIS WILL JUST GO TO COMMITTEE, LAND USE AND SPECIAL STUDIES.

>> THANK YOU FOR YOUR TIME THIS EVENING.

>> ALL RIGHT. NUMBER 14, WE HAVE NO NEW

[16. OTHER BUSINESS ]

BUSINESS. NUMBER 15, NO AGENDA ADD-ON ITEMS. NUMBER 16, OTHER BUSINESS.

CITY COUNCIL APPOINTMENTS, THE CARMEL AUDIT COMMITTEE, TERMS EXPIRE 12/31/23 AND 12/31/24, TWO-YEAR TERMS. I BELIEVE WE'RE STILL LOOKING FOR CANDIDATES FOR THAT.

THE CARMEL ECONOMIC 2022 COMMISSION, TERM EXPIRES 1/31/26, THREE-YEAR TERM, ONE APPOINTMENT.

16B. 22022 EARN BRUM BR DEN ENCUMBRANCES. WE DO NEED TO ACKNOWLEDGE IT.

I'LL ACCEPT A MOTION TO ACKNOWLEDGE.

>> SO MOVED. >> SECOND.

ALL RIGHT. JACOB.

(VOTING).

[17. ANNOUNCEMENTS]

>> 8-0. >> ALL RIGHT.

NUMBER 17, ANNOUNCEMENTS. >> MADAM VICE PRESIDENT?

>> COUNCILOR NELSON. >> THANK YOU.

JUST ON BEHALF OF THE FAMILY OF OUR COLLEAGUE BRUCE KIMBALL, THEY WANTED ME TO LET EVERYONE KNOW ON COUNCIL THAT THEY APPRECIATED THE FLOWERS, AND THEY APPRECIATED EVERYONE'S

THOUGHTS AND PRAYERS. >> THANK YOU.

AND ON THAT NOTE, THERE IS A CAUCUS TOMORROW NIGHT FOR THE CENTRAL DISTRICT SEAT. SO, AT OUR NEXT MEETING, WE WILL HAVE A FULL NINE-M
