[1. CALL TO ORDER] [00:00:09] GOOD EVENING. I AM GOING TO CALL TO ORDER THE MEETING OF THE COMMON COUNSEL FOR MONDAY, JUNE 19, 2023, FOR THOSE OF YOU WHO CANNOT SEE ON TV WE HAVE A PACKED HOUSE TONIGHT. THANK YOU TO ALL OF OUR GUEST WITH US TONIGHT. BEFORE BEGINNING OUR AGENDA I WOULD LIKE TO MAKE A STATEMENT, GOOD EVENING, TODAY ON JUNE 19 WE ACKNOWLEDGE AND HONOR THE SIGNIFICANCE OF JUNETEENTH. THIS DAY COMMEMORATES THE END OF SLAVERY IN THE UNITED STATES AND MARKS A PIVOTAL MOMENT IN OUR NATION'S HISTORY. ON THIS DAY IN 1865 UNION GENERAL GORDON GRANGER ARRIVED IN GALVESTON TEXAS TO ANNOUNCE THAT ALL ENSLAVED PEOPLE WERE NOW FREE. THIS MOMENTOUS OCCASION CAME OVER TWO YEARS AFTER PRESIDENT LINCOLN'S EMANCIPATION PROCLAMATION, WHICH HAD DECLARED ALL SLAVES AND CONFEDERATE STATES TO BE FREE. HOWEVER, DUE TO THE LACK OF ENFORCEMENT IN TEXAS, SLAVERY PERSISTED UNTIL GENERAL GRANGER'S ARRIVAL. TODAY WE REFLECT ON THE SIGNIFICANCE OF JUNETEENTH AND ITS IMPACT ON OUR COUNTRY'S HISTORY. WE ACKNOWLEDGE THE INJUSTICES THAT HAVE BEEN INFLICTED UPON BLACK AMERICANS THROUGHOUT OUR NATION'S HISTORY AND WE STAND IN SOLIDARITY WITH THOSE WHO CONTINUE TO FIGHT FOR EQUALITY AND JUSTICE. AS A CITY WE COMMIT TO CONTINUING OUR EFFORTS TOWARD CREATING THE BEST COMMUNITY FOR ALL AND WE WILL CONTINUE TO CELEBRATE AND HONOR JUNETEENTH AS A REMINDER OF OUR PAST, BUT YET A SYMBOL OF HOPE FOR A BETTER FUTURE. >> THAT WAS LOVELY WRITTEN. IN FUTURE YEARS WHEN JUNETEENTH FALLS ON A COUNCIL MEETINGS FALL ON THE JUNETEENTH THAT WE DO NOT HAVE A MEETING JUST LIKE MARTIN LUTHER KING DAY. >> I WOULD ASK THAT WE ALL AGREE TO THAT AND THAT THAT BE PUT INTO THE MINUTES AND THE RECORD AND SHOULD CORPORATE COUNCIL DECIDE THERE SHOULD BE RESOLUTION TO DO SO. ALL IN FAVOR SAY AYE. >> AYE. >> ANY OPPOSED? THANK YOU. [2. AGENDA APPROVAL] WE WILL NOW MOVE ON WITH OUR NORMAL AGENDA. CAN I HAVE A MOTION TO APPROVE OUR AGENDA? >> MOVED. >> IT'S BEEN PROPERLY MOVED AND [3. INVOCATION] IS THERE ANY DEBATE? PLEASE VOTE. AGENDA IS APPROVED. NOW I WOULD ASK REVEREND JESSICA STEVENS FROM CARMEL UNITED METHODIST CHURCH TO PLEASE LEAD US IN OUR INDICATION. >> TAKE A DEEP BREATH WITH ME. CLOTHES YOUR EYES. HOLY AND GRACIOUS GOD WE ARE SO GRATEFUL TO BE HERE THIS EVENING ON THIS JUNETEENTH WHEN WE REMEMBER THE OPPRESSED WHEN WE REMEMBER OUR FREEDOMS AND THAT WE ARE HERE TO DO BUSINESS AT THE CITY BUT WE ARE ALSO HERE TO PROTECT THE VULNERABLE. LET US KEEP YOUR WAYS AND OUR HEARTS AND OUR MINDS AS WE MOVE [4. PLEDGE OF ALLEGIANCE] FORWARD THIS EVENING IN YOUR NAME WE PRAY, AMEN. >> COULD I ASK EVERYONE NOW TO PLEASE RISE FOR PLEDGE OF ALLEGIANCE. (PLEDGE OF ALLEGIANCE) >> THAT WAS THE BEST EVER. COULD I GET THIS GROUP TO PLEASE COME TO ALL OF OUR [5. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS] MEETINGS JUST FOR THE PLEDGE OF ALLEGIANCE. THAT'S THE BEST I'VE EVER HEARD, THANK YOU. WE HAD TOURNAMENT IN APRIL AND WE CAME OUT ON TOP ACROSS THE NATION. OUR KIDS SCORED THE HIGHEST NUMBER OF TOTAL POINTS ACROSS THE NATION. (APPLAUSE) >> FIRST OF ALL, WE ARE GOING TO HAVE ALL THE CHAMPIONS COME UP FRONT FOR A PICTURE BUT BEFORE WE DO THAT, DO ANY OF MY COLLEAGUES HAVE ANY QUESTIONS OR SPECIAL NOTES OR COMMENTS THEY WOULD LIKE TO MAKE TO OUR AUDIENCE? >> COULD I GET ALL OF OUR CHAMPIONS TO PLEASE COME FORWARD FOR AN AWESOME PICTURE. (APPLAUSE) >> PRESIDENT WORRELL: WE HAVE TO KEEP OUR MEETING MOVING BUT JUST AS A SMALL TOKEN OF OUR APPRECIATION, I'M GOING TO GIVE MRS. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL] >> PRESIDENT WORRELL: I AM GOING TO PROCEED WITH THE MEETING, NEXT UP ON OUR AGENDA IS RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL, FIRST UP IS MIKE SHAVER, IF YOU [00:10:05] COULD PLEASE MAKE YOUR WAY TO THE PODIUM. OFFICER, WHEN THEY ARE OUT, I WILL ASK YOU TO CLOSE THE DOORS. MIKE, YOU CAN WAIT UNTIL WE HAVE A QUIETER ROOM. >> WHATEVER YOU WANT, COUNCILOR, THAT WORKS FOR ME. >> I'VE GIVEN YOU THE LETTER I READ THE LETTER ALOUD, COUNCILOR IS RESPECTFUL REQUEST TO CONFIRM YOUR TRANSPARENCY, MAY 2, 2023 PRIMARY ELECTION CARRIED SEVERAL INTERESTING MESSAGES AND WE HAVE THE RESULTS. COMMITMENT TO TRANSPARENTLY WAS PERHAPS THE MOST PROMINENT AND UNIVERSAL OF ALL THE CAMPAIGN COMMITMENTS AND AS WE MOVE FORWARD TOWARD GENERAL ELECTION WE HAVE A UNIQUE OPPORTUNITY FOR CANDIDATES TO CONFIRM THEIR COMMITMENTS FOR TRANSPARENCY. ON MARCH 13, 2023 A REQUEST WAS FILED FOR FISCAL REPORTING DOCUMENTS RELATED TO FINANCIAL PLAN REGARDING CARMEL REVENUES AND DEBT WHICH IS ATTACHED. ON MAY 4, 2023 AN EMAIL WAS RECEIVED FROM THE CARMEL CITY ATTORNEY'S OFFICE AND RESPONSE? THE CITY HAS IDENTIFIED 68 PAGES OF RECORDS THAT MAY BE RESPONSIVE TO YOUR REQUEST HOWEVER, THESE RECORDS ARE IN DRAFT FORM WILL NOT BE RELEASED AS THEY CONSTITUTE ADVISORY DELIBERATIVE MATERIAL AND CAN PBE WITHHELD FROM DISCLOSURE. THE CITY ATTORNEY'S EMAIL CATEGORICALLY CONFIRMS THAT CARMEL ENGAGED IN PUBLIC POLICY WERE PUBLIC DOCUMENTS ARE RENDERED SECRET FROM THE PUBLIC SIMPLY BY STAMPING THEM DRAFT. SUCH POLICIES ARE ACTUALLY THE OPPOSITE OF THE TRANSPARENCY PROMISED BY THE CANDIDATES FOR OFFICE INCLUDING YOURSELVES. WE RESPECTFULLY, I EMPHASIZE RESPECTFULLY TRUST THAT THE DICHOTOMY BETWEEN THE CITY ATTORNEY'S RESPONSE DENYING TRANSPARENCY IN THE CANDIDATE'S COMMITMENT TO TRANSPARENCY NEED NO FURTHER EXPLANATION. WE HEREBY RESPECTFULLY REQUEST THAT THE CITY COUNCIL INDIVIDUALLY AND COLLECTIVELY CONFIRM YOUR COMMITMENT TO TRANSPARENCY BY PROPERLY RELEASING THE REQUESTED FINANCIAL PLAN DOCUMENTS. WE FURTHER RESPECTFULLY AND EMPHASIZING RESPECTFULLY REQUEST THAT THE COUNCIL TAKE FORMAL ACTION TO END THE CITY'S POLICYMAKING DOCUMENT SECRET SIMPLY BY STAMPING THEM DRAFT. SUCH PRACTICE IS THE ANTITHESIS OF TRANSPARENCY THAT WAS PROMISED. WE ARE EXCITED YOUR CAMPAIGNS HAVE EMBRACED THE NEED FOR CHANGE DEMOCRACY CANNOT SURVIVE WHEN PUBLIC DOCUMENTS ARE RENDERED SECRET. THANK YOU FOR YOUR COMMITTEE TO ADDRESS THE COUNCIL. RESPECTFULLY. >> COUNCILOR WORRELL: THANK YOU. NEXT UP IS JOE MEISENHEIMER. >> MY NAME IS JOE MEISENHEIMER ICE SENT A LETTER TODAY PART OF IT WAS ADDRESSED WHERE I DISCOVERED THAT THERE IS AN ORDINANCE THAT DEALS WITH THIS NEXT TO DEVELOPMENTS. WHAT I WOULD LIKE TO TALK ABOUT IS THE ORDINANCE REGULATING THE PARKING OF MOTOR VEHICLES CITY STREETS. I WONDER COULD YOU INCLUDE A MAP WITH THE STREET LOCATIONS IN THE PAPERLESS PACKET COULD YOU DISCUSS THE PROCESS FOR APPLYING FOR SIGNS AND DECALS WHAT ARE THE CONSEQUENCES FOR PEOPLE PARKING IN A MINUTE IF THEY DON'T HAVE THOSE DECALS AND COULD YOU ADDRESS HOW DEFENSE COULD BE PROTECTED FROM UNWANTED CARS BEING PARKED IN THEIR STREETS BY CUSTOMERS AND TENANTS AND MULTIUSE DEVELOPMENT MANY STREETS IN CARMEL HAVE PROBLEMS WITH PARKING FEES THAT I'VE SEEN THE CITIES ENCOURAGE BUSINESSES AND MIXED-USE DEVELOPMENTS TO SHARE PARKING WHICH ENABLES THE NEXT USES TO BE DEVELOPED WITH FEWER PARKING SPACES FOR CUSTOMERS AND TENANTS. WHEN CITY COUNCIL APPROVED DEVELOPMENTS NEAR NEIGHBORHOODS WITH SINGLE-FAMILY HOMES THESE RESIDENTS HAVE A REASON TO BE CONCERNED THAT CUSTOMERS AND TENANTS FROM SAC TOWN HOMES AND APARTMENTS WILL PARK ON THE STREETS OF OUR NEIGHBORHOODS. THE CITY COUNCIL ADDRESS COMPLAINTS FROM NEIGHBORS WHEN TOO MANY STUDENTS AND PARENTS WERE WALKING THE STREETS AND DRIVEWAYS. AN EXAMPLE OF THIS AND PERSONAL ISSUE FOR ME IS MY ZERO LOTS WINDMILLS SUBDIVISION IT'S ALREADY CHALLENGING TO PARK ON THE STREETS WERE A HOMEOWNER BACKING DOWN THE DRIVEWAY COULD [00:15:01] HIT THE PARKED CAR WHEN OUR NEIGHBORHOOD WAS ANNEXED BY CARMEL WE HAVE PERMISSION TO KEEP THE NARROW STREETS AND LEADERS OUR STREETS TO THE CITY. SAFETY IS A REAL ISSUE FOR MOSTLY ELDERLY RESIDENTS IS IMPERATIVE THAT EMERGENCY VEHICLES BE ABLE TO REACH A NEIGHBOR AND DISTRESS BUT IF THE CARS PARKED ON THE STREET IT'S DIFFICULT FOR RESIDENTS FIRE TRUCKS AND AMBULANCES DELIVERY AND GARBAGE TRUCKS AND SERVICE TRUCKS FROM ROOFING PAINTING LANDSCAPING TO PARK OR PASS OTHER PARKED CARS. DURING THE LAST 10 YEARS WE HAD A CONTINUAL AND MASSIVE AMOUNT OF CONSTRUCTION ON OUR AREA INCLUDING THE DEVELOPMENT OF THE 60 ACRE BRIDGES ACROSS SPRING RAILROAD FROM US AS PART OF THE BRIDGE IS A CITYSCAPE PROPOSAL STATEMENT APARTMENTS WITH 260 UNITS AND THREE AND FIVE STORY BUILDINGS DIRECTLY EAST OF OUR ONE AND TWO STORY NEIGHBORHOOD. WE VOICED HER CONCERN WITH 404 PARKING SPACES WOULD NOT BE ENOUGH PARKING SPACES FOR TENANTS IF THEY HAD TWO CARS, GAS, OR PARTY SPEAK UP WE ASKED FOR THE NUMBERS OF UNITS AND STORIES BE REDUCED WHICH IT WOULD TO REDUCE THE NEED FOR PARKING SPACES BUT THEY WERE NOT REDUCED. STEGMANN APARTMENT WILL HAVE TO ACCESS THE ENTRANCES OF TWO OTHER NEIGHBORHOODS SINGLE-FAMILY HOMES NEAR US. AND THEN THE HERITAGE ZERO LOT SUBDIVISION WILL BE A DIRECTLY ACROSS THE STREET TO STATEMENT APARTMENTS. THE ENTRANCE IN THE SPRING NO PLACE WILL BE SHARING AROUND ABOUT ON 111TH STREET WITH STATEMENT APARTMENTS. [8. CONSENT AGENDA] IF THERE IS NOT ENOUGH PARKING SPACES FOR STEDMAN TENANTS PLUS GUESTS THEY MIGHT BE PARKING THERE VEHICLES IN OUR NEIGHBORHOOD I WOULD ASK THAT NEIGHBORHOODS NOT BE PART OF THE SOLUTION TO THE LACK OF REQUIRED PARKING SPACES FOR MULTI USE DEVELOPMENTS. >> THANK YOU FOR YOUR COMMENTS. NEXT UP ON OUR AGENDA WILL BE THE ANY COUNCIL AND MAYORAL COMMENTS AND OBSERVATIONS THAT ANYONE WHO WOULD LIKE TO MAKE A COMMENT? WE WILL MOVE ON. TO CONSENT AGENDA THE APPROVAL OF MINUTES FOR JUNE 5, 2023 AT REGULAR MEETING. CLAIMS GENERAL CLAIMS THE AMOUNT OF $5,975,831.45. RETIREMENT $106,146. AND WIRE TRANSFERS IN THE AMOUNT OF $4,242,361.13. >> MOVED TO APPROVE. >> SECOND. [10. COMMITTEE REPORTS] >> IS THERE ANY DISCUSSION? PLEASE VOTE. THAT CARRIES UNANIMOUSLY. NEXT UP IS COMMITTEE REPORTS, FINANCE UTILITIES AND RULES COMMITTEE DID ME. [11. OTHER REPORTS] I WILL COVER THAT WE GET THAT PART OF THE AGENDA. LAND-USE AND SPECIAL STUDIES COMMITTEE. >> WE HAVE NOTHING BEFORE US WE HAVE NOT MET.>> DO WE HAVE A REPORT FROM THE MAYOR'S ADVISORY COMMISSION ON HUMAN RELATIONS? PLEASE MAKE YOUR WAY TO THE PODIUM. >> THANK YOU MR. PRESIDENT AND COUNCIL. I'M HERE TO REPORT ON BEHALF OF MAYOR'S ADVISORY COMMISSION ON HUMAN RELATIONS WAS ESTABLISHED IN NOVEMBER 2009, THE MISSION OF THE COMMISSION IS TO HELP OUR COMMUNITY AND APPRECIATE THE CONTRIBUTIONS OF ALL CITIZENS, THE COMMISSION RECOGNIZES THE IMPORTANCE OF FULL CIVIC ENGAGEMENT FREE FROM PREJUDICE AND TOLERANCE AND BIGOTRY AND REMAINS VIGILANT TO ISSUES THAT DEMONSTRATE LACK OF SENSITIVITY TO THE RIGHTS AND NEEDS OF ALL OF OUR NEIGHBORS. ARE THERE ANY QUESTIONS. DR. HANNON. >> THANK YOU FOR THE WORK AND THE WORK OF YOUR COMMITTEE. THE CHANGES WE'VE SEEN IN THIS CYCLE IS WHEN I FIRST JOINED THE MEETINGS WERE BEING HELD IN THE MAYOR'S CONFERENCE ROOM SO MOVING THEM DOWN TO CAUCUS HALL OR EVEN CAUCUS ROOMS ARE THE MAIN ASSEMBLY AREA OPENS IT UP TO THE PUBLIC AND WE ARE VERY HAPPY ABOUT THAT. I THINK IT'S ALSO IMPORTANT PERHAPS COMMUNITY SERVICE CAN HELP YOU GET MORE INFORMATION ABOUT YOUR MEETINGS FOR ATTENDANCE AND THEN THE OTHER THING IS, I WILL HAVE TO GO LOOK AT THE WEBSITE, YOU HAVE A CONTACT FORM IS IT FOR ANY CAUSES OR CONCERNS PEHAVE GI . CONCERNS PEOPLE MAY HAVE? >> THEY HAVE AN EMAIL ADDRESS. IF PEOPLE WANT TO SUPPORT YOUR E IS THERE PORTUNITIES. >> OWES WE ARE PLANNING FOR THE EVENT SEPTEMBER 23 AND 24TH I'M SURE THERE WILL BE WILL BE MORE. >> IS THERE A GOOD CONTACT PERSON FOR PEOPLE? >> AT THIS TIME THE SAME EMAIL ID. JUST ONE EMAIL ID. >> WE SEND OUR GRATITUDE TO THE [14. NEW BUSINESS] COMMISSION. WE ARE MOVING ON TO ITEM 12 OLD BUSINESS WE HAVE NONE THERE ARE NO PUBLIC HEARINGS WE WILL MOVE ON TO 14, NEW BUSINESS, A AS FIRST READING OF ORDINANCE B2670 Ã23. AND ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL INDIANA, ADDING SECTION 2:Ã14 TO CHAPTER 2 ARTICLE 1 DIVISION THREE OF THE CARMEL ÃÃALLOWS THE CITY TO MAKE ADVANCE PAYMENTS FOR GOODS AND SERVICES BEFORE THE GOODS ARE DELIVERED OR THE SERVICES ARE COMPLETED. >>. >> THE LEGISLATURE JUST ENACTED THIS LAW CURRENTLY WHEN THE CITY PROCURES GOODS OR SERVICES WE CAN'T MAKE A PAYMENT UNTIL WE ACTUALLY RECEIVE THE GOODS OR SERVICES. THIS LAW MAKES IT A LOT EASIER FOR US TO CONTRACT IN CERTAIN SITUATIONS IF THE VENDOR REQUIRES DEPOSIT WE ARE NEVER ABLE TO PAY THE DEPOSIT THIS WOULD ALLOW US TO PAY THE DEPOSIT OR IF WE WERE ORDERING FOOD AND THEY REQUIRE DEPOSIT FOR THE UPFRONT MATERIAL COST WE CAN PAY THE DEPOSIT UP TO [00:25:01] 50%. THE LEGISLATURE THE BILL STATED THAT THE CITY CAN'T USE THIS PROCEDURE UNLESS COUNCIL APPROVES IT. THERE ARE SOME FINANCIAL CONTROLS AS WELL TO MONITOR THE ADVANCE PAYMENTS. I SPOKE WITH THE CONTROLLER WE ARE PLANNING ON OUTLINING SOME PROCEDURES PLANNING PROCEDURES FOR THE BRIGHTNESS TO USE IF THIS GETS USED IN THE FUTURE. >> COUNCILOR WORRELL: DO YOU WANT TO JUST READ PARAGRAPH C FOR FURTHER CLARIFICATION IN CASE THERE ARE ANY QUESTIONS. >> C STATES THAT THE CITY'S FISCAL OFFICER THE FISCAL OFFICER'S DESIGNEE MUST DO ALL OF THE FOLLOWING WHEN ADVANCE PAYMENTS ARE MADE. TRACK PREPAYMENTS BY DEFINING THE PREPAYMENT ON A PURCHASE ORDER CREATE A PREPAYMENT INVOICE THAT'S ASSOCIATED WITH THE PURCHASE ORDER AND REQUIRE INSURANCE OR A SURETY BOND IN THE AMOUNT OF THE PREPAYMENT AT THE AMOUNT OF THE PREPAYMENT IS MORE THAN $150,000. THERE IS ALSO A 50% OR UP TO $2 MILLION WHICHEVER IS LESSER OF THE TWO. >> COUNCILOR WORRELL: ARE THOSE SAFEGUARDS OR GUARDRAILS PART OF THE STATUTE OR IS THIS æ >> THAT'S VERBATIM FROM THE STATUTE. >> COUNCILOR WORRELL: NOW WE OPEN UP TO QUESTIONS FOR ANYONE ON THE COUNCIL. COUNCILOR HANNON. >> I THINK IT'S REASONABLE TO HELP OPERATIONS TO OPERATE MORE LIKE THE PUBLIC SECTOR IT'S THE SAFEGUARD AND I APPRECIATE YOU GOING THROUGH THOSE. I WOULD BE OKAY IF WE WOULD SUSPEND THE RULES ON THIS. >> IS THAT A MOTION. >> I WOULD MAKE A MOTION TO SUSPEND THE RULES. >> THE SECOND. >> COUNCILOR WORRELL: IT'S BEEN PROPERLY MOVED AND SECONDED TO SUSPEND THE RULES IS THERE ANY DISCUSSION? DID EVERYBODY GET THEIR QUESTIONS IN? >> ONE COMMENT AS A FORMER SMALL BUSINESS OWNER I UNDERSTAND SOMETIMES YOU ARE PAYING FOR THE COST OF THINGS AND THEN WAITING TO GET PAID. I THINK THIS REALLY HELPS SOME OF OUR SMALLER BUSINESSES MAYBE THEY NEED TO DEPOSIT TO GET STARTED FOR SOMETHING. >> WITH THE CLAIMS PROCESS SOMETIMES IT CAN TAKE A LITTLE BIT LONGER WHEN THE GOODS ARE DELIVERED JUST TO ROUTE THROUGH COUNCIL TO BE APPROVED AND PAID. >> COUNCILOR WORRELL: ANY FURTHER DISCUSSION. PLEASE VOTE. THAT MOTION CARRIES. I'M LOOKING FOR A MOTION. >> MOTION TO APPROVE. >> SECOND. >> ANY DISCUSSION? PLEASE VOTE. THAT MOTION IS CARRIED UNANIMOUSLY WE WILL NOW MOVE ON TO ITEM B, THANK YOU FOR MOVING THAT THROUGH. FIRST READING OF ORDINANCE D-2671-23. AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 8, ARTICLE 5, SECTIONS 8-2, 8-37, 8-47, AND 8- 48 OF THE CARMEL CITY CODE; SPONSOR: COUNCILOR WORRELL. THAT I HAVE A MOTION TO INTRODUCE. >> MOVED TO INTRODUCE. >> SECOND. >> COUNCILOR WORRELL: WE ARE GOING TO MOVE ÃÃCOULD I ASK COUNCILOR AYERS PLEASE READ THE SYNOPSIS. >> COUNCILOR AYERS: ORDINANCE REGULATING THE PARKING OF MOTOR VEHICLES ON CITY STREETS. >> COUNCILOR WORRELL: SOME OF US HAVE RECEIVED EMAILS ABOUT THIS, THERE'S A LOT OF REDLINES, WHY DON'T YOU GIVE US A SUMMARY THERE ARE REALLY TWO AREAS WE ARE WORKING ON. >> THAT'S CORRECT. THERE ISN'T CLEANUP IN THIS ORDINANCE BUT THE MAIN AREAS THAT WILL REGULATE THERE IS UNDER SECTION 8 Ã2 AS THE SECTION TO ESTABLISH STANDARDS THAT WORK IN CONJUNCTION WITH A SECTION A LITTLE FURTHER ALONG THE ORGANS IF ENGINEERING HAS THE AUTHORITY TO PLACE SIGNS THIS WILL GIVE THEM GUIDANCE ON HOW AND WHERE TO PLACE THE SIGNS. THE OTHER MAIN SUBSTANTIVE SECTIONS ARE IN THE LOADING ZONES THIS WOULD ADD MANON BOULEVARD WHICH IS LONGER THAN BONE ON TRAIL BETWEEN WALMART AND ELM STREET IT'S GOING TO ALLOW UP TO 10 15 MINUTE LOADING ZONES ALONG THAT ROAD. THAT'S ALSO IN CONJUNCTION WITH LINE 120 YOU MIGHT BE AWARE THERE IS SECTIONS ALONG THE BOULEVARD THAT HAVE FIVE SPACES IN EACH SECTION 5 ON EACH SIDE WE WOULD MAKE THAT ALL THREE HOUR PARKING AND ONE 15 MINUTE LOADING ZONE IN EACH SECTIONS ALONG BOTH SIDES. DOING IT THIS WAY IS GOING TO GIVE ENGINEERING FLEXIBILITY ONCE THE AREA IS BUILT OUT TO DESIGNATE PARKING SPACE 18 ALONG THIS IT'S GOING TO GIVE [00:30:04] ENGINEERING THE DISCRETION OF THE SIGNS IN ACCORDANCE WITH THE GUIDANCE IN SECTION 8 Ã2. ONE OTHER SUBSTANTIVE CHANGE IN THIS IS ONLINE TO DEPRIVE THAT'S GOING TO HAVE NO PARKING AREA FOR ROLLING HILL DRIVE THOSE AGREED TO AS PART OF THE PLANNED UNIT DEVELOPMENT DISTRICT EVOLVEMENT ORDINANCE AND THIS IS JUST CODIFYING SO IT CAN BE SIGNED AND THEN ENFORCED IF ANYBODY VIOLATES IT. >> AS SPONSOR OF THIS I WANT TO MAKE A COUPLE CLARIFICATIONS. I WILL JUST START WITH ROLLING HILLS DRIVE FIRST. THAT WASAPPROVED BY PLAN COMMISSION AND FOR WHATEVER REASON IT WAS MISSED WE STARTED RECEIVING COMPLAINTS FROM THE RESIDENTS THAT LIVE THERE SO IF THEY ARE WATCHING I APPRECIATE THEM DRAWING OUR ATTENTION TO THAT. I'VE ASKED THEM TO WORK TOGETHER WHENEVER THERE IS SOMETHING IN THE FUTURE TO BE CODIFIED THAT IT WOULD BE HIGHLIGHTED AND POINTED OUT TO US OR BECOME A SECTION OF THE STAFF NOTES WHEN WE ARE LOOKING AT POD WE ALL ARE LOOKING AT STAFF NOTES THE COMMITMENTS THERE SHOULD NOW BE A SECTION FOR CODIFICATION. THAT WILL CALL OUR ATTENTION THEN WE WILL HOPEFULLY CATCH AND ALLOW LEGAL TO WORK TOGETHER. THAT THE FIRST IMPROVEMENT WE MADE ON THAT. THE ISSUE IS WE NEED THE SIGNS UP SOONER THAN LATER SO AS WE TALK ABOUT IT TONIGHT THAT IS SOMETHING BROUGHT TO MY ATTENTION RIGHT FOR THE MEETING. THE OTHER THING ON THE 15 MINUTES IT'S NOT AN ABSOLUTE FOR 10 INCHES GIVES THE ENGINEERING DEPARTMENT THE ABILITY SO IN FRONT OF SERENDIPITY IT MIGHT NOT MAKE SENSE TO HAVE A 15 MINUTE LOADING ZONE BECAUSE THE WHOLE CONCEPT BETWEEN THE 15 MINUTE LOADING ZONES AS IT WAS EXPLAINED TO ME COUNCILOR FINKAM HAVE HAD GOOD CONVERSATIONS ABOUT THIS WEATHER IS A BANK OR RESTAURANT WHERE YOU WANT TO RUN IN AND GET SOMETHING VERY QUICKLY AND THEN GET OUT THE 15 MINUTES MAY MAKE SENSE. I JUST WANT TO MAKE THOSE CLARIFICATIONS ALL THINGS IT'S BEEN A VERY ACTIVE AFTERNOON WORKING ON THIS. IF ANYONE HAS ANY QUESTIONS OR COMMENTS BEFORE WE DECIDE WHAT TO DO. COUNCILOR CAMPBELL. >> COUNCILOR CAMPBELL: JOHN, THE LAST COUPLE SUMMERS I'VE DEALT WITH QUESTIONS ABOUT RVS AND CAMPERS PARKED IN THE DRIVEWAYS IN MY DISTRICT AFTER THE PAPERLESS PACKET CAME OUT WILL RECEIVE QUESTIONS ABOUT THE PARKING OF RVS AND HOMES ON CITY STREETS. IS THIS ADDRESSED IN THE ORDINANCE? >> THAT ISSUE ISN'T ADDRESSED IN THE CURRENT AMENDMENT. THERE'S ACTUALLY A SECTION THAT IS ALREADY IN CITY CODE THAT IS APPLICABLE TO MOST RVS. THAT'S SECTION 846 SUBSECTION B THAT STATES THAT NO FREE CARRYING VEHICLE NOR ANY DEAL MORE THAN 20 FEET IN LIFE SHOULD PART OF ANY STREET EXCEPT WHEN ENGAGING IN THE LOADING OR UNLOADING OF THAT WOULD APPLY TO ANY VEHICLE OVER WOULDN'T BE ABLE TO PARK ALONG THE RIGHT-OF-WAY. THERE ARE DIFFERENT REGULATIONS IF THE VEHICLE IS PARKED IN THE DRIVEWAY THAT'S ACTUALLY OR IN THE LAWN THAT'S ADDRESSED IN THE YOU DO AND WOULD BE ENFORCED THROUGH THAT. I THINK THAT'S SUBSECTION APPLIES TO PARKING WITHIN CITY STREETS. >> I BECAME VERY FAMILIAR WITH THE PARKING IN THE DRIVEWAY OF THE RVS. WAS THE PROCESS IF AN OVERSIZED VEHICLE IS PARKED ON CITY STREETS TAKING UP MORE THAN ONE SPACE. >> IF SOMEBODY WOULD LIKE TO FILE A COMPLAINT THEY CAN CALL I RECOMMEND THE CALL THE CPD, NOT EMERGENCY DISPATCH.T'S ON THE WEBSITE 317-571-2580, THEY CAN SEND AN OFFICER OUT TO LOOK AT THE SITUATION AND ISSUE A TICKET IF NECESSARY. THIS IS UNDER THE ORDINANCE VIOLATION BUREAU AS WELL SO THE TICKET WILL BE $25 NO COURT COST IF IT'S PAID WITHIN 30 DAYS. SUBSEQUENT VIOLATIONS ARE $100. >> COUNCILOR RIDER: SINCE WE ARE MESSING WITH THIS IT WAS BROUGHT UP TO ME RIGHT IN FRONT OF MERCHANTS BANK ON ELM STREET BETWEEN MANON BOULEVARD AND THIRD AVENUE SOUTHWEST IN FRONT OF THE BANK IT'S 30 MINUTE PARKING. ON THE OTHER SIDE OF THE STREET IS WHERE ALL THE EMPLOYEES PARK ALL DAY. CAN WE CONSIDER EITHER MAKING THE OTHER SIDE 30 MINUTE PARKING OR MAKE UP A THREE HOUR OR WHATEVER BUT PUT SOME [00:35:01] RESTRICTION ON IT SO WE DON'T HAVE EMPLOYEES PARKING ON THE ROAD ALL DAY THERE IS A GARAGE SO LET'S USE THE GARAGE. >>. >> MAYBE WE NEED TO GO TO FINANCE BUT I DID JUST WANT TO, THERE'S NO WAY WE CAN PUT UP TEMPORARY SIGNAGE ON ROLLING HILLS ONLY DEAL WITH THIS. >> IT WOULDN'T BE ENFORCED. >> WE CAN PUT IT UP. FOR THE PEOPLE WHO DON'T KNOW IT'S NONENFORCEABLE. >> IF YOU PUT IT UP THE MAJORITY THE PEOPLE ARE GONNA PARK THERE WHETHER IT'S ENFORCEABLE OR NOT. I WOULD SUPPORT THAT TO GO AHEAD AND PUT THEM UP. >> I KNOW WITH 4TH OF JULY TO BE HARD TO GET æ >> IT WAS ON FIRST AVENUE NORTHWEST THEY PUT UP TEMPORARY NO PARKING BECAUSE THE CONSTRUCTION SO IF WE NEED TO PUT UP TEMPORARY I THINK WE SHOULD DO THAT BUT I BELIEVE IT NEEDS TO GO TO COMMITTEE. >> SORRY TO INTERRUPT.HERE'S ALSO A PROCESS TO THE COURTS WE CAN LOOK AT AS WELL. THEY HAVE A MEETING ON WEDNESDAY. WE MIGHT BE ABLE TO GET SOME TEMPORARY "NO PARKING" THAT'S ENFORCEABLE. >> IF YOU WOULDN'T MIND SHEPHERDING THAT THEY WOULD NEED TO HELP FOLKS ON ROLLING HILLS. >> COUNCILOR FINKAM: WHEN YOU COME TO COMMITTEE, CAN WE TALK A LITTLE BIT MORE ABOUT THAT 20 LENGTH OF THE VEHICLE I DON'T UNDERSTAND WHY WE HAD TO DO A WHOLE ORDINANCE TICKET NO TRUCKS ON ÃÃI DON'T UNDERSTAND THE DIFFERENTIATION THERE. >> THERE ARE WAITLIST MINUTES TO THAT. THAT WAS ACTUALLY COMPLETELY RESTRICTED PARKING IT WASN'T FOR CERTAIN LIKE THAT WAS NO PARKING UNCERTAIN SIDE OF THE ROAD JUST NORTH OF 96TH STREET. >> THE WANTED LEGACY, THE BIG TRUCKS PARKING THERE FOR SOME KIND OF TRANSPORT BUSINESS WE SAID NO TRUCKS WE HAD TO DO AN ORDINANCE FOR THAT. IF WE HAVE RESTRICTION OF NO VEHICLES UNDER THE 20 FEET PARKING ON CITY STREET WE NEED TO UNDERSTAND WHAT COULD BE REPLIED. >> WE CAN REPEAL THE ONE WE CAN CERTAINLY ENFORCE IT. >> WE CHASE THE TRUCK WITHIN A COUPLE DIFFERENT AREAS WHICH I ASSUMED MIGHT HAPPEN I JUST DON'T WANT TO HAVE TO DO 15 ORDER THAT SAYS IF WE CAN JUST CALL AND GET THAT MOVED.HANK YOU FOR THAT WE CAN TALK MORE ABOUT THAT LATER. >> COUNCILOR AASEN: IF ANYONE'S WATCHING IF YOU SEE THESE THINGS, PLEASE CONTACT THE POLICE RIGHT AWAY DON'T DO IT SEND A PICTURE A DAY LATER BECAUSE THERE'S NOTHING THEY CAN DO BUT I'VE BEEN DEALING WITH THE ISSUE AND WILLIAMSON RUN AND THEY GET OUT THERE VERY QUICKLY WE'VE HAD CHILDREN PLAYING IN THE STREET AND LARGE UNLOADING VEHICLES CUTTING THROUGH RESIDENTIAL NEIGHBORHOODS AND BLOCKING THE VIEW AND SO PLEASE LET THE POLICE KNOW THEY CAN'T ENFORCE IF THEY CAN'T SIT THERE ALL DAY IF YOU LET THEM KNOW THEY WILL GO OUT THERE IF WE SEND THIS COMMITTEE AND SUPPORT SOME OF THE THINGS COUNCILOR RIDER IS TALKING ABOUT WILL HAVE MORE PEOPLE GETTING CARRY OUTS AND QUICK OUTS OF BUSINESSES BUT IF YOU ARE A MOM OF THE STROLLER AND TWO KIDS AND TRYING TO PICK SOMETHING UP REAL QUICK SOMETIMES THOSE 30 MINUTE, 15 MINUTE SPACES ARE NEEDED IT'S GOOD FOR THE BUSINESSES IT'S GOOD FOR PEOPLE WITH DISABILITIES AND SO I APPRECIATE US TAKING A LONGER LOOK AT THAT. >> COUNCILOR WORRELL: IS THERE [16. OTHER BUSINESS] ANY ADDITIONAL QUESTIONS OR CONCERNS WE WILL SEND THIS TO FINANCE COMMITTEE MEETING I WILL GET A MEETING SCHEDULED AS QUICKLY AS POSSIBLE. WE WILL NOW MOVE ON TO ITEM 15 AGENDA AND ADD-ON ITEMS WE HAVE NONE, OTHER BUSINESS, CITY COUNCIL APPOINTMENTS CARMEL AUDIT COMMITTEE. WE HAD ACTION FROM THE INDIANA ASSOCIATION OF CPAS HELPED US OUT AND THEN MR. ÃWHO WAS JUST HERE I DIDN'T HAVE A CHANCE TO THANK HIM. HE HAS NOW SENT US SOMEONE I WILL GET YOU ALL THE DOCUMENTS, THE RESUME ETC. BUT WE HAVE SOMEONE WHO HAS EXPRESSED INTEREST IN HELPING US OUT SO WE WILL PROCEED WITH THAT. AGENDA ADD-ON ITEMS THERE ARE NONE. OTHER BUSINESS ÃÃPROPERTY ABATEMENTS/COMPLIANCE WITH STATEMENT OF BENEFITS WE REVIEWED SIX COMPANIES THAT HAD ABATEMENTS AND VOTE TO APPROVE. AND I APPROVED SIX OF THEM. PROGRESSIVE INSURANCE COMPANY [00:40:03] MIDCONTINENT INDEPENDENT SYSTEM OPERATOR, INC (MISO), SCHLAGE LOCK COMPANY, LLC, BRAUN CORPORATIZP INVESTMENTS, LLC AN ZOTEC PARTNERS, LLC, AND OF TRENTO ATAPCO CARMEL, INC.. AS IT TURNS OUT, THEY HAVE DECIDED TO WITHDRAW THEIR REQUEST FOR ABATEMENT SO WE WILL NOT NEED TO TAKE A VOTE ON THAT TONIGHT. ARE THERE ANY QUESTIONS REGARDING THAT. >> DO WE NEED TO TAKE ACTION ON THE OTHER FOUR OR IS THE FINANCE COMMITTEE SUFFICIENT. >> WE ARE GOOD. IS THERE ANY ANNOUNCEMENTS? * This transcript was compiled from uncorrected Closed Captioning.
