[1. CALL TO ORDER] [2. AGENDA APPROVAL] [3. INVOCATION] [00:00:46] CITY COUNCIL MEETING TO ORDER. WE HAVE A QUORUM TONIGHT. I MOVE FOR A MOTION TO APPROVE THE AGENDA? >> SECOND. >> DISCUSSION? PLEASE VOTE. ALL RIGHT, THE AGENDA IS APPROVED, 9-0. I WOULD LIKE TO MOVE ON TO THE INVOCATION, AND CALL PASTOR SCOTT GEIGER TO FROM THREE CORNERSTONE LUTHERAN CHURCH . THE YOU APPROACH THE PODIUM AND LEAD US IN INVOCATION, PLEASE? [4. PLEDGE OF ALLEGIANCE] >> IF YOU WOULD, WOULD YOU PLEASE PRAY WITH ME? LORD, WE THANK YOU FOR GATHERING US THIS NIGHT, A BEAUTIFUL NIGHT. IN A TO REJOICE IN ALL THE GOOD GIFTS YOU GIVE US. WE PRAY FOR OUR CITY, WE PRAY FOR OUR CITY COUNSELORS, WE PRAY FOR OUR MAYOR, WE PRAY FOR WISDOM, WE PRAY FOR YOUR CONTINUED INTERVENTION IN OUR LIVES. LORD, WE PRAY THAT YOU MAKE US PROSPEROUS AND GENEROUS, MAKE US JUST, BUT ALSO MERCIFUL, MAKE US CAPABLE, BUT ALSO WILLING. WE PRAY, LORD, THAT ALL THINGS WE DO TO YOUR GLORY. WE PRAY IN THE NAME OF JESUS, [6. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL] AMEN. >> THANK YOU, PASTOR. NOW, PLEASE STAND FOR THE PLEDGE OF ALLEGIANCE. COUNCILMEMBER MINNAAR LEAD US IN THE PLEDGE. I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS ONE NATION UNDER GOD INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL. ALL RIGHT. MOVING ON TO ITEM NUMBER FIVE ON OUR AGENDA, RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS. THERE ARE NONE. ITEM NUMBER SIX, RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL. WE HAVE ONE BLUE CARD . FOR THE FIRST TIME, I DON'T KNOW IF WE HAD THIS BEFORE, BUT A NICE LITTLE HELPING SHE BY THE DEPUTY CLERK. I DON'T KNOW IF I BUTCHERED, YOU KNOW, THE DIRECTIONS ON WHO IS GOING TO GIVE THE BLUE CARDS AND HOW YOU DO IT, BUT I WILL GO AHEAD AND READ IT. RIGHT NOW, WE HAVE ONE CARD. SO, MARIE MORGAN, WILL YOU PLEASE GO AHEAD OVER TO THE PODIUM? I WILL READ THE DIRECTIONS. I LIKE DOING THIS KIND OF FORMAL SCRIPT. NOW IS THE TIME ON OUR AGENDA WERE WE CAN HEAR FROM OUR PUBLIC. YOUR COMMENTS ARE VERY IMPORTANT TO US. THOSE WHO SUBMITTED BLUE CARDS TO SPEAK DURING THIS PART OF THE AGENDA, PLEASE GO TO THE PODIUM. NOTE THAT WE WILL NOT BE ENTERING INTO A DIALOGUE AT THIS TIME WITH YOU. THE PURPOSE OF THE AGENDA ITEM IS FOR YOU, THE PUBLIC, TO INFORM US, THE COUNCIL, ON YOUR VIEWS. YOU HAVE A LIGHTS SYSTEM RIGHT THERE. GREEN, YELLOW, AND RED. THE GREEN LIGHT WILL START WHEN YOU CAN START, AND THE RED LIGHT ON YOUR MICROPHONE SHOULD BE ON. THAT WAY, YOU HAVE THAT RED MICROPHONE , SO EVERYONE AT HOME IN THE RECORDING SO EVERYONE CAN PICK UP WHAT YOU SAID. THE GREEN LIGHT WILL COME ON FOR THREE MINUTES, AND WHEN IT GETS DOWN TO 30 SECONDS, A YELLOW LIGHT WILL GO ON, AND IN THE RED LIGHT WILL GO ON. I WILL LET YOU FINISH HER SENTENCE, AND THEN WE WILL BE FINISHED. SO, PLEASE, THE FLOOR IS YOURS. >> PLEASE, MY NAME IS MAUREEN ORGAN, AND I WANT TO ADDRESS THE CLIMATE COMMITTEE THAT MADE RECOMMENDATIONS FOR CLIMATE ACTION PLAN. FIRST, I DO THINK OUR CITIZENS WHO VOLUNTEERED THEIR TIME, BECAUSE CARMEL BENEFITS GREATLY WHEN CITIZENS GET INVOLVED. ALL CARMEL RESIDENTS WOULD AGREE THAT MAINTAINING A HEALTHY ENVIRONMENT IS A HIGH PRIORITY. HAVING CLEAN AIR, PURE WATER, CREATING WASTEWATER STRATEGIES, MAINTAINING GREEN SPACES, MAINTAINING MATURE WOODLANDS, THOSE ARE ALL VITAL TO CARMEL'S HEALTHY FUTURE. HOWEVER, I HAVE CONCERNS WHEN THE COMMITTEE BRINGS CARMEL INTO SOME CONTROVERSIAL TIME AND CHANGE ACTIONS. IT IS IMPORTANT TO KNOW THAT MANY RESIDENTS ARE NOT LINING WITH THE GLOBAL CLIMATE CHANGE AGENDA. THIS SO-CALLED "CLIMATE FOOTPRINT CRISIS" IS HEAVILY DEBATED AMONG SCIENTISTS, SO I WANT TO BRING A FEW ITEMS TO YOUR ATTENTION. AS THE CITY GOVERNMENT TRANSITIONS TO EV VEHICLES, LET'S REMEMBER WHAT HAPPENED [00:05:03] IN WINTER STORMS AROUND THE COUNTRY. ELECTRIC VEHICLES WERE STRANDED SINCE VEHICLES AND CHARGING STATIONS WEREN'T WORKING PROPERLY IN THE COLD WEATHER, AND NOT TO MENTION THAT THE HEAVY METALS USED TO MAKE THE EV BATTERIES, THEY ARE MINED IN CHINA. WHY WOULD WE WANT TO CREATE A FOR THE DEPENDENCE ON A NATION THAT CAN STOP SUPPLYING OUR VITAL METALS AT ANY TIME? ONE OF CARMEL'S CLIMATE CHANGE RECOMMENDED EMENDATIONS IS TO EAT LESS MEAT. COWS HAVE EXPELLED MY METHANE FOR CENTURIES. DO WE REALLY BELIEVE THAT SLAUGHTERING HUNDREDS OF THOUSANDS OF COWS, AS WAS PROPOSED IN IRELAND, WILL AFFECT OUR CLIMATE? PLANTS AND CROPS ON OUR FARMS AND RANCHES NEED THE CO2 THAT IS EXPELLED BY CATTLE SO THAT THEY CAN THRIVE. IT IS CALLED PHOTOSYNTHESIS. WHEN SOMEONE POSTS SOME OF THE MOST RECENT -- IT MUST MAKE EVEN THE SIMPLEST MIND WONDER. LIKE CO2 PIPELINES. OTHER THAN BIG MONEYMAKING CORPORATIONS, WHO THINGS CONSTRUCTING DANGEROUS COMBUSTIBLE CO2 PIPELINES ACROSS OUR FARMLANDS WOULD BE A GOOD IDEA? NOT ONLY ARE THE PROPERTY RIGHTS OF FARMERS BEING TRAMPLED ON WHEN THEY TRY TO STOP THESE COMPANIES FROM DESTROYING THEIR FARMLAND , BUT RESIDENTS OF CITIES LIKE MISSISSIPPI, THEY ARE STILL'S SUFFERING FROM CONVULSIONS AND UNCONSCIOUSNESS WHEN THAT PIPELINE EXPLODED. ISN'T THIS WHY THE CLIMATE CHANGE GLOBALISTS WERE AGAINST THE KEYSTONE PIPELINE? THEY DID NOT WANT PIPELINES ACROSS OUR NATION. FINANCIALLY, NOT [7. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS] PRESENTLY, THE COSTS CONTINUE TO RISE. AT THE CO2 SUMMIT THAT WAS LAST MONTH IN DUBAI, THE U.S. WAS CALLED TO PAY EXORBITANT CLIMATE TAXES TO A GLOBAL/FUND WHILE CLIMATE CHINA AND RUSSIA CONTINUE TO USE FOSSIL FUELS WITHOUT ANY CONSEQUENCE. UNFORTUNATELY, MAINSTREAM MEDIA AND EDUCATION SECTORS PRESENT ON THE ONE SIDE TO THE CLIMATE CHANGE, BUT OTHER PUBLICATIONS DEBUNK THEIR HYPOTHESIS , AND THEY READILY AVAILABLE FOR THOSE WHO WANT TO BECOME BETTER EDUCATED ON THE MATTER. I ENCOURAGE OUR CLIMATE COMMITTEE TO CONSIDER THE SOURCES SO THEY WILL BE WELL INFORMED WHEN THEY MAKE THE RECOMMENDATIONS. CARMEL SHOULD BE A LEADER IN INNOVATION, NOT A FOLLOWER OF A DANGEROUS AGENDA. THANK YOU. >> THANK YOU. THAT IS IT FOR BLUE CARDS. MOVING ON TO ITEM NUMBER SEVEN. ANY COMMENTS ON THE COUNCIL? YES? >> THE LARGEST FUNDRAISER FOR THE CARMEL EDUCATION FOUNDATION IS THIS FRIDAY. IT IS CALLED THE TASTE OF CARMEL. IT IS A GREAT, GREAT TIME, WELL RECEIVED BY THE PUBLIC. THERE [8. CONSENT AGENDA] ARE STILL TICKETS AVAILABLE FOR THIS YEAR FOR SOME REASON. THOSE NORMALLY CELLO. THOSE ARE AVAILABLE AT OUR WEBSITE. ALL THE RESTAURANTS IN CARMEL, COME. YOU PAY TO GET IN, AND THEN YOU EATEN TO YOUR HEARTS CONTENT. ON OUR CIVILITY PROJECT, WE HAVE OUR NEXT MEETING WITH ALEXANDRA HUDSON, WHO IS THE AUTHOR OF THE BOOK "THE SOUL OF STABILITY". SHE WILL BE HERE ON 6:00 ON SUNDY AT THE VILLAGE WEST CLAY MEETINGHOUSE. THAT IS WHERE WE WILL ANNOUNCE OUR LEADERSHIP TEAM, AND SOME OTHER ANNOUNCEMENTS AT THAT MEETING. SO, I HOPE YOU CAN MAKE IT. >> NO MORE COUNSEL, FOR OBSERVATIONS? THEN ON TO ITEM NUMBER EIGHT, CONSENT AGENDA. APPROVAL OF THE MINUTES FOR FEBRUARY 19TH, 2024, REGULAR MEETINGS, AND CLAIMS FOR PAYROLL IN THE AMOUNT OF [10. COMMITTEE REPORTS] $3,654,053.37 FOR FEBRUARY 9TH, 2024 ON PAYROLL, AND $191,915.12 FOR UNIFORM ALLOWANCE , AND THE AMOUNT OF 2900 $293,669.62 FOR VACATION PAYOUT. >> I MOVE TO APPROVE. >> SECOND? >> SECOND. >> OKAY, DISCUSSION? PLEASE VOTE. ALL RIGHT. THAT IS APPROVED, 9-0. MOVING ON TO ACTION ON BARREL VETOES. THERE ARE NONE. I'M NUMBER 10, COMMITTEE REPORTS, FINANCE UTILITIES AND RULES. COUNCILMEMBER MINNAAR? >> THANK YOU. OUR REGULAR MEETING FOR MARCH 12TH HAS BEEN CANCELED FOR THE SWEARING IN OF THE POLICE CHIEF. OUR NEXT MEETING WILL BE APRIL 9TH. WE ARE STILL COLLECTING INFORMATION AND OPINIONS FROM THE PUBLIC ON THE PROPOSAL THAT IS CURRENTLY ON THE TABLE. LAND-USE AND SPECIAL STUDIES. COUNCILMEMBER SNYDER? >> YES, WE MIGHT THE WEDNESDAY FOLLOWING THE LAST COUNCIL MEETING. IT THE AGENDA WAS EDO REVIEW, WHICH WAS NOT DISCUSSED , AND THE PUD. THE COMMITTEE VOTED UNANIMOUSLY [00:10:04] TO SEND THE ANDERS PUD OUT OF COMMITTEE WITH A FAVORABLE RECOMMENDATION WITH A COUPLE OF STIPULATIONS. ONE WAS A STOUT FINE SCHEDULE FOR CONSTRUCTION TRAFFIC IN AREAS THAT THEY SHOULD NOT BE IN. THAT HAS BEEN PROVIDED. TWO WAS SOME CHANGES IN THE LANGUAGE AS THEY PERTAIN TO THREE-CAR GARAGES, DUSK TO DAWN LIGHTS, AND ATTACHED LIVING QUARTERS. THERE WERE NOT BE DETACHED LIVING QUARTERS BEHIND THE HOUSE. AND THEN FINALLY , THEY DID REACH OUT TO CITY ENGINEERING ABOUT GETTING CLARIFICATION ON A SPEEDBUMP. THE CITY ENGINEER GAVE HIS OPINION , WHICH WAS NOT [11. OTHER REPORTS] FAVORABLE FOR A SPEEDBUMP AT THAT LOCATION. SO, AS FAR AS I AM CONCERNED, WE HAVE SATISFIED EVERYTHING THE COMMITTEE HAD ASKED FOR. WE ASK BEFORE THIS MEETING TO PROVIDE IT, AND THEY HAD. OUR NEXT MEETING WILL BE THIS COMING WEDNESDAY AT 6:00 P.M. AT THE CARMEL LIBRARY. WILL BE AT THE CARMEL LIBRARY AT THIS TIME, BUT WE WILL BE DISCUSSING AN AGENDA SET SETTING ABOUT THE EDO. SO, ANYONE ARE INTERESTED IN THAT, THERE WON'T BE MUCH DISCUSSION EXCEPT HOW TO TACKLE THIS DOCUMENT. >> ALL RIGHT, THANK YOU. >> THANK YOU. >> MOVING ON TO ITEM NUMBER 11, CARMEL REDEVELOPMENT COMMISSION . HENRY? >> GOOD EVENING, COUNSEL. A COUPLE OF THINGS TODAY. FIRST, THE AMERICAN PLANNING ASSOCIATION , THE AND CHAPTER HAD ANNUAL REWARDS LAST WEEK. THE CARMEL REDEVELOPMENT COMMISSION, TO TOGETHER WITH OUR PARTNERS , HAVE LED AN AWARD FOR THE PERSON YOU PROJECT. MAYOR BRAINARD ALSO WON AN AWARD, AND HE PICKED THAT UP LAST WEEK. SO, WE HAVE THAT PLAQUE IN VISTA REDEVELOPMENT . THE CITY ALSO CONTINUES TO WIN AWARDS. IN LIEU OF MY REGULAR PRESENTATION, WHICH, YOU KNOW, FOLLOWS THE CRC INFORMATION IN OUR MONTHLY REPORT THAT IS IN YOUR PACKET, I WOULD LIKE TO PRESENT TWO OTHER REPORTS INSTEAD. ONE OF THEM IS BORING, AND THE OTHER IS REALLY NEAT. SO, IF YOU WOULD ALLOW ME TO DO ONE OF THEM FIRST. EVERY YEAR, THE REDEVELOPING COMMISSION PUTS TOGETHER A TO MANAGEMENT REPORT. THE TO MANAGEMENT REPORT LISTS ALL EXPENDITURES OF THE COMMISSION FOR THE YEAR , LISTS EVERY TO AREA , EVERY BOND THAT THE TO AREA MAKES PAYMENTS ON, AND WHAT PERCENTAGE OF WHAT TO AREA , AND WHAT AMOUNT IS PAID BY EACH PARCEL INTO EACH BOND. WE PUT THESE TOGETHER EVERY YEAR. THIS GETS UPLOADED TO THE DEPARTMENT LOCAL GOVERNMENT FINANCE. THE STATES THAT YOU CHANGED FOR THE FIRST TIME EVER THIS YEAR, AND THE REPORT IS ALSO TO BE REPORTED TO THE PHYSICAL BODY. IT DOES NOT DEFINE WHAT THAT PRESENTATION IS, SO, IN EACH OF PACKETS, THIS REPORT THAT WE DO EVERY YEAR IS ATTACHED . BUT, TO SATISFY YOUR PRESENTATION TO THE PHYSICAL BODY ASPECT OF IT, AND JUST GOING TO TALK ABOUT WHAT THIS REPORT ENTAILS. ALSO, I WANT TO NOTE THAT THIS REPORT IS 118 PAGES, MOSTLY EXHIBITS, IT WAS PUT TOGETHER BY A REDEVELOPMENT FINANCE DIRECTOR, MR. MIKE LEE. MIKE DOES THESE EVERY YEAR. THIS IS ONE OF THE REPORTS THAT THE CRC PUTS OUT EVERY YEAR. FOR ANYONE PAYING ATTENTION ARE FOLLOWING ALONG, THE CRC PUTS OUT A MONTHLY REPORT TO CITY COUNCIL. THE CRC DOES AN ANNUAL TO MANAGEMENT REPORT. MICHAEL DOESN'T IN-HOUSE, AND SAVES US TENS OF THOUSANDS OF DOLLARS, BECAUSE THAT IS HOW LONG IT TAKES TO BE TOGETHER, AND WE DID AN ANNUAL REPORT -- IS AVAILABLE ONLINE , AND IT BREAKS DOWN BEGINNING AND ENDING BALANCES OF EVERY ALLOCATION AREA, EVERY AREA THAT WE HAVE IN THE CITY . THERE AREN'T MANY. IT TALKS ABOUT WHAT KINDS OF AREAS EACH OF THEM ARE. MOST ART ECONOMIC DEVELOP IN AREAS. SOME ARE REDEVELOPMENT STANDARDS. BUT, IT'S VERY MUCH THE SAME THING. NUMBERS OF THE COMMISSION , EXPENSES OF THE COMMISSION, AND IF ANYONE HAS ANY QUESTIONS ABOUT THAT, I AM HAPPY TO ANSWER. AND THEN, WHICH TIFF BONDS ARE BEING [00:15:01] PAID OFF BY A BIG TIFF BONDS. MORE BIG TIFF BONDS. AND THEN, THIS IS LITERALLY TRACKED PARCEL BY PARCEL. MIKE SPENDS A LONG TIME ON THIS STUFF, AND I'M GLAD THAT HE DOES , BECAUSE IT WOULD BE MUCH MORE EXPENSIVE. BUT ESSENTIALLY, THAT IS THE REPORT AS PRESENTED TO COUNSEL. I AM HAPPY TO ANSWER ANY QUESTIONS ABOUT THIS ONE, OR MOVE ONTO THE NEXT THING. BUT, I BELIEVE I HAVE MET MY STATE STATUTE REQUIRED PRESENTATION. >> ANY QUESTIONS TO THE RIGHT? TO THE LEFT? YEAH, I DID NOTICE A LOT OF PAGES. YOU KNOW, WE ARE STILL MAKING OUR WAY THROUGH THEM. NOW, THIS IS THE BORING OR THE INTERESTING? EVERYONE, THIS WAS THE BORING. OKAY, THIS REPORT THAT I JUST TALKED ABOUT IS LOOKING BACK. IT LOOKS BACK FOR THE YEAR ON CRC EXPENSES. SO, I THOUGHT THIS WAS AN OPPORTUNITY TO TALK, FOR A SECOND, ABOUT LOOKING FORWARD. REDEVELOPMENT PROJECTS GET REPORT REPRESENTED IN PARTNERSHIP -- AND CITY COUNCILAPPROVES THOSE THAT IT DEEMS WORTHY OF BOND APPROVAL. OFTEN TIMES, WHEN I AM PRESENTING THESE PROJECTS , THERE IS A LITTLE STATS, OR A LITTLE STATISTIC THAT I LIKE TO HAVE ON OUR SLIDES. AND THE STATISTIC IS ABOUT INCREASING THE VALUE BREAKER FROM BEFORE THE PROJECT IS BUILT TO WHAT HAPPENS AFTER THIS PROJECT IS BUILT. THE VALUE BREAKER , IF YOU WANT TO THINK ABOUT THE ECONOMIC HEALTH OF THE PARCELS IN THE CITY , THERE IS VALUE, WHICH DIRECTLY CORRELATES HOW MUCH TAXES THEY PAY . YOU KNOW, US, AS A CITY, WE SHOULD BE TRYING TO GROW OUR CORPORATE CORE , GROW OUR COMMERCIAL AREAS , BECAUSE THE MORE THE CITY, FOR ITS BUDGET, RELIES ON COMMERCIAL TAXES AND BIG COMMERCIAL PROPERTIES , THE LESS OF A BURDEN HAS TO BE SHARED BY INDIVIDUAL OWNERS. THAT'S A BROAD WAY OF LOOKING AT IT. WE'VE ALL SEEN THESE , YOU KNOW, VALUES GOING UP. BUT, WE NEVER HAD THE TOOLS, HAD THE VISUAL, HAD THE DATA PUT IN A VISUAL WAY FOR PEOPLE TO DIGEST IT. WELL, I WANT TO THANK JEREMY CASH IN THE ENGINEERING DEPARTMENT. THERE IS A GUY WHO WORKS WITH JEREMY NAMED SHANE RUMMEL, WHO IS A GIS GURU. THAT MAN CAN DO ANYTHING IN JS THAT ANYONE CAN IMAGINE. SO, WITH THE HELP OF SHANE, WE'VE PUT TOGETHER THIS MAP. THIS IS THE MAP OF CARMEL. IT'S A MAP OF CARMEL BASED ON THE ASSESSED VALUE PER ACRE IN THE CITY OF CARMEL. THIS MAPS OUT HOW PRODUCTIVE LAND IS AND PARCELS ARE IN THE CITY OF CARMEL FROM AN ECONOMIC DEVELOPMENT STANDPOINT. THERE ARE A COUPLE THINGS THAT JUMP OUT AT ME THAT I JUST WANTED TO SHARE. FIRST, YOU KNOW, AS YOU SEE OUR EASTSIDE NEIGHBORHOODS, THIS IS OUR EAST SIDE. NEIGHBORHOODS DO NOT PROVIDE -- GENERAL NEIGHBORHOODS ARE PROVIDING HUGE ACCESS PER ACRE. SAME FOR OUR WEST SIDE. EXCEPT FOR HERE, I THOUGHT THIS WAS PRETTY NEAT. RIGHT ON OUR WEST SIDE, DOES EVERYONE KNOW WHAT THIS IS RAY HERE? ME JUST HIM OUT A BIT. THERE IS A WEST SIDE, AND THIS WEST CLAY. THEY ARE DENSE. YOU HAVE CONDOS ALL STACKED ON TOP OF EACH OTHER, ALL ASSESSED. SO, WEST CLAY SPENDS OFF A LOT OF THE ASSESSED VALUE. A VILLAGE IN WEST CLAY IS ALSO CALLED A TRADITIONAL NEIGHBORHOOD DEVELOPMENT. IT'S WALKABLE, AND IT HAS A BIT OF DENSITY , AND THAT'S HOW IT GETS ASSESSED VALUE. THE OTHER THING THAT KIND OF STANDS OUT AT ME IS OUR U.S. 31 CORRIDOR. IF YOU THINK ABOUT THE CITY OF CARMEL , YOU KNOW, IN THE LAST 20 OR 30 YEARS, WHEN IT HAS POWERED THE CITY COMMERCIALLY, IT HAS BEEN OUR TAX BASE ALONG 31. THOSE BIG BUILDINGS PAY A LOT OF TAXES. THAT HAS EMPOWERED THE CITY FOR 30 YEARS. WE HAVE [00:20:01] BEEN ABLE TO RELY ON THE BIG BUILDINGS ALONG U.S. 31. I THINK IF YOU LOOK AT THIS, YOU WILL SEE THAT, THOUGH, ON AND ASSESSED VALUE BREAKER, BECAUSE YOU'RE TALKING ABOUT THESE LARGE BUILDINGS, THERE ARE ACRES AND PARKING LOTS. OFTEN TIMES, A SIX STORY OFFICE BUILDING THESE SEVEN OR EIGHT ACRES OF PARKING JUST TO PARK IT. THEN, ON A THREE ACRE BASIS, OUR U.S. 31 PARCELS AREN'T MUCH DIFFERENT FROM OUR WEBSITE HOUSES. OBVIOUSLY, SOME OF YOU CAN POINT OUT THAT YOU CONTACT C.A.P. THAT 1% AT TAXING RESIDENTIAL VERSUS 2% FOR COMMERCIAL. THE TAXES ARE DIFFERENT, BUT FROM A VALUE STANDPOINT, WE ARE GETTING AN ASSESSED VALUE THAT FELT ON THE WEST SIDE. I KNOW THIS IS IN A QUESTION AND ANSWER, CAN ANYONE TELL ME WHAT WE ARE LOOKING AT HERE? THIS IS ONE 16TH STREET. WHY ARE THEY SO HIGH IN ASSESSED VALUE PER ACRE? BECAUSE THE CITY DID PUBLIC PRIVATE PARTNERSHIPS WITH THOSE TWO PROJECTS, AND WE USE THEIR FUTURE TAXES TO HELP THEM BUILD A PARKING GARAGE. SO, NOW THEY NEED WAY LESS LAND TO BUILD THE SAME KIND OF VALUABLE BUILDING. THEY CAN BUILD A PARKING GARAGE ON TWO ACRES OF LAND INSTEAD OF TAKING UP 10 ACRES FOR SURFACE PARKING. ONCE REPUBLIC GETS BUILT , WHEN IT GETS BUILT, YOU WILL SEE THE SAME THING. SO, THEN COMES THE BIG ONE. GUYS, THIS IS OUR CENTRAL CORRIDOR. THIS IS A CHART. THIS IS A DATA CHART . IT IS NOT REPRESENTATIVES ON HOW TALL I WANT SKYSCRAPERS TO BE . BEFORE PEOPLE START MAKING COMMENTS , THIS IS NOT TO SCALE, OKAY? THIS IS NOT NEW YORK CITY. THIS IS ASSESSED VALUE PER ACRE. IN SOME OF THESE, YOU CAN SEE THERE ARE TITLES ON TOP OF THE BUILDINGS. THAT IS BECAUSE THEY PUT IN THE LAYER OF BUILDINGS THAT IS ALMOST GIVE FINISH WITH CONSTRUCTION, AND THEN THERE IS ASSESSED VALUE FOR WHAT THERE IS GOING TO BE. BUT ESSENTIALLY, U.S. 31 REHEAR IS WHAT POWERED OUR CITY FOR THE LAST 30 YEARS ON A DEVELOPMENT STANDPOINT. AND WE ARE USING TAX INCREMENT FINANCE TO BUILD UP A CENTRAL CORE WITH SO MUCH VALUE THAT OUR CITY IS GOING BE STRONG FOR THE NEXT 100 YEARS. THERE IS A WEBSITE THAT HAS PLENTY OF VIDEOS ON HOW TAXES AND FINANCES WORK, BUT JUST FOR A QUICK PRIMER , YOU LOCK IN AN AREA FOR 25 YEARS, AND YOU TAKE THE NEXT 25 YEARS OF THE TAXES FROM THAT AREA TO CREATE THE PROJECT IN THE FIRST PLACE, AND INCENTIVIZE A PROJECT IN THE FIRST PLACE. WE JUST TALKED ABOUT THE CAR HEADQUARTERS ALONG U.S. 31. IF WE DO NOT USE HER FUTURE TAXES TO HELP INCENTIVIZE A GARAGE FOR THEM , THEN THEY WOULD NOT HAVE LOCATED ON THAT SITE, BECAUSE THEY NEED WAY MORE PARKING THAN THAT. THEN THERE WOULD HAVE BEEN NO TAXES FROM THE PROJECT TO BEGIN WITH. YOU ENABLE THE PROJECT IN THE FIRST PLACE BY USING THE PROJECTS FUTURE TAXES TO MAKE THE PROJECT HAPPEN ON DAY ONE. AND MAKE IT HAPPEN FROM AN URBAN PLANNING STANDPOINT AND WE BETTER FASHION THAN WHAT THE MARKET WILL BE, BECAUSE THE MARKET BUILD STRIP CENTERS AND GUARDS APARTMENTS. ANYTHING IN THE CORE IS NOT THE MARKET. THE COURSE PUBLIC PRIVATE PARTNERSHIPS. I KNOW SOMETIMES IT IS EASY TO THINK OF THINGS IN INCREMENTS AND WHEN YOU'RE LOOKING AT A PROJECT, IT'S EASY TO SAY THAT THIS IS A 90-10 SPLITS, AND WE SHOULD DO THAT INSTEAD OF 100% BEING GIVEN AWAY. BUT, WHAT THIS CHART SHOWS THAT WE SHOULD NOT THINK ABOUT THINGS IN THAT ONE YEAR INCREMENT. TIFF AREAS LAST IN 10 YEARS, AND THEN THEY EXPIRE. THAT GIANT BUILDING WITH THAT HUGE ASSESSED VALUE HITS THE CITY'S GENERAL ROLES. WHEN THESE BUILDING START PAYING TAXES TO THE CITY , THE CITY IS GOING TO HAVE TO RELY LESS ON OUR SINGLE-FAMILY HOMEOWNERS FOR THEIR TAXES. BECAUSE WE WILL BE ABLE TO TAX OUR COMMERCIAL BUILDINGS IN THE CORE FOR MORE OF THAT BUDGET. SO, AS WE USE TAX AND FINANCE TO BUILD STRUCTURES THAT ARE WALKABLE, VIBRANT, AND BECOMING A PLACE WHERE PEOPLE WANT TO BE , AND WHERE WE WANT TO PUT OUR HEADQUARTERS, WE SHOULD NOT FORGET ABOUT THE LONG-TERM PHYSICAL IMPLICATIONS OF THESE THINGS. WHICH IS DOING THESE TIFF DEALS MAKES A VALUE IN THE CORE THAT WOULD OTHERWISE NEVER EXIST. AND IT IS GOING TO KEEP OUR CITY FISCALLY HELP HEALTHY FOR THE NEXT 100 YEARS. BY THE WAY, THIS IS A CHART OF PROPERTY TAXES. THE CITY ALSO GETS INCOME TAXES. A LOT OF [00:25:04] THESE BUILDINGS ARE APARTMENTS. I SUSPECT THAT IF WE DO AN INCOME TAX PROJECTION THE WAY THAT THIS PROPERTY TAX PROJECTION IS, I SUSPECT IT WILL DUE LARGELY THE SAME WITH LARGE PARTNER BUILDINGS BEING FILLED WITH PEOPLE WHO MAY, ON AVERAGE, $150,000.00 A YEAR. THAT'S A LOT OF PROPERTY TAXES AND INCOME TAXES ALL ON THE COURT BEING PAID BECAUSE OF THESE NEW PROJECTS WHICH, AGAIN, REDUCES THE BURDEN ON OUR EASTSIDE AND WESTSIDE HOMEOWNERS. AND, THE BIG TAKE AWAY IS IF YOU WANT HIGHER VALUES, WALK ABILITY AND VIBRANCE GETS US THERE. WALK ABILITY IN WEST CLAY RAISES THEIR PROPERTY VALUES , OUR WALKABLE CORE IS INCREDIBLE . IF YOU WANT TO DO A MAP OF WESTFIELD, IT LOOKS LIKE THIS WITHOUT THE CORE. WITHOUT THE ASSESSED VALUE IN THE CORE. AND THEN, YOU CAN SEE ON OUR WESTSIDE, LEGACY IS DOING OKAY AS WELL. YOU HAVE A LITTLE WALKABLE LEGACY COMPONENT ON THE WEST SIDE, AND -- SORRY, EASTSIDE, ON THE NORTHEAST SIDE. IT HAS HIGHER RECESS VALUES. SO, VALUE WILL NEVER GO ON THE EAST OR WEST SIDE. IT IS GOING TO STAY IN THE CORE. BUT, AS IT IS DOING INCREASED PROJECTS FOR DESIRABILITY, FOR THOSE OF US WHO OWN HOMES IN THE CITY OF CARMEL, WE CAN BE SECURE KNOWING THAT OUR TAXES ARE GOING TO FALL , BECAUSE WE WILL HAVE MORE AND MORE LARGE PROJECTS ASSESSING CRAZY AMOUNTS PER ACRE. IT WILL HIT THE CITY'S TAX ROLLS AS THESE TIFF AREAS EXPIRE. SOPHIA SQUARE ON OUR MAIN STREET, -- IS THE CITY'S GENERAL ROLES IN 2006. THAT'S NOT THAT FAR AWAY FROM TODAY. EVERY PRIVATE PARTNERSHIP SECURES OUR FUTURE AND OUR FINANCIAL HEALTH. IT MAKES IT STRONG GOING FORWARD. THAT WAS A LOT. COUNSELORS, DO YOU HAVE ANY QUESTIONS, OR WANT TO LOOK AT ANY OF THIS, OR ANY COMMENTARY IS A LOOK AT THIS ASSESSED VALUE CHART? >> NOT FOR US. THANK YOU. >> I KNOW IN SOME OF THE BONDS WE APPROVED IN THE PAST, FOR EXAMPLE, IF THE REDEVELOPMENT BONDS. THOSE PROJECTIONS, THEY DID NOT FACTOR IN GROWTH . SO, YOU HAVE SOME OF THESE BONDS THAT ARE IN THE PAST THAT WE WERE COLLECTING TIFF FOUR. GROWTH IS NOT FACTORED IN. WE ARE SEEING MASSIVE GROWTH THAT IS OUTPERFORMING WHAT SOME OF OUR BOND OBLIGATIONS ARE. CORRECT? >> YES. AT THE SAME TIME, THE STATE LEGISLATURE IS REDUCING THE S ASSESSED VALUES OF APARTMENTS, AND WE WILL HAVE CERTAIN U.S. 31 PROPERTIES I WILL GET ASSESSED VALUE HITS IN THE FUTURE. IT ADDS AND FLOWS. THE AVERSION POINT IS PUBLIC PRIVATE PARTNERSHIPS, REGARDLESS OF THE ONES THAT ARE BLOWING, INCREASES VALUES IN THE CITY 10, 20 FOLD. AND THE MORE WE DO THAT, THE BETTER OUR FISCAL HEALTH WILL BE LONG-TERM. >> ANY OTHER QUESTIONS? ONE THING I WOULD LIKE TO SEE, IF THERE IS A WAY, AND YOU MADE REALLY GOOD POINTS. IS THERE A WAY TO SEE SOME VACANCY RAINS AND SOME OF THOSE BUILDINGS? ESPECIALLY ON 31, DO WE HAVE A BETTER UNDERSTANDING ON THAT IF IT IMPACTS ANYTHING? >> SURE. ACTUALLY, MIKE LEE IS LEADING THE CHARGE ON THE STRESS TEST RIGHT NOW THAT WE HOPE TO PRESENT. IN THE CORE, THERE IS NO VACANCIES. ALONG U.S. 31, THERE ARE VACANCIES NOT TOO LONG AGO, BUT DOWNTOWN HAS TAKEN A HIT. I SUSPECT SOME OF THESE PROPERTIES ARE GOING TO GET HALVED IN VALUES AS THEY GO THROUGH THIS PROCESS. BUT, THAT'S ALSO PART OF LIFE, AND PART OF THE MARKET. OVERALL, CARMEL REMAINS INCREDIBLY STRONG. FRANKLY, OWNERS OF SOME OF THOSE BUILDINGS THAT ARE UNDERWATER ARE LOCKED INTO DEALS THAT DON'T HAVE ANY EXCESS MONEY TO INVEST IN TO RENEW THEIR PROPERTIES, IF YOU WILL. IT MAY BE BETTER TO TALK TO THE NEXT OWNER WHO BUYS ONE OF THE PROPERTIES FROM A BANK, BECAUSE THAT OWNER WILL HAVE LESS DEBT SERVICE, AND MAY HAVE MORE MONEY TO DO -- TO REINVIGORATE SOME OF THOSE AREAS. SO, WE GENERATED SHOULD NOT NECESSARILY BE AFRAID OF WHAT IS COMING. >> COUNCILMEMBER SNYDER, DO YOU HAVE SOMETHING TO SAY? >> A COUPLE OF THINGS, HENRY. HE TALKED ABOUT HOW THE COUNCIL PROVES THESE BONDS FOR THE PROJECT. I WOULD LIKE YOU TO CLARIFY WHAT THAT ACTUALLY MEANS . THAT WE ARE NOT [00:30:02] ALLOCATING TAXPAYER DOLLARS . TWO, THE ONE QUESTION I WOULD HAVE, OR SOMETHING TO THINK ABOUT WOULD BE, I MEAN, THIS IS GREAT, RIGHT? OTHER THAN SAYING, AND I AM NOT SURE IF I WOULD HAVE SAID IT SO INTENTIONALLY THAT THE'S ARE GOING TO GO DOWN , WHY DO PEOPLE ON THE EAST AND WEST SIDE REALLY CARE? >> GOOD QUESTION. >> HOW DOES THIS AFFECT THEIR LIVES? >> SURE. >> I HAVE FORGOTTEN MY THIRD QUESTION. BUT, IF YOU CAN START WITH THOSE TWO, I WOULD APPRECIATE IT. >> WHAT DO THESE BONDS MEAN? FOR THE LAST FEW YEARS, WE'VE BEEN DOING DEVELOPER BONDS. WHICH MEANS THERE IS ZERO RISK TO THE CITY. DEVELOPER BINDS THE BOND, AND THEY ARE ONLY ATTACHED TO THE LOCATION OF THE AREA BASED ON -- FOR SOME REASONS, IF THE BUILDING DOES NOT ASSESS THEY ARE SUPPOSED TO , THE CITY IS NOT, UNDER ANY OBLIGATION, OBLIGATED TO MAKE A SHORTFALL. EVEN IF THERE IS A BACK END, WE GET A HOST OF PROTECTIONS TO MAKE SURE THAT OUR TAXPAYER WILL NEVER GET TRAMPLED. THE REQUIREMENTS FOR EVERY PARCEL TO KEEP PAYING MONEY, WHETHER THERE ARE BUILDINGS THERE ARE NOT GUARANTEES A HOST OF PROTECTIONS TO MAKE SURE THE CITY AND THE TAXPAYERS ARE ALL THE SAME. TO COUNCILMEMBER SNYDER'S SECOND QUESTION, WE ARE TALKING ABOUT PROPERTY TAXES. I MEAN, WE DO GET BENEFITS ON DAY ONE FROM REDEVELOPMENT PROJECTS. AND YOU ARE SEEING OFFICE BUILDINGS BUILT IN THE CORE, FIRST ON MAINE, THE LOUNGE, THOSE ARE FULLY LEASED. THEY ARE RELEASED BEFORE THEY CAN GET BUILT. WE GET JOBS, WE HAVE PEOPLE WALKING AROUND SPENDING MONEY, USUALLY AS FIRST FLOOR RETAIL. AS YOU CAN TELL, IT IS REALLY THE KEY FOR HIGH VALUES. IT'S WAY DIFFERENT THAN ANY OTHER CITY IN THE STATE. WE MAKE PARKING GARAGES FREE AND OPEN TO THE PUBLIC TO USE. IN OTHER CITIES, THE DEVELOPERS USE THE PARKING AS A WAY TO GENERATE REVENUE FOR THEMSELVES. THE PARKING IS NOT FREE. THE CITY OF CARMEL, THAT IS FREE. THE MORE WE BUILD OUT, THE MORE HE PROVIDED CORE WITH PARKING THAT IS MAINTAIN AND MANAGE BY SOMEBODY ELSE. THAT IS WHY DOWNTOWN IS BEEN SO SUCCESSFUL. WHEN YOUR VISITORS COME FROM OUT OF TOWN, THEY CAN'T BELIEVE THAT THERE ARE 10 PARKING GARAGES THAT ARE ALL FREE. I CAN'T BELIEVE THIS IS ALL FREE. AND, AS MENTIONED, THE CITY OF CARMEL ALSO GETS INCOME TAXES. IF IT IS AN APARTMENT BUILDING THAT GETS FILLED OUT, IT IS USUALLY PEOPLE PAYING INCOME TAXES THAT BENEFIT US A ONE BUDGET WISE. FINALLY, THE SCHOOLS HAVE A REFERENDUM IN THE CITY. SO, ANYTIME WE HAVE INCREASED ASSESSED VALUE, THE SCHOOLS THAT BENEFITED AND GOT MONEY FOR THAT. CARMEL SCHOOLS LOVE OUR REDEVELOPMENT EFFORTS. CARMEL SCHOOLS GET MORE MONEY FROM REFERENDUM ON CARMEL TIFF AREAS THAN ANYWHERE ELSE IN THE STATE. IN EACH TOWN, WE DO A PROJECT THAT IS A FALL FOR THE SCHOOLS. THE SCHOOLS LOVE THESE GREEN AND BLUES, BECAUSE I GET TO BENEFIT FROM ALL OF THEM. COUNSELOR, WAS THAT HELPFUL IN ANSWERING SOME OF YOUR QUESTIONS? >> YES, THANK YOU. AND MY FINAL QUESTION IS, YOU SAID, AND I TRACK YOUR LOGIC 100% THAT IT MIGHT BE BETTER TO WAIT UNTIL SOME OF THESE BUILDINGS HAVE VACANCIES THAT GO INTO FORECLOSURE . I JUST WANT TO BE CAUTIOUS THAT A LOT OF THIS WAS STARTED 30 YEARS AGO . I AM NOT SURE, I THINK WE SHOULD TAKE A HARD LOOK ON IF A SIMILAR DEAL WHERE WE BEG SOMEBODY TO BUILD A BUILDING, AND PROMISE IN THE WORLD IS GOING UPSIDE DOWN. I AM NOT SURE THE CITY -- I MEAN, I QUESTION THE ETHICS OF LETTING THEM FLOUNDER WHEN IT MAY HAVE BEEN THE CITY, LIKE SO MANY OTHER PROJECTS, THAT IS ASKED THE DEVELOPER TO MOVE IN, AND THEN WE LEAVE THEM HANGING. I DON'T KNOW HOW MANY ARE LEFT OF THAT, BUT I JUST WANT TO BE CAUTIOUS THAT WE ARE NOT LEAVING PEOPLE THAT WE HAVE ACTIVELY ENGAGED TO COME HERE HIGH AND DRY. >> NO, THAT IS A GOOD QUESTION. THAT IS DEFINITELY NOT WHAT IS HAPPENING HERE. I MEAN, MORE MODERN, PUBLIC EVER SHIPPED HAVE COMPONENTS WHERE THE PROJECT IS AS MUCH FOR US AS IT IS FOR THE DEVELOPER. WHERE WE ARE BUILDING OUT A WALKABLE [00:35:02] CORE. AND THAT PRODUCT IS, I MEAN, THE MOST VIABLE IN THE STATE. SO, IT IS NOT LIKE SOME OF THESE PROJECTS ARE SIMILAR TO WHAT WE DO NOW. BUT, I MEAN, IF YOU HAVE THE BUILDING ALONG U.S. 31, AND IT IS OLDER, AND YOU HAVEN'T ATTEMPTED TO REINVENT IT OR DO SOMETHING ELSE, AND YOU RENT KEEPS FALLING , AND YOU HAVE COMPANIES THAT MOVE OUT TO NEW BUILDINGS , I MEAN, THAT IS WHAT IS GOING TO HAPPEN. I HAVE NO IDEA IF SOMEONE JUST OVER LEVERED THEMSELVES IN AN OFFICE BUILDING THAT DROPPED IN VALUE 15% THREE YEARS LATER. LIKE, WE HAVE NO IDEA HOW SOME OF THESE OWNERS HAVE THE ABILITIES THAT THEY DO. WE KNOW IT IS NOT A GOOD IDEA FOR THE CITY TO THROW MONEY AT THEM AFTER THAT, AND WE KNOW THAT ULTIMATELY, IT IS STILL IN CARMEL , AND STILL AN ASSET FOR SOMEONE. EVEN IF IT IS STILL AN ASSET, FLYING IT FROM A BANK. THIS IS NORMAL STUFF THAT HAPPENS ALL THE TIME. SO, I THINK WE WILL BE GOOD EITHER WAY, IT IS JUST NATURALLY THE SAME STUFF THAT IS HAPPENING IN EVERY DOWNTOWN IN THE COUNTRY. BY THE NATURE OF THE OLDER OFFICE PROJECT. I DON'T THINK THAT IS ANYTHING LIKE WHAT WE WILL DO IN THE LAST 10 YEARS HERE IN THE CORE. WHERE THESE ARE THE MOST DESIRABLE OFFICE BUILDINGS IN THE STATE. US, AND BOTTLE WORKS. MIDTOWN BOTTLE WORKS FOR THE MOST VIABLE MARKETS IN THE ENTIRE STATE. AND WE ARE OUT OF SPACE IN MIDTOWN. >> COUNCILLOR WORRELL? >> UNTIL WE CAN DO THIS VACANCY, WE DID LEARN ON THE WORKSHOP ON SATURDAY , I HAVE SOME STATISTICS, ALONG LINE CORRIDORS IN MIDTOWN, THAT AREA, THE VACANCY RATE IS THREE-POINT 6%, BUT U.S. 31 IS 16.3%. AND COMPARE THAT TO DOWNTOWN MINNEAPOLIS AT 9.5%. THOSE ARE SOME STATISTICS THAT WE HAD AT A WORKSHOP THAT WE ATTENDED ON SATURDAY. >> ARRAY. COUNCILLOR MINNAAR? >> HENRY, I THINK IT WOULD BE BENEFICIAL, BECAUSE I GET A LOT OF QUESTIONS FROM JUST PEOPLE WHO ASK ME , WITH THESE PROJECTS REALLY HAPPEN IF A STRUCTURE HAPPENED? THE ROUNDABOUTS, THE PARKING GARAGES , WITH THE CITY REALLY NEED TO INCENTIVE THE DEVELOPER TO DO THIS SPECIFIC BONDING? COULD IT HAPPEN, REALLY, WITHOUT IT? >> YEAH, I THINK WE HAVE A PERFECT ANSWER TO THAT QUESTION , WHICH IS THE PREMISE IS IF YOU HAVE A DESIRABLE COMMUNITY WITH GOOD SCHOOLS, GOOD POLICE, AND GOOD FIRE , AND WEALTHY PEOPLE THAT LIVE HERE, THE SUM OF THE STUFF MAY JUST HAPPEN. WESTFIELD IS A WONDERFUL COMMUNITY. GOOD SCHOOLS, AND GOOD FIRE PROTECTION POP, AND GOOD PEOPLE. WHERE IS THERE DOWNTOWN? SWEAR IS A WONDERFUL WALKABLE DOWNTOWN? IT DOES NOT JUST HAPPEN. IT HAPPENS WITH POLITICIANS HAVING THE GUTS TO DO PUBLIC PRIVATE PARTNERSHIPS , AND ADMINISTRATIONS THAT WORK THESE DEALS. IT TAKES EVERYBODY TO DO THIS. AND IT IS NOT EASY. I KNOW I AM SPEAKING TO A COUNSEL, BUT IT IS NOT EASY FOR COUNSELORS TO MAKE THESE DEALS. IT'S, LOCATED, AND GET PEOPLE ASKING QUESTIONS, AND THERE'LL BE A CERTAIN PERCENTAGE OF THE POPULATION WHERE A LOT OF PRINTABLE THINGS SHOULD NOT BE INVOLVED IN IN ANY OF THE STUFF EVER. I KNOW YOU HEAR FROM THOSE PEOPLE , BUT WESTFIELD IS WHAT CARMEL WOULD LOOK LIKE IF WE DID NOT HAVE PUBLIC PRIVATE PARTNERSHIPS. IT'S A GREAT PLACE TO LIVE, BUT OUR FRIENDS IN WESTFIELD ON SATURDAY NIGHT WHEN IT IS 80 DEGREES OUTSIDE, THEY ARE IN MIDTOWN. >> THANK YOU, HENRY. THANK YOU, MR. PRESIDENT. >> COUNCILLOR SNYDER? >> WAS AT AN OCCUPANCY RATE JUST COMMERCIAL? WAS IT BLENDED? >> THAT'S OFFICE. >> COUNCILLOR TAYLOR? >> DIRECTOR, THANK YOU. QUESTIONS ABOUT MERCHANT SQUARE. SO, RECENTLY , THE REAL ESTATE INVESTMENT TRUST THAT HELD THAT PROPERTY RECENTLY SOLD . THAT TIFF ALLOCATION AREA EXPIRES ON THE 28TH. WITH CHANGES IN LEGISLATION, IT MIGHT BE MORE DIFFICULT TO LEVERAGE THAT TRADITIONAL COMMERCIA RETAIL AREA. HAS THERE BEEN ANY CONVERSATION WITH THE NEW OWNER? I BELIEVE IT IS A NEW JERSEY FIRM, THAT IS A PRIVATE FAMILY? >> WE HAVE REACHED OUT TO THEM. WE HAVE CONVERSATIONS WITH THE LAST OWNER . SO, I THINK THE OFFICIAL LINE IS I THINK WERE GOING TO SEE WORKERS. THE REASON WHY IT IS SO DIFFICULT -- [00:40:02] >> CASH FLOWS? MAKES MONEY? >> CASH FLOW. IT'S NICE ENOUGH TO BE FILLED . IT'S NOT BAD ENOUGH THAT SOMEONE WILL SCRAP IT AND DO SOMETHING TOTALLY DIFFERENT AND REVAMP IT. I MEAN, IT IS FILLED WITH A B AND C CLASS TENANTS? MY MOM GOES TO TUESDAY MORNING, BUT TUESDAY MORNING IS NOT LIKELY THAT ON OR ANYTHING. IT'S NOT A CLASS TENANTS, BUT IT IS A NICE ENOUGH AREA. IS JUST NICE ENOUGH TO PREVENT SOMEONE FROM TAKING A WHOLESALE LOOK AT IT. IF YOU YEARS AGO, I THINK WE'RE CLOSE TO THAT, AND THEN FLINT MOVED IN AND SAVE THAT AREA. NOW, IT IS NICE ENOUGH FOR NOTHING TO HAPPEN. AND I HOPE AS I SAY THAT, I THINK IT WILL CONTINUE TO BE WORKED ON. I JUST RECOGNIZE WHY I THINK IT IS TOUGH. >> IF YOU LOOK AT THE PRODUCT THAT THE NEW OWNER HAS , IT IS VERY SIMILAR TO MERCHANT SQUARE. THAT IS WHY I'M CONCERNED, ESPECIALLY WITH THE ALLOCATION AREA EXPIRING. THE ONLY QUESTION I HAD IS ON THE EAST SIDE OF THE U.S. 31 COURT OR , I WAS LOOKING AT THE ECONOMIC DEVELOP IN AREAS. ON THE BUILDINGS ON THE WEST SIDE, IS THERE ANYTHING IN THE ALLOCATION AREA THAT WILL SET OFF OPPORTUNITY? >> WELL, EXPIRING DOESN'T HAVE TO DO ANYTHING. SOME OF THE TROUBLED OFFICE PRODUCTS, YES. >> HAS THERE BEEN ISSUES WERE STARS TO CLOG? >> NONE OF THEM HAVE THOSE KIND OF DEBT ISSUES. >> OKAY. >> THOSE ARE ALL IN TIFF AREAS THAT WERE USED TO DO THE BIG TIFF FROM THE PALLADIUM BONDS. NONE OF THEM ARE TIED TO PROJECT SPECIFIC BONDS. >> OKAY. WERE THE CLOCK HAS STARTED? >> NONE OF THAT. >> ARRAY. THOSE ARE MY TWO QUESTIONS. THANK YOU. >> COUNCILLOR LOCKE? >> MY QUESTION WAS MORE FROM THE DATA PERSPECTIVE. WHEN YOU ARE LOOKING AT THIS GOING FORWARD, LOOKING LONGITUDINALLY, WE LOOK AT GENERATIONS OF DEVELOPMENT AND REDEVELOPMENT, AND STRUCTURES OF TODAY THAT ARE WORTHWHILE IN SEARCHES OF YESTERYEAR THAT ARE NO LONGER WORTHWHILE. I WAS WONDERING IF WE COULD ADD A COLUMN OR STRUCTURE TO COMPARTMENTALIZE THE STATE IN A DIFFERENT WAY TO SAY THIS IS RETAIL, LIKE HOW MERCHANT SQUARE WAS , OR HOW THE U.S. 31 COURT OR WAS PURE COMMERCIAL FOR OFFICE SPACE . THIS IS DIFFERENT FROM OUR INCENTIVIZING TODAY , SO LOOKING FROM WHAT WENT DOWN, WHAT HAPPENED, WITH THE BONDS THAT WERE COMING DUE, WHAT TAX REVENUE COMES IN, THAT GIVES US THE ABILITY TO SEE ON A FUTURE SCOPE. IT SHOWS AS HER PROJECTS MAYBE 25 OR 30 YEARS WHERE THEY ARE MOVING, AND THAT GIVES US A DATA SET TO HOW OUR STRATEGIC BUILDOUT WITH THE TIFF IN THE BUILDING WE HAVE DONE THREE DEVELOPMENT IS REALLY SHAPING THE CITY. I THINK IT WOULD BE INTERESTING TO LOOK AT IT FROM THAT PERSPECTIVE, BECAUSE ULTIMATELY, U.S. 31 WAS REDEVELOPED. THOSE ARE TWO DIFFERENT THINGS THAT MAY JUST BENEFIT FROM MORE DATA BEING PULLED TO VERIFY HOW WE ARE DOING. >> ABSOLUTELY. I MEAN, WE DO TRACK THAT STUFF. WE HAVE TWO GIGANTIC REPORTS THAT HAVE ALL OF THAT DATA. SHANE WAS JUST GOING FOR SOMETHING THAT WAS QUICK AND EASY TO UNDERSTAND IN A GENERAL ASSESSED VALUE BREAKER. I THINK WE START BREAKING IT DOWN BY TYPE, AND IT STARTS O GET REALLY OBLIGATED. BUT THE GENERAL ASSESSED VALUE BREAKER MAP REALLY TELLS THE STORY. >> COUNCILLOR TAYLOR? >> THANK YOU, MR. PRESIDENT. ONE LAST QUESTION. I KNOW WE WERE TRACKING HOUSE BILL, WAS IT 1153? IS THAT RIGHT OR SOMETHING LIKE THAT? >> FEELING WHICH CAME OUT OF 1120, AND WENT TO A NEW BUILD IF YOU'RE TALKING ABOUT THE TIFF LANGUAGE. >> YES. HAVE WE DETERMINED HOW THEY ARE GOING TO HANDLE THE SINGLE PARCEL ISSUE? SORRY STILL CONCERNED ABOUT THAT? WHAT ARE OUR LOBBYISTS SAYING? GOT INSERTED IN THE INCENTIVE BILL THAT WAS TAKEN OUT OF THE HOUSE BILL. IT'S STILL TOO BROAD FOR PEOPLE TO REALLY KNOW WHAT IT MEANS. AIM IS ON THAT, AND HOPEFULLY WE WILL SEE SOME TRACTION TO THE CHANGES. >> I THINK COLEMAN IS HEARING THAT? >> ANY TAX AND SENATE BILL, YEAH. >> OKAY. IT WOULD BE GREAT TO FIND OUT HOW THAT IS PROGRESSING AND HOW WORK IS GETTING. >> WE GET EMAILS FROM OUR LOBBYISTS. THE MAYOR GETS EMAILS FROM OUR LOBBYISTS WHEN ANYTHING CHANGES. BUT UNTIL THEY HAVE THE NEXT COMMITTEE TO GO TO THE LANGUAGE, I SUSPECT NOTHING WILL HAPPEN. [00:45:03] >> WE HAVE FIVE TO A BUSINESSES? YEAH. >> YEAH, EVERY COMMITTEE IS ALL DONE, SO EVERYTHING IS ON THE FLOOR. >> RATE. CARMEL IS NOT THE ONLY CITY TRACKING THAT IS IS LIKE. THE LANGUAGE IS TOO BROAD FOR ANYONE TO AND FORWARD. >> AND THEY DON'T EVEN USE CORRECT LANGUAGE LIKE ECONOMIC DEVELOPMENT. THANK YOU. >> ARRAY. ANY OTHER QUESTIONS? THANK YOU, HENRY. >> THANK YOU, ALL. >> MOVING ONTO 11 K, CLIMATE ACTION ADVISORY QUARTERLY REPORT. TONY? PROBLEMS THERE. WILL OKAY, THERE WE GO. MY NAME IS TONY RICK, I AM THE CHAIR OF THE CLIMATE ACTION ADVISORY COMMITTEE. WE HAD A COUPLE MORE MEETINGS SINCE THE LAST TIME I SPOKE , AND WE HAVE COME TO A CONCLUSION ON SOME RECOMMENDATIONS THAT WE WOULD LIKE TO OFFER TO THE CITY COUNCIL. THE FIRST RECOMMENDATION IS THE ESTABLISHMENT OF SUSTAINABILITY COORDINATORS. THIS POSITION WAS ACTUALLY APPROVED BACK IN AUGUST OF 2022 IN THE ORIGINAL CLIMATE ACTION PLAN , AND I HAVE GOT THE QUOTE THERE FROM THE CLIMATE ACTION PLAN . THE CITY WILL HIRE A FULL-TIME SUSTAINABILITY COORDINATOR IN THE COMMUNITY SOURCES OF THE PRIMARY RESPONSE ABILITIES LAMENTING THE C.A.P. AND RELATED SUSTAINABILITY INITIATIVES. THE SUSTAINABILITY COORDINATOR WILL MAKE MAKE SURE THAT THE IMPLEMENTATION IS TAKEN OUT IN A -- THE SUSTAINABILITY COORDINATOR WILL ALSO BE IN CHARGE OF EVOLVING THE PLAN -- WE NEED SOMEBODY FULL-TIME WHO CAN FOCUS THEIR FULL ENERGY ON THIS POSITION , AND WORK WITH THE DIFFERENT DEPARTMENTS WITHIN THE CITY GOVERNMENT. WHAT WE WILL NEED IS A DESCRIPTION OR QUALIFICATION OF THE POSITION, SALARY RANGE, AND THE REPORTING STRUCTURE THAT D.O.C. HAS. SO, I THINK A LOT OF THAT HAS BEEN MAPPED OUT [00:50:02] ALREADY , BUT WE JUST THE FINALIZATION OF IT FROM THE CITY COUNCIL. LIKE I SAID, THE RATIONALE IS WE NEED SOMEONE TO CONTINUE TO MAINTAIN THE DASHBOARD THAT THE CITY HAS PUT UP THROUGH ERI IN COLLABORATION WITH ERI. WE NEED SOMEBODY WHO CAN HELP WORK WITH THE DIFFERENT DEPARTMENTS ON IDENTIFYING THE ITEMS THAT ARE GOING TO FIT THE STRATEGIES TO ESTABLISH NEED SOMEBODY WHO CAN THAT. WE HAVE COME TO A CONCLUSION THAT THIS IS A FULL-TIME POSITION. NOT A SINGLE MEMBER OF THE COUNCIL OR THE COMMITTEE IS EQUIPPED TO DO THAT. THEN, SOME OF OUR RECOMMENDATIONS , I WENT OVER THEM BRIEFLY LAST TIME. EB ONE AND EB TWO, WE COMBINE THESE TOGETHER . EB-2 HAVE REPORTING ON AN ANNUAL BASIS. WE WANTED TO DO THIS WE COULD ESTABLISH A BENCHMARK WHEREVER WE ARE, BUT WE ALSO WANTED TO ESTABLISH A KPI WE COULD MEASURE THE PROGRESS OVER TIME. AND THEN, EB-1 KIND OF GOES IN LINE WITH THAT. THEY WANT TO GO WITH CONFERENCE OF EVALUATION OF ALL USABLE BUILDINGS FOR ENERGY EFFICIENCY. UPGRADES SUCH AS MORE EFFICIENT HVAC SYSTEMS REPLACING FOSSILS AND SYSTEMS WITH LOW FLOW , SOLAR POTENTIAL FOR EACH OF THE CITY BUILDINGS, ROOFTOPS OR SOLAR FIELDS , AND ENERGY-SAVING TECHNOLOGY FOR COMPUTERS AND OTHER ACTIVITIES. LIGHT SWITCHES, AND SO FORTH. SO, WE NEED TO ESTABLISH A BENCHMARK FIRST. THEN, WE WILL SET UP WITH STRATEGIES WE WILL USE TO MITIGATE CARBON REDUCTION FROM EACH INDIVIDUAL BUILDING. AND GOING FORWARD TO WASTEWATER AND WATER USAGE , WE DETERMINED THROUGH OUR MEETINGS THAT WE NEEDED TO DO AN ASSESSMENT FIRST BEFORE WE DO ANYTHING ELSE. WE NEED TO FIND OUT WHERE WE ARE. SO, IT COMES DOWN TO WE NEED TO SET A BENCHMARK ON ALL OF THESE DIFFERENT STRATEGIES SO WE CAN ACTUALLY DEVELOP THE KPIS IN THE METRICS ON WHERE WE NEED TO BE. AND WHAT WILL THESE DO? THIS IS ALSO WHERE THE SUSTAINABILITY COORDINATOR COMES INTO PLAY. BY CONDUCTING THE ANALYSIS ON TIME AND COST THAT THE STRATEGIES WILL ENDURE. SO, THE WASTEWATER WILL ALLOW THE CITY THE BENCHMARK AND ALLOW THE METRICS. THE G3 IS CLIMATE CHANGE PROGRESSION. WE NEED TO BE READY FOR THIS, AND WE NEED TO LOOK AT DIFFERENT THINGS SUCH AS DROUGHT RESISTANT VEGETATION THROUGHOUT THE CITY. SO, THAT WILL ENABLE US NOT TO JUST HAVE VEGETATION THAT CAN WITHSTAND DRY PERIODS OF TIME, BUT ALSO, THE CITY DOES NOT HAVE TO SPEND EXORBITANT AMOUNTS OF ENERGY WATERING THESE PLANS DURING THAT TIME. IT HAS BEEN BROUGHT TO MY ATTENTION THAT IT IS NOT NECESSARILY JUST THE WATER, BUT IT IS THE PUMPING OF THE WATER THAT WE HAVE TO GET UTILIZATION OF TO DO A LOT OF THE IRRIGATION THAT THE CITY DOES. AND, SAME WITH RESIDENTS. YOU KNOW? CAN TELL YOU WHEN THEY ARE WATERING THEIR YARDS IN THE SUMMERTIMETO THE EXACT MINUTE. SO, IT'S PRETTY NICE TECHNOLOGY THAT WE HAVE HERE IN CARMEL. SO, THAT'S ANOTHER ONE. MOVING FORWARD, FOOD COMPOSTING PILOT PROGRAMS WITH THE BIN VOUCHER PROGRAM. WE WOULD LIKE TO SEE THE CITY PARTNER WITH BUSINESSES THROUGHOUT THE COMMUNITY TO INCORPORATE COMPOSTING. BUT WE ALSO KNOW THAT IN ORDER TO REALLY MAXIMIZE THE GREATEST IMPACT, WE NEED GREEN TO GO IN THERE. LIKE YARD CLIPPINGS AND SO FORTH. WE HAVE THAT, BUT IT IS THROUGH THE PARKS AND RECREATION STREET APARTMENT. WE NEED TO FIND OUT WAYS TO BRING THOSE THINGS TOGETHER. AND THAT IS ONE AREA WHERE THE SUSTAINABILITY COORDINATOR CAN REALLY ASSIST. IN WORKING WITH THOSE DEPARTMENTS , DEVISING A PLAN TO WHERE WE CAN REALLY BRING THOSE THINGS TOGETHER , AND MAKING IT WORK TO OPTIMIZE THE COMPOSTING AND EVERYTHING. ONE THING IT IS GOING TO DO IS IT IS GOING TO ELIMINATE THE AMOUNT OF GRASS CLIPPINGS AND YARD WASTE THAT GOES TO THE LANDFILLS. LANDFILLS, WHEN YOU DO THAT WITH VEGETATION ORGANIC MANNER, YOU WILL RELEASE METHANE, WHICH IS 10 TIMES WORSE THAN CARBON IN THE ATMOSPHERE. SO, WE WOULD BE AVAILABLE TO REDUCE THAT [00:55:05] DRAMATICALLY WITH COMPOSTING AND EVERYTHING. THAT WILL BE VERY BENEFICIAL THERE. PLUS, THAT THE CROSSING MEASURE AS WELL. IN THE PUBLIC EDUCATION AND CLIMATE VULNERABILITY ASSESSMENTS. WE GOT THESE 22 GO TOGETHER. WE NEED TO SET UP AN INITIAL AWARENESS PROGRAM. AND WE GOT MANY AVENUES THAT WE CAN PUBLICIZE THIS THROUGH THIS CARMEL NEWSLETTER. SOCIAL MEDIA, OTHER AVENUES AND ACTIVITIES AND EVENTS THAT ARE GOING ON AROUND THE CITY AT DIFFERENT TIMES OF THE YEAR. WE CAN ADVERTISE AND EDUCATE THE COMMUNITY ABOUT WHAT THE CITY IS DOING. ANOTHER GOOD AVENUE IS THE DASHBOARD. IF YOU LOOK AT OUR DASHBOARD, IF ANY OF YOU HAVE NOT DONE SO, I WOULD RECOMMEND IT. WE HAD THE BEST DASHBOARDS THAT YOU WILL FIND IN THE COUNTRY THAT IS REALLY HIGHLIGHTING WHAT WE ARE DOING IN THE CITY AND WE PLAN TO DO IN THE CITY, AND WHERE WE ARE RIGHT NOW. IT'S A GREAT OPPORTUNITY TO BASICALLY EDUCATE THE COMMUNITY ON WHAT THE CITY IS DOING TO REALLY SET THE EXAMPLE GOING FORWARD. AND THEN, WITH THE CLIMATE VULNERABILITY ASSESSMENT, WE HAVE IT. WE NEED TO FINALIZE IT . WE NEED TO GO BACK AND LOOK AT IT, AND START SOME OF IT IS STARTING TO GET UPDATED. SO, WE NEED TO DO ANOTHER CARBON COUNTING TO SEE WHERE WE ARE AT THIS POINT IN TIME. THIS WOULD BE COMPARED TO, I BELIEVE, IT WOULD BE DONE BACK IN 2018. WE PROBABLY NEED TO UPDATE THAT AND SEE IF ANYTHING HAS CHANGED. ESPECIALLY IF WE WANT TO ESTABLISH THOSE BENCHMARKS TO REALLY HAVE SOMETHING TO BENCHMARK IT AGAINST, AND REALLY KNOW WHERE WE ARE. SO, THOSE OF THE RECOMMENDATIONS RIGHT NOW FROM THE CARMEL CLIMATE ACTION PLAN, AND THEN WE HAVE ONE WITH THE HYDROGEN PURCHASING. SORRY ABOUT THAT. WE ARE KIND OF LOSING FOCUS HERE. I DON'T KNOW IF THAT CAN COME IN. NO, WE LOST IT. BUT THIS IS THE HYDROGEN FLEET PURCHASING AND RETROFIT POLICY THAT WE ARE RECOMMENDING TO THE CITY AS WELL. ONE OF THE NICE THINGS IS IT CAN BE WORKED ON BY THE SUSTAINABILITY COMMITTEE. IT HAS BEEN STARTED BY A CITY EV WORKING GROUP. SO, THIS IS SOMETHING THAT THE CITY HAS GONE TOGETHER AND CREATED. WE JUST WANT TO RECOMMEND THAT THERE IS MORE FOCUS GIVEN TO IT, AND MORE ATTENTION , AND THAT WE LOOK AT SOME RESOURCES AND EVERYTHING THAT THEY MAY NEED, AND DELIVER THOSE TO THEM. IN THE CARMEL CLIMATE ACTION COMMITTEE AND THE SUSTAINABILITY COORDINATOR CAN WORK WITH THAT GROUP WITHIN THE CITY , MAKE IT FLOURISH , AND MAYBE START LOOKING AT REPLACING SOME OF OUR GASOLINE POWER OR ICED AUTOMOBILES WITH ELECTRIC OR EVEN HYDROGEN AS THAT BECOMES MORE AVAILABLE. SO, THAT IS WHERE WE ARE RIGHT NOW. OUR NEXT MEETING IS SCHEDULED FOR MARCH 26 AT 6:00 P.M. HERE AT THE COUNCIL CHAMBERS. ANY QUESTIONS FROM ANY COUNCIL MEMBERS? >> COUNCILLOR AYERS? >> THANK YOU. GOES TO THE COORDINATOR, -- TALKING HIM WAS HAVING A STRONG RETURN ON INVESTMENT IF POSSIBLE IN THIS POSITION. MY RECOMMENDATION, YOU DO THOSE KPIS , OR ESTABLISH THEM TO HAVE COST SAVINGS AS ONE OF THE KPIS THAT YOU ARE TRACKING QUARTER BY QUARTER. AND THEN, LOOKING AT THE QUALIFICATIONS , WE HAVE A LOT OF GREAT PEOPLE WHO DO MARKETING ALREADY FOR THE CITY. OUR MAYOR IS A STRONG MARKETING BACKGROUND. HOPEFULLY YOU CAN FIND SOMEBODY WITH MORE OF A PROCESS IMPROVEMENT OR ENGINEERING BACKGROUND THAT UNDERSTANDS ENERGY EFFICIENCIES. NOTHING AGAINST MARKETING, I THINK WE ALREADY HAVE THAT, AND CREATE AWARENESS OF MARKETING. THERE ARE PEOPLE WE CAN PARTNER WITH. WHAT WE MIGHT BE MISSING IS THAT ENERGY MANAGER SITUATION. SO, I THINK THAT'S A GREAT START. HOPEFULLY WHEN THEY ARE POSTING THAT, THAT IS WHAT WE ARE LOOKING FOR. >> ONE THING WE ARE REALLY LOOKING FOR ANY COORDINATOR IS GRANT TRADING EXPERIENCES. WE HAVE MISSED OUT ON SOME GRANT PROPOSALS ON THE STATE AND FEDERAL LEVEL ALREADY THAT WE HAVE TAPPED INTO FOR THE CITY TO HELP PAY FOR SOME OF THESE PROGRAMS. IS NOT EASY TO NAVIGATE THAT RED TAPE. SO, WE NEED SOMEONE WITH THAT EXPERIENCE AS WELL. THAT AS TO THEIR QUALIFICATIONS AS AN INDIVIDUAL. >> COUNCILLOR MINNAAR? >> THANK YOU, MR. PRESIDENT. I'M VERY MUCH IN FAVOR OF SUSTAINABILITY. SO, THANK YOU SO MUCH FOR THE EFFORTS THAT YOUR COMMISSION HAS BROUGHT FORTH. I HOPE AT SOME POINT, I CAN ATTEND ONE OF YOUR [01:00:03] MEETINGS. I SEEM TO MISS THEM EVERY TIME THEY COME, BECAUSE I HAVE SOMETHING SCHEDULED ON THAT NIGHT. I AM JUST CURIOUS . YOU ARE TALKING ABOUT RETROFITTING OUR FLEETS. WHICH FLEETS WERE YOU TALKING ABOUT? OUR SALT TRUCKS? >> GAS POWERED VEHICLES. IF WE HAVE DIESEL, THEY CAN BE RETROFITTED TO NATURAL GAS. THEY ARE LOOKING AT RETROFITTING INTERNAL COMBUSTION ENGINES WITH HYDROGEN CELLS. AND, YOU KNOW, JUST THINGS LIKE THAT. OR, JUST REPLACING. AS THEY SERVE THEIR LIFE, INSTEAD OF BUYING IN NEW OR LEASING IN NEW INTERNAL COMBUSTION ENGINE VEHICLES, LOOKING AT A HYBRID OR ELECTRI VEHICLE WOULD BE BETTER ON USAGE. >> WITH THAT IN MIND, I HAVE DONE A LITTLE BIT OF RESEARCH ON THE COST OF THESE VEHICLES. THEY ARE VERY EXPENSIVE. WHAT IS THE RATE OF RETURN? I MEAN, OBVIOUSLY, THE CLIMATES, BUT WHAT IS THE RATE OF RETURN ? >> I CAN SPEAK FROM EXPERIENCE . ALSO LOOKING AT THE FLAT OUT COST, THE ACQUISITION COST OF IT, IF YOU INCORPORATE THE GRANT TRADING ABILITY OF THE INDIVIDUAL OR THE COORDINATOR , THE I.R.A. IN THE FEDERAL GOVERNMENT RIGHT NOW CAN ACTUALLY GIVE A $30,000 REBATE PER VEHICLE FOR CITY GOVERNMENTS. THAT WHICH ARE MEDICALLY LOWER THE COST BELOW OF AN INTERNAL COMBUSTION ENGINE VEHICLE. AND THEN, I KNOW FOR MY PERSONAL EXPERIENCES , I JUST GOT A HYBRID THREE WEEKS AGO. 12 GALLONS OF GAS, I HAVE PUT OVER 850 MILES ON IT. >> THAT IS FANTASTIC. >> AND I THINK CHARGING IT COSTS ME JUST A LITTLE OVER $20.00, COMPARED TO HOW WOULD COST AND GAS. THE RETURN ON INVESTMENT, IF DONE APPROPRIATELY, CAN BE VERY GOOD. >> THAT'S GREAT. I KNOW I HAVE SPOKEN WITH A LOT OF THE FIREFIGHTERS , AND I THINK IF YOU'RE GOING TO DO SOMETHING LIKE THAT, THE COMMITTE SHOULD CONTACT EACH DEPARTMENT, MEANING THE FIRE DEPARTMENT , THE STREET DEPARTMENT TO SEE HOW THEY FEEL ABOUT IT , HOW THEY FEEL IT COULD BE AND LAMENTED. I THINK A GOOD PARTNERSHIP BETWEEN THE TWO OR ALL THE DEPARTMENTS THAT HAVE GAS POWERED VEHICLES , IT WOULD BE IMPORTANT TO ENGAGE THEM. >> RIGHT. AND THAT IS WHAT WE HAVE TALKED ABOUT IN THE LAST MEETING. REACHING OUT TO EACH OF THE INDIVIDUAL DEPARTMENTS. WE, AS VOLUNTEERS ON THE COMMITTEE, WE DON'T HAVE THE BANDWIDTH TO DO THAT. SO, THAT RIGHT THERE ALSO JUSTIFIES THE COORDINATOR'S POSITION. >> FANTASTIC. THANK YOU SO MUCH. >> ALL RIGHT. COUNCILLOR LOCKE, AND IT WILL GO TO COUNCILLOR TAYLOR? >> I WAS JUST GOING TO RESPOND ON THAT. FROM THE COUNCIL, ONE OF THE THINGS WE ARE LOOKING AT IS STRATEGICALLY CREATING THESE STRUCTURES IN A WAY WHERE WE CAN FIND THE RIGHT PEOPLE AND PLACES WHERE THEY MAKE SENSE. SO, THE FINANCIAL NATURE THAT WE ARE TALKING ABOUT, IT DOESN'T MAKE SENSE TO REPLACE A FIRE TRUCK YET BECAUSE THE ECONOMY IS NOT THERE. THERE MAY BE OTHER VEHICLES AS FLEETS COME DO THAT MAKE SENSE TO REPLACE OR LOOK AT. SO, REALLY, THE KEY TO THE PLAN , AS YOU HAVE SEEN, IT'S 10 OR 11 THAT WE HAVE STRUCTURED FROM THE COMMITTEE SO FAR AS TOP PRIORITIES. BUT THERE ARE 50 SUM TOTAL THAT WERE FOUND BY THE CITY THAT HAD A PLAN PUT FORTH. SO, HAVING A WAY TO GO THROUGH THEM AND SEE WHAT MAKES SENSE TO IMPLEMENT, WHAT, FOR ME JUDICIARY STANDPOINT, IS COST EFFECTIVE TO CUT DOWN ON CARBON? SOME STUDIES OUT THERE NOW BASED ON WHERE INDIANA IS . ON OUR ELECTRICITY CREATION , IT'S NOT EITHER CARBON NEUTRAL TO HAVE AN ELECTRIC VEHICLE IN SOME INSTANCES BECAUSE OF THE AMOUNT OF COAL BURNED BY THE CHURCH VEHICLE. ENSURING THAT WE LOOK AT THE FUTURE OF OUR PURCHASES OR STRUCTURES FROM SPACE SUSTAINABLE PERSPECTIVE , THIS COMMITTEE IS SET UP TO ALLOW FOR STRATEGIC BY AND FROM THE PUBLIC, FROM THE MEMBERS OF THE COMMITTEE, FROM ANYBODY. SO, PLEASE FEEL FREE TO COME AND SHARE YOUR INPUT TO ENSURE THAT WE ARE MOVING IN THE RIGHT DIRECTION WITH THE STRATEGIES WE ARE PUTTING INTO PLACE. SO FAR, IT HAS BEEN FUN , AND I THINK THERE IS A LOT OF WORK TO DO FROM A STRATEGY PERSPECTIVE ON JUST HOW TO GET THIS SET UP RAY TO BE IN LAMENTABLE. I MEAN, HOW CAN WE BE SUPPORTIVE TO THIS GOVERNMENT ENTITIES? THE FIRE, THE ENGINEERING, THE STREETS? IS THERE ANYTHING LOOKING INTO WHAT THEY DO? SUSTAINABILITY MIGHT NOT BE TOP OF THE MIND. WE MIGHT JUST BE LOOKING FOR THE BEST DEAL OR STRUCTURE THAT WORKS WELL. HOW CAN WE HELP PRIORITIZE THAT , AND APPLY FOR GRANTS TO KEEP THEIR COSTS LOW TO ALLOW US TO DO MORE TO KEEP THE CITY MOVING IN A CERTAIN DIRECTION ON THE SPECIFIC ISSUE? THIS IS REALLY THE ASKED TODAY. JUST A PRESENTATION OF HERE IS WHAT WE HAVE TALKED ABOUT, HERE IS WHERE WE ARE MOVING, AND REALLY, THE STRATEGY OF WHO, HOW, WHY, WHEN IS REALLY THE WORK OF WHAT THIS COMMITTEE WILL DO MOVING FORWARD. [01:05:04] >> THAT'S FANTASTIC. THAT IS A GOOD, LONG TERM PROCESS. COUNCILLOR TAYLOR? >> THANK YOU, MR. PRESIDENT. A BIG PART OF SUSTAINABILITY IS ALSO FINANCIAL SUSTAINABILITY. SOMETHING I WOULD REALLY LOVE TO SEE THE CITY MOVE FORWARD WITH, AND I HAVE TALKED TO THE MAYOR MUCH ABOUT THIS HIGHER TO ELECTION AND POSTELECTION. IF DEVELOPING A LONG-TERM CAPITAL ASSET PLAN FOR OUR FACILITIES. WHEN YOU DO AN ASSESSMENT OF THESE FACILITIES , I'M NOT ONLY LOOKING FOR CONSERVATION EFFORTS , BUT LOOKING AT THE FINANCIAL VIABILITY , AND THE FUTURES OF THESE ASSETS THAT WE HAVE BUILT , OUR FIRE STATIONS AND ET CETERA. WHEN YOU LOOK AT THE ENVIRONMENTAL SUSTAINABILITY PIECE, WHICH THE COMMITTEE MAY WANT TO LOOK AT, THERE IS ALSO WHAT IS CALLED PERFORMANCE CONTRACTING. IT IS WHERE THESE MECHANICAL SYSTEMS, THESE UPGRADES, ET CETERA CAN BE PAID FOR INSTEAD OF COMING FROM TAXPAYER DOLLARS . IT CAN BE PAID FOR BY THE ENERGY SAVINGS PRODUCED BY UP LAMENTING THESE SYSTEMS. SO, HOPEFULLY THE COMMITTEE CAN LOOK AT SOME OF THOSE SOLUTIONS AND RECOMMENDATIONS AS WE LOOK AT LONG-TERM MAINTENANCE FOR OUR FACILITIES. I ALSO WANTED TO MENTION, BECAUSE MICHAEL IS HERE FROM THE PARKS, AS YOU NOTED , THE NATIVES. PLANTING IN A NATURAL PRAIRIE NOT ONLY DOES ALL THE GREAT THINGS THAT YOU MENTIONED IN THE COMMITTEE, BUT ALSO, IT COSTS LESS THAN MAINTAINING TURF. IT PRODUCES WILDLIFE HABITAT. SO, FROM THE FISCAL SUSTAINABILITY PORTION , ALONG WITH THE ENVIRONMENTAL CITY ABILITY PIECES, I THINK IT IS IMPORTANT TO INCORPORATE SOME OF THOSE NOTES IN YOUR WORK. SO, THANK YOU FORT YOU GUYS ARE DOING. >> THANK YOU. >> COUNCILLOR JOSHI? >> I JUST WANTED TO THANK YOU FOR COMING IN DOING A PRESENTATION. I HAVE THE OPPORTUNITY TO SIT ON SOME OF THESE MEETINGS. I THINK THE IMPORTANCE IS THAT DATA-DRIVEN PROCESS THAT YOU ARE SORT OF LOOKING AT TO GATHER THE DATA, BOTH FROM THE FISCAL PERSPECTIVE, AS WELL AS THE ENVIRONMENT OF PERSPECTIVE. PUT THAT TOGETHER, AND CREATE A PLAN THAT CAN ACTUALLY MOVE THE CITY FORWARD, AND LET US CONTINUE TO BE LEADERS IN THIS AREA. BECAUSE I THINK WE HAVE DONE A GOOD JOB THUS FAR, AND I THINK WE CAN CONTINUE THAT PROCESS, BECAUSE IT IS IMPORTANT. SO, I JUST WANT TO COMMEND YOU, AND THANK YOU FOR COMING. >> THANK YOU. >> COUNCILLOR WORRELL? >> THANK YOU. TONY, THANK YOU FOR YOUR PRESENTATION. I JUST WANTED TO ASK, ARE YOU FAMILIAR WITH THE TESTING THAT IS GOING ON AT THE STREET DEPARTMENT TO CONVERT A FEW OF OUR PICKUP TRUCKS TO HYDROGEN? >> IT HAS BEEN MENTIONED. I'M NOT VERY FAMILIAR WITH IT. BUT IT HAS BEEN MENTIONED. >> SO, I DON'T KNOW IF STAFF -- IT SEEMS TO ME , I WANT TO [12. OLD BUSINESS] MAKE SURE THAT THE LATINOS WITH THE RIGHT HAND KNOWS, BUT I ATTENDED A PRESENTATION BACK IN 2021 WHERE, YOU KNOW, WATER TURNS INTO THE ENERGY TO MAKE THE TRUCK GO. SO, IT'S PRETTY AMAZING. I HAVE NO IDEA WHERE THAT HAS GONE SINCE NOW, BUT I WANT TO ASK YOU TO PUT THAT ON YOUR TARGET LIST . OR, I WILL SEND YOU SOME INFORMATION TO SEE. >> THAT IS PROBABLY THE INTERNAL SUSTAINABILITY GROUP THAT IS WORKING ON THAT. >> I JUST WANTED TO MAKE SURE YOU KNOW ABOUT IT. >> OKAY. ANY OTHER QUESTIONS? NO? THANK YOU. >> THANK YOU. >> ALL RIGHT . MOVING ONTO AGENDA ITEM NUMBER 12, OLD BUSINESS. A, SEVENTH READING OF ORDINANCE T-2696-23. IN ORDINANCE OF THE COMMON COUNCIL, THE CITY COUNCIL OF INDIANA , ADDING CHAPTER 8, ARTICLE FOUR, SECTION 8-44 TWO [13. PUBLIC HEARINGS] CARMEL CITY CODE. COUNCILLOR WORRELL AND VICE PRESIDENT AASEN . REMAINS IN FINANCE, AND THE NEXT MEETING IS APRIL 9TH. MOVING ON TO B, SECOND ORDINANCE OF ORDINANCE Z-8687-24 . IN ORDINANCE OF COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ESTABLISHING THE INJURIES PLANNED UNIT DEVELOPMENT DISTRICT. SPONSOR IS COUNCILLOR MINNAAR. IT REMAINS IN LAND AND SPECIAL STUDIES COMMITTEE. THAT IS ON MARCH 8TH? AND THEN WE WILL HAVE THE PUBLIC HEARING. MOVING ONTO AGENDA ITEM 13, PUBLIC HEARING. FIRST READING OF ORDINANCE T-2702-24 , AND ORDINANCE OF THE COMMON COUNCIL [01:10:03] OF THE CITY OF CARMEL, INDIANA, AUTHORIZING AND APPROVING AND APPROPRIATION OF FUNDS FROM THE PARKS AND RECREATION ON REVERTING CAPITAL FUND, FUND NUMBER 103. SPONSORS ARE COUNCILLOR SNYDER AND COUNCILLOR TAYLOR. HAVE A MOTION TO INTRODUCE? >> I MOVED TO INTRODUCE. >> SECOND. >> ALL RIGHT, THAT IS GOOD. >> WE HAVE THEM BOTH COVERED. >> SYNOPSIS, COUNSELOR TAYLOR, PLEASE? >> APPROPRIATE $6,800,000.00 FOR PARK CAPITAL PROJECTS FROM LOCAL INCOME TAX , LIT, FUNDS RECEIVED FROM CLAY TOWNSHIP ATTRIBUTABLE TO CENTRAL PARK BOND. >> THANK YOU. TONIGHT, WE ARE ASKING YOU TO DO IS APPROPRIATE FUNDS HELD TO THE CITY OF CARMEL , AND THE NON-AVERTED FUNDS CONTROLLED BY THE PARK BOARD. TO GIVE A LITTLE BIT OF BACKGROUND, THE INTERLOCAL COOPERATION AGREEMENT BETWEEN THE CITY OF CARMEL AND CLAY TOWNSHIP, THE CLAY TOWNSHIP IS OBLIGATED TO PROVIDE ALL THE LOCAL INCOME TAX DOLLARS THAT THE TOWNSHIP RECEIVES THAT ARE ATTRIBUTABLE TO THE CURRENT CENTRAL PARK BOND TO THE PARK BOARD FOR PARK CAPITAL PROJECTS. THE CENTRAL PARK BOND WAS THE LAST MUSICAL BOND THAT WAS ISSUED IN THE STATE OF INDIANA THAT FACTORED INTO THE DISTRIBUTION FOR PERFORMING FOR THOSE LOCAL INCOME TAX DOLLARS. THAT HAS BEEN A SIGNIFICANT FUNDING SOURCE FOR PARKS AND RECREATION SINCE THE ISSUANCE OF THAT BOND. BASICALLY, LAST YEAR, THE STATE BOARD ACCOUNTS ISSUED A RULING TO CLAY TOWNSHIP INDICATING THAT, UNLIKE PREVIOUS YEARS OF THE TOWNSHIP HAD RECEIVED WITH FUNDS, THAT THEY COULD NO LONGER DEPOSIT THOSE FUNDS INTO THE 1215 ON REVERTING FUND THAT THE TOWNSHIP TRUSTEE HOLDS FOR THE PARK BOARD. THE ONLY WAY THAT THE TOWNSHIP COULD EXPEND THOSE FUNDS IS OUT OF THE TOWNSHIP GENERAL FUND, AND IT WAS THROUGH A DISCUSSION WITH THE TOWNSHIP THAT ULTIMATELY AGREED THAT IT WAS BEST NOT TO KEEP THE PARK BOARD'S FUNDS WITHIN THE TOWNSHIP'S GENERAL FUND. JUST FOR TRANSPARENCY PURPOSES. SO, THE BEST SOLUTION WAS TO MAINTAIN THOSE FUNDS IN THE 103 NON-AVERTED PARK FUND THAT IS MAINTAINED BY THE CITY OF CARMEL. SO, WE ARE ASKING FOR THE APPROPRIATION OF THOSE FUNDS SO WE COULD USE HIM FOR A VARIETY OF PROJECTS THAT HAVE BEEN PLANNED THAT ARE IDENTIFIED IN OUR CURRENT COMPREHENSIVE RECREATION PLAN. THE MAJOR PROJECTS THAT WE ARE LOOKING AT, ONE $500,000.00 FOUR THE WHITE RIVER BRIDGE THAT HAS A JOINT PROJECT WITH CLAY TOWNSHIP. THE PARK BOARD HAS COMMITTED ONE $500,000.00 FOR THE BRIDGE , AND WE ARE LOOKING AT USING THE LIP FOR THAT. WE ARE ALSO USING IMPACT FEE IS FOR THE INFRASTRUCTURE THAT IS WITHIN HAZEL LANDING PARK, WHICH IS SEPARATE FROM THIS. WE ARE ALSO REQUESTING $500,000.00 IN THE AMOUNT FOR WEIGHT RIVER GREENWAY EXPANSION. NOT ONLY THE PROJECT THAT IS A GRANT FUND, BUT A PROJECT THAT WILL CONNECT RIVER HERITAGE PARK TO THE EXISTING GREENWAY THAT CURRENTLY TERMINATES IN THE COUNTY'S RIVER WORD PARK. THERE IS CURRENTLY $1,000,000.00 SET FOR THE SPLASH PAD CONVERTING THE EXISTING KIDDIE POOL TO A SPLASH PAD. THAT WILL ALLOW US TO UPGRADE THIS POPULAR FEATURE , AND ALSO ALLOW US TO REDUCE STAFFING WITHIN THE WATER PARK, WHICH WILL HELP US WITH THE DIFFICULTY THAT WE HAVE ON SECURING LIFEGUARDS. $1,000,000.00 TOWARDS THE DEVELOPMENT OF THE INDOOR PLAYGROUND , WHICH WILL BE A NEW RECREATIONAL AMENITY WITHIN THE GOLDENEYE COMMUNITY CENTER THAT WILL BE PARTNERED WITH THE PAST STRUCTURE, AS WELL AS USABLE BY VISITORS WITH A PASSES THAT WILL BE HELD TOWARDS THE COST RECOVERY OBJECTIVES OF THAT FACILITY . APPROXIMATELY THREE AND $52,000.00 FOR RENOVATING WESTERN MEYER CONFERENCE , SPECIFICALLY REPLACING THE RUBBER SURFACING IN THAT VERY HEAVILY USED PLAYGROUND THAT WE SEE IN UPWARDS OF 400,000 VISITORS PER YEAR. SO, WE REQUEST AND APPROPRIATION OF THOSE FUNDS TONIGHT SO THAT WE CAN GET STARTED ON THOSE PROJECTS. WITH THAT, I WOULD BE HAPPY TO ADDRESS ANY QUESTIONS THE COUNCIL HAS. >> ANY QUESTIONS? ALL RIGHT. ANY QUESTIONS TO THE LEFT? COUNCILLOR MINNAAR? >> I JUST WANTED TO CONGRATULATE YOU ON YOUR AWARD. THAT IS ALL I HAD TO SAY. >> THANK YOU. >> I JUST THOUGHT EVERYBODY SHOULD KNOW. >> IT IS A HUGE HONOR TO RECEIVE THAT AWARD. PREVIOUS RECIPIENTS OF IT HAVE BEEN [01:15:03] PEOPLE THAT HAVE BEEN MY IDOLS IN THE PROFESSION FOR YEARS. INCLUDING THE FORMER GENERAL MANAGER OF THE CHAMPAIGN PARK DISTRICT, WHICH IS WHERE I GREW UP. IT'S SIMILAR TO MY PROFESSION FROM THE '50S TO THE 2000'S. THE PAST DIRECTOR OF LAFAYETTE, WHO IS ONE OF MY EARLIEST MENTORS , GIVE ME THAT. IT WAS TRULY AN HONOR TO RECEIVE THAT, SO, THANK YOU SO MUCH. >> ANYONE ELSE? WE WILL HAVE THE PUBLIC HEARING NOW. IF ANYONE WANTS TO MAKE A COMMENT, THEY CAN COME UP TO THE PODIUM. I WILL START THE PUBLIC HEARING AT OFFICIALLY 7:16. AGAIN, IF ANYONE WANTS TO MAKE A COMMENT, THEY CAN GO TO THE PODIUM FOR THREE MINUTES. I KNOW. I AM JUST, YOU KNOW, GIVING YOU GUYS A HARD TIME. I WAS WAITING FOR [14. NEW BUSINESS] SOMEONE TO SAY SOMETHING. WE WILL AND THE PUBLIC HEARING NOW AT 7:17. THIS WOULD GO TO COMMITTEE, ALYSSA MAUTZ TO MAKE A MOTION? >> I MOVED TO WAY THE RULES . >> I SUSPEND THE RULES. >> SECOND. >> ANY DISCUSSION? OKAY, PLEASE VOTE. ALL RIGHT, THAT IS 9-0. IS THERE ANOTHER MOTION? >> I MOVE TO APPROVE. >> SECOND. >> ALL RIGHT. DISCUSSION? PLEASE VOTE. ALL RIGHT. THAT IS APPROVED, 9-0. THAT IS IT FOR PUBLIC HEARINGS. MOVING ON TO AGENDA ITEM 14, NEW BUSINESS. FIRST READING OF ORDINANCE D-2702-24 . AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, REPEALING ORDINANCE D-2409-18, AS AMENDED, AND REMOVING ARTICLE TWO, CHAPTER 2 , SECTION 25 FROM CARMEL CITY CODE. SPONSORED BY PRESIDENT GREEN AND COUNCILLOR WORRELL. >> I MOVE TO APPROVE. >> SECOND. >> MIMI READ THE SYNOPSIS? >> REPEALS D-2409-18 AS AMENDED, AND ABOLISHES THE CARMEL PUBLIC ART ADVISORY COMMITTEE. >> ANY PRESENT, IF THERE IS ANYTHING YOU WANT TO ADD? >> GOOD EVENING. THERE IS REALLY NOT MUCH TO ADD. THAT IS EXACTLY WHAT THE ORDINANCE DOES. IT IS ONE OF THOSE THAT HAS A LOT OF LEGAL LANGUAGE, BUT REALLY, THAT IS WHAT IT DOES. IT ABOLISHES THE CARMEL PUBLIC ART COMMITTEE. THE MAYOR WILL INTRODUCE A DIFFERENT TYPE OF ART COMMISSION. SO, THE ART IN CARMEL IS NOT GOING AWAY , AND THE PUBLIC INPUT WILL ACTUALLY BE INCREASED RATHER THAN DECREASED. I KNOW IT SOUNDS A LITTLE BIT DAUNTING, BUT IT IS A GOOD TAKE. >> THANK YOU. THE IDEA IS TO GET RID OF THIS COMMISSION, AND ESTABLISH A NEW COMMISSION. TONIGHT, WE WILL BE APPOINTING THREE INDIVIDUALS TO THE COMMISSION, AND THE MAYOR HAS ALREADY APPOINTED HER FOUR. ACTUALLY, THE FIRST MEETING, -- WELL, I AM JUMPING AHEAD. ALL RIGHT. I WILL ENTERTAIN A MOTION? >> I MOVE TO APPROVE. >> SECOND. >> THIS IS TO SUSPEND. >> THERE IS A MOTION TO SUSPEND THE RULES. WE HAVE A SECOND. ANY DISCUSSON? PLEASE VOTE. ALL RIGHT, THAT PASSES 9-0. IS THERE ANOTHER MOTION? >> I MOVE TO APPROVE. >> SECOND. >> ALL RIGHT. DISCUSSION? PLEASE VOTE. ALL RIGHT. THAT IS APPROVED, 9-0. MOVING ON TO 14 B, FIRST READING OF ORDINANCE D-2706-24;, AN ORDINANCE OF THE COMMON COUNCIL OF CITY OF CARMEL, INDIANA, AMENDING CHAPTER THREE, ARTICLE ONE, DIVISION TWO, SECTION 3-30 OF THE CARMEL CITY CODE. SPONSORS PRESIDENT GREEN AND COUNCILLOR WORRELL. >> I MOVE TO APPROVE. >> SECOND. >> COUNCILLOR WORRELL, CAN YOU READ THE SYNOPSIS? >> THIS IS AN ORDINANCE THAT AMENDS THE ORDER OF BUSINESS AGENDA BY REMOVING PUBLIC ART COMMITTEE'S ANNUAL REPORTS. THIS GOES IN LINE WITH WHAT WE [01:20:02] JUST DID, AND I MOVED TO SUSPEND THE RULES. >> SECOND. >> ANY DISCUSSION? VICE PRESIDENT AASEN? >> JUST ONE THING, I WANT TO THANK COUNCILLOR WORRELL FOR ESTABLISHING THE PUBLIC ART COMMITTEE MANY YEARS AGO. I KNOW THERE WAS SOME PUSHBACK AT THE TIME ON THE COUNCIL FROM SOME OF THE PUBLIC. BUT I THINK IT WAS A GREAT STEP TO GET MORE PUBLIC INPUT INTO OUR ART PROCESS. I THINK WE, AS A COMMUNITY, HAVE LEARNED A LOT FROM THE COMMITTEE. SO, THANK YOU FOR THAT. I AM GLAD TO SEE THAT IT IS STILL LIVING ON JUST IN A DIFFERENT FORM. >> THANK YOU, VICE PRESIDENT AASEN. >> >> I JUST WANTED TO VERIFY, AS WE GET RID OF THE CODE COMMITTEE AND A PLACE IT WITH AN EXECUTIVE ORDER COMMITTEE, WILL BE STILL, HERE AT THE COUNCIL, GET INFORMATION ON STRUCTURES? WILL THAT BE SOMETHING THAT IS PART OF THE MAYORS UPDATES WHEN SHE COMES BEFORE US? I JUST WANT TO MAKE SURE WE DON'T LOSE THAT PROCESS HERE AT THE CITY COUNCIL LEVEL . >> YOU KNOW THAT AS PART OF THE EXECUTIVE ORDER? I KNOW THERE IS SOMETHING ABOUT REPORTS AREA AND >> IT WAS NOT EXECUTIVE ORDER, BUT WE CAN CERTAINLY WORK ON THAT SO THAT THE COUNCIL IS FULLY INFORMED OF COMMISSIONS DOINGS. BUT EITHER WAY, IT WILL BE EITHER THE MAYOR'S REPORT OR THE REPRESENTATIVE OF THE COMMISSION REPORT. >> THANK YOU. I JUST WANTED TO MAKE SURE THAT AS WE MOVE TOWARDS AN EXECUTIVE ORDER COMMISSION ON THIS, THAT WE WILL FUNCTION IN A SIMILAR WAY WHERE WE STILL CONTINUE TO GIVE THIS PUBLIC FORUM TO THESE DISCUSSIONS OF NECESSARY , CONSIDERING WE WILL BE APPROPRIATE IN FUNDS FOR THESE PROJECT MOVING FORWARD. >> FIRST READING OF ORDINANCE D-2707-24; , AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER EIGHT, ARTICLE FIVE, SECTIONS 8-36, 8-37, 8-47, AND 8-48 OF THE CARMEL CITY CODE. THE SPONSORS ARE COUNCILLOR WORRELL, PRESIDENT GREEN, AND COUNCILLOR AYERS. >> I MOVED TO INTRODUCE. >> SECOND. >> OKAY, COUNCILLOR AYERS, CAN YOU PLEASE READ THE SYNOPSIS? PARKING OF MOTOR VEHICLES ON CITY STREETS, AND REGULATING/PROHIBITING TURNING OF VEHICLES AT CERTAIN INTERSECTIONS. >> ALL RIGHT. SURGERY, PLEASE PRESENTS? >> GOOD EVENING, AGAIN. THIS ORDINANCE REGULATES FOUR DIFFERENT LOCATIONS IN CARMEL. FIRST IS THE ORDINANCE IS SECTION 836 . THE FIRST LOCATION THAT MAC -- CAN I GET A CAMERA APPEAR? HERE WE ARE. THE FIRST LOCATION PROHIBITS LEFT-HAND TURNS ONTO WESTBOUND RED TRUCK ROAD . THIS IS RED TRUCK ROAD. AND ON NORTHBOUND RANGELINE ROAD. THIS PROHIBITS LEFT-HAND TURNS ON THE NORTHBOUND RANGELINE ROAD FROM EASTBOUND RED TRUCK ROAD. BASICALLY, THIS TURN WILL BE PROHIBITED . THAT'S PERSONALLY TURN I TAKE TO GO TO WORK , BUT I UNDERSTAND THE NECESSITY OF THAT. AND THEN, THE LEFT TURN GOING FROM RED TRUCK ROAD GOING DOWN BRANCH LINE WILL BE PROHIBITED AS WELL. SO, THIS IS THE FIRST ONE. THE SECOND ONE IS SECTION 8-37, 50 MINUTE LOADING ZONES. THIS ONE IS THE FIRST PARKING SPACE ON THE NORTH SIDE OF WAYNE STREET AND EAST OF RANGELINE ROAD IS THE SPACE REHEAR. THIS IS FIRST ON MAINE. THIS IS ELEMENT OF WOODY'S REHEAR. THIS CREATES A 15 MINUTE SPACE FOR LOADING AND UNLOADING THAT AREA FOR FIRST ON MAINE. THE THIRD , THIS ONE CONCERNS SECTION 8-47, NO [01:25:10] PARKING AREAS. THIS ONE CREATES A NO PARKING ZONE ON THE EAST SIDE OF MAPLE DRIVE FROM 99TH STREET TO -- LANE. THIS ELAINE REHEAR , IT CREATES A NO PARKING AREA. AND FINALLY, THIS ONE IS A TWOFOLD AMENDMENT . THAT CONCERNS TWO SECTIONS , 8-47, THE PARKING AREA, AND 8-48, THE LIMITED PARKING AREA. THIS ONE IS IN FRONT OF THE FIRE HEADQUARTERS. RIGHT NOW, IT IS UNREGULATED AT ALL. SO, WE CAN PARK THERE AT ANY TIME. THE FIRST SECTION WOULD CREATE A NO PARKING ZONE MONDAY THROUGH FRIDAY , AND THE SECOND SECTION WILL CREATE A THREE HOUR PARKING ZONE ON SATURDAY AND SUNDAY. THAT HAS BEEN VETTED, OF COURSE, BY THE CARMEL FARM FIRE DEPARTMENT , AND THEY ARE ON BOARD WITH THIS. THESE ARE THE FOUR CHANGES TO THE PARKING AND TURNING. I WILL BE ABLE TO ANSWER ANY QUESTIONS. ANY TECHNICAL QUESTIONS I'M SURE WILL BE ANSWERED. >> ANY QUESTIONS? COUNCILLOR TAYLOR? >> THANK YOU, SERGI. THE LEFT IN AND OUT WOULD BE ALLOWED FOR EMERGENCY VEHICLES GOADING TO STATION 41, RIGHT? >> THAT IS CORRECT. >> THIS QUESTION MIGHT BE FOR JEREMY, BUT I WAS WONDERING WHY IN FRONT OF THE CARMEL CLAY COMMUNITY BUILDING AND CARMEL FIRE DEPARTMENT ADMINISTRATION , THIS QUESTION JUST AS IT WAS VETTED BY THEM, BUT PARKING IS LIMITED THERE ANYHOW FOR THE CARMEL FIRE DEPARTMENT MINISTRATION. WHY WOULD IT WE JUST MAKE THAT, FIRE DEPARTMENT PARKING ONLY IN FRONT OF THE CARMEL CLAY COMMUNITY BUILDING, AND ALLOW PUBLIC USE AT ALL? BESIDES MAYBE ON THE WEEKENDS OR SOMETHING? >> DIRECTOR OF ENGINEERING. WE ARE TRYING TO LIMIT THAT AREA THAT SAYS NO PARKING, BUT THE MAIN GOAL IS TO HAVE SCHOOL BUSES THERE TO COME TOTHE BUILDING AND DROP OFF LIKE THAT . THE IDEA IS THAT IF THE BUILDING IS NOT BEING USED FOR PUBLIC USE ON THE WEEKEND, THEN WE WOULD ALLOW NORMAL THREE HOUR PARKING. >> THE ROOFTOP OR WHAT HAVE YOU? >> YES. >> COUNCILLOR WORRELL, STAY THERE, JEREMY. DID THAT COME FROM A COUNSELOR? WHAT IS THE PROBLEM? >> THAT ACTUALLY CAME -- THAT AREA RIGHT THERE, THERE IS A CURB . I BELIEVE IT IS A DEPRESSED CURB, AND THERE IS STONE. >> ANY PUT THE MAP BACK UP THERE? >> SO, FROM IN SHADOW UP TO 99TH STREET, THIS AREA RIGHT HERE, I BELIEVE THERE IS SOME TRENCHES THERE. AND IT STONE ON THE BACKSIDE OF THE CURB. THERE WERE A COUPLE OF THINGS WE WERE WORRIED ABOUT. THE LIGHT WAS NOT THERE TO BEGIN WITH, BECAUSE WE DID NOT THINK PEOPLE WOULD PARK IN A LANDSCAPED INVITATION TRENCH. THAT HAS STARTED HAPPENING, AND THERE IS SOME CONCERNS WHEN YOU EXIT AND ENTER THE AREA THERE. IT WAS NOT INTENDED TO BE A PARKING AREA TO BEGIN WITH, BUT THEY STARTED PARKING THERE. >> IF YOU CAN PUT THAT BACK UP , I DROVE THROUGH THAT, AND I TALKED TO SOMEONE BEFORE , AND YOUR GUYS PUT A TEMPORARY NO PARKING SIGN UP THERE. ISN'T THAT A LITTLE BIT FURTHER SOUTH DO YOU KNOW? >> THAT, NOT EXACTLY SURE ABOUT. >> ALL RIGHT, THANKS. >> COUNCILLOR SNYDER? >> BACK TO THE FIRE STATION, JEREMY, WHEN I ASKED YOU, I GUESS I DO NOT HEAR YOU ALL ENOUGH. BUT YOUR SING THE PUBLIC CAN PARK THERE? ON THE WEEKENDS? >> YES, IT WOULD JUST BE NORMAL THREE HOUR PARKING , AND THAT IS CONSISTENT WITH WHAT WE HAVE DONE ON VETERANS WAY AND ON MAIN STREET. >> RIGHT UP AGAINST THE BUILDING? I JUST WANT TO MAKE SURE. [01:30:02] >> YES. THERE IS A SIDEWALK. >> YES, THE SCHOOL BUS DROP OFF. MY CONCERN IS THAT ON THE WEEKENDS OR THE TIMES WHERE ZOOM IS GOING TO BE PULLING THE RECORDING OUT THE MOST , IF THERE ACCESS IN FRONT OF THE GARAGE DOORS ARE BLOCKED, HOW ARE THEY -- >> THAT IS WHAT WE NEED TO TAKE A LOOK AT THE MOST. WE CAN IDENTIFY THAT . >> JUST AN APPARATUS I THINK WOULD BE PRUDENT. >> WE CAN TAKE A LOOK AT THAT. >> I DON'T CARE. >> VICE PRESIDENT AASEN? >> IF THEY DO HAVE THE TWO HOUR PARKING ON WEEKENDS, BUT IF THERE IS AN EVENT, OR LIKE COUNCILLOR SNYDER WAS SAYING, WE CAN STILL BLOCK OFF PARKING IF WE NEED TO? >> YES. IF THERE IS AN EVENT THAT WILL GO THROUGH THE EVENT SCHEDULE THROUGH THE BOARD OF PUBLIC WORKS, AS PART OF THAT, THEY CAN WORK WITH NO PARKING SIGNS ON THE WEEKENDS. THAT'S KIND OF STANDARD PRACTICE. >> COUNCILLOR SNYDER, DO YOU HAVE SOMETHING? >> IT MIGHT BE SOMETHING THAT WE HAVE TO LOOK AT AFTER:00 P.M. I JUST KNOW THE PROGRAMMING FOR THE MUSEUM IS PRIMARILY GEARED TOWARDS A SPECIAL EVENT. I DON'T KNOW. I THINK IT IS SOMETHING , A BLANKET IN FRONT OF THOSE DOORS. I THINK IT IS WHAT THE PROGRAMMING IS INTENDED TO BE. >> OKAY, WE CAN DO THAT. >> COUNCILLOR MINNAAR? >> I WOULD AGREE WITH MATT. I WAS INVITED TO A WEDDING ON MONDAY OF THE ECLIPSE, AND THERE WILL BE NO PARKING IN FRONT OF THAT BUILDING IN THE EVENING. SO, I AGREE WITH MATT. MAYBE WE SHOULD LOOK AT IT IN A DIFFERENT WAY AFTER 530, 6:00 P.M. , BEING ALLOWED TO PARK THERE AS WELL? I MEAN, I KNOW IT IS A MONDAY, IT IS IN OUR DAY TO HAVE A WEDDING , BUT IT IS STILL, TO ME, A BIT STRANGE. >> COUNCILLOR TAYLOR, GO AHEAD? >> JUST A COUPLE OF THINGS. YOU KNOW, -- BLESS YOU. NO, THE FIRE DEPARTMENT NEEDS APPROPRIATE PARKING . I KNOW PARKING IN THE GARAGE IS WHERE THE PUBLIC HAD USED IT , MATT IT ON A GOOD POINT AS WELL. IF THERE WAS ANYBODY TO TAKE A LOOK AT HOW WE CAN ADDRESS THAT? I UNDERSTAND AFTER HOURS, THERE MIGHT BE A SCHOOL BUS PULLING UP TO GO THROUGH , WHAT IS THE CALL NOW? FIRE SAFETY TRAININGS? YEAH. BUT IN GENERAL, I THINK IT IS DIFFICULT FOR OUR FIRE DEPARTMENT LEADERSHIP TO FIND PARKING. >> OKAY. >> CAN YOU SHOW US THE LANGUAGE? AND SERGI, WHAT IS THE BEST WAY? WE HAVE BEEN BE RESOLUTION TONIGHT ? OR THIS IS THE ORDINANCE? >> YEAH, THAT IS A THREE HOUR PARKING ZONE ESTABLISHED ON VETERANS WAY. THAT IS A WITH FELL STREET FOR A DISTANCE OF 200 FEET ON SATURDAY AND SUNDAY ONLY. OTHER THAN THAT, IT REMAINS IN THE NO PARKING AREA. WE WOULD PROBABLY HAVE TO REVISIT OTHER SECTIONS OF THE CITY CODE TO SEE IF THERE IS SOMETHING ELSE TO DO THAT. >> VICE PRESIDENT AASEN? >> I THINK COUNCILLOR SNYDER MADE A GOOD POINT. THERE ARE TWO THINGS TO DRESS. ONE WOULD BE IF YOU COULD OPEN IT UP ON WEEKDAYS. IF YOU GO ON SATURDAY AND SUNDAY, SOMEBODY WHO IS 8:00 ON A FRIDAY WOULD BE UNAVAILABLE. AND THEN COUNCILLOR SNYDER WOULD KNOW MORE ABOUT THIS. IF THERE IS TIME OFF DURING THE DAY, THE FIRE DEPARTMENT NEEDS THOSE SPACES . IS THERE GOING TO BE AN EASIER WAY FOR THEM TO DO THAT AS OPPOSED TO HAVING TO GO THROUGH THE BP W EVERY TIME? BECAUSE IT IS NOT A HUGE INCONVENIENCE, BUT THERE IS A TIME SENSITIVITY FOR THAT. >> I DON'T KNOW HOW TO DO IT, BUT IS THERE A WAY TO MOVE THIS FOR STRIKING THAT? WE CAN JUST SEND THAT SECTION FOR FURTHER REVIEW? >> ABSOLUTELY. >> SO, I WAS NOT ACCEPTING THE FIRE DEPARTMENT TO HAVE TO GO, BUT FOR THE MUSEUM TO GO, I CLASSIFY THE AREAS RIGHT FROM THE GARAGE DOOR AS DRY VERSUS ON STREET PARKING AREAS. SO, I THINK WHAT WE COULD DO IS LOOK TO SEE HOW THE PARKING SPACES THEMSELVES IN FRONT OF THE [01:35:03] BUILDING ARE ESTABLISHED VERSUS THE DRY AREA? >> AND IF WE PULL THAT OUT TONIGHT , THEN IT IS JUST A FREE WHEEL. EVERYONE CAN PARK THERE ALL THE TIME? IF WE MOVE IT AND THEN HAVE THEM LOOK AT IT, THAT WE CAN HAVE THEM AMEND THAT PROVISION SPECIFICALLY LATER AND HAVE THAT SHIFT IF NEED BE. DRIVING BY, I WOULD ASSUME THERE IS SOMETHING THERE? IT GOES INTO GARAGE DOORS FOR STREET PARKING. THE PROCESS WISE, WE WOULD RECOMMEND THAT WE MOVE ALL FOR , AND IF WE NEED TO RECOMMEND, THAT WE CAN LATER DO THAT. >> OKAY, VICE PRESIDENT AASEN? AMEND PART OF IT RIGHT NOW, AND THEN WE CAN SEE WHAT YOU WANT TO DO THERE. I MAKE A MOTION TO AMEND THAT SECTION OF IT TO SAY NO PARKING BEFORE 5:00 P.M. MONDAY THROUGH FRIDAY , AND THEN KEEP THE WIDTH OF THE LANGUAGE THE SAME. DOES THAT MOTION WORK? >> I SECOND THAT. >> AND, MR. PRESIDENT? >> IT LOOKS LIKE WE HAD TWO MOTIONS. >> YES, I AM JUST DISCUSSING THE MOTION. HOW MANY PARKING SPOTS ARE WE TALKING ABOUT? AND WHERE ARE THEY, PLEASE? >> I THINK IT IS AROUND THREE OR FOUR FROM THE ROOFLINE OF THE BUILDING HERE . >> RAY, IS OFF OF THE GARAGES? >> RIGHT. >> OKAY. THIS THING WHICHEVER DID TALK ABOUT THE DRIVEWAY. SO, WE CAN GET RID OF THAT CONCEPT. SO NOW, WE ARE TALKING ABOUT HOURS. IS THE FIRE TO PERMIT EVEN THERE AFTER 5:00 ON WEEKDAYS? MINISTRATION IS PRETTY MUCH CLOSED, RIGHT? SO, THIS WOULD NOW BE THREE HOURS AFTER 5:00 OR WHATEVER YOU SAID, I AM SORRY, AFTER 5:00, AND THEN SATURDAY AND SUNDAY, THREE OR PARKING? OKAY, GREAT. >> GREAT. ANYTHING ELSE? >> YEAH, WE ARE STILL MISSING THE POINT, IN MY OPINION, THAT THIS IS A PUBLIC BUILDING , AND MOST OF THE BUILDING IS OPEN TO THE PUBLIC. WHEN THERE ARE EVENTS IN THE EVENINGS , THERE ARE LOTS OF DROP-OFFS. I MEAN, ANYTIME THERE ISN'T AN EVENT, PEOPLE UP TO PULL UP AND DROP THINGS OFF. IF THEY DON'T HAVE THE ABILITY TO PULL UP AND DROP THINGS OFF, WHAT ARE THEY GOING TO DO? BALLPARK? LIKE, WE ARE TALKING ANYTHING FROM SMALL U-HAUL'S FOR TABLES AND CHAIRS TO JUST THE KNITTING CLUB IN THEIR SUPPLIES. YOU KNOW? >> AND THE USE THE DRIVEWAY? WHAT WE ARE SAYING IF THE SPOTS ARE EMPTY AND IT IS 7:00 ON A FRIDAY, WOULDN'T IT BE OKAY FOR SOMEONE TO PARK THERE FOR THREE HOURS? >> THREE HOURS 6210:00, WHEN THEY WOULD NEED TO UNLOAD. >> IS A BLOCK OFF THE SPACES WHEN THEY ARE RESERVING THE SPACE? WITH A HAVE TO GO TO THE BP W? >> I THINK WE SHOULD PROBABLY TALK TO THE FIRE DEPARTMENT BEFORE MAKING IT A LAW. >> WOULD IT BE -- THAT'S WHAT I WAS GOING TO SAY. >> WE WILL CERTAINLY CONFIRM IT ONE MORE TIME. IN THE FIRE DEPARTMENT WAS ON BOARD. THAT IS WHY WE ARE PRESENTING. BUT WE WILL GO TO THE NEW CONCERNS THAT YOU ALL RAISED, AND DISCUSS IT AT THE COMMITTEE. >> SERGI? IT'S A TOWNSHIP BUILDING. I WOULD RECOMMEND CALLING THE TOWNSHIP . BECAUSE THAT IS WHO WOULD REALLY NEED TO GIVE THEIR BLESSING ON THIS. LAND-USE COMMITTEE. SO RULED. >> WELL, THERE IS A CURRENT MOTION ON THE TABLE, CORRECT? MOTION TO AMEND. DO I HAVE A MOTION TO WITHDRAW THE AMENDMENT? >> I MOTION TO WITHDRAW THE MOTION SO IT WILL BE CONSIDERED BY THE COMMITTEE. >> SECOND. >> MOTION HAS BEEN WITHDRAWN. WE WILL SEND THIS TO THE FINANCE RULES COMMITTEE. COUNCILLOR LOCKE? >> THERE ARE THREE OTHER PARTS OF THIS ORDINANCE THAT DO MAKE SENSE TONIGHT OR COULD IF WE MOVED AND APPROVED THAT. I MAKE A MOTION TO AMEND IT? I CAN'T BECAUSE IT IS AN ORDINANCE? [01:40:02] >> SERGI? >> YES, SIR, YOU CAN PARDON SECTIONS ONE, TWO, THREE, FOUR, A-76, AND SIX- 78. >> OKAY, TO CLARIFY, SERGI, WE CAN MAKE A MOTION TO ATTEND TO WITHDRAW THE ONE PORTION, AND THEN ACT ON EVERYTHING ELSE? >> WE HAVE TO CREATE A NEW ORDINANCE JUST FOR THAT ONE PART. >> THAT IS A GOOD QUESTION. I WILL HAVE TO COME BACK ON THAT. >> THAT IS PROBABLY WE WILL HAVE TO DO. OKAY. >> OKAY, WE HAVE A MOTION? >> YEP. I WILL MOVE THE ORDINANCE IN ITS ENTIRETY, NOT INCLUDING SECTIONS FOUR AND FIVE . >> SECOND. >> I'M SORRY, SECTION FOUR-A-76. THAT'S A LITTLE MAPLE DRIVE . >> OKAY. I MOVED TO AMEND AS COUNSEL RECOMMENDED? >> SECOND. >> SERGI, DO YOU UNDERSTAND THAT? >> AND YOU REPEAT IT FOR ALL OF US? >> SURE, ABSOLUTELY. THE MOTION AMEND THE ORDINANCE TO EXCLUDE THE CENTER COMMITTEE SECTION FOUR, AND THAT IS CONCERNING CITY CODE , NO PARKING AREAS, SUBSECTION A-77 AND SECTION 5 CONCERNING CITY CODE, SECTION 848 LIMITED PARKING AREAS, SUBSECTION Q. THE ORDINANCE , SECTION 4 CONCERNING CITY CODE SECTION 8-47, NO PARKING AREAS , A-76 CAN MOVE FORWARD. >> THANK YOU. WE HAVE A MOTION IN A SECOND. SERGI JUST READ IT OFF. ANY DISCUSSION? ALL RIGHT, PLEASE VOTE. ALL RIGHT. THE AMENDED IS APPROVED , 9-0. I'M LOOKING FOR A MOTION TO SUSPEND THE RULES? >> IT TO SUSPEND THE RULES AND ACT AS AMENDED. >> SECOND. >> OKAY. DISCUSSION? PLEASE VOTE. IT'S APPROVED, 9-0 . SUSPENDING THE RULES. WE CAN ACT ON IT TONIGHT. >> SECOND. >> DISCUSSION? PLEASE VOTE. ALL RIGHT! IT'S APPROVED AND AMENDED, 9-0. COUNCILLOR SNYDER? >> I REALIZED I DID NOT DO A GOOD JOB EXPLAINING THE IN FRONT OF THE DOORS PART. THERE IS NO PARKING THERE. BUT, WHEN THOSE TRUCKS PULL OUT , YOU ARE BLOCKING THE ENTIRE PATH. SO, IN MY HEAD, THEY ARE GOING TO NEED SOMEWHERE TO GO. IF THEY GO OUT AND THEN PULL IN WITH THE TURNOUT , OTHERWISE, THE PEDESTRIANS WOULD HAVE TO MOVE INTO THE STREET TO GO AROUND THE TRUCKS. I AM SORRY YOU DID NOT MAKE THAT CLEAR. THERE ARE NO PARKING SPOTS THERE, BUT I ALSO DON'T THINK IT IS PRUDENT TO HAVE THEM SITTING OUTSIDE FOR EVERYBODY TO SEE COMPLETELY BLOCKING THE PEDESTRIAN TRAFFIC. >> GOOD POINT. WE WILL DISCUSS THE FINANCE. MOVING NTO 14 D, RESOLUTION CC-03-04-24-01, A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, APPROVING A TRANSFER OF FUNDS IN THE 2024 INFORMATION AND COMMUNICATION SYSTEMS DEPARTMENT BUDGET, SPONSOR, COUNCILLOR WORRELL. >> I MOVED TO INTRODUCE. >> SECOND. >> OKAY, COUNCILLOR WORRELL?, COVER EXPENSES INCURRED IN THE CONSULTING FEES LINE ITEM WITHIN THE 2024 INFORMATION AND COMMUNICATION SYSTEMS DEPARTMENT BUDGET. >> SERGI, PLEASE PRESENT. >> THERE HAS ACTUALLY BEEN A REQUEST TO RECEIVE, AFTER THE DEADLINE . THE AMOUNT OF MONEY THAT CAN BE TRANSFERRED IS NOT [01:45:03] $69,040.00, BUT $49,780.00. I APOLOGIZE FOR A VERY LATE AMENDMENTS, BUT THAT IS THE UPDATED PROPOSAL THAT WE RECEIVED FROM OUR CONSULTANTS. SO AGAIN, WE WILL BE ASKING FOR AN AMENDMENT FOR $69,030.00 TO $49,080.00. THE REST OF IT IS CORRECT. THE RESOLUTION TRANSFERS FROM COMMUNICATION SYSTEMS DEPARTMENT NUMBER 1115, LINE ITEM 435-5600 , SUBSCRIPTION SOFTWARE. THAT'S FOR THE AMOUNT OF $40,780.00 INTO INFORMATION AND CAN VACATION SERVICES DEPARTMENTS NUMBER 1115, LINE ITEM 434300, CONSULTING PIECE . AGAIN, THAT AMOUNT IS $49,780.00. WE HAVE TIMOTHY RENICK HERE WITH US TODAY IF YOU LIKE TO LEARN MORE ABOUT THE TRANSFER OR THE TECHNICAL SIDE OF THAT. >> ANY QUESTIONS? >> YEAH, I THINK WE NEED TO BE CLEAR IN CASE ANYONE IS WATCHING. DO I ASSUME THEN WHATEVER SOFTWARE THIS IS , THE CONSULTANT NOW TOLD US IT IS NO LESS MONEY? IS THAT WHAT I CAN SAFELY ASSUME? >> THAT IS CORRECT. >> OKAY, I WILL VOTE FOR THAT ALL DAY. OKAY. >> ANY QUESTIONS? >> I WAS JUST LOOKING FOR A CLARIFICATION ON THAT EXACTLY, AND I DON'T KNOW IF TIM WANTS TO SPEAK TO THAT. BUT I GUESS THE CONSULTANT SAID IT WAS LESS, BUT THERE MAY BE SOME OTHER REASON WHY IT MIGHT BE A LITTLE BIT LESS , SO I JUST WANT TO GIVE THE OPPORTUNITY FOR TRANSPARENCY FOR THE NEXT DONATION. >> GOOD EVENING, COUNSEL. THE REDUCED COST, THIS IS CONSULTING SERVICES. SO, THIS WAS AN INITIATIVE PLACED BY THE MAYOR. SO, WHAT MY PLAN IS IS TO COVERED THIS PHASE OF THE CONSULTING COST FOR THIS PROJECT OUT OF MY CURRENT CONSULTING PHASE , AND THEN MOVING MONEY THAT HAS ALREADY BEEN BUDGETED FOR A CYBERSECURITY INITIATIVE THAT WE HAVE BEING COVERED BY FEDERAL GRANT FUNDS. SO, IT IS NOT AND APPROPRIATION, IT IS JUST MOVING FUNDS ARE NOW CONSIST OF THE THE CONSULTING IN ORDER TO COVER THIS PHASE OF THE PROJECT. >> THANK YOU FOR THAT. >> ABSOLUTELY. ANY OTHER QUESTIONS? TO THE LEFT? TO BE RIGHT? >> WHAT IS THE PROJECT? >> 311. IT IS A DISCOVERY, AND ASSESSMENT, AND A REDO OF 311. IN CASE YOU DON'T KNOW WHAT 311 IS, DIALING 311 , I HESITATE TO SAY 911, EVERYONE SAYS KNOWS WHAT 911 IS, BUT USING 311 FOR NONEMERGENCIES STARTED IN THE MID-'90S IN BALTIMORE. SO, THEY WANTED TO TAKE STRESS OFF OF THEIR 911 SERVICES, AND SAY THAT IS ONLY FOR EMERGENCIES. IF YOU NEED TO INTERACT WITH THE CITY, YOU 311. WITH THE EVOLUTION OF TECHNOLOGY , TEXTING AND EMAILING, THINGS LIKE THAT, 311 HAS BECOME AN UMBRELLA TERM FOR GENERIC INTERACTION BETWEEN THE CITY , CONSTITUENTS, AND THINGS LIKE THAT. RIGHT NOW, WE HAVE THE CARMEL APP, AND THEN OF COURSE, WE HAVE PHONE CALLS AND THINGS LIKE THAT. BUT THIS FIRST PHASE WITH THE CONSULTANT IS REALLY MEETING WITH EACH DEPARTMENT, AND SAYING HOW DO YOU HANDLE REQUESTS FROM THE CITIZENS BUILDING THAT INTO A SCOPE , AND THEN YOU MOVE INTO A SECOND PHASE OR OTHER PHASES TO SAY , YOU KNOW, THIS IS HOW WE NEED TO DO IT MORE EFFICIENTLY FROM THE CITY . INTERESTINGLY ENOUGH, TODAY'S A PERFECT EXAMPLE. THIS MORNING, I RECEIVED AN EMAIL ASKING ABOUT DOG BARKING ORDINANCES , AND THIS AFTERNOON, I RECEIVED ONE WITH THE PERSON COMMENTING ON SPECTRUM CABLE TV RATE HIKES. SO, YOU KNOW, HAVING THEM GO TO THE DIRECTOR OF TECHNOLOGY IS NOT PROBABLY WHERE THEY SHOULD START. SO, THAT KIND OF SLOWS DOWN THE PROCESS. BUT IT IS REALLY LOOKING AT THAT SYSTEM AND HOW THE CITY IN TOTAL HANDLES REQUESTS MOVING FORWARD IN THIS INDUSTRY. >> ANY OTHER QUESTIONS ? TIMOTHY, I'M LOOKING FOR A MOTION TO AMEND? >> I WILL MOTION TO AMEND. >> SECOND. >> ARRAY, WE HAVE A MOTION TO AMEND FROM $69,030.00 TO $49,780.00? ALL RIGHT, AND THERE IS A SECOND. ANY DISCUSSION? PLEASE VOTE. ARI, THAT IS APPROVED. I'M LOOKING [01:50:02] FOR A MOTION TO APPROVE THE RESOLUTION AS AMENDED? >> I MOVE TO APPROVE. >> SECOND. >> DISCUSSION? PLEASE VOTE. ALL RIGHT. THE RESOLUTION, AS AMENDED, IS APPROVED, 9-0. THANK YOU. >> THANK YOU. >> MOVING ON TO RESOLUTION CC-03-04-24-02 , RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, REGARDING TRANSFER OF REAL PROPERTY TO THIRD-PARTY. SPONSORS ARE VICE PRESIDENT AASEN AND PRESIDENT GREEN. >> I MOVED TO INTRODUCE. >> SECOND. >> OKAY, VICE PRESIDENT AASEN, PLEASE READ THE SYNOPSIS? >> THIS RESOLUTION AMEND THE MINIMUM SALES PRICE FOR SALE OF EXCESS REAL PROPERTY LOCATED NEAR 96 STREET AND KEYSTONE PARKWAY THAT IS NOT NEEDED FOR PUBLIC PURPOSE. SERGI HAS PROVIDED SOME AMOUNTS VIA EMAIL, AND CAN SHARE THAT WITH US. >> GOOD EVENING. AS VICE PRESIDENT AASEN MENTIONED, THIS ORDINANCE AMEND THE MINIMUM SALES PACE PRICE THAT IS LOCATED AT THE INTERSECTION OF 96TH STREET AND HAYWARD WAY OR KEYSTONE PARKWAY. IN 2021, THIS COUNCIL APPROVED THE RESOLUTION THAT ESTABLISHED A MINIMUM SALES PRICE FOR THE EXCESS LAND THAT THE CITY NO LONGER NEEDS FOR PUBLIC PURPOSE WHICH, IN TURN, THERE WAS A MAJOR IMPROVEMENT WERE OTHER BERRIES AND PERMITS WERE CONSTRUCTED. WE ESTIMATED THE AMOUNT THAT THE CITY NEEDED WAS INCORRECT. SO, THERE IS A PROBLEM THAT THE CITY DOES NOT NEED FOR PUBLIC PURPOSE. AT THE TIME, AGAIN, AND 2021, HE ESTABLISHED A MINIMUM SALES PRICE AS REQUIRED BY INDIANA CODE TO MOVE FORWARD TO SELL THE LAND FOR THE BIDDING PROCESS. THAT'S AMOUNT WAS ESTABLISHED AT $1,750,000.00. HOWEVER, TWO APPRAISALS THAT CAME BACK WHERE ONE WAS FOR 800,000 , THE OTHER ONE WAS FOR 770,000. I AM NOT EXACTLY SURE WHY THE AMOUNT OF MINIMUM BIDDING PRICE WAS ONE .7 MILLION, BUT IT CLEARLY WAS CONSIDERABLY HIGHER THAN THE APPRAISED VALUE OF THE LAND. SURPRISINGLY, WE DO NOT RECEIVE THE BID FOR THE LAND, AND ALSO, ACCORDING TO THE INDIANA CODE, THE NEXT STEP WAS TO HIRE A BROKER TO TRY TO FIND SUITORS DIRECTLY. AFTER SEVERAL YEARS, WE FINALLY HAVE AN OFFER THAT OFFERS $1,060,000.00 , AND THE RESOLUTION OF AMENDS MINIMUM SALES PRICE FOR THIS PARCEL TO 1,060,000. SO, TO GIVE YOU LITTLE BIT MORE BACKGROUND ON THE PROPERTY ITSELF, I APOLOGIZE FOR THE QUALITY OF THE GOOGLE MAP THAT I AM ABOUT TO PRESENT , BECAUSEMY PRINTER RAN OUT OF COLOR. SO, THIS IS THE GENERAL LOCATION WHERE THE PROPERTY IS LOCATED. YOU CAN SEE THIS IS KEYSTONE AND 96 THREE. YOU CAN SEE IT AS A REGULAR SHAPE. BUT THE PARCEL IS ACTUALLY THIS. SO, IT IS NOT THE ENTIRETY OF THAT PROPERTY . IS A VERY REGULAR SHAPE. IT DOES HAVE ACCESS FROM HABER WAY . IT ONLY HAS LIMITED VISIBILITY AS WELL. AND, IT HAS A GIANT TRANSMISSION LINE THAT GOES AROUND IT THAT LOOKS AT THIS. SO, THAT IS A PROPERTY BEHIND A TRANSMISSION LINE. THAT IS A PROPERTY QUESTION. SO, PERHAPS IT WAS NOT SURPRISING THAT IT WAS SITTING THERE FOR SO LONG, AND WE FINALLY HAVE AN OFFER THAT THE OFFER AMOUNT IS CONSIDERABLY HIGHER THAN APPRAISED VALUE. I DID CONSULT WITH THE APPRAISER WHO DID THE INITIAL APPRAISAL TODAY TO CONFIRM THAT BASED ON HIS LIMITED ANALYSIS WITHOUT OBVIOUSLY PRODUCING A NEW APPRAISAL, THE EXACT NUMBER CAN BE A LITTLE BIT OFF. BUT, HIS APPRECIATION IS ABOUT NINE TO 10% PER YEAR. SO, WE WILL BE RIGHT ON THE MONEY. IT WILL [01:55:07] STILL JUST BE A LITTLE BIT ABOVE THE CURRENT APPRAISED VALUE AND WITH THE CURRENT APPRAISED VALUE WOULD BE . BUT THE MARKET A LITTLE BIT IN THE LAST YEAR OR YEAR AND A HALF. BUT, WITHOUT PRODUCING ANOTHER APPRAISAL, IT WOULD BE HARD TO SAY. BUT, IT IS FAIR TO SAY THAT THE OFFER THAT WE HAVE RECEIVED IS AT OR SLIGHTLY ABOVE MARKET VALUE FOR THAT PARTICULAR PERSON. SO, AGAIN, JUST TO SUMMARIZE, THIS RESOLUTION WOULD AMEND THE MINIMUM SALES PRICE FOR THE PARCEL TO $1,060,000.00 . SO, IT IS MY INDIANA CODE. YOU, AS A PHYSICAL BODY, HOW TO APPROVE THAT SALE , AND THAT IS WHAT THE RESOLUTION DOES. DELIVERS THE SALE MINIMUM PRICE TO GO FORWARD, AND THEN YOU WILL FINALIZE THE SALE. >> VICE PRESIDENT AASEN? >> THANK YOU. I HAVE A FEW QUESTIONS. I WILL JUST ASK THEM ALL, AND YOU WILL ANSWER THEM. FIRST OFF, AND I KNOW THIS WAS A WHILE AGO, BUT I CAN'T REMEMBER. JUST WHISTLING TO THE COUNCIL THE DIFFERENCE BETWEEN THE ONE .75 AND WHERE WE ARE AT TODAY, I KNOW JEREMY MIGHT STEP IN THEIR , TO CONFIRM, THIS IS INDIANAPOLIS LAND. SO, WE ARE RECOUPING INVESTMENT, BUT THERE WILL BE NO TAX BENEFIT GOING FORWARD IN THIS PROJECT. AND THEN TWO MORE QUESTIONS. THIS PART OF THE PARCEL, THERE IS STILL LAND THAT WE OWN, IS THAT CORRECT? THAT WE HAVE NOT SOLD YET? >> NO. ONCE WE STARTED LOOKING INTO MARKETING THIS PROPERTY , IT WAS ALMOST TWO ACRES AT KEYSTONE. WE GOT THE APPRAISALS, AND WE CONSULTED A BROKER AT THAT TIME. HE FELT LIKE THERE IS A POSSIBILITY THAT WE COULD GET MORE MONEY THAN THE APPRAISALS GOING OUT FOR A HIGHER OFFER PRICE. SO, THE PROPERTY DID SIT FOR ROUGHLY TWO YEARS ON THE MARKET BEFORE WE GOT , ABOUT NINE MONTHS AGO, WE SIGNED A LETTER OF INTENT ON THE PROPERTY FOR THEM TO DO SOME DUE DILIGENCE. WE ARE FAR ENOUGH ALONG SO WHERE THEY THINK THEY CAN GO THROUGH ZONING WITH THE CITY OF INDIANAPOLIS, BUT THEY NEED OUR APPROVAL TO GO THROUGH WITH THIS. >> SO, THE ONE .75, YOU ARE TALKING TO THE BROKER, BUT IT WAS PURCHASED ON OUR PURCHASE PRICE OF THE LAND? >> OUR PURCHASE PRICE OF THE LAND WAS FOR A GAS STATION THAT WAS ON THE CORNER, AS WELL AS CHASE BANK. OUR PRICE OF THE LAND WAS MUCH MORE THAN THAT. >> A LOT MORE THAN THAT? OKAY. SHOOT FOR THE STARS, AND IF WE LANDED ON THE MOON, THAT WOULD BE FINE. >> AND THIS IS A RESOLUTION. WE DON'T HAVE TO SUSPEND THE RULES, BECAUSE WE NEED TO DO THIS BEFORE THE BP W CAN APPROVE THE STALE, AND YOU HAVE A BUYER. TALK TO US ABOUT TIMING ON GETTING THIS DONE? >> SO, JUST MOVING THIS THROUGH? >> YES. >> WE PREFER IF WE CAN GET APPROVAL TONIGHT, THAT WE CAN GET APPROVAL ON THE BP W ON WEDNESDAY , AND THEN THE PROJECT THAT IS SLATED TO GO THERE WILL FILE WITH THE CITY OF INDIANAPOLIS FOR ZONING ON THURSDAY . >> OKAY. THERE IS A LITTLE URGENCY ON THE TIMING FOR THIS? >> YES. >> JUST A COUPLE MORE CLARIFICATIONS ON THAT. THE CORRESPONDING RESOLUTION WILL BE INTRODUCED ON BP W ON THIS WEDNESDAY? REASON WHY THE ZONING IS SO URGENT IS BECAUSE RIGHT NOW, THAT LAND IS ZONED AS RIGHT AWAY, BECAUSE THAT IS WHAT WE ACQUIRED IT FOR. WE WOULD HAVE TO GO AND CHANGE THAT. AS YOU KNOW, IF YOU HAVE EVER SERVED, IT IS QUITE A LENGTHY PROCESS TO CHANGE IT FROM ANY USE TO A DIFFERENT USE. SO, IT WOULD REQUIRE A USE VARIANCE OR REZONING. I AM NOT SURE WHAT THE OFFER WOULD GO FOR , BUT EITHER OF THOSE TWO THINGS WOULD COMPLETE THE TASK. SO, THAT IS THE REASON FOR THE URGENCY. >> ANY OTHER QUESTIONS? >> JUST A HISTORICAL CONTEXT. WE BOUGHT THE SPECIFIC PARCEL IN THE PAST FOR A PURPOSE . WAS IT A LARGER PARCEL WITH SOMETHING YOU BUILT INTO RIGHT-OF-WAY? WAS IT THIS SPECIFIC ACRE ? >> SO, THIS PARTICULAR PARCEL SPLIT INTO TWO. THERE IS A [02:00:09] LITTLE SLIVER FROM THE OLD BURGER KING SIDE , THE GAS STATION, AND THEN THE BANK. THE CHASE BANK AND THE GAS STATION ON THE RIGHT TO THE RIGHT-OF-WAY ACQUISITION PROCESS, THEY WERE BOTH DEEMED TOTAL TANKS BY THE APPRAISER , SO THAT DEEMED THEM DETRIMENTAL TO THE OUTCOME OF THE BUSINESS. THAT IS WHY WE HAVE NEVER SEEN THEM ENTIRELY. >> THANK YOU. >> AND THEN, TO ANSWER VICE PRESIDENT AASEN'S QUESTION, WE HAVE AN ADDITIONAL PIECE OF PROPERTY THAT WE STILL HAVE ON THE EAST SIDE OF THE ROAD ALSO. THAT HAS GOT SOME CHALLENGES TO IT, SO WE ARE STILL LOOKING TO TRY TO FIND A BUYER FOR THAT PIECE OF PROPERTY OR SOMETHING. >> ANY OTHER QUESTIONS? ALL RIGHT. I AM LOOKING FOR A MOTION. >> I MOVE TO AMEND ONE $750,000.00 TWO 1,060,000 TO THIS ORDINANCE . >> IS THAT THE CORRECT MOTION? RESOLUTION. >> I THINK THE RESOLUTION AMENDMENT. WE JUST HAVE TO MOVE TO APPROVE THE RESOLUTION. >> SECOND. >> ANY DISCUSSION? PLEASE VOTE. ALL RIGHT, THAT HAS BEEN APPROVED, 9-0. THANK YOU. MOVING ON TO RESOLUTION CC-03-04-24-03, A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, REGARDING LEASE OF REAL PROPERTY TO THIRD PART. VICE PRESIDENT AASEN. >> THANK YOU. THIS RESOLUTION APPROVES THE LEASE OF REAL PROPERTY LOCATED AT 10 583 LAKESHORE DRIVE EAST, AND IS NOT NEEDED FOR A PUBLIC PURPOSE IN ESTABLISHED MINIMUM MONTHLY RENT. SERGI IS HERE TO DISCUSS. >> THIS IS A SIMILAR RESOLUTION TO THE ONE YOU JUST CONSIDERED, EXCEPT FOR THIS IS A FIRST STEP IN THE PROCESS , AND THE VEHICLE OF DISPOSITION IS ON THE PROPERTIES RELEASE . SO, IF THE PROPERTY WAS ACQUIRED -- I AM ACTUALLY NOT QUITE SURE. LOW VOLUME ] >> IT WAS ACQUIRED IN EARLY 2023. THAT'S ON THE CORNER OF 106 AND LAKESHORE DRIVE EAST. IT WAS ACQUIRED FOR THE ROUNDABOUT THAT WAS PLANNED ON AN INTERSECTION. HOWEVER, ROUNDABOUT FINANCES DID NOT WORK OUT. SO, RIGHT NOW, CONSIDERING THE PROPERTY -- RATHER, CONSIDERING THE ROUNDABOUT IS NOT REALLY HAPPENING AT THIS TIME , THIS PROPERTY IS SITTING WITHOUT A TENANT. THE PROPERTY IN QUESTION IS A SINGLE-FAMILY HOME WITH 2200 SQUARE FEET OF SPACE. IT'S A THREE BEDROOM, TWO BATH SINGLE-FAMILY HOME. WE HAVE ACQUIRED TWO RENTAL APPRAISALS THAT CAME REMARKABLY CLOSE. ONE WAS AT 2500, AND THE OTHER ONE WAS AT 2600. SO, THE AVERAGE OF TWO APPRAISALS IS 2550. WE ARE ASKING COUNSEL TO APPROVE A MINIMUM RENTAL PRICE OF 2550 PER MONTH , WHICH WAS ABOUT $46,600.00 PER YEAR. AS PREVIOUS RESOLUTIONS, THIS WILL GO INTO BP W , SO WE ARE A DISPOSING AGENT FOR THE CITY TO DELETE THE RELEASE. IT WILL ADVERTISE IT AND PUT IT OUT WITH THAT BIDDING AMOUNT. IT WILL BE BID FOR 60 DAYS, AND IF WE CAN'T FIND A BIDDER IN 60 DAYS, WE WILL LIKELY ALSO HIRE A BROKER TO TRY TO FIND THE TENANT. AGAIN, AS OPPOSED TO THE LAST RESOLUTION I WAS TOWARDS THE END OF THE RESOLUTION, THIS IS THE VERY SOON FIRST STEP. I WILL BE HAPPY TO ANSWER ANY QUESTIONS. >> VICE PRESIDENT AASEN? >> HI, A FEW THINGS. ONE, COUNCILLOR WORRELL AND I HAVE RECEIVED AN EMAIL ABOUT THE [02:05:02] CONDITION OF THE PROPERTY. I KNOW WE ON THE PROPERTY RIGHT NOW, SO IF THERE IS ANYTHING WE CAN DO TO FIX THAT CONDITION SO IT DOES NOT LOOK SO SHABBY , I THINK THAT IS ONE THING THAT WOULD BE APPRECIATED. ONE THING, I GUESS SQUEEZING OF THE PROPERTY AS OPPOSED TO SELLING IT , THIS ROUNDABOUT IN PARTICULAR, AND JEREMY CAN COMMENT ON THIS, WAS NOT PARTICULARLY POPULAR IN THE AREA THAT REPRESENTS IT. THE STOP SIGN THERE , AND COUNCILLOR WORRELL CAN TALK ABOUT THIS, IS VERY MUCH A PUSH FROM THE NEIGHBORS BECAUSE OF THE SCHOOL RIGHT THERE, THE SWIMMING POOL, AND PEDESTRIAN ACTIVITY BACK AND FORTH. AND WHEN WE PURCHASE THIS PROPERTY , I REASSURED SOME NEIGHBORS IN THE AREA THAT IF ANYTHING WERE TO HAPPEN, IT WAS IN THE IMMEDIATE FUTURE, BECAUSE A LOT OF WHAT HAPPENED HAS ONLY WITH THE RIGHT ABOUT THERE ON 106. BUT, WE WANTED TO KEEP THE OPTION OPEN BY MAINTAINING IT. OBVIOUSLY, WE DON'T HAVE FUNDING , BUT IS THIS STILL SOMETHING WE ARE EYEING AS A PRIORITY? WHAT IS IT LOOKING LIKE THERE? >> YEAH, I GUESS THE BIG THING IS WHAT IS THE DEFINITION OF IMMEDIATE FUTURE? YOU HAVE YOURSELF A YEAR SO FAR, SO THAT IS GOOD. THIS FOUR-WAY STOP IS BASICALLY AN UNWARRANTED FOR A STOP. THIS IS LAKESHORE UP INTO THE KEYSTONE ENTERTAINMENT. BUT IS ONE THAT WE WOULD LIKE TO COME UP WITH THE RIGHT SOLUTION FOR. WHEN HE FIRST PURCHASED THE PROPERTY, THE MAYOR ASKED US TO PURCHASE THE PROPERTY BECAUSE HE DID NOT WANT SOMEBODY MOVING INTO THE HOUSE ONLY TO THEN GET SURPRISED BY A PROJECT TAKING PLACE. THAT WAS THE IMPOTENCE FOR PURCHASING IT. IN THE INTEREST OF NOT DOING THAT TO ANOTHER PROPERTY OWNER THAT WE CAN SELL IT TO UNTIL WE GET A DESIGN FINALIZED, WE WANTED TO TAKE THE OPTION OF GOING WITH THE LEASING ROUTE. THAT WAY, WE CAN MAKE SURE IT IS IN THERE, IT IS WELL-MAINTAINED , AND THE HOUSE MAINTAINS VALUABLE. SO, THAT IS WHAT WE ARE LOOKING FOR. ON THE LAST MPO CALL , THE PLANNING ORGANIZATION, THE LAST CALL WE DID APPLIED FOR FUNDING AT THIS LAST LOCATION . UNDER THE CURRENT LIST, WE ARE NOT SUCCESSFUL YET, BUT MICHAEL HERE IS TO PUT A MORE COMPACT ROUNDABOUT WITH RACE PEDESTRIAN CROSSWALKS . BUT A MAIN THING TO BE A CONTEXT-SENSITIVE SOLUTION HERE WOULD BE TO MAINTAIN SENSITIVE ACCESS AT 160 KEYSTONE , BUT ALSO SLOW TRAFFIC DOWN ON 106 STREET SINCE THIS IS A BIT OF A QUARTER WITH A LOT OF HOMES FACING THAT STREET. >> WHY DID WE NOT LEASE IMMEDIATELY AFTER WE PURCHASED IT? >> A LOT OF IT IS THE PROCESS. WE THOUGHT WE COULD LEASE IT WITHOUT GOING THROUGH THE SAME PROCESS. IT TURNS OUT MUCH RESEARCH BECOMES, WAS WE GOT THE APPRAISALS, IT WOULD BE MORE THAN $25,000.00 PER YEAR. SO, WE HAD TO COME TO THE COUNCIL . WITH LAST YEAR, IT TOOK A LITTLE BIT OF TIME TO HAVE THAT PROCESS GO THROUGH, WHICH LEADS US HERE TONIGHT. >> COUNCILLOR SNYDER? >> IF HE CAN'T GET THE $2500.00 A MONTH, YOU HAVE TO GO THROUGH THIS AGAIN? JUST GIVEN THE CONDITION OF THE HOUSE, I UNDERSTAND YOUR APPRAISALS, BUT ALSO KNOWING WHAT OTHER HOUSES RENT IN THAT AREA, THAT SEEMS LOFTY TO ME. ANY BIDS FOR THE RENTAL VALUE OF A HOUSE , THEN THE CITY WILL HIRE A BROKER TO FIND A RENTER DIRECTLY. UNFORTUNATELY, THAT IS A PROCESS THAT IS BLIND ON THE INDIANA CODE THAT WE HAVE TO FOLLOW. IF THE AMOUNT WAS LESS THAN $25,000.00 PER YOUR, WE WOULD NOT BE IN FRONT OF YOU TONIGHT, BUT BECAUSE WE HAVE TO FOLLOW THE APPRAISALS THAT WE GOT, WE HAVE TO FOLLOW THAT NUMBER. IT'S REALLY NOT THE CITY, IT IS THE EXPERIENCES . IT'S NOT A KEY FACTOR HERE, AS YOU POINT OUT, BUT UNFORTUNATELY -- >> MAYBE THAT IS WHAT I DON'T UNDERSTAND. WAS A GHOSTLY BROKER, IT DOES NOT MATTER? >> RAY. THE BROKER CAN ENGAGE WITH POTENTIAL BROKERS . WE ARE DISPELLING THE INADEQUATE PROCESS. HER DEALING WITH LAND AND PUBLIC FUNDS. >> QUESTION, DOES THIS NEIGHBORHOOD HAVE A NEIGHBORHOOD ASSOCIATION? DOES THE PROPERTY OF COVENANTS AND RESTRICTIONS FOR THE RENTALS? IF SO, HAVE YOU GAINED APPROVAL? [02:10:02] >> I CANNOT SPEAK FOR SURE, BUT THE SAME NEIGHBORHOOD , I DEALT WITH ON AN ISSUE ON THE PAST FEW YEARS, AND THEY BROUGHT UP RULES AGAINST RENTALS. I DON'T KNOW THAT WAS WRITTEN INTO THE COVENANTS ARE JUST A ROLE. BUT THAT IS SOMETHING THAT THE WOODLANDS H AWAY HAS BROUGHT UP WHEN THERE WAS THE GROUP HOME ISSUE. >> I THINK IT WOULD BEHOOVE YOU TO REACH OUT TO OTHER HOAS AND FIND OUT ABOUT THOSE IN SECTIONS. THANK YOU. >> COUNCILLOR JOSHI? >> IS THERE A WAY UNDER INDIANA CODE TO INCORPORATE THE BROKER PROCESS IN THIS EXISTING RESOLUTION? YOU DON'T HAVE TO COME BACK? >> WE DON'T NEED TO GO BACK IN [16. OTHER BUSINESS] FRONT OF COUNSEL. IT DOES NOT MATTER IF IT HAS BEEN IN THE MARKET, SO TO SPEAK, OR IN ANY PROCESS FOR MORE THAN 60 DAYS. WE WOULD BE A DISCLOSING AGENT TO HIRE BROKERS. THAT IS ALREADY IN. >> ARRAY. ANY OTHER QUESTIONS? WE WILL DO SOME THIS IN THE 90S COMMITTEE. ALL RIGHT, THAT'S IT FOR NEW BUSINESS. MOVING ON TO ITEM NUMBER 15 , AT ON ITEMS. THERE ARE NONE. MOVING ON TO 16 , OTHER BUSINESS, WE HAVE SEVERAL THINGS ON THERE. THE FIRST ITEM YOU WILL SEE IS ENGAGEMENT TO CONDUCT ANALYSIS OF THE CITY'S DEBT. THERE IS NO ACTION THAT NECESSARILY NEEDS TO BE TAKEN. THIS IS ALL WITHIN THE COUNCILS CONTROL OR COUNSEL'S ABILITY. BUT, I HAVE HAD DISCUSSIONS WITH ALL OF YOU THE LAST 2 1/2 MONTHS ELECTION THAT WE WANTED TO DO. PART OF IT WAS HAVING AN INDEPENDENT STUDY OF OUR DEBT. YOU KNOW, WE GOT HIT WITH A BALLOON PAYMENT THAT MOST PEOPLE DID NOT KNOW WHAT HAPPENED AFTER THE ELECTION. THERE WAS QUESTIONS . IS COUNCILS, YOU GET QUESTIONS ABOUT THE DEBT. SO, WHAT WE WANTED TO DO, WE HAVE 20,000 WITHIN THE CITY COUNCIL'S BUDGET TO GO OUT AND HIRE AN ENTITY TO GO IN AND, AGAIN, GIVE US AN INDEPENDENT ANALYSIS OF OUR DEBT. ANY CAPACITIES WE HAVE, THOSE TYPES OF ITEMS. I WILL BE SENDING YOU THE SCOPE OF WORK IN THE AGREEMENT RIGHT NOW IN THE CITY OF. I SENT IT TO LEGAL, AND THE REDOING THE AGREEMENT TO MAKE SURE THEY ALL THE CORRECT TERMS, AND WE ARE NOT TAKING ANY UNNECESSARY RISKS. ONCE WE SETTLE ON THOSE TERMS, I WILL BE FORWARDING IT TO EVERYBODY. WE HAVE NOT CONTACTED OR DONE ANYTHING. NOW, WE HAVE DONE SOMETHING THAT WE THINK WILL BE REALLY GOOD, AND WE THINK WILL BE INDEPENDENT OF WHO WE ARE WITH THE CITY INTO THE CONTRACT, AND THE PRICING HAS BEEN. IS NOT WHO WILL BE ADVISING US, IT IS IS THE COUNCIL FOR THE FIRST TIME GOING OUT AND CONTRACTING WITH SOMEBODY TO GET AN OBJECTIVE THIRD-PARTY ANALYSIS TO SEE WHAT RISK THERE IS. SO, COUNCILLOR JOSHI, DO YOU HAVE ANYTHING TO ADD? >> PRESIDENT GREEN, YOU SUMMARIZED WELL. I THINK IT IS AN IMPORTANT STEP , YOU KNOW, TO WATCH THE DECEMBER COUNCIL MEETING IN THE CAPITAL APPRECIATION BOND THAT HAS BEEN OUTSTANDING SINCE 2008. YOU KNOW, THE BALLOON CAUSED -- WELL, YOU KNOW OTHER ISSUES CAUSED A , BUT AN INCREASE IN FERTILITY RATES. I THINK IT IS IMPORTANT TO UNDERSTAND OUR DEBT STRUCTURE , SOURCES REPAYMENT, IMMUNIZATION SCHEDULES , MATURITY DATES . I JUST THINK IS PART OF OURSELVES ABILITY IS A'S CITY COUNCIL AND A PHYSICAL BODY. >> IS APPROXIMATELY $20,000.00 IN THE CITY COUNCIL BUDGET. SO, COUNCILLOR WORRELL? >> NO, I WOULD AGREE WITH COUNCILLOR TAYLOR. I THINK IT'S A GOOD IDEA. IT'S REALLY GOOD FOR THE CITIZENS TO FEEL COMFORTABLE. THERE IS ALWAYS DIFFERENT REASONS FOR WHY THINGS ARE DONE. ON THE CAPITAL APPRECIATION BOND THAT COUNCILLOR TAYLOR IS TALKING ABOUT, IT'S RIGHT TO EVERYBODY ON THE SAME PAGE. I HAVE BEEN AN ADVOCATE FOR TRYING TO EXPLAIN CARAMELS DEBT FOR YEARS , SO, I WELCOME THIS, AND WOULD LOVE IT IF EVERYBODY FELT GOOD AND PROUD OF WHAT THEIR CITY IS DOING. SO, I TOTALLY WILL DO THIS. >> THANK YOU, COUNCILLOR SNYDER. >> THANK YOU. EVERYBODY, THANK YOU. ONE THING I WANT TO POINT [02:15:01] OUT ABOUT THIS , AS YOU ALL KNOW, I HAVE BEEN AN ADVOCATE FOR THE CITY COUNCIL IN THE INDEPENDENTLY COUNSEL AS WELL, WHICH WILL GET INTO IN ANOTHER MEETING. BUT, WHAT MANY COUNCILS TO IN FINANCIAL AUDITS IS THE HIGHER THEM THROUGH, AND I SEE THESE ALL CROSS INDIANA, THEY HAVE THEIR LEGAL COUNSEL HIRE A FINANCIAL GROUP TO DO THE REVIEW. THE ONLY REASON THAT I CAN THINK THAT THEY DO THAT IS BECAUSE THEN IT BECOMES PRIVILEGED INFORMATION. AND WE INTENTIONALLY, I BELIEVE, DID NOT DO THAT, BECAUSE WE DID NOT WANT WHATEVER THE FINDINGS ARE , WHATEVER THEY ARE, GOOD, BAD, INDIFFERENT TO HAVE ANY PROTECTION BEHIND THEM. IT WILL BE A PUBLIC DOCUMENT NOT HIDING BEHIND ATTORNEYS. AND I COMMEND THIS COUNSEL FOR NOT DOING THAT INSTEAD OF TRYING TO HIDE BEHIND LEGAL ISSUES ON A DOCUMENT. THANK YOU. >> VICE PRESIDENT AASEN? >> THANK YOU. A FEW THINGS I WANT TO KNOW. ONE, IF SOMETHING IS FOUND, MAYBE IT HAS NOTHING. IT COULD BE BIG COST SAVINGS FOR THE CITY THAT FAR EXCEED THIS $20,000.00 EXPENDITURES. THAT IS WHY PRESIDENT GREENE TOLD ME HE SPOKE WITH THE MAYOR. SHE IS ON BOARD AND HAS NO OBJECTIONS TO THIS. THIS WILL BASICALLY BENEFIT HER AS WELL. AND THEN FINALLY, WITH THE 20,000 , AND THEN I WANTED ANNE-MARIE TO SEE THIS, BUT MAYBE YOU CAN SEE THIS, THIS IS ALREADY IN THE COUNCIL BUDGET. I BELIEVE WE HAVE OVER $40,000.00 THAT IS NORMALLY IN THE COUNCIL BUDGET FOR LEGAL FEES AND CONSULTING FEES. THIS DOES NOT ZERO OUT OUR BUDGET, AND THIS DOES NOT COME -- THERE IS NO INCREASE FUNDING FOR THIS. THIS IS SOMETHING THAT THE COUNCIL ALREADY HAS IN THE BUDGET EVERY YEAR FOR CONSULTING LEGAL FEES. PROFESSIONAL FEES. WE HAVE ANOTHER LINE ITEM WITH GRANTS. BUT CORRECT. ANY OTHER QUESTIONS? OKAY. MOVING ON TO OTHER BUSINESS, 16 B, CITY COUNCIL APPOINTMENTS. THE MAYOR'S ADVISORY COMMISSION ON ARTS THAT WE WERE TALKING ABOUT EARLIER , WE REFILLED THE ORDINANCE THAT ESTABLISHED THE COMMISSION, AND NOW, THE EXECUTIVE ORDER, AS WE DISCUSSED , IT IS ESTABLISHING A NEW MAYOR'S ADVISORY COMMISSION ON ART.
