[1. CALL TO ORDER]

[00:00:07]

(. >> GOOD EVENING, CALLING TO ORDER THE MEETING FOR THE COMMON COUNCIL FOR CARAMEL, INDIANA MONDAY NOVEMBER 20TH, 2023. WE DO HAVE A QUORUM.

[2. AGENDA APPROVAL]

SO COULD I HAVE A MOTION TO APPROVE OUR AGENDA?

>> SO MOVED. >> ANY STYLINGS?

>> ALL RIGHT. PLEASE VOTE.

[3. INVOCATION]

AND THAT CARRIES. NOW, I WOULD ASK FOR OUR INVOCATION FOR PASTOR TIM ERRS OF GRACE CHURCH TO PLEASE LEAD -- TIM AYRES OF GRACE CHURCH TO PLEASE LEAD US.

>> PRAY WITH ME, PLEASE. DEAR FATHER IN HEAVEN, DURING THIS SEASON OF THANKSGIVING, I AM FIRST THANKFUL THAT WE CAN COUNT ON YOUR PRESENCE WITH US THIS EVENING.

SECONDLY, I'M THANKFUL FOR THOSE IN THIS CHAMBER WHO HAVE SO WILLINGLY GIVEN OF THEIR TIME AND ENERGY IN SERVICE TO THE THOUSANDS WHO LIVE HERE IN OUR GREAT CITY.

MY PRAYER THIS EVENING THAT YOU'LL GIVE EACH MEMBER OF THIS COUNCIL THE WISDOM, THE VISION, AND THE INSIGHT THAT THEY WILL NEED TO MAKE THE BEST DECISIONS FOR ALL THE CITIZENS OF CARMEL.

I ALSO PRAY TONIGHT'S SESSION WILL BE CHARACTERIZED BY THANKSGIVING THAT BEST REFLECTS --

[4. PLEDGE OF ALLEGIANCE]

[5. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS]

>> MY PRIOR ASSESSOR STARTED A TRADITION IN THE CITY OF GIVING OUT AN AWARD OF GIVING OUT THE RANGE LINE PIONEER AWARD.

I'M GOING TO READ BRIEFLY WHAT IT SAYS.

WHEREAS PIONEERS LATE 1800S SETTLED IN WHAT IS NOW CARMEL INDIANA BRING WITH THEM FRIENDSHIP THAT CONTINUES TO THRIVE IN THE COMMUNITY TODAY. AND WHEREAS THE CITY OF CARMEL SUPPORTS THOSE CITIZENS WHO LIVE INSIDE AND OUTSIDE THIS COMMUNITY WHO HAVE BEEN A FRIEND TO IT.

AND WHEREAS -- ONE MO MERHOFF IS A FRIEND OF CARMEL HELPING TO KEEP THE SPIRIT OF THE PIONEERS ALIVE.

THOSE CITIZENS -- RANGE LINE PIONEER THIS 20TH OF NOVEMBER IN THE YEAR TO 23. BEFORE I CONGRATULATE HER, I WANT TO JUST TAKE A FEW MINUTES AND TALK BRIEFLY ABOUT HAD YOU CONTRIBUTIONS TO THIS COMMUNITY. MO IS ORIGINALLY FROM WISCONSIN AND GRADUATED FROM PURDUE UNIVERSITY WITH TWO DEGREES I BELIEVE. FIRST ONE AS PHI BETA, KAPPAWHICH IS A VIE CABBING DELLIC HONOR.

SHE WAS HEAD OF THE U.S. ROWING ASSOCIATION IN INDIANAPOLIS.

WORK AT SEVERAL OLYMPIC EVENTS. WORLD ROWING CHAMPIONSHIPS AND SO ON. HELPED THE INDIANA COMMUNITY

[00:05:05]

GREATLY BUT WHAT SHE DID FOR CARMEL WAS HEAD UP OUR CHAMBER OF COMMERCE FOR I BELIEVE 14 YEARS.

AND -- 20. I SHOULD MENTION AS WELL I THINK YOU WERE CHAITED ON THE ACCOLADES YOU SHOULD HAVE RECEIVED BECAUSE YOU WERE DEALING WITH THIS THING CALLED THE PANDEMIC WHEN YOU OFFICIALLY RETIRED.

. HOPEFULLY WE CAN MAKE UP FOR A BIT OF THAT TONIGHT. BUT THE CHAMBER OF COMMERCE IN A CITY IS IMPORTANT TO ITS ADVANCEMENT TO WORKING OUT ISSUES WITH THE BUSINESS COMMUNITY TO PROMOTING BUSINESSES IN THAT COMMUNITY WHICH IN TURN CREATE GOOD JOBS AND WHICH IN TURN CREATE ECONOMIC DEVELOPMENT, BLOWED ROY -- SOMETIMES -- SOMETIMES SHE WON A THINK. WAS ALWAYS THERE AND WILLING TO TALK ABOUT NEW INNOVATIVE WAYS TO MAKE THIS COMMUNITY BETTER.

AND COORDINATE BETTER THROUGHOUT THE NORTHSIDE CENTRAL INDIANA AREA. AND THAT IS UNUSUAL TOO.

TO SEE PEOPLE VOLUNTARILY WORK TOGETHER TO MERGE WITH ANOTHER ORGANIZATION [APPLAUSE]

. >> THANK YOU, JIM.

BLUES PLAYS

. >> ALL RIGHT.

THANK YOU, MAYOR. THAT WAS VERY NICE.

CONGRATULATIONS, MO, WELL DESERVED.

NEXT UP WE'RE GOING TO MOVE TO ITEM B ON OUR AGENDA WHICH IS PROCLAMATION CELEBRATING HINDU AMERICAN AWARENESS AND APPRECIATION MONTH. EARLIER NOR THE YEAR IN OCTOBER A PROCLAMATION WAS DELIVERED TO FRIENDS OF OUR HINDU COMMUNITY AND SO NOW I UNDERSTAND THAT THERE IS A SPEAKER COMING FORWARD, AVIKA? SO, AVIKA AND HER FAMILY, THE GUARD FAMILY ARE HERE. IF YOU WANT TO COME RIGHT OVER HERE.

OKAY.

ALL RIGHT. LET'S SEE.

SO WE CAN SEE YOU THERE. SO DO YOU HAVE SOMETHING YOU

WANT TO SAY? >> YEAH.

>> GO AHEAD. >> DWALI IS THE MOST IMPORTANT HOLIDAY OF THE WORLD FOR HINDUS ACROSS THE WORLD.

IT GETS ITS NAME IN THE LAMPS PEOPLE LIGHT OUTSIDE THEIR HOMES TO SYMBOLIZE THE LIGHT THAT PROTECTS FROM DARKNESS.

THIS FESTIVAL IS AS IMPORTANT TO HINDUS AS THE CHRISTMAS HOLIDAY.

[00:10:09]

DWALI IS CELEBRATED TO UPHOLD THE VICTORY OF GOOD OVER EVIL.

PEOPLE ALSO LIGHT UP FIRE CRASHINGS AND EXCHANGE GIFTS AND SWEETS WITH FRIEND AND FAMILY. IT'S A MONTH-LONG CELEBRATION STARTING WITH -- FOLLOWED BY -- AND EVENTUALLY DWALI THE MONTHS OF OCTOBER AND NOVEMBER. THERE'S UNITY FROM DIVISION AND BONDS OF EMPATHY AND COMPASSION. THERE IS COMMUNITY AND CONNECTIONS AS WE SHARE AS WE LOOK AT FROM EACH OTHER AND HOPE DR DREAMS AND BELIEVE IN

[6. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL]

POSSIBILITIES. >> I'M CHAD HUGHES OF THE CARMEL FIRE DEPARTMENT. I'M THE STATION CAPTAIN AT STATION 42 AT 106TH AND SHELL BORN.

I COME THIS EVENING WITH SOME VERY IMPORTANT AND QUITE FRANKLY DISTURBING INFORMATION THAT I WOULD LIKE TO HAVE ADDRESSEDED IN REGARD TO THE RETIREES INSURANCE.

AS YOU KNOW WE JUST HAD OPEN ENROLLMENT LAST WEEK AND I WAS FLABBERGASTED BY THE PREMIUMS FOR THE FAMILY OF RETIREE INSURANCE. YOU MAY OR MAY NOT BE AWIRE OF THAT. BUT CURRENTLY JUST TO GIVE YOU A BACKGROUND, I'M ENTERING MY 36TH YEAR OF FIRE SERVICE IN 2024.

30 OF WHICH ARE HERE AT THE CITY OF CARMEL UNDER THE MAYOR JOHNSON ADMINISTRATION IS WHICH I WAS HIRED IN.

WHEN WE DID THE OPEN ENROLLMENT, YOU KNOW, I LOOKED FORWARD TO RETIREMENT AND I'VE ALWAYS BEEN TOLD THAT WITH MY SACRIFICES OF FOUR SHOULDER SURGERIES, WITH A REPLACEMENT IN MY FUTURE, THE SCARRING OF THE SPLEEN DUE TO PATHOGENS THAT I'VE INCURRED WHILE ON EMS CALLS AND I'M ACTIVELY BEING SURVEYED WITH LUNG NODULES THAT WE JUST RECENTLY HAD LOW DOSE CT PERFORMED, SO THE JOB HAS REALLY TAKEN A TOLL ON OUR BODIES AND AS WE WANT TO GET INTO THE AWE TOM OF OUR CAREER TOWARDS RETIREMENT WE'RE TOLD IF YOU WORK AS A CIVIL SERVANT, YOU'LL

[00:15:03]

BE GIVEN AN AMPLE PENSION TO SURVIVE ON.

YOU'LL BE GIVEN RETIREE INSURANCE WHICH IS NO LONGER AFFORDEDED TO THE NEW HIRES WHICH PUTS CARMEL FRANKLY AT A DISADVANTAGE WHEN WE'RE COMPETING WITH THE TALENT POOL FOR OTHER COMMUNITIES AND I'LL GET INTO THAT IN A MINUTE WHICH IS CONCERNING. BUT ALSO WE ENJOY THE 457 WHICH IS VERY GRACIOUS IF WE CAN AFFORD TO PARTICIPATE IN IT.

SO, YOU KNOW, I WENT AHEAD AND DID CALCULATIONS AND RIGHT NOW, WE'RE AT $484 A MONTH FOR A FAMILY PLAN WITH THE EMPLOYEE INCLUDING THE DENTAL. WHAT'S QUITE DISTURBING IS THE FKT THAT WHEN YOU ADD IN THE $3,000 ON THE HIGH DEDUCTIBLE WITH RETIREE INSURANCE FOR FAMILY IT GOES FROM $484 TO OVER $3,800 A MONTH ACTUALLY WHEN YOU INCLUDE THE $3,000 DEDUCTIBLE AND SPREAD THAT OUT OVER 12 MONTHS, IT'S $4,050 A MONTH.

$48,600 A YEAR BEFORE YOU RECEIVE YOUR FIRST BIT OF BENEFIT. SO THIS IS QUITE DISTURBING.

IT'S NOT AFFORDABLE FOR ANY CITY EMPLOYEE AND I'M NOT COMING WITH A PROBLEM WITHOUT A SOLUTION AND IT LOOKS LIKE MY TIME IS UP SO I'LL BE BRIEF. WHAT I BELIEVE -- WE'RE ASKING FOR YOUR HELP AS WE COME IN WITH THE NEW ADMINISTRATION THIS IS SOMETHING THAT'S NOT SUSTAINABLE FOR US.

WE'RE A WORLD CLASS CITY. NUMBER FUN MANY MAGAZINES SO I'M REQUESTING YOUR HELP. I AM LEAVING THE CITY OF NOBLESVILLE AND WHEN YOU RETIRE FROM THE CITY OF NOBLESVILLE WITH 20 YEARS OF SERVICE YOU PAY THE SAME PREMIUM.

I JUST WANT TO KNOW WHY CARMEL CANNOT OFFER THAT AS WELL AND I LEAVE THIS. THIS IS ON THEIR WEBSITE.

I ASK FOR YOUR HELP ON THIS. IT'S VERY CONCERNING AS SOMEONE WHO IS GOING TO BE RETIRING IN THE NEAR FUTURE.

THAT'S JUST A FEW YEARS BUT JUST TO LEAVE YOU THAT AND JUST TO LEAVE THIS FOR AN EXAMPLE. I GOT TWO THOUGHTS AND I'LL BE VERY BRIEF. WITH OUR PENSION BASE OUR BENEFIT IS $46,000 A YEAR WITH 20 YEARS OF SERVICE.

YOU'VE GOT TO EITHER CHOOSE YOUR PENSION OR YOU CHOOSE INSURANCE UNDER THAT SCENARIO. AND SO ALSO MY LAST POINT TO

DRIVE THIS HOME FOR EVERYONE -- >> I'LL TELL WHAT YOU, I APOLOGIZE BUT WE DO HAVE A RULE ABOUT THREE MINUTES.

BUT I'M HAPPY TO MEET WITH YOU. I'M SURE THE ENTIRE COUNCIL IS HAPPY TO MEET WITH YOU IF YOU HAVE DETAILS AND DATA WE'D LOVE, YOU KNOW, WHATEVER YOU WERE JUST GOING TO DO BUT I HAVE TO FOLLOW

OUR RULES. >> ABSOLUTELY.

>> I UNDERSTAND. TY APPRECIATE YOUR TIME.

I WOULD LIKE TO LEAVE YOU WITH THIS.

THIS IS IN ADDITION NOBLESVILLE INDIANAPOLIS AND FORT WAYNE ALL

SUPERIOR PREMIUMS. >> VERY GOOD.

YES.

>> ALL RIGHT. NEXT UP IS DEE FOX.

>> THANK YOU.

>> HOW DO I PUT A PICTURE ON THE SCREEN?

>> LAY IT ON THAT BROWN BOARD. HELLO, I'M DEE FOX AND CITIZENS FOR SPOPSABLE ZONING. MY SUBJECT IS THE 111TH AND PENN CRC PROJECT OVERALL. CRC IS THE CARMEL REDEVELOPMENT COMMISSION. THIS 111TH AND PENN PROJECT SHOWS GLOWING PROBLEMS OF INTENSE DOWNTOWN TYPE DEVELOPMENTS STEADILY ENCROACHING ON RESIDENTIAL AREAS. IT IS NOT DOWNTOWN.

YET THE CITY ALLOWED THIS 35.2 ACRE SITE CONSISTING OF A HOUSE FARM AND WOODS TO BE REZONED FROM OUR ONE LOW DENSITY SINGINGAL FAMILY RESIDENTIAL TO THE MOST INTENSE MIXED USE URBAN ZONING POSSIBLE C2 REDEVELOPMENT.

THE SITE HAS ADJACENT LOW DENSITY SINGLE FAMILY NEIGHBORHOODS. THOSE ENABLES WERE ENSURED THEY WOULD HAVE INPUT DURING THE PROCESS BUT WE'VE BEEN HEARING FROM THEM THAT IS NOT THE CASE. THE CONCEPTUAL SITE PLAN ON THE SCREEN AND IF THIS HAS CHANGED PLEASE TELL ME BECAUSE I HAVEN' HEARD ANYTHING NEW ON THIS IN A WHILE, SHOWS JUST HOW DENSE CROWDED AND DEVOID OF GREEN SPACE AND INCOMPATIBLE WITH THE

[00:20:04]

NEIGHBORS THAT IT IS. THE PLAN INCLUDES REMOVAL OF 6.# 2 ACRES OF DENSELY WOODED MATURE FOREST.

ABOUT 17% OF THE TOTAL ACREAGE TO BE BUILT OVER LEAVING ONLY SMALL STRIPS ON THE PERIMETER. INSTEAD OF A SMALL CONTRIVED PUBLIC GATHERING ENTERTAINMENT SPACE WOULD BE BUILT IN THE DEVELOPMENT CENTER. THAT SPACE IS A TINY AND INADEQUATE PORTION OF THE ENTIRE DEVELOPMENT WITH A LARGE PORTION OF THAT SPACE BEING STILL MORE CONCRETE.

NEXT WEEK THIS PROJECT WILL REQUEST A VARIANCE FROM THE BZA TO ALLOW AN INCREASE TO 95% LOT COVERAGE INSTEAD OF THE UDO'S ALREADY GENEROUS MAXIMUM OF 80% LOT COVERAGE.

I'VE HEARD A LOT OF NEGATIVE PUBLIC REACTION TO THE 100% LOT COVERAGE AT FIRST AND MAIN. I WAS HOPING THAT WAS NOT GOING TO BECOME COMMON. THE PROPOSAL DOES NEITHER NOR DOES IT MEET THE STATEMENTS IN THE RECENTLY REVISED COMPREHENSIVE PLAN. WHEN THE PLAN IS PRESENTED, I ASKED CITY COUNCIL TO REQUIRE MEANINGFUL IMPROVEMENTS AND NOT JUST GIVE IT A PASS. ALSO REMEMBER THESE ISSUES IN FUTURE DEVELOPMENTS IF IT'S TOO LATE FOR 111TH AND PENN.

WITH A NEW ADMINISTRATION I'M ASKING CITY COUNCIL TO STEP UP TO THE PLATE AND USE THE POWER YOU HAVE TO REPRESENT CONSTITUENTS AND REIGN IN OVERREACHING DEVELOPMENT.

>> THANK YOU. >> THANK YOU.

NEXT UP IS JILL MEISENHEIMER.

>> MY NAME IS JILL MEISENHEIMER, I'M THE OTHER HALF OF CRCZ.

AT 116TH AN MAIN LINE AND FIRST AND MAIN BECAUSE OF THEIR EXTREME DENSITY TOWERING HEIGHT LACK OF GREEN SPACE AND THEY'RE BUILT JUST TOO CLOSE TO THE STREET.

THE FIRST TO MAIN PROJECT WAS 65% BUILT WHEN IT ASKED FOR A WAIVER FOR 100% LOT COVERAGE WITH NO ROOM FOR GREEN SPACE AND TREES. RECENTLY THE PLAN COMMISSION APPROVED THE EDGE AT WEST CARMEL A DENSE MIXED USE DEVELOPMENT OF APARTMENTS AND COMMERCIAL USES WHICH ALSO REQUESTED SEVERAL SIGNIFICANT VARIANCES FROM THE UDO REQUIREMENTS.

IT SEEMS THE EDGE IS SETTING A PRESENCE DENT FOR SIMILAR INTENSE DEVELOPMENTS DOWN MICHIGAN ROAD BECAUSE TONIGHT -- I LOST MY PLACE -- THE CRC IS RE-QUESTION A RESOLUTION TO CREATE THE MICHIGAN ROAD ECONOMIC DEVELOPMENT AND ALLOCATION AREAS. TONIGHT THE CRZ IS ALSO RE-QUESTION A RESOLUTION TO DESIGNATE 12 SEPARATE ALLOCATION AREAS WITH 111TH AND PENN REDEVELOPMENT AREA AND ADOPTING A SUPPLEMENT FOR THAT AREA. WHY? WHAT DOES THIS MEAN? WHAT WILL BE BUILT ON THIS PROPERTY TO WHICH THIS RESOLUTION WOULD APPLY? THE 111TH AN PENN PROJECT IS DENSE.

THIS SHOWS THE NEARBY NEIGHBORHOODS AND HOW THIS COMPARES WITH IT HERE. IT'S THE PIT CORE DEVELOPMENT AND HERE ARE THE OTHER SURROUNDING NEIGHBORHOODS.

IT'S CROWDED WITH LITTLE GREEN SPACE AND NOT COMPATIBLE WITH THE NEARBY NEIGHBORS WHO HAVE LESS INTENSE SINGLE FAMILY NEIGHBORHOODS THAT DO INCLUDE GREEN SPACE AND TREES.

I'VE HEARD THE SITE IS INTENDED TO BE A SECOND DOWNTOWN

[00:25:03]

ENTERTAINMENT CENTER BUT I'M NOT SURE THAT ANYBODY FEELS THAT THIS IS ACTUALLY NEEDED. IT'S A DON SEPTEMBERTUAL PLAN JUST A PLACE HOLDER? THIS IS THE CITY SHOULD BE HELPING TO PROCORRECT THESE WOODS FOR THE ADJACENT NEIGHBORS AND THE PEOPLE WHO PLAN TO ATTRACT TO LIVE AND WORK HERE.

IT APPEARS THE ONLY GREEN SPACE LEFT WILL BE A NARROW SPACE AROUND THE EDGES AND A TEENY -- CENTRAL PUBLIC GATHERING SPACE WHICH IS MORE CONCRETE. IT MAY APPROXIMATE TOO LATE FOR THE PROJECTS I'VE MENTIONED BUT I ASK TO HELP PROTECT OUR TREES AND GREEN SPACES AND FUTURE DEVELOPMENT.

THANK YOU VERY MUCH FOR YOUR INPUT.

WE APPRECIATE IT. >>> OKAY. THAT CONCLUDES PUBLIC COMMENT. THANK YOU.

TO ALL WHO SPOKE. WE WILL NOW MOVE ON TO ITEM 7 ON OUR AGENDA WHICH IS COUNCIL AND MAYORAL COMMENTS OBSERVATIONS.

[8. CONSENT AGENDA]

ARE THERE ANY? OKAY. WE WILL THEN MOVE ON TO OUR CONSENT AGENDA APPROVAL OF MINUTES.

OCTOBER 16TH, 2023, REGULAR MEETING, OCTOBER 24TH, 2023, SPECIAL MEETING, NOVEMBER 2, 2023, SPECIAL MEETING.

PLUS CLAIMS, GENERAL CLAIMS $2,393,640.51, RETIREMENT $107,695.97, AND WIRE TRANSFERS $4,528,869.74.

>> MOVE TO APPROVE. >> ANY QUESTIONS? PLEASE VOTE.

[10. COMMITTEE REPORTS]

ALL RIGHT. THAT CARRIES.

THERE ARE NO VETOES. WE'LL NOW MOVE ON TO COMMITTEE REPORTS. FINANCE EWE TILL ACE AND RULES COMMITTEES HAS NOT MET. LAND USE.

WE HAVE IN THE MET. >> WE'LL MOVE ON NOW TO CARMEL REDEVELOPMENT COMMISSION. THIS IS THEIR MONTHLY REPORT.

>> THANK YOU. CARMEL REDEVELOPMENT DIRECTOR.

I'M GOING TO MOVE THROUGH THIS MONTHLY REDEVELOPMENT REPORT.

LOTS OF PROGRESS GOING ON. IN THE CITY CENTER AT OUR WONDERFUL ICE SKATING RINK. THEY'RE BOTH GOING UP.

OKAY. >> IT'S ON MY LAPTOP.

>> ARE YOU TRYING SOMETHING DIFFERENT?

>> I JUST UNPLUGGED AND PLUGGED BACK IN.

>> OKAY.

[00:30:53]

>> BACK IT TO. THE TAVERN WHICH IS A MONUMENTAL AWARD WINNER IS MAKING ITS WAY THROUGH THE CITY.

FIRST ON MAIN CONTINUES. IT'S EXCITING TO SEE THE ARCHITECTURE TAKE SHAPE ON THAT PROJECT.

THE FACADE IS BEING BUILT ON THE SECOND MAGNOLIA STACKED FLATS CONCEPT. MUSIC MOVING FORWARD AS WELL.

SAME WITH THE SIGNATURE. THE LAUNCH IS ALMOST COMPLETE.

YOU MAY HAVE NOTICED THAT THE NORTH AND WEST SIDE OF THE GARAGE IS A BLANK WALL TODAY. ON WEDNESDAY THE CARMEL REDEVELOPMENT APPROVED THE CONDOS PROJECT.

AS ORIGINALLY PRESENTED TO CITY COUNCIL WAY BACK WHEN WHEN THIS GARAGE WAS FIRST BEING PROPOSED. THESE ARE FOR SALE CONDOS 24 FOR SALE CONDOS THAT WRAP THE TWO REMAINING WALLS OF THE CIVIC SQUARE GARAGE THAT CURRENTLY DO NOT HAVE ARK SECRETARY WHICH YOU ARE ON THEM. IT'S THE SAME BRICKS -- SAME BRICKS THAT ARE USED ON THE MELANGE PROJECT AND WOULD COMPLETE THIS URBAN NEIGHBORHOOD.

MORE FOR SALE UNITS COMING. THIS PROJECT SHOULD START NEXT YEAR.

>> REPUBLIC CONTINUES BUILDING OUT.

ELEVATOR TOWERS ARE UP ON THE 1933 LOUNGE PROJECT.

WE HAVE BEEN WORKING WITH THOSE CONTRACTORS TO ENSURE AS LITTLE DISTURBANCE TO THE NEIGHBORS IN THAT AREA AS POSSIBLE.

AND THEY ARE MAKING PROGRESS ON THAT.

SLOWLY. I CON IS MOVING FORWARD AS -- ICON IS MOVING FORWARD AS WELL. SAME WITH SQUARE NORTH AS WE DISCUSSED AT THE LAST MEETING. SIMILAR TO THE LAST MEETING WE TALKED ABOUT THE AT&T SITE REDEVELOPMENT.

WE SHOULD SEE DEMO OF THE CURRENT OLD AT&T WAREHOUSE.

IT STARTED. THAT'S HOW WICK QUESTION WORK AT THE CRC.

>> THE TOWNSHIP AND CARMEL REDEVELOPMENT COMMISSION CONTINUE TEAM WORKING ON THE HISTORIC NEW HOME FOR THE HISTORICAL SOCIETY. WE HAD A CALL ON THAT TODAY ACTUALLY WORJING THROUGH THE EXHIBITS ON THE TIN SIDE.

AND FINALLY WORK IS BEING DONE TO MOVE PEN 111 FORWARD.

A COUPLE MORE THINGS I JUST WANTED TO MENTION.

FIRST, PALADISCOPES CONTINUES TO GARNER ACCOLADES.

I HOPE EVERYONE HERE HAS HAD THE CHANCE TO -- WITH THE NEW BACKDROP FOR THE CHRIS KIN KNELL MARKET.

IT LOOKS GOOD. FINALLY, ON TUESDAY OF LAST WEEK, THE ART ADVISORY COMMITTEE MET AND APPROVED THE CRC'S PURCHASE OF THE TAKING FLIGHT ROUND ABOUT ART AT 4G9 AND MAIN AND THOSE ARE BOOKS FLYING THROUGH THE AIR AND LIGHT UP IN NIGHT AND INSPIRE YOUNG MINDS TO I'M HAPPY TO ANSWER ANY QUESTIONS IF THE COUNCIL HAS ANY.

OTHERWISE I'LL BE BACK UP HERE SHORTLY.

>> ALL RIGHT. ANY QUESTIONS FOR THE DIRECTOR?

COUNCIL LORE? >> WILL YOU EXPLAIN ABOUT HOW THE PROFIT SHARE ABOVE THE LIST PRICE IS GOING TO HAPPEN WITH

THE CONDOS? >> YES.

[00:35:02]

>> LET'S SAY JUST FOR EXAMPLE THEY LIST AT 600,000.

600,000 THEY LIST AT AND DON'T SELL AT 600,000 AND DROP TO 600,000. WHAT'S THE LIST PRICE?

>> IF THEY DROP THE PRICE NOTHING HAPPENS.

IF THEY SAID THEY WERE GOING TO SELL 600,000 AND SELL AT 650 AND NOTHING HAPPENS IF THEY SELL AT 660 NOTHING HAPPENS.

IF THEY SELL AT 661, THEN THE CITY WOULD GET BACK $250 OUT OF THAT. SO THE WAY IT WORKS IS IT'S ONCE YOU GO ABOVE 110% OF THE INITIAL LISTING PRICE THE CITY GETS A 25% SHARE OF THAT.

>> WHAT'S TO STOP THE DEVELOPMENT FROM LISTING SUPER

HIGH SO THEY'D HAVE TO DROP IT? >> WE VET THEIR NUMBERS IN THE BEGINNING TO MAKE SURE THEY'RE REASONABLE.

>> SO IT'S -- WE'RE PARTICIPATING IN THE INITIAL ASK

SETTING? >> WHEN WE NEGOTIATE THESE WE VET THE DEVELOPER'S PRO FORMA TO SEE WHAT THEY EXPECT.

TO CALCULATE THE TIFF WE NEED TO KNOW THE LISTING PRICE OF THE CONDOS SO WE VIEW THE NUMBERS IN THE BEGINNING WHEN WE VET THE PROJECT AND INCORPORATE THOSE INTO THE PROJECT AGREEMENT SO WHEN THEY EVENTUALLY LITERATURES, IF IT LISTS IT SELLS FOR ESSENTIALLY MORE THAN 110% OF THE INITIAL PRICE THEN

WE SHARE IN 25% OF THAT. >> INITIAL PRICE IS SET YEAR AND

A HALF AGO? >> YES.

>> SO WE'RE TAKING A LOT OF RISK POTENTIALLY WITH WILDLY FLUCTUATING MARKET AND I SAY WILDLY WITH AN ASTROPHICS.

>> WE ONLY BENEFIT IF THE DEVELOPMENT DOES BETTER THAN ANYONE ANTICIPATED WHICH IS FAIR.

WE WANT TO INCENTIVIZE THE DEVELOPER TO DO THIS BUT IF THE PRICES RISE LIKE CRAZY AND THEY DO BETTER THAN ANYONE EXPECTED THEN THE CITY WILL SHARE IN THAT BENEFIT AS WELL.

IT'S NOT INTENDED TO BE PUNITIVE ADDS WELL.

IT'S ONLY A RISING TIDE. >> I AGREE WITH THAT.

IF THE COST OF CONSTRUCTION COSTS LIKE LAST TIME WE

RENEGOTIATE. >> YEAH OR THAT EXTRA 10% CUSHION IS EXPECTEDED TO ASSIST WITH.

>> OKAY. SO WE'RE NOT IN THE WEEDS ON WHY THE PRICE WENT UP.

IF IT GOES UP MORE THAN 110% WE JUST BENEFIT FROM IT.

>> OKAY. AND THE AT&T SITE HAD TWO SINGLE FAMILY HOMES STILL LISTED THOSE ARE OFF THE TABLE RIGHT?

>> FOR NOW THAT'S NOT PART OF THE PROJECT.

>> OKAY. >> COUNSELOR.

>> THANK YOU. JUST TO REQUEST MAYBE SOMETHING FOR NEXT YEAR BECAUSE I'M GOING TO TAKE SOME TIME BUT WE HAVE NEW COUNSELORS COMING IN. CAN WE INCLUDE INFORMATION ABOUT PARK IMPACT FEES FOR THESE PROJECTS MAYBE BOTH HISTORICALLY KIND OF WHAT HOW MUCH WE GENERATED FROM PROJECTS AND WHAT THEY WERE USED FOR AND GOING FORWARD AS WE ADD NEW PROJECTS AND SLIDES AND UNDERSTANDING THE PARK IMPACT FEES ASSOCIATED WITH THE -- REFERENDUM MONEY AND A LOT OF DETAILS IN THERE.

I THINK THAT'S A DETAIL WE'D LIKE TO HAVE MORE INFORMATION ESPECIALLY WITH NEW COUNCIL COMING IN.

>> ABSOLUTELY.

>>. >> ALL RIGHT.

ANY OTHER QUESTIONS?

>> OKAY. THANK YOU VERY MUCH. >> WE WERE SUPPOSED TO HAVE A PRESENTATION FOR BIKE CARMEL BUT I DON'T SEE THE TANNERS HERE.

SO ANYBODY FILLING IN FOR THEM? ALL RIGHT.

WE WILL MOVE ON THEN. WE'VE HAD A MISCOMMUNICATION THERE. JACOB IF THANK YOU DON'T MIND FOLLOWING UP WITH THEM AND LET THEM KNOW WE TRIED.

[13. PUBLIC HEARINGS]

NO OLD BUSINESS. MOVING INTO PUBLIC HEARINGS.

ITEM 13 A IS FIRST READING OF D-2685-23.

[00:41:34]

>> MOVE TO APROF >> ALL RIGHT.

ANY DISCUSSION? PLEASE VOTE.

>> MOTION CARRIES. VERY GOOD.

THANK YOU, CHIEF. MAUVING TO ITEM B FIRST READING OF ORDINANCE 2686-23.

>> MOVE TO INTRODUCE. >> GO AHEAD.

>> THIS APPROPRIATES $3,750 IN GRANT FUNDS RECEIVED FROM THE

INDIANA ARTS COMMISSION. >> OKAY. NANCY.

DIRECTOR HECHT IS HERE. >> BRIEFLY.

THESE ARE GRANT FUNDS WE GOT TO DO A MEET ME ON MAIN ACTIVITY BOOKS WE HAND OUT IN THAT EVENT THAT HAS INFORMATION ABOUT THE DISTRICT AND SO THIS IS JUST GOES INTO THE GENERAL FUND WE HAVE TO MOVE IT BACK INTO OUR LINE ITEM TO SPEND IT.

>> ALL RIGHT. DEAL, $3,750.

LY OPEN THE PUBLIC HEARING AT 7:42.

ANYONE THAT WISHES TO SPEAK FOR OR AGAINST THIS MAKE YOUR WAY TO THE PODIUM.

642. GOT IT.

I WILL WORK ON THAT WHILE WE HAVE SPEAKERS.

ALL RIGHT. HEARING NONE I'LL CLOSE THE

PUBLIC HEARING. >> MR. PRESIDENT.

>> 6:42. >> I MOVE YOU SUSPEND THE RULES

AND ACT ON THIS THIS EVENING. >> SECOND.

>> OKAY. ANY DISCUSSION? >> PLEASE VOTE.

>> THAT CARRIES. >> MOVE TO APPROVE.

>> SECOND. >> DISCUSSION.

>> PLEASE VOTE.

MOTION CARRIES. >> ALL RIGHT.

THANK YOU. >> MOVING TO ITEM C FIRST READING OF D-2687-23.

FEES FROM SKATE RENTAL AND SKATE TIME ON THE ICE.

THIS IS NOT TAX MONEY. JUST USER FEES GOING INTO THAT NONREVERTING FUND AT THE ICE AT CARTER GREEN.

THIS IS FOR THIS YEAR'S OPERATING FOR THIS SEASON WHAT HAPPENS USUALLY I GO INTO THE BUDGET YEAR AND ASK FOR THE ENTIRE YEAR'S APPROPRIATION. .

SO LAST YEAR WHEN YOU APPROPRIATE IT FOR THIS YEAR THAT WE HAD IN THE PIPES WHICH HAVE NOW BEEN REPAIRED BUT THIS IS MOVING SOME MONEY IN SO THAT WE ARE REPLENISHING THAT AMOUNT WE SPENT OVER THE SUMMER FOR REPAIRS THAT WERE UNANTICIPATED.

THANK YOU. >> ALL RIGHT.

ANY QUESTIONS FOR DIRECTOR HECHT? I WILL OPEN THE PUBLIC HEARING AT 6:44.

ANYONE WISHING TO SPEAK FOR OR AGAINST THIS PLEASE MAKE YOUR WAY TO THE PODIUM. NICE TO GET THAT HOUR BACK.

>> YEAH.

>> SEEING NONE, I WILL CLOSE THE PUBLIC HEARING AT 6:44.

[00:45:05]

I MOVE WE ACT ON THIS THIS EVENING AND SUSPEND THE RULES.

>> SECOND. >> ANY DISCUSSION?

>> PLEASE VOTE. THAT CARRIES.

WE'LL NOW MOVE ON TO ITEM D FIRST READING OF 684-23.

SECOND, PLEASE. >> OKAY.

>> GLOW AHEAD. WE READ THE SYNOPSIS.

>> REZONES 3.3 ACRES LOCATED ON CAR T CARMEL DRIVE.

TO THE C1 CITY CENTER DISTRICT. IN KEEP, THE STYLE OF THE -- WHICH IS LOCATED EAST OF THE SITE.

ONCE A SPECIFIC PROJECT IS PROPOSED, A PUBLIC HEARING FOR DEVELOPMENT PLAN AND SLDS WILL BE HELD UNDER THE C-1 DISTRICT WITH PUBLIC NOTICE. REQUIRING FOR THE PLANNING COMMISSION AND PUBLIC HEARING INCLUDING NEWSPAPER PUBLICATION LETTERS TO ADJOINING PROPERTY OWNERS AS WELL AS A PUBLIC HEARING SIGN ON THE PROPERTY. ANY HE DEVELOPMENT PROPOSAL THAT COMES FORTH WOULD ALSO BE SUBJECT TO THE TECHNICAL ADVISORY COMMITTEE VIEW AND CARMEL REDEVELOPMENT COMMISSION APPROVAL. WE'VE RECENTLY HAD MORE C2 STRIATE REZONES THAN C1 BUT THE C1 DISTRICT WAS PROPOSED INSTEAD OF C THE BECAUSE OF ITS PROXIMITY TO THE C1 DISTRICT THAT EXISTS ALONG -- OVER THE -- AS WELL AS THE CIVIC SQUARE COMPLEX JUST TO THE NORTH OF THE SITE.

AND YOU CAN SEE THAT ON THE MAP AND THE SITE IS OUTLINEDED IN RED. AS OTHER THINGS THAT COME FROM THE PLANNING COMMISSION, THERE IS A CERTIFICATION THAT GOES ALONG WITH THAT AND THAT 90 DAY WINDOW EXPIRES ON DECEMBER 26TH TO TAKE ACTION. SO I'M HAPPY TO TAKE ANY QUESTIONS THIS EVENING. OR SAVE QUESTIONS UNTIL LATER.

THANK YOU. >> ANY QUESTIONS COUNSELOR

GREEN? >> THANK YOU, MR. PRESIDENT.

COULD YOU JUST KIND OF EXPLAIN A LITTLE BIT MORE THE DIFFERENCE BETWEEN C1, C2, ULTIMATELY WHAT IS THE IMPACT?

>> THE C1 DISTRICT IS WAS PRIMARILY WRITTEN FOR THE CITY CENTER AREA WHEREAS C2 IS A LITTLE LESS INTENSE.

AND COULD BE LOCATED IN THE ARTS AND DESIGN DISTRICT OR OTHER AREAS OF THE CITY. THE MAIN STARCHES IS -- MOST OF THE DEVELOPMENT STANDARDS ARE VERY SIMILAR.

THERE IS A DIFFERENCE IN BUILDING HEIGHT AND I BELIEVE THE C2 DISTRICT HAS SOME BUFFING REQUIREMENTS AND TRANSITION REQUIREMENTS WHEN NEXT TO RESIDENTIAL HOWEVER THE C1 DISTRICT IS NOT GENERALLY NEXT TO RESIDENTIAL SO THOSE DO NOT APPEAR IN C1.

>> THANK YOU. ARE WE PLANNING ON SENDING THOSE

TO COMMITTEE? >> I WILL SEE WHAT THE PLEASURE IS BUT THAT WAS WHAT IS IN MY NOTES, YES.

>> SEND THIS TO LAND USE.

>> OKAY. ANY OTHER QUESTIONS?

[00:50:01]

>> ALL RIGHT. I'M GOING TO OPEN UP THE PUBLIC HEARING IF ANYONE WOULD LIKE TO SPEAK FOR OR AGAINST ORDINANCE C 68423 PLEASE MAKE YOUR WAY TO THE PODIUM.

OPENING AT 6:49.

SEEING NO MOVEMENT WE'LL CLOSE THE PUBLIC HEARING AT 6:49.

AND THIS WILL GO ONTO COMMITTEE.

>> THANK YOU. >> ALL RIGHT.

LAND USE. >> ALL RIGHT.

MOVE ON NOW TO FIRST READING OF Z 685-23.

ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL INDIANA REZONING 9983RD AFTER SOUTHWEST TO THE CITY CENTER DISTRICT.

COUNCILLOR AASEN SPONSORS THIS. >>.

>> YES. AGAIN, I'M ADRIAN KEELING WITH THE DEPARTMENT OF COMMUNITY SERVICES.

THIS SITE IS PROPOSING TO REZONE 5.5 ACRES FROM THE INDUSTRIAL DISTRICT TO THE C1 DISTRICT. THIS IS LOCATED ALONG THIRD AVENUE SOUTHWEST AND -- THE GREENWAY SETS TO THE EAST OF THE SITE. AND IT'S RIGHT HERE NEAR CITY HALL. THE ZONING MAP UP HERE.

AGAIN, THE C1 DISTRICT MAKES SENSE IN THIS INSTANCE RATHER THAN C2 BECAUSE IT IS DIRECTLY ADD JEW SENT TO CITY CENTER ALL THE TOWN HOMES AND CIVIC SQUARE AREA TO THE EAST AND TO THE NORTH IS ZONED C1 AS WELL. THIS PROPOSAL DOES HAVE THE SAME CERTIFICATION 90 DAY WINDOW AS THE PREVIOUS AND WOULD EXPIRE ON DECEMBER 26TH. SO AGAIN I'M HAPPY TO TAKE ADDITIONAL QUESTIONS IF YOU HAVE THEM.

>> ALL RIGHT. THANK YOU.

SO WHEN THE PLANNING COMMISSION RECEIVED THIS, THEY WERE TOLD THAT THERE WAS NO SPECIFIC OR IMMEDIATE PLANS.

THAT CORRECT? >> CORRECT.

>> OKAY. AND BUT THIS IS -- THIS REZONE WOULD BE TIED TO A PROPOSAL WE HAVE LATER ON ON THE AGENDA FROM THE CRC?

>> YES. I WOULD STILL SAY THAT NOTHING HAS BEEN FILED FOR PUBLIC HEARING OR REVIEW BY THE DEPARTMENT. WHEN IT WAS BROUGHT TO MY ATTENTION THAT THE PROJECT WAS A PROJECT ON THIS SITE FOR AN APPROVAL THIS EVENING I BELIEVE FOR TIFF ALLOCATION, I WAS TOLD BECAUSE I HAD OF COURSE CONTACTED THE REDEVELOPMENT COMMISSION OFFICE TO SEE WHAT WAS GOING ON BECAUSE I MONITORED THESE THINGS AND I WAS TOLD THAT THE AGENDA ITEM LATER THIS EVENING IS TRULY THE VERY FIRST STEP IN TERMS OF BRINGING FORTH A PROPOSAL SO THERE'S NOTHING HAS BEEN FILEDED IN TERMS OF DEVELOPMENT PLAN. THIS IS JUST THE VERY INITIAL STEPS. SO THAT WAS DEFINITELY -- THAT WAS DEFINITELY THE CASE IN SEPTEMBER WHEN THIS WAS PROPOSED. SOUNDS LIKE SOME CONCEPTS AND THINKING HAVE CAUGHT UP WITH THIS PROPOSAL AS ITS MOVED TO

COUNCIL. >> AND I APPRECIATE AND I'M NOT ATTACKING YOU ON THIS. I WISH YOU WERE INFORMED AND COMMUNICATED WHEN THERE WAS MOVEMENT ON THIS.

AND SO I KNOW THAT'S A FRUSTRATION ON THE PLANNING COMMISSION LEVEL THAT MAY HAVE BEEN THE TRUTH AT THE MOMENT BUT WE WERE TOLD THERE WERE NO PLANS FOR THE SITE THAT SEEMS TO BE SOMETHING ELSE WAS IN MIND. BUT I ASSUME THIS IS GOING TO COMMITTEE SO WE CAN DISCUSS THAT THERE.

BUT IT SOUNDS LIKE THE REZONE IS VERY MUCH TIED TO A PROJECT LATER ON OUR AGENDA.

>> ANY OTHER QUESTIONS?

>> ALL RIGHT. I'LL OPEN THE PUBLIC HEARING AT 6:54. IF ANYONE WISHES TO SPEAK FOR OR AGAINST THIS. PLEASE MAKE YOUR WAY TO PODIUM.

[00:55:03]

ONE LAST CLARIFICATION. >> THIS IS -- THIS REZONE ISN'T SPECIFICALLY TIED TO A PROJECT. THIS PROPOSAL FOR THE REZONE TO C1. WHATEVER MONTH JACKED GETS APROFED -- PROJECT GETS APPROVED LATER ON IN THE AGENDA OR NOT DOESN'T -- IS NOT TIED TO A C1 REZONING.

BUT I DO BELIEVE THAT REGARDLESS OF WHAT HAVE PROJECT IS APPROVED IT DOES MAKE SENSE THAT THIS ZONING DOES CHANGE TO A C1

DISTRICT. >> OKAY.

>> FOR FUTURE PROJECT WHENEVER THAT DOES MOVE FORWARD

>> OKAY. ALL RIGHT. VERY GOOD.

THANK YOU FOR THAT CLARIFICATION.

>> DIRECTOR, DID YOU WANT TO ADDRESS ANYTHING?

>> YEAH. I JUST DON'T WANT ANYTHING WRITTEN THAT IS NOT INTENDED. I MEAN, THE REDEVELOPMENT FUNCTION OF THE CITY RESPECTS THE ROLE THAT CITY COUNCIL PLAYS. AND MAKES SURE THAT ANY TIME A PROJECT IS INTRODUCED IT HAPPENS AT CITY COUNCIL AND NOT ONE OF THE OTHER BOARDS THAT DUE DEFERENCE IS PAIDED TO CITY COUNCIL SO IT'S TRUE THAT BACK IN SEPTEMBER THERE WAS NO PUBLIC PROJECT -- PROJECT ON THE SITE. TODAY IS WHEN THAT PROJECT IS BEING PRODEUCED AND IT JUST HAPPENED TO WORK ITSELF OUT THAT WAY. SO I JUST WANT TO MAKE SURE THAT THERE IS NO MISLEADING OF ANY SORT.

IT'S JUST THAT'S HOW IT HAPPENED TO WORK OUT.

CRC WILL ALWAYS INTRODUCE A PROJECT FOR THE FIRST TIME AT CITY COUNCIL AND THAT'S WHEN THE PUBLIC WILL HEAR ABIT.

>> OKAY. ALL RIGHT. VERY GOOD.

THANK YOU. >> WE WILL MOVE NOW ON TO FIRST READING OF ORDINANCE 686-23. COMMON COUNCIL OF THE CITY OF CARMEL INDIANA UPDATING OWNERS ASSOCIATION STANDARDS IN THE UNIFIED DEVELOPMENT ORDINANCE SPONSORS OR COUNSELORS

CAMPBELL -- >> SECOND.

>> ALL RIGHT. COUNCIL LORE CAMPBELL, READ THE

SYNOPSIS. >> REQUIRES OWNERS ASSOCIATIONS ALLOW CHANGES TO GOVERNING DOCK DEMENTS RELATING TO RENTAL RESTRICTIONS WITH NO MORE THAN A SIMPLE MAJORITY OF ITS OWNERS

>> ALL RIGHT. YOU'RE GOING TO --

>> YEAH. AGAIN.

>> VERY GOOD. TAKE IT AWAY.

[01:01:31]

OUR FUTURE CITY COUNCIL ERROR TAKING OVER FOR MAYORAL ELECT'S DISTRICT SHANNON WAS THE PRESIDENT OF OUR HOME OPENERS ASSOCIATION WHEN WE STARTED GETTING WORRIED ABOUT INVESTMENT FIRMS BUYING HOUSES AND YOU STARTED THE PROCESS AND SOME OF US HELPED KNOCK ON DOORS AND TALK TO PEOPLE AND IT'S A DIFFICULT PROCESS TO GET THROUGH.

IT TOOK TIME AND MONEY MADE SOME PEOPLE MAD.

BUT IT WAS -- WE ADDED JUST FOR AN IDEA OF NEIGHBORHOODS WE ADDED YOU HAD TO OWN YOUR HOME FOR THREE YEARS BEFORE YOU COULD RENT IT. IT TOOK THE INVESTMENT FUN OUT OF IT FOR THE BIG FUNDS BUY PLEAD GUILTY THE HOUSES.

SO YOU HAVE GOOD REPRESENTATION COMING TO TAKE OVER FOR YOU.

BUT THIS IS A NECESSARY THING. I MEAN, LIKE YOU SAID RENTALS ARE NOT BAD. INVESTMENT FIRMS THAT ARE BUYING UP LARGE BLOCKS ARE COMPLICATED FOR THIS IS A NICE PROSECTION

FOR NEIGHBORHOODS. >> I WOULD NOTE THAT AT PLANNING COMMISSION, THIS WAS PRETTY NONCONT NONCONTROVERSIAL. WE DID ASK ABOUT WHETHER TO TRY TO STRENGTHEN IT AS MUCH AS WE COULD BUT UNDER THE LAW THIS IS AS TIGHT ADDS WE COULD GET IT. WE CAN'T GO BACK AND CHANGE THINGS UNDER THE COVENANT SO THIS ONLY APPLIES TO NEW DEVELOPMENTS. SO ALTHOUGH MAYBE SOME WOULD WISH IT GO FURTHER THIS IS THE BEST WE CAN DO.

THERE'S NO REASON THIS CAN'T GO TO COMMITTEE BUT BECAUSE IT WAS NOT ON THE TROW VERBAL ON PLAN COMMISSION I MIGHT MAKE A MOTION WE SUSPEND THE RULES IF NO ONE OPPOSES TO THAT.

>> YOU NEED TO WAIT UNTIL WE CLOSE THE PUBLIC HEARING.

>> THERE'S NOTHING THAT PROHIBITS THEM THEMSELVES OF GOING IN AND CHANGING IT THEMSELVES.

>> ABSOLUTELY. AS LONG AS THEY COMPLY WITH WHAT'S IN THEIR CURRENT GOVERNING DOCUMENTS THEY CAN DO

THAT. >> ALL RIGHT.

ANY OTHER QUESTIONS OR COMMENTS? >> ALL RIGHT.

I'LL OPEN THE WAY THIS IS WORDED IT ALSO.

[01:06:22]

>> I WILL BE REPLACING THE HONORABLE SOON TO BE HONORABLE MAYOR AND I WANT TO SAY I'M VERY MUCH FOR THIS ORDINANCE BECAUSE IT DOES HELP WITH HOMEOWNERS ASSOCIATIONS TO -- HOMEOWNER ASSOCIATIONS COULD DO IT ALREADY HAVING THAT 50 PLUS ONE IS REALLY IMPORTANT BECAUSE TRYING TO GO DOOR TO DOOR KNOCKING KNOCKING KNOCKING TO TRY AND GET 50% OF THE PEOPLE TO EVEN COME OUT AND VOTE IS ALMOST UNHEARD OF.

SO I'M REALLY FOR THIS ORDINANCE.

AND I WISH YOU PUT THREE YEARS OWNERSHIP FIRST IN THERE.

BUT I UNDERSTAND DEE'S CONCERN BUT IT DOES GIVE THE NEIGHBORHOODS THE RIGHT TO AND THE NEIGHBORS TO SPEAK UP.

SO I WANT TO SAY GOOD JOB ON THE ORDINANCE.

>> ANYONE ELSE WISH TO SPEAK FOR OR AGAINST? ALL RIGHT. I'LL CLOSE THE PUBLIC HEARING AT 7:06. AND TAKE EITHER A MOTION OR SOMEONE CAN REQUEST THIS TO GO TO COMMITTEE.

>> >> I MOVE TO SUSPEND THE RULES

AND ACT THIS EVENING >> SECOND.

>> ALL RIGHT. IS THERE ANY DISCUSSION ABOUT SUSPENDING THE RULES IN ORDER TO VOTE ON THIS THIS EVENING? PLEASE VOTE.

THIS IS UNDER NEW BUSINESS FIRST RARING OF ORDINANCE D 2689-23.

ORDINANCE OF THE COMMON COUNSEL AMENDING ORDINANCE NUMBER D.

IS THERE A MOTION TO INTRODUCE?

>> SO MOVED. >> ALL RIGHT.

SECOND. PLEASE.

OKAY. SO WE'VE GOT TO INTRODEUCE.

READ THIS -- >> THIS ORDINANCE AMENDS THE PRIOR ORDINANCE 2486-19 TO AUTHORIZE A MAXIMUM INTEREST RATE OF 6% RATHER THAN THE ORIGINAL 5% FOR BOND ANTICIPATION NOTES OF THE WATER WORKS

>> ALL RIGHT. MR. DUFFY, DID SOMEONE PRESENT -- ARE YOU PRESENTING? YES.

>> CAN YOU GO AHEAD AND SWITCH THE SCREENS BACK TO VOTING, PLEASE?

>> GO AHEAD AND SWITCH THOSE BACK, PLEASE, THANK YOU.

GO AHEAD. >> THANK YOU.

>> IN NOVEMBER OF 2019, THE WATER UTILITY ISSUED A BOND ANTICIPATION NOTE. THE WATER UTILITY HAS A NEED TO EXTEND THE PAYMENT TERMS OF THAT HAVE TO MAY OF NEXT YEAR.

THE ORIGINAL RATE, THE ORIGINAL ORDINANCE CAPPED THE INTEREST RATE AT 5%. BUT BY EXTENDING THE TERMS TO MAY OF NEXT YEAR THE INTEREST RATES HAVE GONE UP SO THE RATE WITH THE BANK NOW IS AT 5.63%. SO THE BOND ATTORNEY'S ADVICE WE

[01:10:01]

NEED TO AMEND THE ORDINANCE TO REFLECT THE HIGHER INTEREST RATE.

>> OKAY. ANY QUESTIONS?

>> MOVE TO INTRODUCE. >> OKAY. GO AHEAD.

>> THIS ORDINANCE AMENDS THE 2024 EXECUTIVE BRANCH SALARY ORDINANCE BY ADDING A NEW POSITION WITHIN THE CARMEL POLICE DEPARTMENT AND ADDING ON CALL COMPENSATION FOR CERTAIN EMPLOYEES OF THE DEPARTMENT OF COMMUNITY SERVICES OFFICE AND BUILDING SAFETY AND CODE ENFORCEMENT.

FOR POLICE, TALKING TO THE CHIEF, THEY BUDGETED FOR THIS.

THEY FORGOT TO CREATE THE POSITION.

IT'S BASICALLY TO CLEAN THE NEW BUILDING.

>> OKAY. SO THAT'S WHERE WE HAVE THERE.

AND THEN THE OTHER PART FOR -- IT'S A $10 IF YOU'RE ON CALL.

FOR THE INSPECTORS AND THEY GET JUST THE OTHER NIGHT THEY GOT JUST SATURDAY OR SUNDAY THEY GOT CALL CANNED OUT FOR A CAR HITTING A HOUSE OR HITTING A BUILDING.

BASICALLY, YOU GET $10. IF YOU GET CALLED IN, YOU GET PAID WHAT YOU GET PAID FOR OVERTIME.

BUT IT'S PUTTING IN PLACE A $10 ON CALL.

>> OKAY. >> ALL RIGHT.

ARE THERE ANY QUESTIONS REGARDING THAT ISSUE?

SO IS THERE ANY DISCUSSION? REGARDING A TRANSFER OF REAL PROPERTY. MOVE TO INTRODUCE.

>> SOMEBODY ELSE SHOULD ALSO DO THAT.

>> SO MOVED. OKAY. THANK YOU.

>> THANK YOU. ESSENTIALLY, THE REDEVELOPMENT DEPARTMENT OWNS SOME OF THE LAND IN THIS AREA BUT NOT ALL THE LAND. SOME OF THE OTHER LAND IS OWNED BY THE CITY OF CARMEL WHERE THE CURRENT I.T. BUILDING IS.

[01:15:04]

IT'S LIKE A BUNCKEER FROM THE 60S WHERE THEY HANG OUT.

I.T. HAS MOVED INTO THE TOWNSHIP BUILDING.

THIS IS LOOKING TO -- THIS RESOLUTION IS LOOKING TO TRANSFER THAT LAND TO THE REDEVELOPMENT COMMISSION FOR PUTTING TOGETHER A PROJECT AND BRING THAT TO CITY COUNCIL FOR APPROVAL. WE KNOW THERE'S STILL FIBER OR THE BE CONNECTED SOD WE DON'T EXPECT ANYTHING TO HAPPEN ON THIS SITE THIS YEAR OR FOR A WHILE NEXT YEAR.

AT SOME POINT CRC WILL DEMO AND PREPARE THAT LAND FOR SOMETHING ELSE IN WHICH CASE ANYTHING THAT WOULD COME HERE WOULD BE FIRST BROUGHT IN FRONT OF CITY COUNCIL FOR APPROVAL.

SEEING NO QUESTIONS, WOULD SOMEONE LIKE TO MAKE A MOTION?

>> MOVE TO APPROVE. >> IS THERE A SECOND?

>> SECOND. >> ALL RIGHT.

ANY DISCUSSION?

>> ALL IN FAVOR PLEASE SAY AYE. >> OR EXCUSE ME, VOTE.

>> ALL RIGHT. THAT CARRIES.

ALL RIGHT. THAT IS DONE.

THIS NOW MOVES ON TO FIRST READING OF D 2688-23.

AUTHORIZING THE ISSUANCE OF ECONOMIC DEVELOPMENT TAX INCREMENT REV NEW BONDS TO SUPPORT THE GRAMERCY PROJECT AND AUTHORIZING AND APPROVING OTHER ACTIONS IN SUSPECT THERETO.

SPONSOR COUNCILLOR WORRELL. >> ORDINANCE AUTHORIZES THE ISSUANCE OF DEVELOPER TIF BONDS BY THE CITY TO FINANCE IMPROVEMENTS TO SUPPORT THE DEVELOPMENT OF THE GRAMERCY PROP

APOLOGETIC. >> THEY'RE BOTH DEVELOPER BONDS SO I WANTED TO SPEND ONE SECOND TO TALK ABOUT WHAT ARE DEVELOPER BONDS. ESSENTIALLY DEVELOPER BONDS ARE BONDS THAT ARE PURCHASED BY THE DEVELOPER MONETIZED BY THE DEVELOPER, BUT IF THE PROAPOLOGETIC DOES NOT PRODUCE TIF THEN THE DEVELOPERS ON THE HOOK BUT THE CITY IS NOT ON THE HOOK. SO ALL RISK HERE IS ON THE DEVELOPER EVEN THOUGH THIS WILL SHOW UP AS CITY DEBT ON THE DEPARTMENT OF LOCAL GOVERNMENT FINANCE, AND SOME PEOPLE LIKE GOING TO THAT WEBSITE AND LOOKING AT THAT NUMBER AND SHOUTING IT FROM THE THE ROOF TOPS, THIS IS NOT DEBT THAT THE CITY HAS ANY OBLIGATE TCPI FOR. WE'RE MERELY ACTING AS THE ISSUER BUT HAVE NO OBLIGATION FOR THESE BONDS.

THESE ARE RISK FREE TO THE TAXPAYERS RISK FREE TO THE CITY.

THE ONLY RISK HERE IS ON THE DEVELOPER.

>> AND THIS IS A TOPIC THAT HAS BEEN COVERED WIDELY IN THE CITY INCLUDING BY THE INDIANAPOLIS STAR AND THE CARMEL CURRENT FEATURING THIS COVER FROM A FEW YEARS AGO THAT SAYS NOT AT TAXPAYER RISK SO THESE NEXT TWO PROJECTS ARE IN NO WAY A TAXPAYER OR CITY RISK. I WOULD LIKE TO CALL UP THE VICE PRESIDENT OF BUCKING HAM COMPANIES TO HELP ME INTRODUCE THIS MONTH APOLOGETIC.

-- INTRODUCE THIS PROJECT. >> THANK YOU.

GOOD EVENING, COUNCIL. SENIOR VICE PRESIDENT OF GOT WITH BUCKLEHAM COMPANIES. QUICK OVERVIEW.

WE ARE AN INDIANAPOLIS-BASED REAL ESTATE INVESTMENT COMPANY.

WE'RE COMING UP ON 49 YEARS OLD. IF YOU'LL NOTE ON THE STATS ON THE LEFT OF THAT SLIDE, OVER 50% OF OUR PROJECTS HAVE BEEN OWNED FOR OVER 15 YEARS SO WE EVALUATE EVERY PROJECT FOR MORE OF A LEGACY HOLD RATHER THAN A MERCHANT BUILD KIND OF TURN AND BURN ATTITUDE. ONE THING TO POINT OUT ABOUT BUCKING HAM IS WE ARE VERTICALLY INTEGRATED MEANING I HAVE ACCESS NOT ONLY TO IN HOUSE DESIGN AND DEVELOPMENT BUT ALSO FINANCING CONSTRUCTION ASSET MANAGEMENT AND PROPERTY MANAGEMENT SO THAT ENABLES ME TO BUILD A TEAM AROUND EVERY PLOW APOLOGETIC AND SPECIFIC OF THE GRAMERCY AND MARKETPLACE WE'RE GOING TO TALK ABOUT THAT IS QUITE LARGE AND A LONG DURATION.

SO SUBJECT TO ANY QUESTIONS I'LL --

>> SO ERIC IS GOING TO INTRODUCE A PROJECT THAT IS ESSENTIALLY A TEN YEAR PROJECT SO THIS DOESN'T COME ALL AT ONCE.

IT COMES OVER STAGES. PHASES IF YOU WILL.

AND SOME OF THESE UNITS WON'T BE COMING IN LINE UNTIL 2031 OR LATER POTENTIALLY. SO LET'S THINK ABOUT THIS AS A TEN-YEAR HORIZON. THIS PROJECT CONTAINS A

[01:24:33]

SIGNIFICANT ART COMPONENT WITH A SOLAR COMPONENT ON THE MARKETPLACE SECTION OF IT. THE AREA D CONDOS WILL ALSO HAVE -- THAT POT TOM RIGHT PICTURE.

THAT WILL ALSO HAVE A PROFIT SHARE.

WITH THE CITY. SO WHEN THE DEVELOPER DOES WELL THE CITY WILL BENEFIT. AND ADDITIONALLY, THEY WILL BE USED FOR TWO SOURCES. THE FIRST IS A PUBLIC MID TOWN

[01:25:02]

LIKE PUBLIC PLAZA PART OF IF MARKETPLACE DEVELOPMENT WITH A CITY TV AND THE SECOND IS GOING TO BE THE GREEN SPACE WHERE THE CONDOS IN THE MIDDLE OF THE NEIGHBORHOOD WILL BE.

I LOOK FORWARD TO WORK, THE DIRECTOR IN ENSURING THOSE URBAN PARK SPACES ARE THE BEST THAT THEY CAN BE.

THIS IS I THINK VERY THOUGHT OUT PRODUCT THAT IS NOT ALL DENSE AND HAS CHARACTERISTICS OF SPUR BAN AND CHARACTERISTICS OF URBAN AND CREATES NEW PUBLIC SPACES AND NEW URBAN NOTES FOR US AND CONNECTS CREATES CONNECTIVITY WITHIN THE CITY.

>> AND MY FAVORITE THINGS IS NUMBERS.

SO OVERALL, THIS PROJECT INCREASES THE ASSESSED VALUE PER ACRE FROM $270,000 AN ACRE FOR THERE PROJECT TO $6.5 MILLION AN ACRE RESULTING IN A NET WIND FALL TO THE SCHOOLS AND AS NEW FOR SALE TO THE MARKET. AND ERIC AND I CAN ANSWER ANY

QUESTIONS. >> COULD YOU JUST WERE THERE ANY APICK-AND-ROLLS TO WHAT HAPPENEDS TO ALL THIS AND THAT AND HOW IS THIS NOW BEING -- WHAT ALL OF A SUDDEN HAPPENED TO MAKE THIS THING POP UP? NOW? THE EARLIER PROJECT DID NOT MOVE FORWARD.

THE NEIGHBORHOOD, I THINK THE WEEKLY HOMES THEY GOT BUILT OUT ALONG KINSER AND SO THIS PROJECT I THINK IS THE BEST THAT COULD BE PUT TOGETHER WITH THE SITE AS IT IS NOW.

THIS IS NOT C ZONING OR AT LEAST THE NORTHERN PART OF IT IS NOT.

IN FUTURE WE BELIEVE WILL BRING A C ZONING REQUEST FOR THE MARKETPLACE PORTION BUT THE REST SIN SIDE AN EXISTING PUD AND I BELIEVE THIS PROJECT AS DESIGNED CONFORMS TO WHAT THE PD ALLOWS TODAY AND I CAN DOUBLE CHECK THAT.

>> THE ORIGINAL PUD? >> AS IT IS IN PLACE TODAY.

>> OKAY. ALL RIGHT. YEAH.

>> WHO'S NODDING YES. MIKE?

>> OKAY. GOT YOU. ALL RIGHT.

AND OKAY SO WE'LL GO AHEAD AND OPEN IT UP TO ANY QUESTIONS.

>> I DO HAVE ONE MORE THING. COULD YOU GO THROUGH THE STEPS SO THIS IS IN ORDER TO DO THE BONDS IS THIS STEP THAT WE'RE DOING NOW BUT WHAT WILL YOU BE BACK JUST GIVE EVERYBODY A

SYNOPSIS OF HOW THIS ALL WORKS. >> IF ANYONE IS WATCHING FOR THE FIRST TIME THESE PROSTACKEDS ARE INCREDIBLY HEAVY LIFTS FOR DEVELOPERS TO INVEST A LOT OF HEAVY MONEY INTO SO THE FIRST THING THAT USUALLY OCCURS' PROJECTS LIKE THIS WHETHER IN CARMEL OR ANYWHERE ELSE IS THE BOND ASK OCCURS IN FRONT OF CITY COUNCIL AND IF CITY COUNCIL BELIEVES THIS IS A PROJECT SHARAD MOVE FORWARD PASSES THE BONDS THAT ALLOWS THE DEVELOPER TO ESSENTIALLY BEGIN IN ANNERNEST ON FULL DESIGN AND SO WE THEN HAVE TO GO THROUGH ALL THE OTHER PROCESSES ALL THE OTHER COMMITTEES THAT EXIST. SO FOR ARCHITECTURE AND DESIGN AGAIN IT'S SUBJECT TO THE PUD INSIDE THE PLANNING COMMISSION AND ALSO GOES THROUGH DESIGN INSIDE THE ARCHITECTURE REVIEW COMMITTEE. WE'LL HAVE TO COME BACK LATER AND FORM ALLOCATION AREAS BRING THAT PACK THROUGH COUNCIL SO THAT THEY ARE FORMED IN A STRATEGIC FASHION AND ESSENTIALLY FULL DESIGN APPROVAL STILL NEEDS TO OCCUR BUT THIS WILL GET THE GOPPER ROLLING ON GETTING THIS GOING.

>> OKAY. COUNCILLOR. >> THANK YOU.

I ASSUME THIS IS GOING TO GO TO COMMITTEE.

I'M GOING TO MAKE THE RECOMMENDATION TONIGHT THOUGH THAT WITH THIS ITEM IS CONSIDERED FWI NEXT COUNCIL.

AFTER 23 JUST BECAUSE THIS IS GOING TO AFFECT A TEN-YEAR PROJECT AND I THINK THAT WARRANTS THE NEXT COUNCIL TO BE THE ONE ON THE REALLY HEAR THIS IN COMMITTEE CONSIDERING THAT THIS WILL BE GOING ON FOR YEARS AND YEARS AND WHEN WE WERE OUT TALKING TO VOTERS, THE NUMBER 4 LENT UNITS WAS A BIG TOPIC AND IF YOU COMBINE THIS WITH THE NEXT ITEM ON THE AGENDA WHICH I WOULD ALSO LIKE TO SEE THE NEXT COUNCIL TO BE THE ONE TO CONSIDER YOU HAVE OVER AREN'TAL UNITS BEING ADDED TO THE CITY. A COUPLE OF QUESTIONS THOUGH THAT WE WOULD MAYBE LIKE TO TALK ABOUT IN COMMITTEE AND I KNOW

[01:30:02]

WE'LL HAVE TIME. I WANT TO GET INTO THE GARAGES ON THIS PROJECT AND THE NEXT AND HOW MANY SPACES DOES IT FILL THE NEED FOR THE COMMUNITY. HOW MANY FOR THE PUBLIC AND IF PROJECTS. TRAFFIC IMPACT.

I REALLY LIKE TO SEE US LOOK AT THIS IN THE NEXT ITEM ALMOST THE SAME WAY WE LOOK AT PUDS AND REALLY GET INTO A LOT OF THOSE DETAILS ON A CITY COUNCIL LEVEL AT THIS STAGE IN THE PROCESS.

I KNOW WE'RE GOING TO HAVE THE CONVERSATION AND I'VE QUESTIONS TO ON THE TIP SPLITS. I KNOW THAT THESE DEALS ARE MADE BUT WHAT IS THE COVERAGE WE KIND OF NEED FOR THE OVERAWE TIF OF THESE PROJECTS. I KNOW WE'RE GETTING, YOU KNOW, 10% ON THIS. 90/10 SPLIT.

THOSE ARE QUESTIONS WE CAN GET INTO LATER BUT I WOULD LIKE US TO REALLY DELVE INTO THIS AND WOULD LIKE TO SEE THE NEXT COUNCIL TO SINK THEIR TEETH INTO THIS PROJECT.

>> SO COUNCILLOR, ARE ARE YOU MAKING A MOTION TO TABLE IT?

>> IF IT'S SENT TO COMMITTEE CAN IT STAY IN COMMITTEE THROUGH THE NEXT COUNCIL? THAT'S MY QUESTION.

IF YOU WANT IT TO THE GO TO NEXT COUNCIL I WOULD SAY YOU TABLE IT AND THEY CAN DECIDE WHAT TO DO WIT THEN.

OTHERWISE, THE COMMITTEE WE CAN DO WHATEVER YOU WANT BUT THEY CANNOT DEAL WITH IT UNTIL AFTER JANUARY.

>> THEN I WOULD MAKE A MOTION THAT WE TABLE IT AT THIS TIME.

>> ALL RIGHT. IS THERE A SECOND? CHEESE .

>> SECOND.

>> ALL THOSE IN FAVOR OF TABLING THIS, WILL YOU PLEASE VOTE.

ANY DISCUSSION? >> I DON'T SEE THE VALUE IN TABLING THIS. I FEEL THE DISCUSSION SHOULD CONTINUE AND IF WE GET TO A POINT TO VOTE ON IT WE SHOULD.

BUT THESE THINGS COME TO US TO VOTE ON.

I THINK WE SHOULD AT LEAST START THE PROCESS.

IF IT DOESN'T GET APPROVED IT CAN CARRY OVER TO NEXT YEAR.

THESE ARE PROJECTS THAT HAVE BEEN DISCUSSED FOR YEARS.

>> IF IT DOESN'T GET DONE IT DOESN'T GET DONE.

>> YEAH. I AGREE WITH YOU.

SO WE HAVE A MOTION AND A SECOND.

SO WE'LL HAVE TO VOTE ON THAT. >> YEAH.

>> SO IS THERE ANY DISCUSSION ABOUT TABLING THIS?

>> ALL RIGHT. PLEASE VOTE.

>> ALL RIGHT. LET'S SEE HERE.

I'VE NOT HAD TO DO THIS FOR A WHILE.

I GOT -- THE MOTION CARRIES TO TABLE IT.

SO ALL RIGHT. SO IT IS TABLED.

>> MR. PRESIDENT. >> WE'RE TABLING THE IT UNTIL NO

DATE. >> NO DATE.

UNLESS THE COUNCILLOR WANTS TO CLARIFY THAT MEANS NO SOONER THAN JANUARY 4TH.

WE'LL MAKE A MOTION LATER ON TO UNTABLE IT RIGHT.

IS THAT RIGHT? >> LIFT IT OFF THE TABLE SO WE'LL JUST TABLE IT AND THEN IN THE NEXT COUNCIL WE CAN MAKE A MOTION TO UNTABLE IT AND MOVE IT INTO COMMITTEE.

>> YEAH. >> MR. PRESIDENT.

>> YES. >> WHAT IS THE DATE THAT THIS WOULD GO INTO EFFECT? THIS DIDN'T COME FROM PLANNING COMMISSION SO IT DOESN'T HAVE ANY TIMELINE ON IT.

>> WE DON'T VICE PRESIDENT A TIME --

>> THE NEW -- YOU'RE GOING TO MAKE THE NEW COUNCIL CUT THEIR

TEETH. >> YEAH.

>> AND YOUR PROJECT. >> OKAY. ALL RIGHT.

SO IT'S TABLED. I'M MOVING ON TO FIRST READING OF D 2690. ORDINANCE OF THE COMMON COUNCIL OF CARMEL, INDIANA AUTHORIZING THE ISSUANCE OF ECONOMIC DEVELOPMENT TAX INCREMENT REVENUE BONDS.

>> COULD YOU INTRODUCE THAT, PLEASE?

>> MOVE TO INTRODUCE. >> ORDINANCE AUTHORIZES THE ISSUANCE OF DEVELOPER TIF BONDS BY THE CITY OF CARMEL, INDIANA TO FINANCE IMPROVEMENTS TO SUPPORT THE DEVELOPMENT OF THE

VALENTIN ASSIST PROJECT. >> HERE YOU GO.

>> I WOULD LIKE TO ACT -- ASK THE KEYSTONE CFO TO COME JOIN ME AND SPEAK FOR A SECOND ABOUT KEYSTONE BEFORE WE DISCUSS THE PROJECT.

>> TO GIVE A BETTER BACKGROUND FOR THOSE OF YOU NOT FAMILIAR WITH KEYSTONE, WE'RE AN INDIANAPOLIS-BASED DEVELOPMENT AND REAL ESTATE COMPANY. WE HAVE -- AND A PROPERTY MANAGEMENT ARM. WE'VE DONE A NUMBER OF PROJECTS YOU MAY BE FAMILIAR WITH IN CARMEL NOTABLY THE SOPHIA AND OLIVIA PROJECT. SOPHIA BEING THE FIRST LUXURY MIXED USE PROJECT IN CARMEL WITH 214 APARTMENTS 33,000 SQUARE

[01:35:05]

FEET OF RETAIL. AND PARKING GARAGE.

YOU HAVE OLIVIA WITH 203 APARTMENTS AND ALSO MIXED USE WITH 19,000 SQUARE FEET OF RETAIL.

WE'VE DONE SOME OTHER SIGNIFICANT PROJECTS IN CARMEL WITH THREE MASS PROJECTS WHICH IS ANOTHER MIXED USE PROJECT WITH RETAIL OVER DEVELOPMENT AND THEN WE RECENTLY CONVERTED A 21-STORY HIGH-RISE DOWNTOWN INDIANAPOLIS SOME OF OUR NEW PROJECTS WE HAVE GOING ON ARE ALSO SOME MIXED USE PROPERTIES WITH THE -- SIMILAR TO SOPHIA. THEY HAVE A GATEWAY TO THE PARK AREA WE ARE DOING A PROJECT THERE.

WE KNOW GENERALLY THERE'S AMPLE PARKING BUT IF YOU GO TO MARKET ON SATURDAY, YOU MIGHT HAVE HAD SPENT SOME TIME LOOKING FOR A PARKING SPOT. EASTBOUND THOUGH WE HAVE THE VETERANS WAY GARAGE AND THE NEWLY BUILT SQUARE GARAGE WHEN THE GREEN IS INCREDIBLY BUSY, IT DOES MORE PARKING WOULD BE HELPFUL. AND SO THE FACT THAT THIS IS BRINGING US 600 SPACE PARKING GARAGE BASICALLY IMMEDIATELY SOUTH OF THE TARTANTAN BASICALLY BRINGS A FOURTH DISTRICT GARAGE HERE THAT I THINK WILL BE A SIGNIFICANT HELP TO THE CITY ESPECIALLY WHEN, YOU KNOW, WHAT'S THAT SAYING THAT IT WAS -- THERE'S TOO MANY PEOPLE OR IT'S TOO BUSY OR TOO MANY PEOPLE ARE OUT ENJOYING CITY CENTER AT ANY GIVEN POINT.

I THINK SOMETIMES WE HAVE THAT WHERE EVERYBODY WANTS TO BE THERE AND SO WE HAVE -- IT IS NICE IN THE CITY LIKE CARMEL WHERE THE DEVELOPERS CAN BUILD THE PROJECTS THAT THEN SUPPORT THE PARKING FOR OTHER USES AS WILL BE THE CASE HERE.

SO MR. -- T -- IN THIS IMAGE, ON TOP RIGHT, THIS IS SUPPOSED TO BE IN -- THIS WILL BE DESIGNED BUT THIS IS SUPPOSED TO BE AN EXPANDED LINEAR PARK THAT EXPANDS THE -- DOWN SOUTH TO -- I EXPECT THAT TO BE A PARTNERSHIP BETWEEN JEREMY CASHMAN, REDEVELOPMENT COMMISSION, AND MICHAEL IN THE DESIGN OF THAT LINEAR PARK AND EXPANDED MONAN.

AND FINALLY THIS PROJECT WILL DEDICATE LAND IN BOTH THE EAST ANTICIPATE WEST SIDES TO ASSIST THIRD AVENUE INTO ASSIST THE EXPANSION.

AND MY FAVORITE NUMBERS THE ASSESSED VALUE PER ACRE ON THIS SITE JUMPS FROM $400,000 ACRE TO $157,000 AN ACRE.

THAT'S A SIGNIFICANT INCREASE. IT PAYS ABOUT 45 GRAND OF TAXES CURRENTLY. IT WILL END UP PAYING $1.4 MILLION OF TAXES EVERY YEAR SO SCHOOL TAXES SCHOOL WILL GET THE BENEFIT OUR SCHOOLS GET THE BENEFIT OF $190,000 A YEAR OF NEW FUNDS FLOWING TO THEM WHEN THIS PROJECT IS BUILT.

I KNOW THAT TODAY THERE ARE TENANTS IN THOSE SPACES AND SO

[01:40:01]

IT WILL PROBABLY BE A YEAR OR TWO BEFORE ANYTHING ANY SIGNIFICANT DEVELOPMENT OCCURS HERE.

AND THERE'S LOTS OF DESIGNS STILL TO BE HAD ON THIS PROJECT.

>> WE'RE HAPPY TO ANSWER ANY QUESTIONS.

>> ALL RIGHT. THANK YOU.

>> OUT OF THE 600 SPACE GARAGE, HOW MANY ARE NEEDED FOR THE USE

OF THE PROJECT? >> I'M GOING START PLAYING MUSIC

HERE IN A SECOND. >> JUST DOING MY CALCULATOR.

>> I JUST DID THE 380 UNITS TIMES 1.2 PARKING RATIO.

THAT'S ABOUT 450 SPACES. OBVIOUSLY ONE OF THE BENEFITS HERE IS THAT THERE'S A LOT OF FLEXING GOING ON BETWEEN THE 50,000 SQUARE FEET OF OFFICE RETAIL AND THE MULTIFAMILY AND WE DON'T KNOW TODAY THE OFFICE MIX.

OFFICE SLASH RETAIL MIX SO IF IT'S MORE OFFICE THERE WILL BE MORE SPACES AT NIGHT. IF IT'S MORE RESTAURANT THAT'S MAYBE OPEN FOR DINNER IT WILL BE TIGHTER BUT THIS IS EXPECTED TO PROVIDE SOME EXCESS PARKING IN THE EVENING ESPECIALLY FOR --

>> AND THE TIF SPLIT ON THIS YOU DON'T HAVE IT.

>> I'M SORRY IT'S NOT LISTED. THIS IS A 95/5 SPLIT.

>> THANK YOU. >> COUNCILLOR CAMPBELL.

>> BEAVER TALKED IN THE PAST AND HAD DISCUSSIONS ABOUT THE TECHNOLOGY, APPS FOR PARTIALINGING GARAGES.

REDEVELOPMENT COMMISSION AND THE STREET DEPARTMENT ARE WORKING TO BRING THE SAME LIGHTS THAT COUNT SPACES IN THE GARAGE.

AND WE ACTUALLY OPENED SOME BIDS FOR THAT LAST WEEK.

IT'S A LITTLE MORE DIFFICULT WITH DEVELOPER PROJECTS BECAUSE YOU NEED TO TRACK EVERY PARKING SPOT AND THAT'S SIGNIFICANT.

WHEN THERE ARE RESERVE SPACES AND NOT RESERVE SPACES, YOU CAN'T JUST PUT A COUNTER AT THE ENTRANCE OF THE GARAGE AND COUNT THE CARS COMING IN BECAUSE YOU HAVE NO IDEA IF THEY'RE GOING TO PARK IN A RESERVE SPACE OR NOT SO YOU NEED THE INFRASTRUCTURE TO COUNT EVERY SINGLE SPACE AND LOOK AT EVERY SPACE.

THAT'S A SIGNIFICANT COST. THE ABILITY TO DO THAT IF THE CITY WANTS TO CONTRIBUTE TOWARDS THAT FUNDING LATER AND I THINK THAT'S JUST SOMETHING THAT NEXT MAYOR GETS TO LACK AT.

IT IS A SIGNIFICANT COST THAT WE HAVE NOT ASKED THE DEVELOPERS TO BEAR SO FAR.

I'VE HEARD A LOT OF FRUSTRATION. IF YOU'RE NOT FROM AROUND HERE OR EVEN IF YOU ARE, WE NEED TO MAKE IT AS EASY AS POSSIBLE FOR PEOPLE TO FIND PARKING BECAUSE YOU CAN HAVE ALL THE GARAGES YOU WANT BUT IF THEY DON'T KNOW WHERE TO PARK AND CAN'T FIND THE SPACES IT'S USELESS.

>>. >> MAY I HAVE A SECOND BITE OF

THE APPLE? >> FOR THE FUTURE AND I ASKED HER THIS ON FIRST ON MAIN, IF WE'RE GOING TO RESERVE SPACES IN THE GARAGES THAT GET BUILT THAT WE GIVE TIF MONEY FOR I WOULD LIKE TO SEE THOSE RESERVE SPACES MOVED UP.

INSTEAD OF THE ENTIRE LOWER LEVEL.

LET'S GIVE THE PEOPLE THAT ARE GOING IN AND OUT I MEAN THERE'S NO REASON IF YOU'RE GOING TO BE THERE ALL DAY, IT JUST MAKES SENSE.

>> IT'S BETTER FOR YOUR PROJECT TOO.

[01:45:02]

>> YEAH. >> OKAY. COUNCILLOR GREEN.

>> YEAH. JUST TO CLARIFY.

THE 380 MULTIFAMILY UNIT SETS APARTMENTS.

>> AND THEN WHAT KIND OF BUFFER IS THERE WITH THE TRAIL? IS THERE ANY BUFFER OR WHAT KIND OF --

>> THE MONAN TRAIL THERE THERE WOULD BE A PORTION OF THE PROJECT THAT WOULD DEDICATE LAND TO EASTBOUNDS PANNED THE TRAIL THERE AND WE WOULD DESIGN AND PROGRAM THAT TRAIL TO ESSENTIALLY FIT WHAT WE'VE BEEN DOING EVERYWHERE ELSE AND THAT DESIGN HAS NOT STARTED. AND I EXPECT THE DIRECTOR AND ENGINEERING SITTING IS ENGINEER CASHMAN TO BE HEAVILY INVOLVED

IN THAT PROCESS. >> I DID WANT TO COUNSELOR AASAN ASKED EARLIER ABOUT THE VEGETATION ON THE DITCH AND I'VE DISCUSSED IT WITH THE URBAN FORESTER AND HE DEFINED THIS AREA AS NOT A HIGH VALUE FORCE IF YOU WILL.

AND THAT IS THE VEGETATION THAT WE HAVE NOW SO I THINK IF YOU WALK ALONG THE NORTHERN SECTIONS OF THE MONAN EVEN THE LAST FEW YEARS YOU HAVE SEEN HOW THE TREES THAT WE PUT IN THE SILVACELLS HAVE GROWN ALREADY JUST IN THE LAST FEW YEARS SO IT MAKES SENSE THAT WE HAVE A THOUGHT OUT PURPOSEFUL APPROACH ON HOW WE DEAL WITH TREES AND ADD TREES IN THIS AREA.

AND JUST BECAUSE SOME OF THOSE NOT THE GREATEST TREES IN THE WORLD THERE NOW DOESN'T MEAN WE NEED TO JUST KEEP IT ALL.

WE NEED TO BE THOUGHTFUL WITH HOW WE PLAN NEW TREES IN THIS

AREA. >> COUNCIL GREEN.

>> ALSO. CAN YOU TALK TO ME ABOUT THE GREEN SPACE? YOU KNOW.

SEE SOME GREEN SPACE IN THERE BUT WHAT KIND OF GREEN SPACE

WOULD BE PROVIDED? >> YEAH.

I MEAN, GENERALLY, THE EXPANSION OF THE MONAN ALONG THIS PART GREEN SPACE WITHIN THIS PROJECT IN THE MIDDLE OF IT VALENTINA PLAZA IS WHAT WE'LL CALL IT. BUT REALLY IT'S THAT AND THE MONAN. ONE BENEFIT OF THIS PROJECT IS THE GAZEBO IS SUPER CLOSE. THE GREEN IS CLOSE.

THE JAPANESE GARDEN ISN'T TOO FAR AWAY.

OBVIOUSLY CARTER GREEN IS ON THE OTHER SIDE OF THE BUILDING NORTH OF THIS. AND OBVIOUSLY THE COURTYARD IS SUPER CLOSE SO I WOULD SAY FROM AN URBAN PLANNING STANDPOINT THIS BUILDING SERVES MORE AS CREATE SOME BORDERS AND HELP THE DEVELOPMENT GO TOWARDS THIRD STRAIGHT SO IT DOESN'T NEED TO PROVIDE THE SAME AMOUNT OF GREEN SPACE AS -- IT'S SURROUNDED BY

GREEN SPACES. >> I APPRECIATE THE OPINION BUT A LOT OF CONSTITUENTS DON'T SEE IT THAT WAY.

I'M GOING TO SEND THIS TO COMMITTEE.

COUNCILLOR CAMPBELL DO YOU WANT TO TAKE THIS UNDER LAND USE EVEN THOUGH IT'S FOR THE BOND IT'S ALMOST LIKE HOW IS THE THIS SITE GOING TO LOOK AND BE USED. WELL, IS THERE A MOTION?

>> BEFORE WE HAVE MAKE A MOTION I WANTED TO MAYBE GAUGE.

TY KNOW THIS IS A SMALLER PROJECT THAN THE PREVIOUS ONE SO IF THIS COUNCIL WANTED TO TAKE IT UP I UNDERSTAND BUT I DON'T KNOW IF OTHERS FEEL WE SHOULD TABLE THIS AS WELL.

IT FALLS UNDER THE SAME KIND OF OVERARCHING THEME OF ANOTHER 380 RENTAL UNITS ALONG WITH THAT KIND OF CONSIDERING THAT ALL TOGETHER.

>> I'M GOING TO MAKE THE MOTION THAT WE TABLE THIS ITEM.

>> SECOND. >> ALL RIGHT.

>> OKAY. ANY DISCUSSION? >> OKAY. HEARING NO FURTHER QUESTIONS, WILL YOU PLEASE VOTE.

>> IT IS TABLED. OKAY. THAT MOTION.

CARRIED. ALL RIGHT.

WE WILL NOW MOVE ON TO SO SOCIAL SECURITY NOT GOING TO COMMITTEE.

I WANT TO THE BE CLEAR WITH THAT AND IT IS TABLED.

RESOLUTION C C11202301 >> MOVE TO INTRODUCE.

[01:50:11]

>> SECOND. >> OKAY. RESOLUTION APPROVES A RESOLUTION OF THE CARMEL REDEVELOPMENT DEVELOPMENT -- FOR THE PROSCENIUMII ALLOCATION AREA AND A RELATED CARMEL PLANNING

COMMISSION RESOLUTION. >> THANK YOU.

ALL RIGHT. DIRECTOR.

THE NEXT FEW ITEMS ARE ALLOCATION AREAS.

IF I COULD JUST TAKE A SECOND TO DISCUSS WHAT ALLOCATION AREAS ARE. SOMETIMES TIF BOND VOTES ARE BROUGHT IN FRONT OF COUNCIL AND SOMETIMES ALLOCATION AREAS ARE BROUGHT IN FRONT OF COUNCIL AND TIF BOND VOTES ARE MUCH MORE USUALLY THE FIRST TIME THE COUNCIL IS LOOKING AT A PROJECT THOSE ARE THE BIG KIND OF POLITICAL QUESTIONS DO YOU WANT THIS PROJECT OR NOT. THOSE ALWAYS GET SENT TO FINANCE COMMITTEE. OR TABLED AND THEN GET SENT TO FINANCE COMMITTEE. ALLOCATION AREAS ARE DIFFERENT.

THEY'RE MORE ADMINISTRATIVE IN NATURE.

OFTENTIMES ALLOCATION AREAS ARE BROUGHT WHEN IT MAKES SENSE STRATEGICALLY TO BRING THEM WHEN IT COULD BE YEARS AFTER BONDS ARE APPROVED AND SO I JUST ALLOCATION AREAS ARE OFTEN NOT SENT TO COMMITTEE BUT JUST VOTED ON WHEN FIRST INTRODUCED.

JUST DUE TO THEIR ADMINISTRATIVE NATURE.

SO ANYONE WATCHING FOR THE FIRST TIME, HOPEFULLY THAT GIVES COLOR

TO THESE NEXT FEW ITEMS. >> OKAY. SO THE FIRST ONE THAT COUNCIL LO RIDER JUST MENTION 2 DEGREE CHANGING 126TH STREET.

SO THERE'S TWO THINGS HAPPENING HERE.

FIRST IS ON THE LEFT. THAT IS THE JAPANESE GARDEN.

/POND. THERE'S FOUR PARCELS THERE.

THESE PARCELS USED TO BE KIRBY INDUSTRIAL BUILDINGS IF YOU REMEMBER. AND THEN THEY GOT PUT INTO AN ALLOCATION AREA WITH AN ASSESSED VALUE BECAUSE THEY WERE INDUSTRIAL ASSESSED COMMERCIAL BUILDINGS.

THEN THE CITY BOUGHT THESE PARCELS AND TURNED THEM INTO A JAPANESE GARDEN AND SO THEN THEY LOST THEIR ASSESSED VALUE.

THEIR VALUE TURNED ZERO WHICH IS WHAT HAPPENS WHEN A CITY OWNS A PARCEL MEANING THAT THIS ALLOCATION AREA THIS OVERALL 126 ALLOCATION AREA TOOK A HIT IN THE AMOUNT OF THE VALUE OF THESE FOUR PARCELS THAT OTHER PARCELS IN THIS ALLOCATION AREA HAD TO MAKE UP SO IT'S A HIT TO THE TIF.

IT NEGATIVELY IMPACTED THE TIF. HAVING COMMERCIAL PARCELS IN AN AREA GO TO ZERO VALUE HAS A NEGATIVE IMPACT ON THE TIF.

SO WE GET TO DO ONE OF MY FAVORITE THINGS, PRUNING THE TIF. LIKE A BONSAI TREE.

SO WHAT WE'RE DOING IS TAKING THESE PARCELS OUT OF THE 126TH

STREET AREA AND PRUNING THEM. >> A MORE NE'ERCY EXPLANATION.

WE HAVE BRAD BING BOWEL MOVEMENT THAT CAN REPEAT WHAT I SAID WITH MORE LEGAL WORDS.

[LAUGHTER].

>> ALL RIGHT. ANY QUESTIONS ABOUT PRUNING THE

TIF? >> THAT'S THAT ONE.

THE OTHER ONE THAT'S ALSO PART OF THIS PROSCENIUMII

>> WE HAVE NOT INTRODUCED IT YET.

I'M SO SORRY. >> I THOUGHT COUNCILLOR RIDER

DID. >> THAT'S PART ONE.

PART TWO IS WE ESSENTIALLY CREATED A BASE YEAR IN 2021 FOR

PROSCENIUMII II SINCE THEN >> OKAY.

>> THE VALUE HAD ACTUALLY GONE DOWN SO WITH THE PROJECT TAKING A HIT RESETTING THE VALUE TO THE BASE HERE THIS YEAR IT HELPS THE PROJECT. SO THAT'S ALL WE'RE DOING.

WE'RE CHANGING THE BASE VALUE FROM 21 TO 23 FOR THE PROSCENIUMII II PROJECT SO THOSE ARE TWO COUNTERPOINTS OF THE -- OF THIS SPECIFIC ALLOCATION AREA AMENDMENT.

>> OKAY. ANY QUESTIONS?

>> MR. PRESIDENT. >> COMMENT FIRST.

>> I JUST WANT TO REMEMBER THIS WAS A DEVELOPER-BACKED TIF AND SO WE'RE NOT IN ANY WAY AFFECTING OUR FINANCES.

WE'RE GIVING THE DEVELOPER A BETTER BASE JUST TO GO FROM.

>> ON THE PROSCENIUMII II WE ARE GIVING THE DEVELOPER A BETTER

[01:55:03]

BASE. >> JUST WANTED TO CLARIFY THAT.

IT AFFECTS US IN NO WAY. >> IT DOES NOT AFFECT US.

ON THE PRUNING IT DOES AFFECT US AND DOES BENEFIT US.

>> I WOULD MAKE A MOTION TO APPROVE.

>> IS THERE A SECOND? SECOND.

>> OKAY. ANY FURTHER QUESTIONS OR COMMENTS? ALL RIGHT. PLEASE VOTE.

>> THAT MOTION IS CARRIED. >> MOVING ON NOW TO RESOLUTION C C11202302 RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL WITH THE NORTH ILLINOIS STREET ECONOMIC DEVELOPMENT AREA.

RESOLUTION RESETTING THE BASE ASSESSMENT DATE FOR THE FRANCIS CAN NORTH ALLOCATION AREA WITHIN THE NORTH ILLINOIS STREET ECONOMIC DEVELOPMENT AREA. AND A RELATED CARMEL PLANNING

COMMISSION RESOLUTION. >> GO AHEAD.

>> I'M TRYING TO FIGURE OUT WHAT HAPPENED THERE.

>> WHAT DO YOU MEAN? >> I NEED A PICTURE.

>> THERE WE ARE. OKAY. FRANSISCAN NORTH.

THIS AREA WAS CREATED WHEN HAD THAT NEIGHBORHOOD WAS STILL THERE. THE NEIGHBORHOOD HAS BEEN DEMOLISHED SO IT DROPPED THE VALUE OF THE PROPERTY AND SO WE NEED TO RESET THE BASE OF THIS YEAR WHICH ACTUALLY HAPPENS TO BE LOWER WHEN THIS WAS INITIALLY CREATE SOD THAT IS WHAT IS HAPPENING WITH THAT PARCEL. CARMEL REDEVELOPMENT COMMISSION.

DESIGNATING THE ENTIRETY THEREOF AS A NEW ALLOCATION AREA KNOWN AS THE MICHIGAN ROAD ALLOCATION AREA.

IN ADOPTING AN ECONOMIC DEVELOPMENT PLAN FOR THE MICHIGAN ROAD ECONOMIC DEVELOPMENT AREA AND SO A RELATED CAREL PLAN COMMISSION RESOLUTION.

>> DIRECTOR, PLEASE EXPLAIN THIS ONE.

>> THIS IS THE REI PROJECT THAT WAS APPROVED RECENTLY.

THIS WOULD CREATE AN ALLOCATION AREA.

THERE IS NO BOND REQUEST THAT COMES WITH THIS.

IT'S JUST AN ALLOCATION AREA CREATION.

ANY ASSISTANCE WOULD PROBABLY GO TOWARDS THE STOPLIGHT THAT WILL BE PUT IN THE AS PART OF THIS PROJECT.

AND WHAT'S THE PROJECT? >> I FORGOT THE NAME OF IT.

REI IS DOING IT. >> THIS WAS AT PLANNING COMMISSION AND DIDN'T GO TO COUNCIL.

>> I'M SORRY. >> THIS IS THE GARDEN STYLE

APARTMENTS. >> YES.

THIS IS THE GARDEN STYLE APARTMENTS.

>> YES. >> ALL RIGHT.

OKAY. IS THERE ANY QUESTIONS THE DIRECTOR?

>> IS THERE A MOTION?

>> MOVE TO APPROVE. >> SECOND.

>> ALL RIGHT. ANY DISCUSSION?

>> ALL RIGHT. PLEASE VOTE.

TONY, WE NEED YOUR -- OKAY. ALL RIGHT.

WE HAVE ONE NEGATIVE. ALL RIGHT.

THAT MOTION CARRIES. OKAY. WE WILL NOW MOVE ON TO RESOLUTION C C11202305 RESOLUTION OF THE COMMON COUNCIL OF THE CITY APPROVING MATTERS IN CONNECTION WITH THE 111 PENN REDEVELOPMENT AREA. MOVE TO INTRODUCHENNE.

>> RESOLUTION APPROVES A RESOLUTION OF THE CARMEL REDEVELOPMENT COMMISSION DESIGNATING 12 SEPARATE ALLOCATION AREAS WITHIN THE 111TH AND PENN REDEVELOPMENT AREA AND ADOPTING A SUPPLEMENT TO THE REDEVELOPMENT PLAN FOR THE 111TH AND PENN REDEVELOPMENT AREA AND RELATED CARMEL PLANNING

RESOLUTION. >> ALL RIGHT.

DID WE -- ARE WE ON 04 OR -- I OR J RIGHT NOW?

>> WE SHOULD BE ON AH 4. >> OKAY. SO.

>> I READ 5. >> CREATING NEW ALLOCATION AREA KNOWN AS THE STAR ALLOCATION AREA WITHIN THE OLD -- ECONOMIC

[02:00:07]

DEVELOPMENT PLAN FOR THE OLD -- >> THIS IS THE -- I'M NOT GOOD AT FRENCH PRONUNCIATIONS BUT IT MEANS STAR IN FRENCH BUT THIS IS THE PROJECT ON MAIN STREET THAT I BELIEVE WENT THROUGH PLANNING COMMISSION NOT TOO LONG AGO. SIMILAR TO THE PREVIOUS ONE.

THAT WE JUST TALKED ABOUT. THE COMMISSION IS NEGOTIATING WITH THIS DEVELOPER ON SOME INFRASTRUCTURE IMPROVEMENTS.

THIS WOULD CREATE AN ALLOCATION AREA.

THERE IS NO BOPPED REQUEST THAT COMES WITH THIS PROJECT.

IT'S JUST AN ALLOCATION AREA. AND I'M -- IT'S CALLED STAR BECAUSE THAT THE NAME OF THE GOMENT IN ENGLISH.

-- DEVELOPMENT IN ENGLISH. THIS IS IS AMERICA SO WE WENT

WITH STAR. >> THANK YOU FOR THAT.

>> ALL RIGHT. >> IS THERE ANY DISCUSSION?

>> COMMENTS? >> IS THERE A MOTION?

>> MOVE TO APPROVE. >> SECOND.

>> THANK YOU.

>> ANY DISCUSSION? KEY

. >> ALL RIGHT.

PLEASE VOTE.

>> THAT CARRIES. WE WILL NOW MOVE ON TO

RESOLUTION C C11202 -- >> ALLOCATION AREA SPONSOR IS

COUNCILLOR WORRELL. >> THE RESOLUTION APPROVES A RESOLUTION OF THE CARMEL REDEVELOPMENT COMMISSION 111TH AND PENN REDEVELOPMENT AREA AND ADOPTING SUPPLEMENTAL TO THE REDEVELOPMENT PLAN FOR 111TH AND PENN REDEVELOPMENT AREA AND RELATED CARMEL PLANNING COMMISSION RESOLUTION.

>> GO AHEAD. >> OKAY. PICTURE, PLEASE.

>> OKAY. SO WHAT'S HAPPENING HERE LOOK THIS IS A 20-YEAR PROJECT. IT'S A LARGE PROJECT.

IT'S A 35-ACRE SITE. SO WE STRATEGICALLY DIVIDED ALLOCATION AREAS INTO FEASIBLE INDIVIDUAL PIECES IF YOU WILL OF A PROJECT THAT CAN MOVE FORWARD. SO, FOR EXAMPLE, AS EACH -- THIS CONSCIOUS THESE BUILDINGS ALONG PENNSYLVANIA, FOR EXAMPLE, ARE LARGE OFFICE BUILDINGS. THEY'RE ONLY GOING TO GO ONCE THERE'S A TENANT THAT'S READY TO GO INTO THEM.

THAT'S WHAT'S GOING TO CAUSE THE DEVELOPER TO HAVE THE FINANCING TO BUILD IT SO IT MAKES SENSE THAT WE CREATE ALLOCATION AREAS AS INDIVIDUAL AREAS THAT CAN BENEFIT FROM THE FULL AMOUNT OF THE 25 YEARS EACH INDIVIDUAL OFFICE BUILDING CAN PAY.

WHEN THERE'S AN OFFICE BUILDING THAT USUALLY CAN GET THE NEXT MULTIFAMILY BUILDING AND THE NEXT -- AND THE GARAGE TO GO AT THE SAME TIME BECAUSE THE GARAGE WOULD BE PARKING THE MULTIFAMILY AT NIGHTTIME AND THE OFFICE DURING THE DAY.

SO ESSENTIALLY WE'VE SUBDIVIDED THESE AREAS THIS DEVELOPMENT INTO ALLOCATION AREAS THAT IT MAKES SENSE FOR THEM TO START AT DIFFERENT POINTS AS CONSTRUCTION BEGINS IN DIFFERENT PHASES ON THIS PROJECT. BECAUSE IT'S SUCH A LARGE PROJECT THERE'S 12 AREAS AND THEY ALL MAKE SENSE SO THAT THE DEVELOPMENT CAN CAPTURE AS MUCH TIF TO EFFECTUATE THIS PROJECT AS MUCH AS POSSIBLE. BECAUSE AS WE ALL KNOW AS SOON AS THERE'S A BOND TIED TO AN ALLOCATION AREA, IT BEGINS THE 25-YEAR RUN OF THAT ALLOCATION AREA.

SO YOU DON'T WANT ONE ALLOCATION AREA WHERE ONE BOND IS ISSUED FOR A PROJECT ON ONE CORNER FOR EXAMPLE THAT BEGINS THE 25-YEAR CLOCK FOR THE REST OF THE DEVELOPMENT.

BECAUSE BY THE TIME ANOTHER BUILDING COMES ONLINE TEN YEARS LATER YOU'VE JUST LOST TEN YEARS OF TIF TO BENEFIT THE PROJECT.

SO IT MAKES SENSE TO CREATE SMALLER ALLOCATION AREAS SO WE CAN BE MORE AT THAT TENOLIC IN CAPTURING -- STRATEGIC IN CAPTURING THE TIF. THIS IS NOT TOO DISSIMILAR FROM MIDTOWN, FOR EXAMPLE, WHERE THE DIFFERENT PHASES OF MID-TOWN WERE IN THEIR OWN ALLOCATION AREAS BECAUSE THIS IS A 40 ACRE PROJECT ESSENTIALLY THAT'S WHY WE HAVE 12 AREAS.

CHEESE .

>> IT'S CALLED 111 PENN AND THE MARKERS FIGURED OUT THE NAME FOR THE GOMENT SHOULD BE PENN 111 HENCE THE WEIRD DIFFERENCE BETWEEN ALLOCATION AREA AND THE NAME OF THE PROJECT.

WITH THAT I'M HAPPY TO ANSWER ANY QUESTIONS.

>> ALL RIGHT. ANY QUESTIONS.

>> THE ALLOCATION AREA EVEN THOUGH WE KEY ATE THEM DO NOT START AND WHAT IS THE TRIGGER FOR STARTING THEM SO THEY GET

THE MOST BENEFIT? >> A BOND IS TIED TO A SPECIFIC

AREA. >> THANK YOU.

CHEESE .

>> SO WE'VE BEEN HEARING ABOUT THIS PROJECT FOR A LONG TIME.

[02:05:03]

WHERE ARE WE IN THE PROCESS? >> WHAT ARE THE NEXT STEPS?

>> THEY'RE PARCELLING OUT THE AREAS.

THEY'RE IN DESIGN. I EXPECT THE BEGINNING -- LET ME JUST GO TO A DIFFERENT -- THE SLIDE FOR THIS BECAUSE IT'S PROBABLY EASIER.

>> SO THEY'VE PARCELLED IT OUT. THEY'RE IN DESIGN ON SOME OF THE BUILDINGS. I SUSPECT THAT WHAT'S NEXT IS A FURTHER DESIGN OF THE PLAZA. FOR REFERENCE THIS PLAZA IS ABOUT TWICE THE SIZE OF MIDTOWN. I EXPECT TO WORK WITH THE DIRECTOR AND THE DEVELOPER TO REFINE THE PLAZA.

PROBABLY THE CENTRAL PART WITH THE PLAZA WILL BE THE FIRST PART OF THE DEVELOPMENT. TO CREATE KIND OF THE HEART OF THE DEVELOPMENT. THE DEVELOPER WILL PROBABLY BRING ONE OTHER PHASE IN THE BEGINNING.

THE PHASES THAT ARE CLOSER TO PENN ARE REALLY GOING TO DEPEND ON THE ABILITY TO GET OFFICE TENANTS TO GO INTO THOSE PROJECTS. THAT'S WHAT'S GOING TO DRIVE THAT. AND THEY'RE TALKING TO FOR SALE BUILDERS TO BUILD TOWN HOMES THAT CREATE A BUFFER BETWEEN NEIGHBORHOODS. THIS IS ALL STILL IN ITS VERY EARLY WE EXPECT SITE WORK TO BEGIN PROBABLY MID-NEXT YEAR.

>> OKAY. ALL RIGHT. IS THERE A MOTION? THIS IS FOR THE ALLOCATION AREA. ALL IN FAVOR, PLEASE VOTE.

>> ALL RIGHT. MOTION CARRIES. FOR THE OTHER CONTRACTED SERVICES LINE ITEM WITHIN THE 2023 MOTORCYCLE HIGHWAY FUND STREET DEPARTMENT BUDGET.

HE HAD AN EMERGENCY DENTAL PROCEDURE TODAY AND ASKED ME TO SPEAK ON THIS BE BUT THIS IS JUST A STANDARD END OF THE YEAR TRANSFER HIS DEPARTMENT HAD SOME FUNDS LEFT OVER AND THE PERSONAL SERVICES AND COULD USE THEM IN THE OTHER BUDGET CATEGORIES YOU CAN SEE THERE FOR GIS CONSULTING FEES AND HARDWARE SO AGAIN THIS IS NOT NEW MONEY.

>> THIS FUNDS FROM THE 2023 DEPARTMENT OF COMMUNITY SERVICES BUDGET INTO THE REVERTING CARMEL HISTORIC PRESERVATION FUND 507.

MOVING ON TO FIRST READING OF ORDINANCE D.

THIS IS AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY DESIGNATING THE CARTER HOUSE HISTORIC DISTRICT LOCATED AT 35

AND 39 MAPLE CREST DRIVE. >> MOVE TO INTROSGLUS DESIGNATES HISTORIC DISTRICT CONSISTING OF CAPERTON CARTER HOUSE PROPERTY

AT 35 AND 39 MAPLE CREST DRIVE. >> GOOD EVENING.

I'M THE ADMINISTRATOR FOR THE CARMEL HISTORIC PRESERVATION COMMISSION. THIS ORDINANCE COMES TO YOU WITH A FAVORABLE RECOMMENDATION FROM THE CARMEL HISTORIC PRESERVATION COMMISSION JUST SOME QUICK IMAGES FOR YOU.

THIS IS THE HOUSE ATTORNEY-CLIENT PRIVILEGE BRING IT UP. FULL SCREEN.

>> WE'LL JUST -- THERE YOU GO. >> THERE WE GO.

SO THIS IS THE CAPERTON CARTER HOUSE HERE IN THE COOL CREEK ESTATES NEIGHBORHOOD AT 35-39 MAPLE CREST.

THIS PROPERTY TAKES UP SEVERAL ACRES.

IT WAS ORIGINALLY AN ESTATE PROPERTY KNOWN AS CRICKALWOOD FARMS THAT WAS BUILT BY WOODS CAPERTON SENIOR AND HIS WIFE SUE IN 1932. SO IT WAS ABOUT 85 ACRES AT ONE TIME JUST EAST OF KEYSTONE. SHOW YOU.

IT WAS IN THE 19606S THAT THE OWNER AT THAT TIME OF THE PROPERTY SUBDIVIDED THE ESTATE INTO THE COOL CREEK ESTATES SUBDIVISION AND ALSO THE CAUSECY FAMILY HAD TAKEN OWNERSHIP OF SOME OF THE PROPERTY ALONG COOL CREEK SO IT WAS OVER TIME SUBDIVIDED.

>> THIS IS THE MAP OF THE DISTRICT THAT YOU WOULD BE APPROVING. SORT OF MORE FOCUSED ON THE PROPERTY ITSELF CONSISTING IS OF THREE STRUCTURES.

THE HOUSE ITSELF. A FRENCH EASTBOUNDING CLACK TICK STYLE PROPERTY EXCELLENT EXAMPLE OUTSTANDING EXAMPLE OF ITS TYPE WHICH IS THE HIGHEST CATEGORY THAT A PROPERTY CAN RECEIVE IN OUR SURVEY. THIS IS A VIEW OF THE REAR OF THE PROPERTY OVERLOOKING A TERRACE AND THEN THERE'S A RAH CONVENE ABOUT WHERE THE PHOTO WAS TAKEN THAT DROPS OFF TO THE COOL CREEK VALLEY.

>> AND THERE ARE TWO OTHER CONTRIBUTING RESOURCES ON THE PROPERTY TO THE RIGHT IS A CARRIAGE HOUSE GARAGE PROPERTY WHICH ALSO HAS A LIVING RESIDENTIAL UNIT IN IT AND THEN ON THE LEFT SIDE IS WHAT IS KNOWN AS THE SUMMER HOUSE OR A POOL HOUSE FOR THE PROPERTY.

>> AND JUST SOME QUICK RECAP 1932 CONSTRUCTION IT WAS A

[02:20:02]

FRENCH STYLE PROPERTY. WOODS, CAPERTON WAS AN EXECUTIVE AT ELI-LILY AND COMPANY AND THEY LIVED IN INDIANAPOLIS BUT THIS WAS THEIR SORT OF COUNTRY HOME RETREAT HOME THAT THEY CAME OUT TO ON THE WEEKEND. UNFORTUNATELY MR. CAPERTON DIDN'T ENJOY THE HOUSE FOR VERY LONG FINISHING IN EARLY 19 # 3 AND DIED IN OCTOBER OF THAT YEAR.

BUT HIS SON INHERITED THE HOME AND RAISED HORSES ON FARMS GOING FORWARD. JUST TO SHOW YOU THIS WAS A PROPERTY ON OUR HISTORIC ARCHITECTURE SURVEY WHICH IDENTIFIES IT AS A PROPERTY THAT THE COMMISSION FEELS IS WORTHY OF PROTECTION.

WE RECEIVED AN APPLICATION IN MARCH OF THIS YEAR FROM MRS. ELEANOR CARTER THIS RIGHT NOW IS IN THE COOL CREEKS HOA.

IT'S IN THE COOL CREEK ESTATES NEIGHBORHOOD I'M NOT AWARE IF

THIS IS IN AN HOA OR NOT. >> IT IS.

PLOP. >> I CAN ANSWER THAT.

>> IT IS. SO I HAD A RESIDENT WHO LIFE INSURANCES IN THAT. IT'S DETACHED AND NOT CONNECTED TO THE REST OF IT BUT IT FOLLOWS INTO THE HOA.

WHAT I DO KNOW IS THAT MRS. CARTER AND FUTURE OWNERS OF THE PROPERTY WILL NEED TO COME TO THE CITY OF CARMEL'S HISTORIC PRESERVATION COMMISSION TO APPLY FOR A CERTIFICATE OF APPROPRIATENESS BEFORE YOU'RE ABLE TO GET A BUILDING PERMIT FOR ANY ADDITIONAL IMPROVEMENTS ON THE PROPERTY BE THEY AGAIN NEW ROOF, TUCK POINTING. NEW CONSTRUCTION OF A FOURTH CONTRIBUTING RESOURCE ON THE PROPERTY.

THOSE ARE WHAT THE COMMISSION WOULD CONSIDER.

>> THEY HAVE TO FOLLOW YOUR RULES BEFORE THEY GO INTO ANY HOA RULES CORRECT? THEY WOULD HAVE ENFORCEMENT RIGHTS TO ENFORCE THEIR OWN COVENANTS AND RESTRICTIONS.

THIS IS A PARALLEL TRACK SO WHAT THE CITY IS CONCERNED ABOUT IS WHETHER THEY COMPLY WITH THE UVO AND IF THEY BECOME A HISTORIC DISTRICT THEY WOULD HAVE TO GO TO THE HISTORIC RESERVATION COMMISSION. IT'S NOT GOING TO ABSOLVE THEM FROM REQUIREMENTS IN THE RESTRICTIONS AND COVENANTS.

IT'S JUST TWO SPAT ANALYSIS. DID YOU HAVE RAY COMMENT?

>> OKAY. SO WHEN I WAS LOOKING THROUGH THE DOCUMENT, IN THE RECORD SOMEWHERE DO WE HAVE PERMISSION OR SUPPORT FROM THE

CARTER FAMILY? >> MRS. CARTER I HAVE UP ON THE SCREEN RIGHT NOW. HER APPLICATION AND HER

[02:25:02]

SIGNATURE ACROSS BOTTOM SO I FELT IT WAS AS GOOD AS IT COULD

GET OF HER SUPPORT. >> AND THAT WILL REMAIN WITH

THIS ORDINANCE? >> SORRY?

>> THAT WOULD I WANT TO JUST MAKE SURE THAT'S PART OF THE

RECORD. >> ALL RIGHT.

ANY OTHER QUESTIONS? >> MR. PRESIDENT.

>> COUNSELOR RIDER. >> I DRIVE BY THAT HOUSE ALMOST EVERY DAY BECAUSE MY MOTHER-IN-LAW LIVES ON THE STREET AND I WANT THE MAKE SURE THEY KNOW IS IT SHAKE?

>> IT IS ACTUALLY A TILE DO THEY KNOW HOW EXPENSIVE THAT WULD BE BECAUSE IT WILL NEED A NEW ROOF IF YOU FORCE THEM TO USE THAT SHAME MATERIAL. THE CHILDREN LIVE THERE WITH HER. SHE MADE THIS REQUEST.

IT WAS NOT A FAMILY MEMBER THAT MADE THIS REQUEST.

>> CORRECT. THAT'S WHY I HAD HER SIGN THE DOCUMENT JUST TO MAKE SURE YOU GUYS HAD OWNER CONSENT.

COULD YOU SEND THIS TO COMMITTEE? I WOULD LIKE A LITTLE TIME. I'M JUST UNCOMFORTABLE BECAUSE SHE'S NOT HERE AND WE'RE NOT TALKING ABOUT IT.

>> PERFECT. PER RULES ANY CITY AND COUNTIES LORE CAN ASK FOR ANYTHING TO GO TO COMMITTEE.

>> WE WILL NOW MOVE ON TO FIRST READING 269326.

THE CITY OF CARMEL, INDIANA. SECTION 8 SPONSORS COUNSELORS WORRELL AASEN RIDER AND HAND NON.

CAN I HAVE A MOTION TO INTRODEUCE?

>> OR SOMEBODY INTRODUCE? >> PROSEXUAL ABUSE.

THANK YOU. THERE WE GO.

MY MISSION OF THIS AND I KNOW I'VE HEARD FROM COUNSELORS WHO SAY I CANNOT SUPPORT THIS I GET THAT BUT WHO WE'VE ALL SEEN HAVE VERY STRONG OPINIONS ABOUT THIS BOTH FOR AND AGAINST AND WE CAN GIVE THEM THEIR OPPORTUNITY FOR DUE.

NOW WHAT I WOULD LIKE TO DO IS SHARE WITH YOU REAL QUICK I KNOW THE HOUR IS GETTING LATE. THE BIG THING IS I WAS TOLD THIS WOULD BE DIFFICULT TO ENFORCE AND WAS A REASON SO I WENT OUT AND ROAD WITH THE TRAFFIC OFFICERS LAST WEEK.

IT IS NOT THE SPEED INTO THE ROUND ABOUT IT IS THE ENTRY WHERE EVERYTHING IS SIGNED SO IF WE COULD SLOW TRAFFIC DOWN THAT MAY OR MAY NOT BE OF VALUE. BUT AS DR. HAND NONSAID TO ME WHEN I CALLED ME ABOUT THIS WAS THIS MAY BE A LAYERED APPROACH.

RA RAISED ALL RIGHT.

[02:31:08]

SO THIS GOES TO FINANCE COMMITTEE AND THAT GETS US TO THE END OF OUR AGENDA. IS THERE ANY OTHER BUSINESS TO COME BEFORE THIS ESTEEMED BODY? WE ARE ADJOURNED.
