>> THANK YOU MR. PRESIDENT. AS YOU ARE AWARE, A COUPLE MONTHS AGO, THE CRC APPROVED TECHNICAL REVIEW COMMITTEE TO REVIEW THE PROPOSAL FOR SOME SOUND SYSTEM UPGRADES FOR THE PALLADIUM. HE RECEIVED ALL OF THE PQUALITATIVE AND PRICE PROPOSAL ON SCHEDULE FROM THREE OFFERS.

THE TRC INTERVIEW THE THREE TEAMS AND MET LATE LAST WEEK AND SCORED THEM ALL. WE ARE HERE TODAY TO READ THE REPORT.I WILL FOLLOW-UP WITH OPENING THE BID AFTER WE READ THE REPORT FROM THE TECHNICAL REVIEW COMMITTEE.

FOLLOWING THE OPENING OF THE BID OUTSIDE OF THIS MEANING, WE WILL DO THE MATH TO DETERMINE WHO ARE WILLING OFFER IS.

IN THE CAUCUS ROOM.THIS WAS TO SCORE THE DESIGN BILL QUALITATIVE PROPOSALS IN RESPONSE TO THE REQUEST FOR PROPOSAL FROM THE PROJECT ISSUED ON MAY 26. WE REPRESENTED BY ALL APPOINTED MEMBERS. THE REDESIGN BUILD TEAMS - - PREPARED PRICE PROPOSALS FOR TWO SEPARATE SPEAKER MANUFACTURERS. THOSE TWO SYSTEMS HAVE BEEN SCORED SEPARATELY. - - THE FORCE CHECK MID-AMERICA SOUND COMBINED EFFORT PROPOSED AND ACOUSTIC SOUND SYSTEM.

THE TRC SCORE THE MID-AMERICA BASE OF THE PROPOSAL OF ALTERNATE ONE TOURING MODEL. THIS WAS DONE TO GIVE EQUIVALENT CONSIDERATION TO ALL PROPOSALS AS THE OTHER TWO, OTHER THREE PROPOSALS INCLUDED TOURING MODELS AS A PART OF THE SPACE BID. WE DID REMOVE THE - - TOURING MODELS WHICH IS CENTRAL TO THE TOURING OPERATION.

THE SCORING IS AS FOLLOWS. THE SOUND SYSTEM RECEIVED A 64.

THE - - TECHNOLOGY SYSTEM PROPOSED BY CSD GROUP RECEIVED A 76 AND THE - - MID-AMERICA SOUND RECEIVED A 94.

PRICE PROPOSALS WILL BE A PUBLICLY FOLLOWING THIS REPORT AFTER THIS BRIEF COMMERCIAL BREAK TO ADD SOME TENSION THERE. THE BEST I PROPOSAL WILL BE DETERMINED BASED ON AN ADJUSTED VALUE CALCULATED BY DIVIDING THE BASE BID BY THE QUALITATIVE SCORE.

THE SECOND ONE THAT I'M OPENING IS FROM CSD GROUP AND THIS IS THEIR MEYER SOUND. THE GMP INCLUDING THE OWNER, ALLOWANCE AND CONTINGENCY ALLOWANCES AND OR $7884.

THEY DID INCLUDE NO ALTERNATES. THE THIRD PROPOSAL IS FROM CSD, THIS IS THE DNB SYSTEM. THE TOTAL BID IS INCLUDING OWNER ALLOWANCE AND CONTINGENCY ALLOWANCE, AND $94,009.

THE LAST PROPOSAL FROM FORCED TECH IS INCLUDING BOTH ALLOWANCES, A TOTAL GMP BID OF $742,144.28.

AS MENTIONED PREVIOUSLY, WE WOULD ALSO INCLUDE ALTERNATE NUMBER ONE. THAT'S REFERRING TO ANOTHER PAGE, HOLD ON A MOMENT. THESE WERE NOT INCLUDED IN THE PRICE PROPOSAL, THEY ARE SEPARATE.

THE TOURING OPTION IS AN ADDITIONAL $115,842.82.

WE WILL TO THE TOTAL GMP FOR THE BASE BID PLUS THE ALTERNATE ONE TO DO OUR CALCULATION. THANK YOU.

THIS RESOLUTION IS IN REGARDS TO THE DESIGN BUILD PROPOSAL FOR THE PALLADIUM ACOUSTIC UPGRADES WAS TREATED HER FOR THE REPORT FOR THE TECHNICAL REVIEW COMMITTEE.

WE ARE PRESENTING A RESOLUTION THAT WOULD ALLOW US TO ACCEPT

THE LOWEST PRICE DESIGN BUILD PROPOSAL.

PER THE STATUTE, THE PUBLIC AGENCY ISSUES A REQUEST FOR PROPOSALS. WE OPENLY YIELD PRICE PROPOSAL , DIVIDE EACH OF THE OFFERS PRICE FOR THE COMPOSITE SCORE AND THEN WE OBTAIN THE ADJUSTED PRICE.

ONCE THAT IS COMPLETED, THE AGENCY CAN ACCEPT THE PRICE PROPOSAL THAT PROVIDES THE BEST, LOW SUGGESTED PRICE WITH THE BEST VALUE TO THE TAXPAYER. I HAVE MY JURY HERE WITH ME TONIGHT IN CASE YOU HAVE ANY QUESTIONS ABOUT HOW THE RESOLUTION ISWRITTEN . IT WOULD APPROVE AND RATIFY THE CONTINGENT AWARD FOR THE CONTRACT FOR THE DESIGN BUILD SERVICES TO THE SELECTED OFFER FROM ISSUE THE FORMAL CONTRACT AWARD AND NEGOTIATE AN EXIT CONTRACT TERMS WITH THE SELECTED OFFER IN THE EVENT HE DID NOT COME TO CONTRACT TERMS WITH THE BEST VALUE PROPOSAL, HE WOULD THEN MOVE ON TO THE SECOND LOWEST ADJUSTED PRICE PROPOSAL.

THE PROPOSAL WE HAVE FROM THE OFFERS IS FOR A GUARANTEED MAXIMUM PRICE AND IT DOES INCLUDE CONTINGENCIES.

AS WE GO THROUGH THE FINALIZATION OF THE DESIGN WITHOUT OFFER, WE WILL REFINE THE SCHEDULE OF VALUES FOR THE PROJECT AND DETERMINE WHAT IS GOING INTO EQUIPMENT, WHAT IS GOING INTO LABOR OVERHEAD, ALL THE GENERAL CONDITIONS THAT KIND OF THING. HE WOULD COME TO AN AGREEMENT ON WHAT ALL OF THOSE LINE ITEMS WOULD BE AS A PART OF THE CONTRACT. WITH THAT, WE WILL HAVE ALLOWANCES FOR US TO MAKE SOME DECISIONS ABOUT PRODUCTS THAT ARE SELECTED THROUGH THAT PROCESS, BUT IN NO CASE WITH THE PRICE EXTEND BEYOND THE GUARANTEED MAXIMUM PRICE IS IN THE PROPOSAL. THEIR JOB THROUGHOUT THE DESIGN PROCESS TO MEET THE BUDGET HAS BEEN APPROVED HERE.

RECOGNIZING THE FACT THAT I'M ASSUMING PALLADIUM IS CLOSED DURING THAT PERIOD OF TIME SO

WE WORK CLOSELY WITH THE PALLADIUM STAFF TO ENSURE THAT WE HAVE A PERIOD OF TIME IDENTIFIED WHEN THE SYSTEM CAN BE TAKEN DOWN AND REINSTALLED. PALLADIUM STAFF WILL BE REMOVING THE EXISTING SYSTEM ON THEIR OWN BEFORE THE NEW SYSTEM IS IN PLACE.THERE IS AN EXTREMELY SHORT WINDOW NEXT JUNE IN WHICH THIS CAN OCCUR. ASSUMING THAT THERE ARE NO MAJOR EVENTS THAT CAUSE EXTENSIVE DELAYS TO DELIVERY OF EQUIPMENT, THIS WILL ALL HAPPEN ON SCHEDULE.IF BY CHANCE THERE WAS SOME SITUATION THAT WOULD CAUSE THE EQUIPMENT BE DELIVERED LATER, HE WOULD HAVE TO WORK WITH THE STAFF DEFINED A NEW WINDOW FOR THAT TO HAPPEN.

OBVIOUSLY, WE ARE NOT GOING TO RESCHEDULE SHOWS TO MAKE THIS TRANSITION OCCUR. AS FAR AS PENALTIES, THERE ARE LIQUIDATED DAMAGES. I DON'T REMEMBER EXACTLY WHAT

THE DEVELOPER IS NOW READY TO MAKE THAT PAYMENT. WE WILL TERMINATE ALL THE AGREEMENTS THAT RELATE TO THE PAYMENT WITH THAT PAYMENT BEING COUNTED AS A FULL PAYMENT WITH ALL RELATED OBLIGATIONS.

THEY ARE ALSO GOING TO BE A COUPLE RELEASES OF ANY CLAIMS AGAINST THE CRC. THE CONCRETE IN FRONT OF YOU IS FAIRLY FINAL BUT THERE WILL BE SOME ADJUSTMENTS MADE TO THAT AS THE COUNCIL FOR THE CRC WILL NEGOTIATE TO MAKE SURE THAT IS SQUARED AWAY. I'M HAPPY TO ANSWER ANY
