JEREMY, CAN YOU COME UP TO EXPLAIN THAT [01:15:01] THIS AGREEMENT? >> WITH THE COLLEGE AVENUE RECONSTRUCTION PROJECT WE COORDINATED UTILITIES AND THE ENGINEER TEAM HAS DONE A FANTASTIC JOB OF GETTING A LOT OF THE COMMUNICATIONS, ALL THE TELECOMMUNICATIONS LINES TO BE RELOCATED IN A JOINT FORMAT SO WE CAN CONTROL WHERE THEY ARE GOING AND MINIMIZE CONFLICTS. WE WERE JUST GETTING READY TO GO WHEN IT CAME UP THAT SOME OF THESE UTILITIES ARE GOING WITHIN A REGULATED DRAIN EASEMENT. SO WHEN THAT GOT BROUGHT BEFORE THE DRAINAGE BOARD, THEY WERE ACTUALLY SEEKING REIMBURSEMENT AGREEMENTS WITH EVERY SINGLE UTILITY, WHICH WOULD HAVE CAUSED A TREMENDOUS DELAY, EVEN IF THAT WERE TO BE POSSIBLE. SO WHAT THEY CAME UP WITH WAS TO SIGN A LOCAL AGREEMENT THAT SAYS THEY WOULD SEEK REIMBURSEMENT FROM US BUT WE ALSO RESERVE THE RIGHTS TO SEEK REIMBURSEMENT FROM THE UTILITIES. THAT IS WHAT THE DRAINAGE BOARD CAME UP WITH TO ALLOW THE PROJECT. >> ANY QUESTIONS? >> DO WE HAVE AN IDEA OF THE POSSIBLE COST OF THAT REPAIR? >> I THINK THE RISK IN THIS IS FAIRLY MINIMAL. THE UTILITIES ARE BEING RELOCATED WITHIN THE RIGHT AWAY. SO I FEEL LIKE WE HAVE THE AUTHORITY TO HAVE THE UTILITIES MOVED. THEN THE DRAINAGE EASEMENT OVERLAPS AT THE RIGHT AWAY. PART OF THE ISSUE IS THE DRAINAGE PROJECT HAS BEEN VERY SLOW GOING IN MY OPINION DUE TO LACK OF UTILITY COORDINATION. SO GOING FORWARD IN THE FUTURE, THIS WORKS FOR US. >> I JUST HAD A QUESTION, I DIDN'T UNDERSTAND HER THE INTERLOCAL AGREEMENT. TRANSPORT OBVIOUSLY HAS THE AUTHORITY TO REQUEST REIMBURSEMENT OF DAMAGE FROM UTILITIES AS THEY ARE STATUTORILY REQUIRED TO MANAGE DRAINS THROUGHOUT THE COUNTY. HOW DOES THIS INTERLOCAL AGREEMENT SHIFT THAT ABILITY FOR US TO SEEK THOSE REIMBURSEMENTS AS THE DRAINAGE BOARD WOULD? >> THE PART OF THE REIMBURSEMENT THAT IS ODD OR AT LEAST MINIMAL RISK TO THE CITY, IF WE WERE TO TRY TO GO PULL THE FIBER OUT, I THINK WHAT THEY THINK IS, IF YOU DON'T MOVE WITHIN A CERTAIN PERIOD OF TIME, IF YOU DON'T MOVE IT, YOU COULDN'T GET ANYONE TO MOVE IT FOR YOU. I DON'T THINK WE COULD HIRE A COMPANY THAT WOULD GO AND CUT AT&T'S FIBER LINES. THAT'S WHY I THINK THIS IS MINIMAL RISK TO US. I DON'T THINK YOU COULD GET ANYBODY TO MOVE THE UTILITIES FOR THEM. I WAS A LITTLE BIT PERPLEXED THAT THAT THEY WERE ASKING FOR THE REIMBURSEMENT. PART OF IT WAS THE SURVEYOR'S OFFICE, THEY DON'T HAVE TO LEGALLY ALLOW UTILITIES INTO THE EASEMENT EITHER.
