IT WAS IN 1996, FIVE YEARS LATER, THAT THE CITY COUNCIL ADOPTED THE FIRST IMPACT FEE FOR RESIDENTS OF CARMEL AND IN 2019, OUR MOST RECENT IMPACT FEE AND ZONE IMPROVEMENT PLAN WAS ADOPTED IN DECEMBER OF 2019 WITH THE CURRENT RATES GOING IN EFFECT JUNE 1ST OF 2020 . SO, TO TALK ABOUT THE PROCESS A LITTLE BIT, IN ORDER TO ESTABLISH AN IMPACT FEE RATE , A ZONE IMPROVEMENT PLAN MUST BE ADOPTED. THE ZONE IMPROVEMENT PLAN MUST BE RENEWED EVERY FIVE YEARS ACCORDING TO STATE STATUTE. IT IS BASED ON THE 10 YEAR PROJECTION OF DEVELOPMENT WITHIN THE COMMUNITY. OUR CURRENT PLAN IS FOR THE YEARS 2020 THROUGH 25 AND IT IS IMPORTANT THAT THE COUNCIL ADOPT A NEW ZONE IMPROVEMENT PLAN BY DECEMBER 1ST, 2024 TO MAKE SURE WE DON'T HAVE A LAPSE IN OUR CURRENT IMPACT FEE. THE PLAN GUIDES THE DEVELOPMENT OF THE MANAGEMENT OF THE PARK IT IS SOMETHING WE ARE REQUIRED- TO PREPARE AND UPDATE EVERY FIVE YEARS IN COMPLIANCE WITH THE DEPARTMENT OF NATURAL RESOURCES, AND TOGETHER A SIGNIFICANT AMOUNT OF PUBLIC INPUT TO IDENTIFY WHAT THOSE PRIORITIES ARE, SO WE FEEL IT IS VERY IMPORTANT IN ORDER FOR US TO ESTABLISH BIG PICTURE PRIORITIES FOR THE PARKS SYSTEM TO ALSO AT THE SAME TIME DEVELOP THE NEW ZONE IMPROVEMENT PLAN TO ENSURE THAT PLAN IS BUILT UP AND FACTORED IN TO THE NEW PARK SYSTEM MASTER PLAN. OUR CURRENT RATE UNDER THE EXISTING ZONE IMPROVEMENT PLAN IS 4882 PER RESIDENTIAL DWELLING UNIT. SO, THE IMPACT FEE IS ONLY CHARGED AT THE TIME A DRAWING UNIT PERMIT IS ISSUED BY THE DEPARTMENT OF COMMUNITY SERVICES. IT IS IMPORTANT TO NOTE THAT THIS IS NOT A TAX ON O ALL RESIDENTS. THIS IS A ONE-TIME FEE WHEN A NEW PERMIT TO CONSTRUCT A NEW RESIDENTIAL UNIT IS ISSUED SO AGAIN, IT IS TIED DIRECTLY TO THOSE NEW RESIDENTS EFFECTIVELY THAT ARE MOVING INTO THE COMMUNITY. ADDITIONALLY, UNDER STATE STATUTE, THOSE FEES CAN ONLY BE USED WITHIN PROJECTS IDENTIFIED WITHIN THE ZONE IMPROVEMENT PLAN WITH CERTAIN CAVEATS BUT BY AND LARGE, THE CURRENT ZONE IMPROVEMENT PLAN ALLOWS THOSE TO BE USED IN WEST PARK, BEAR CREEK PARK, AND ALONG THE WHITE RIVER CORRIDOR. LOOKING AT THE REVENUE WE HAVE RECEIVED SINCE THE ADOPTION OF THE CURRENT ZONE IMPROVEMENT PLAN, BASED ON PROJECTIONS , AND AGAIN, WE DEVELOPED THESE PROJECTIONS WITH THE DEPARTMENT OF COMMUNITY SERVICES, SO THE PROJECTIONS WOULD SAY THAT WE WOULD HAVE RECEVED SINCE 2020, A LITTLE OVER $13.5 MILLION . A GOOD PORTION OF THOSE FEES COMES TO CARMEL CLAY PARKS AND RECREATION'S AND HAVE GONE TO ONE OF THE SIX PARK IMPACT FEE FUNDS. SOME OF THOSE FUNDS HAVE GONE TO CRC RELATED PROJECTS TO THE 902 FUND OR ISSUED CREDIT SO COLLECTIVELY BETWEEN US TWO BUCKETS OF MONEY, WE HAVE COLLECTED OVER 14.1, ALMOST $14.2 MILLION . I THINK IT IS IMPORTANT TO GIVE THAT TO SHOW THE NUMBERS FOR PROJECTION WE HAVE USED HAVE BEEN VERY ACCURATE . ACTUALLY, A LITTLE BIT ON THE CONSERVATIVE SIDE BECAUSE IN THIS CASE WE HAVE GENERATED A LITTLE BIT MORE THAN WHAT THE PROJECTIONS WOULD SAY WE HAD AT THIS POINT IN TIME. GOING BACK TO THE PREVIOUS ZONE IMPROVEMENT PLAN, PROJECTIONS WERE LIKEWISE CONSERVATIVE. WE WOULD HAVE PROJECTED TO RECEIVE A LITTLE OVER $8 MILLION. WE RECEIVED ALMOST $8.7 MILLION, SO WE HAVE A DEMONSTRATED HISTORY OF NOT INFLATING THE NUMBERS. WE ARE CONSERVATIVE. WE ARE USING SOME NUMBERS BASED ON REALLY SOLID ESTIMATES THAT THE OCS IS MAKING AND THERE IS A DEMONSTRATED HISTORY WELL OVER A DECADE. I JUST SHOWED THE LAST 10 YEARS. IN THE CURRENT ZONE IMPROVEMENT PLAN, ONLY ACCOUNTING FOR THE FEES PARKS AND RECREATION HAS CONTROL OVER, WE'VE SPENT A LITTLE OVER $5.6 MILLION FROM JANUARY 2020 THROUGH THE END OF LAST MONTH , MAY 31ST. LIKE I SAID, $5.7 MILLION . ABOUT $2.5 MILLION HAS GONE TO BEAR CREEK,[00:25:06]
THE VAST MAJORITY FOR ACQUISITION OF THE PROPERTY, THE BALANCE OF IT GOING TOWARD THE DEVELOPMENT OF THE MASTER PLAN FOR THAT NEW PARK. A LITTLE OVER $925,000 IS GONE TO BUS PARK MOSTLY FOR THE NEW SHELTERS WE HAVE RECENTLY CONSTRUCTED AND ARE AVAILABLE THIS SUMMER. THE OTHER BALANCE ABOUT 2.2 MILLION, A LITTLE OVER HAS GONE TO THE WHITE RIVER CORRIDOR. THE VAST MAJORITY OF THAT, $1.5 MILLION, IS OUR CONTRIBUTION TOWARD DEVELOPMENT OF THE TRAIL FROM HAZEL DELL PARKWAY TO THE NEW BRIDGE BEING CONSTRUCTED OVER THE WHITE RIVER GREENWAY. THE BALANCE OF THAT LARGELY FOR PLANNING EFFORTS RELATED TO WHITE RIVER GREENWAY NORTH EXTENSION AND OTHER PROJECTS RELATED TO THAT, AS WELL AS THE THOMAS IT IS IMPORTANT TO NOTE THAT WHILE THERE HAS BEEN A LOT OF DISCUSSION ABOUT PARK IMPACT FEES AND HOW IT INVOLVES AND IMPACTS CARMEL CLAY PARKS AND RECREATION, IT IS CERTAINLY NOT OUR LARGEST FUNDING SOURCE IN THE PARKS SYSTEM. IT IS AN IMPORTANT PART BUT ONLY REPRESENTS ABOUT 10% OF THE TOTAL REVENUES WE HAVE RECEIVED FOR CAPITAL DEVELOPMENT WITHIN THE PARK SYSTEM. THE LION'S SHARE OF IT HAS COME THROUGH THE TOWNSHIP FIRST LOCAL INCOME TAX DOLLARS, A LITTLE OVER $12.1 MILLION , OR 31% OF THE REVENUES AND 53% , ALMOST 20.5 MILLION, FROM THE CLAY TOWNSHIP IMPACT PROGRAM AND THESE ARE THE DOLLARS WE'VE ACTUALLY SPENT. WE'VE RECEIVED MORE IN TOTALITY BUT WE SPENT THIS DURING THAT TIMEFRAME. A FEW OF THOSE DOLLARS WERE SPENT IN 2019. AGAIN, IT IS NOT THE SOLE FUNDING FORM FOR PARK INFRASTRUCTURE. THIS ALONE DOES NOT GET EVERYTHING WE NEED TO EXPAND THE PARK SYSTEM, BUT IT IS IMPORTANT FOR PROVIDING NEW AMENITIES TO SERVE NEW RESIDENTS COMING INTO THE COMMUNITY, SO LOOKING AT THE LAST FIVE YEARS AS TO WHERE NEW DEVELOPMENT IS OCCURRING WITHIN THE CITY AS PART OF OUR COMPREHENSIVE MASTER PLAN, WE PULLED ALL THE RESIDENTIAL PERMITS AND MAP THEM ON THE MAP OF CARMEL, AND YOU CAN SEE A LARGE CONCENTRATION IN THE CENTER, WHICH MAKES SENSE WITH ALL THE REDEVELOPMENT PROJECTS THAT HAVE BEEN OCCURRING. THERE IS A GOOD CONCENTRATION OCCURRING IN NORTHEAST CARMEL, ESPECIALLY IN THE LEGACY AREA, AND THEN A SMATTERING IN VARIOUS PLACES THROUGHOUT THE WESTSIDE AROUND JACKSON'S GRANT. THERE IS STILL SOME DEVELOPMENT OCCURRING AROUND WEST CLAY IN THE LETTER NORTHWEST CARMEL, AS WELL. LOOKING AT WHERE WE ARE PROPOSING WITHIN THE ZONE IMPROVEMENT PLAN , AREAS OR PARKS WHERE WE WOULD RECOMMEND THESE DOLLARS TO BE SPENT GOING FROM WEST TO EAST, BEAR CREEK PARK, WHICH AGAIN IS SERVING YO CONCENTRATION OF DEVELOPMENT ON THE WEST SIDE OF CARMEL . WEST PARK BECAUSE IT IS THE ONLY OTHER PARK ON THE WEST SIDE OF CARMEL AND THERE IS STILL QUITE A BIT OF DEVELOPMENT OCCURRING AROUND 116TH STREET AND WEST ROAD. LOOKING AT THE JAPANESE GARDEN BECAUSE WHILE THE TOWNSHIP IS PROVIDING SOME GREAT UPGRADES TO THE EXISTING AMENITIES, THERE IS NOT FUNDING TO DO ALL THE DEVELOPMENT ALL THE WAY TO CARMEL DRIVE SO WE SEE THAT AS A POTENTIALLY SIGNIFICANT INCREASE OF DEVELOPMENT WITHIN THE CENTRAL CORE OF THE COMMUNITY. THE CHINESE GARDEN, WHICH AGAIN, IS LOCATED CURRENTLY PROPOSED TO BE BETWEEN, LIBRARY AND CARMEL ELEMENTARY SCHOOL, AGAIN SERVING THOSE RELEVANT -- RESIDENTS IN THE CENTRAL CORE AND WE HAVE IDENTIFIED THE CENTRAL CORE AS A WHOLE BECAUSE WE DO BELIEVE THERE ARE OPPORTUNITIES EITHER WORKING WITH CRC OR OTHERWISE TO IDENTIFY OTHER AMENITIES TO SERVE RESIDENTS IN THE CENTRAL CORE AND THEN JUMPING TO THE EAST SIDE, THOMAS MARCUS NATURE PART RIGHT DAB IN THE MIDDLE OF THE LEGACY DEVELOPMENT FOR NEW RESIDENCE THERE AND THEN MORE BROADLY, THE WHITE RIVER CORRIDOR WHICH AGAIN IS IN THE EXISTING ZONE IMPROVEMENT PLAN. THIS, EVEN THOUGH THERE IS NOT AS MUCH DEVELOPMENT TO THE SOUTHEAST PART OF THE COMMUNITY, WHITE RIVER IS A UNIQUE ASSET FOR THE COMMUNITY, SO OUR MOST SIGNIFICANT NATURAL RESOURCE IS OUR EFFECTIVE STATE PARK WITHIN CARMEL AND IT IS CERTAINLY SERVING ALL OF OUR RESIDENTS, NEW RESIDENTS AND EXISTING RESIDENTS AND WE FEEL IT IS IMPORTANT TO INCLUDE IN THE NEW ZONE IMPROVEMENT PLAN.SO, PART OF THE FORMULA TO IDENTIFY WHAT THE PROPOSED

IMPACT FEE IS LOOKING AT THE PROPOSED DEVELOPMENT COST FOR THE NEXT 10 YEARS FOR THE PROJECTS AND THOSE IDENTIFIED AREAS AND WE HAVE IDENTIFIED THAT AT $63 MILLION. YOU SEE THE DOLLAR AMOUNTS FOR EACH OF THE SPECIFIC AREAS OR PARKS IDENTIFIED. IT IS IMPORTANT TO NOTE THAT THIS IS NOT THE FULL DEVELOPMENT COST OF THE PARKS. BOTH OF THOSE, THE MASTER PLANS HAVE THEM CLOSE TO $30 MILLION. THOSE PARKS ARE GOING TO BE SERVING EXISTING RESIDENTS AND NEW RESIDENTS SO WE FELT THAT ONLY A PORTION OF THOSE DEVELOPMENTS SHOULD BE TARGETED FOR IMPACT. AGAIN, THE IDEA IS THAT IMPACT FEES ARE PROVIDING THE ASSETS NECESSARY TO SERVE NEW RESIDENCE. THE SAME APPLIES FOR EACH OF THE AMENITIES LISTED THERE SO IT IS NOT DOING EVERYTHING ENVISIONED IN OUR CURRENT COMPREHENSIVE MASTER PLAN BUT IT IS GIVING A SIGNIFICANT AMOUNT TOWARD THAT.ALSO, UNDER THE FORMULAS, THE STATE STATUTE ALLOWS THE ABILITY FOR CONTINGENCIES BECAUSE OBVIOUSLY THE COST WILL GO UP OVER TIME FRAME SO THERE IS $12.6 MILLION IN CONTINGENCIES, A TOTAL OF $75.6 MILLION FOR 10 YEARS. IT IS A FIVE-YEAR PLAN SO EVEN IF WE GOT EVERY DOLLAR, IT'S NOT GOING TO ALL COME IN THAT FIVE YEARS SO AGAIN, IT'S NOT GOING TO BUILD EVERYTHING BUT THAT IS HOW THE FORMULA IS ESTABLISHED IN THE STATE STATUTE. ALSO, WE ARE REQUIRED TO TAKE A LOOK AT WHAT IS CALLED THE CURRENT LEVEL OF SERVICE AND THIS IS LOOKING AT THE BUILT INFRASTRUCTURE OF THE PARK SYSTEM WE HAVE TODAY. I TAKE THAT BACK. I GOT AHEAD OF MYSELF. WE START WITH THAT $75 MILLION AND TO GET TO THE CURRENT LEVEL OF SERVICE, WHICH IS THE CALCULATION WHICH WE IDENTIFY WITH THE MAXIMUM FEE IS, WE TAKE THE MAXIMUM AMOUNT.
WE LOOK AT HISTORICAL PRACTICES AND OTHER REVENUE SOURCES, SO WHAT WE RECEIVED FROM THE TOWNSHIP, THE DOLLARS FROM THE 103 FUND THAT IS FUNDED BY THE CITY FOR THE NON-REVERTING PARKS FUND. WE ALSO LOOKED AT CONTRIBUTIONS THAT THE NEW RESIDENTS ARE GOING TO BE MAKING TO THE EXISTING BONDS THAT HAVE BEEN ISSUED AND THAT ARE ON THE BOOKS, SO THERE IS A CREDIT GIVEN BACK FOR THAT AND THEN THERE IS THE NONLOCAL REVENUE IS DONATIONS, SO WE RECEIVED THE PROPERTY FROM BEAR CREEK PARK , NOT BEAR CREEK PARK. THOMAS PARK. WE HAVE HISTORICALLY RECEIVED SOME DONATIONS SO WE HAVE TO FACTOR THAT IN. STATE LAW BASICALLY SAYS WE NEED TO ASSUME THAT THE SAME AMOUNT OF DONATIONS WERE RECEIVED IN THE PAST EQUIVALENT TO THE PORTION OF WHAT WE ARE GOING TO RECEIVE IN THE FUTURE WHETHER THAT IS TRUE OR NOT. WE CAN ALSO ADD IN THE EXPENSES FOR DEVELOPING THIS PLAN, SO THOSE OF BEEN ADDED BACK INTO IT. WE DIVIDED BY THE ESTIMATED NUMBER OF NEW HOUSING UNITS PROJECTED FOR A 10-YEAR PERIOD AND THAT GIVES US A MAXIMUM FEE OF 8276 SO UNDER STATE FORMULAS, THE MAXIMUM WE COULD CHARGE FOR AN IMPACT FEE BASED ON THESE CALCULATIONS IS 8276. THE IMPACT FEE IS THEN BALANCED AGAINST THE COMMUNITY SERVICE AND THAT IS THE TOTAL NUMBER OF ASSETS OUT THERE LOOKING AT ONLY THE ASSETS WE OWN OR MANAGE. IT IS IMPORTANT TO NOTE THAT THIS FEE COULD BE HIGHER BECAUSE THERE ARE AMENITIES OWNED BY THE CITY OF CARMEL SUCH AS BERKSHIRE GOLF CLUB IS THE GREENS AND PAVILION AREA OUTSIDE OF CITY HALL. THE CARTER GREEN. OTHER AMENITIES THAT ARE NOT MANAGED BY, CLAY PARKS AND RECREATION, WE DID NOT FACTOR THOSE NUMBERS INTO THE FORMULA, BUT AS YOU CAN SEE, YOU LOOK AT THE ASSET VALUE OF THE PARK SYSTEM OWNED OR MANAGED BY THE PARK BOARD, $123 MILLION PLUS, THE IMPROVEMENTS OF ALL THE ASSETS, PLAYGROUNDS, COMMUNITY CENTER, WATERPARK AND EVERYTHING WITHIN THE PARK TRAILS AND EVERYTHING, 284 MILLION FOR TOTAL ASSET VALUE OF THE PARK SYSTEM IS MANAGED BY, CLAY PARKS AND RECREATION THAT 407 MILLION.
YOU DIVIDE THAT NUMBER UNDER THE STATE FORMULA BY THE CURRENT NUMBER OF HOUSING UNITS AND AGAIN, THESE NUMBERS CAME FROM DOCS, 43,336 AND THAT GIVES OUR ESTIMATED COMMUNITY SERVICE LEVEL AT $9401. THE REASON THAT IS IMPORTANT IS THAT NUMBER, COMMUNITY LEVEL OF SERVICE CANNOT BE LESS THAN

THERE ARE SOME COMMUNITIES FOR THE ASSET VALUE OF THE PARK SYSTEM IS LESS THAN WHAT IS BEING PROPOSED SO STATE LAW SAYS YOU CAN'T CHARGE NEW PEOPLE MORE THAN WHAT HAS ALREADY BEEN CONSTRUCTED SO THAT'S WHY THIS NUMBER IS IMPORTANT. WHAT WE ARE PROPOSING FOR THE NEW IMPACT FEE RATE, WHICH IS WHAT WOULD BE INSTITUTED THROUGH THE PROPOSED ORDINANCE IS A GRADUATED INCREASE , ANNUAL INCREASE OF 11.13%, WHICH WOULD GET US ONE DOLLAR WITHIN THE MAXIMUM BY YOUR FIVE FOR THE IMPACT FEE, SO YOU CAN SEE THOSE FEES INCREASING. WE HAVE GIVEN THESE PROJECTIONS FOR THE SAKE OF SIMPLICITY, ASSUMING THAT THE COUNCIL IS IN A POSITION AND DECIDES TO ADOPT AS PROPOSED, THIS ORDINANCE BEFORE THE END OF JUNE. I WILL NOTE THAT STATE STATUTE REQUIRES AT LEAST A SIX MONTH WAITING PERIOD BEFORE THE NEW RATE CAN GO IN. IT EFFECTIVELY GIVES THE BUILDING COMMUNITY A LITTLE TIME TO PREPARE FOR ANY RATE INCREASES, BUT WHAT WE WOULD LIKE TO DO IS ENSURE IT STARTS ON THE FIRST OF THE MONTH BECAUSE IT IS EASIER ADMINISTRATIVELY FOR THE DOCS AS WELL AS THE PARK SYSTEM TO HAVE THE BREAK CHANGE START IN THE MIDDLE AT THE BEGINNING OF THE MONTH AS OPPOSED TO THE MIDDLE OF THE MONTH. AND AGAIN, IF AT ALL POSSIBLE, WE WOULD LOVE IT TO START ON THE BEGINNING OF THE YEAR OR TWO BECAUSE IT MAKES IT VERY CLEAN BUT LIKE I SAID, WE HAVE TIME SHOULD THE COUNCIL WHICH TO TAKE SOME. FINALLY , WE LIKE TAKING A LOOK AT HOW WE COMPARE TO NEIGHBORING COMMUNITIES WITHIN THE ZONE IMPROVEMENT PLAN. WE HAVE LOOKED BROADER WITHIN THE METROPOLITAN AREA BUT I FOCUSED IN ON NEIGHBORING COMMUNITIES AND YOU CAN SEE BOTH CURRENTLY AS WELL AS PROPOSED THAT THE RATE ON HERE WOULD BE YOUR ONE PROPOSED RATE. WE ARE THE HIGHEST PARK IMPACT RATE AND AS I TOLD THE PLAN COMMISSION , WHICH ALSO HAS TO REVIEW EVERYTHING THAT HAS BEEN RIGHT BEFORE YOU TONIGHT AND FOR WHICH WE RECEIVED A FAVORABLE RECOMMENDATION, WE DON'T MAKE ANY APOLOGIES FOR THE RATES INCREASING. THE AMOUNT OF INVESTMENT THIS COMMUNITY HAS MADE IN PARKS AND RECREATION IS INCOMPARABLE TO ANY OF OUR OTHER COMMUNITIES. IT IS REALLY INCOMPARABLE TO ALMOST ALL OF THE COMMUNITIES WITHIN THE COUNTRY AND PEOPLE ARE CHOOSING TO MOVE TO CARMEL FOR THE QUALITY OF LIFE, FOR THE INCREDIBLE ASSETS WE'VE CREATED WITHIN THE PARK SYSTEM. THAT COMMUNITY THERE IS LIKE THE COUNCIL RELATED TO THE PARK SO IN ORDER TO SUSTAIN THE PARK SYSTEM AS IT CONTINUES TO HAVE ADDED GROWTH AND DEMAND PLACED UPON IT, YOU KNOW, WE SHOULD NOT APOLOGIZE FOR THE RATES BECAUSE THAT IS THE LEVEL OF INVESTMENT YOU MAKE BUT IT'S ALSO IMPORTANT TO REALIZE THAT STATE STATUTE DOES NOT -- PARKS ARE NOT THE ONLY MEANS BY WHICH YOU CAN CHARGE AN IMPACT FEE.CARMEL HAS CHOSEN SINCE ITS INCEPTION IN 1996 TO ONLY CHARGE FOR PARKS BUT OTHER COMMUNITIES CHARGE FOR OTHER ELIGIBLE THINGS. ALL THE NEIGHBORS IDENTIFIED HAVE A ROAD IMPACT FEE AND WHEN YOU LOOK AT THE COMBINED IMPACT FEES THAT THE NEIGHBORS ARE CHARGED, WE STILL ARE SIGNIFICANTLY LESS THAN THE NEIGHBORS WITH THE EXCEPTION OF SCIENCE WILL AND WE ARE PRETTY MUCH ON TARGET WITH THEM . WITH THAT, I WOULD BE HAPPY TO ADDRESS ANY QUESTIONS AS FAR AS HOW WE ARRIVED AT THE CALCULATIONS AND WHAT WE ARE PROPOSING. I WILL NOTE THAT ADRIAN WITH THE D.O.C.S. IS HERE.
