TONIGHT WE ARE THRILLED TO WELCOME BACK SKYE SIMPSON WHO RECENTLY COMPETED AT THE INTERNATIONAL POWERLIFTING FEDERATION WORLD OPEN HE QUIT POWERLIFTING CHAMPIONSHIP IN ICELAND. SKYE ALONG WITH HIS DAD BROUGHT HIS TRAINER . AM I SAYING THAT RIGHT? RIGHT HERE IN CARMEL. I WANT TO TAKE A MOMENT TO ACKNOWLEDGE KYLE AS HIS DEDICATION AND EXPERTISE PLAYED AN INFLUENTIAL ROLE IN THE SPORT. THE HARD WORK SUPPORTED BY HIS FAMILY, FRIENDS, ATHLETES AND COACHES PAID OFF IN REMARKABLE WAYS. I'M PROUD TO ANNOUNCE SKYE EARNED GOLD MEDALS , A SILVER IN ANOTHER AND TOOK HOLD GOLD OVERALL IN HIS DIVISION. I HAVE THE PRIVILEGE OF WATCHING COMPETE WITH LIFESTREAM. MY HUSBAND AND ME BEYOND WITNESSING THE SWEEP WAS HEARING THE COMPETITION ANNOUNCER DESCRIBE SKYE AS THE MOST ELECTRIFYING ATHLETE REPRESENTING THE UNITED STATES.

    SHOCKING. AS I MENTIONED, WHEN RECOGNIZING SKYE FOR HIS OUTSTANDING CITIZENS AWARD HE STANDS AS A SYMBOL OF INCLUSION FOR THE CITY OF CARMEL AND CARMEL SCHOOLS. I'M PROUD TO CALL SKYE, HIS FAMILY AND COACH MY FRIENDS AND VALUED MEMBERS OF OUR GREAT SKEDEE . UNDER THE MAYOR'S DIRECTION THE CITY WILL TEMPORARILY RENAME A STREET AFTER SKYE .

    I'M HERE TO SHARE MY STORY OF WHAT HAPPENED WITH THE CITY OF CARMEL AND PUD. IN THE NEIGHBORHOOD IN WHICH I LIVED I HAD A PUD. THE NEIGHBOR WENT AND GOT A VARIANCE TO GO FROM 35 TO 45%. I DIDN'T GO TO THE MEETING BECAUSE IT WAS GOING TO BE 30 FEET AWAY FROM ME ALL IS WELL AND GOOD. THE DAY SHE DUG THE POOL WHOLE IT WAS MOVED MUCH CLOSER TO MY PROPERTY. SHE HAD MULTIPLE OTHER STRUCTURES THAT WERE EITHER NOT APPROVED BY THE CITY NOR THE HOAS. SHE DID NOT BUILD THE PLANS AT ALL ACCORDING TO WHAT SHE SUBMITTED, SHE OVERBILLED, SHE ENCROACHED TO SETBACKS AND WENT WELL OVER THE 45% APPROVED. FOR TWO YEARS I TRY TO GET SOME HELP FROM THE CITY OF CARMEL AND SOME OF YOU ON THIS BOARD AND WHAT I'M HOPING MOST IS THAT YOU HEAR ME AND IMPACT WHAT WILL HAPPEN FOR OTHERS THAT COME BEHIND ME. THE FAILURE POINTS IN CARMEL, CARMEL ACCEPTED AN INCOMPLETE APPLICATION. CARMEL WAS OUT OF THE PROPERTY MULTIPLE TIMES WITH ZERO CODE ENFORCEMENT. I HAD A DENIAL OF DUE PROCESS. EVERY ITEM I MENTIONED THERE SHOULD'VE BEEN A VARIANCE HEARING. I ASKED FOR VARIANCE HEARING FROM THE PLANNING DEPARTMENT AREA I NEVER GOT ONE. THERE IS ALSO A LACK OF PUBLIC INFORMATION. THE FAMILY WAS SWIMMING IN THE PROPERTY IN LATE AUGUST AND THE FIRST PLAN THAT SHOWED UP FOR ALL THE STRUCTURES WAS IN NOVEMBER OF THAT YEAR. FROM NOVEMBER ON, THE LEGAL DEPARTMENT SENT ME THREE OTHER UPDATED PLANS AFTER THE STRUCTURES WERE COMPLETE.

    CARMEL DID NOT ACT IN ACCORDANCE WITH INDIANA CODE IN THE ACCESS TO PUBLIC RECORDS. AFTER I HIRED A ZONING COMPANY AND THEY STARTED DIGGING I WAS SHUT OFF, THEY WOULDN'T RESPOND TO ANY EMAILS. SUBSEQUENT EVENTS, CARMEL SUBMITTED -- STARTED A LAWSUIT AGAINST THE HOMEOWNER TO PUT THINGS BACK IN PLACE. THAT WAS IN MAY. IN SEPTEMBER THE CITY OF CARMEL DECIDED THEY WERE GOING TO HELP HER GET HER VARIANCES IN ORDER TO KEEP EVERYTHING SHE HAD. I WENT TO THE HEARING, I SPOKE, SO DID TO OTHER PEOPLE. I BASICALLY SHUT THE VARIANCES , THEY DIDN'T FOLLOW THE PROCESS. I'VE ALSO COPIED YOU ON INDIANACODE. IT DID NOT MEET INDIANA CODE. THE PROPERTY CAUSED HARM TO TWO PEOPLE. IN THE END I ENDED UP HAVING TO MOVE. I LOST MY RIGHT OF DUE PROCESS, I LOST MY RIGHT OF PEACEFUL ENJOYMENT. THE NOISE WAS TOO LOUD AND ON TOP OF IT THE HOA ENDURED SIGNIFICANT FEES SO I HAD SKYROCKETING FEES FROM THAT ALSO. IT WAS A MESS. I HAD TO TRY TO SELL MY HOUSE TWICE BECAUSE NOBODY WOULD BUY IT NEXT TO THOSE STRUCTURES. ANOTHER PERSON IN THE NEIGHBORHOOD TRIED TO SELL THEIR HOME. THEY HAD TO PUT A DISCLOSURE AND THEY HAD TO LOWER THEIR SALES PRICE.

    DESPITE ALL OF THIS AND THREE PEOPLE SPEAKING AGAINST, IT WAS ABSOLUTELY UNANIMOUS. I WOULD SAY THOSE OF US THAT WERE THERE , THERE WERE SEVEN OF US AGAINST THE VARIANCE. IT APPEARED TO US THAT THEY CAME IN WITH A PREDETERMINED

    DECISION . IT WAS ALSO THEY TREATED THE HOMEOWNER ONE WAY AND TREATED ME A COMPLETELY DIFFERENT WAY. UNFORTUNATELY A COUPLE OF WEEKS AGO IT WAS CONFIRMED IT WAS PREDETERMINED BECAUSE A CITY EMPLOYEE IN A PUBLIC FORUM -- OKAY.

TRANSFERRING IT OVER WHERE 100,000 WILL BE GOING TOWARDS PRIME LIFE AND 100,000 TO THE HISTORICAL SOCIETY , I SENT SOME INFORMATION TO COUNCIL LAST WEEK, BUT ESSENTIALLY WHAT PRIME LIFE HAS IDENTIFIED , THERE NEEDS BEING SOME CAPITAL COST RELATED TO A DEHUMIDIFIER IN THEIR POOL AREA, AS WELL AS OPERATING SHORTFALL THAT THEY HAVE, AS WELL AS WANTING TO HIRE MORE DRIVERS. ESSENTIALLY THEY HAVE MORE THAN ENOUGH I THINK THEY WILL APPLY THIS TOWARDS. OVERHEAR THE NEW DEVELOPMENT , BEDFORD FALLS IS 2.5 UNITS PER ACRE. AMBLESIDE IS 4.5 AND THEN THE PROPOSED DEVELOPMENT IS 5.5 UNITS PER ACRE. THOSE ARE FOUND IN THE AREA BUT ON THE NORTH SIDE. WESTFIELD PURSUES DENSITIES 5.5 UNITS PER ACRE. MY CONCERN IS WHEN WE PURSUE DENSITIES SOMETIMES YOU LOSE OF THE QUALITY OF LIFE THAT COMES FROM THE OPEN GREEN SPACES. THE BEAUTIFUL AREAS WHEN PEOPLE COME ACROSS THEY SEE AND NOTICE THEY COULD'VE PUT HOUSES HERE BUT INSTEAD WE HAVE THESE BEAUTIFUL AREAS. NOW THAT WE DO HAVE THE 29 TOWNHOMES AND SINGLE-FAMILY HOMES IN AREAS FOR ELDERLY WHEN YOU DO INCREASE DENSITY WHAT YOU LOSE IS SOME OF THE GREEN SPACE. I WOULD ASK WHERE ARE THEY GOING TO BE GATHERING, WHERE WILL THEY SPEND THEIR TIME? THE TREND IS TO BUILD UP AS OPPOSED TO OUT RESULTING IN HEIGHTENED DENSITY. THIS MAKES SENSE IN AREAS CLOSE TO THE CITY CENTER AND ALSO FITS IN WITH THE OVERALL LANDSCAPE. HIGHER DENSITY DEVELOPMENTS WITH ADJOINING SUBURBAN LOW-DENSITY NEIGHBORHOODS LOOK OUT OF PLACE AND OVERDEVELOPED . FOR EXAMPLE, THE SITE HOMES FACING 146 STREET REALLY APPEAR AS A WALL OF CONCRETE THAT IS UNLIKE ANYTHING ELSE FOR MILES AROUND.

AFTER ADOPTION IN 2006 THEY WERE SIGNIFICANT CHANGES IN THE ECONOMY AND HOUSING INDUSTRY THAT PREVENTED THE OVERALL PLAN FOR THE GRAMERCY PUD FROM ADVANCING FORWARD AT THAT TIME AGAIN IN 2006 BY WAY OF EXAMPLE BUCKINGHAM RETURNED TO THE PLAN COMMISSION AND COUNCIL IN 2018 RECEIVED APPROVAL OF THE GRAMERCY WEST DEVELOPMENT. AT THIS TIME BUCKINGHAM IS PROPOSING AN AMENDMENT TO THE GRAMERCY PUD WITH A PLAN DESIGNED FOR AN URBAN RESIDENTIAL DEVELOPMENT ON A PORTION OF THE OVERALL PROPERTY

IT RUNS HERE AND WILL GO THROUGH THE CARMEL MARKETPLACE DEVELOPMENT. ADDITIONALLY, THE 2024 GRAMERCY AMENDMENT IS A PROJECT AS I MENTIONED TO THE BACK AND HAVE DEVELOPMENT MARKETPLACE . THAT IS HERE. EARLIER THIS YEAR BOTH THAT DEVELOPMENT AND GRAMERCY EAST WAS APPROVED AND WENT THROUGH REDEVELOPMENT AND EFFORT AS FAR AS THIS ORDINANCE IS CONCERNED WOULD BE TO PAPER UP AND DELIVER THOSE PLANS THAT HAD BEEN PREVIOUSLY VETTED WITH THE COMMISSION AS WELL AS THE COUNCIL EARLIER THIS YEAR. THE RESULT OF THAT IS A PLAN WHICH INCLUDES MULTI FAMILY TOWNHOMES AS WELL AS COMMERCIAL DEVELOPMENT. THE AREA HERE IS THE GRAMERCY WEST DEVELOPMENT .

    THERE'S A PORTION OF THIS DEVELOPMENT THAT INCLUDES TOWNHOMES HERE. TOWNHOMES ALONG KINZER, TOWNS HOME ADJACENT TO CITY CENTER AND ADDITIONAL AND PRESERVED DEPARTMENTS TO THE INTERIOR OF THE SITE . THIS IS AN EXAMPLE AT THE TOP OF THE APARTMENTS INTENDED TO BE CONSTRUCTED ON THE SITE AND THIS IS THE CENTRAL LOCATION WHICH IS MORE SIMILAR WITH THE PUBLIC PLAZA AND SPACE THAT BUCKINGHAM IS WORKING ON WITH THE CITY REDEVELOPMENT COMMISSION PARKS DEPARTMENT.

    TRANSFERS 25,000 FROM THE GENERAL FUND NUMBER 101 INTO THE FIRE PENSION FUND NUMBER 802.

    >> THANK YOU. THERE IS A FIRE PENSION FUND AS WELL AS A POLICE PENSION FUND IN BOTH DEPARTMENTS. IT IS ESSENTIALLY THE FUND WE PAY WHICH IS REFERRED TO AS THE 37 PLANT EMPLOYEES. THERE IS A 77 PLAN FOR THE NEWER FIREFIGHTERS AND POLICE OFFICERS, PEOPLE THAT STARTED PRIOR TO 77 PLAN. IT INCLUDES BENEFIT PAYMENTS AS WELL AS COST AND SOME OCCASIONAL MEDICAL STUDIES AS WELL AS THE PENSION SECRETARY RECEIVES A FAIRLY NOMINAL STIPEND . THE CITY COVERS ALL THOSE COST AS THE BENEFIT PAYMENTS. THOSE ARE TO BE REIMBURSED EACH YEAR. WE CURRENTLY DON'T HAVE ANY ISSUES WITH THE POLICE PENSION FUND HOWEVER THE REIMBURSEMENT HAS NOT MATCHED OUR BENEFIT PAYMENTS GOING OUT OF THE FUND.

    HR IS CURRENTLY WORKING TO UNRAVEL THIS AND FIGURE OUT I SUSPECT AN OUTDATED LIST OF EMPLOYEES THAT WAS PROVIDED AND THAT ONCE WE FIX THAT WE WILL GET THE PROPER REIMBURSEMENT.

    IT IS JUST WITH THE CLOCK TICKING, HOLIDAYS, IT IS VERY UNLIKELY THIS WILL GET CLEANED UP BEFORE THE END OF THE YEAR.

    CURRENTLY, THIS HAS A NEGATIVE BALANCE IN THE FUND. THE APPROPRIATION IS SUFFICIENT, IT JUST DIDN'T GET THE REVENUES TO BACK THE APPROPRIATION. IN THIS TRANSFER, WE ARE MOVING DOLLARS FROM THE GENERAL FUND AND PUTTING THEM INTO THE FIRE PENSION FUND TO MAKE THE CASH BALANCE HOLD AT THE END OF THE
