THE ALLEYWAY IS A 10-FOOT WIDE ALLEY AND WE ALLOWED APPROXIMATELY 2.5 ENCROACHMENT INTO THE ALLEY . THE MAIN REASON WAS TO BE ABLE TO GET FIRE SAFETY ACCESS OUT OF THE BUILDING. THE ALLEYWAY RIGHT NOW IS BEING USED FOR THE ABILITY TO GET BACK TO TRASH RECEPTACLES AND THE DUMPSTER.
SO, IT IS A NARROW AREA PICKED THE TRASH TRUCKS ARE STILL ABLE TO REMAIN ON THE CONCRETE, PAVED AREA OF THE ALLEY. WE DID RECENTLY GET THE ALLEY SERVED AWAY . THE CONCRETE AREA SURVEYED AS WE'VE BEEN DISCUSSING WITH THE PETITIONER.
THE CONCRETE THAT WAS PUT IN WAS ROUGHLY TWO OR THREE INCHES ONTO THE PETITIONER PROPERTY SO IT WAS SLIGHTLY OFF. OUR MAIN CONCERN IS THAT WE HAVE ACCESS TO A FURTHER ALLEY BETWEEN THE PARKING GARAGE AND THE FIRST ON MAIN BUILDING , WHICH IS A LINEAR PARK . AND IF WE VACATED THIS ALLEY OR PUBLIC ACCESS TO IT , IT WOULD CREATE ISSUES WITH GETTING THE DUMPSTER OUT, WHICH WE ORIGINALLY WORKED ON. WE WOULD BE IN FAVOR OF VACATING THE ALLEY IF THERE WAS SOME FORM OF ACCESS EASEMENT GRANTED BETWEEN BOTH FIRST ON MAIN AND THE PROPERTY ON TO THE SOUTH. IF YOU WANT TO SPEAK TO YOUR CONCERNS?
