TIF ALLOWS YOU TO CAPTURE FUTURE TAXES FROM A NEW PROJECT ON A PARCEL OF PROPERTY. GENERALLY, TIF QUESTIONS ARE CITY COUNCIL QUESTIONS. THEY'RE USUALLY FINANCIAL QUESTIONS SO THIS IS SOMETHING THAT THE CITY COUNCIL AND THE COMMISSION HAVE PURVIEW OVER.

OBVIOUSLY THE REDEVELOPMENT AND PLAN COMMISSION WORK TOGETHER ON THE PHYSICAL, BUILT ENVIRONMENT AND THE PLANNING AND ZONING SIDE OF IT. IN ORDER FOR A PARCEL TO CAPTURE TAXES TO PAY OVER ON A TIF BOND THAT COUNCIL ALLOWS, YOU HAVE TO CREATE AN ALLOCATION AREA UNDER

STATE CODE. AN ALLOCATION AREA ESSENTIALLY IS A PARCEL OR COMBINATION OF PARCEL THAT NOW CAPTURED TAXES AND PAYS THEM OVER TO WHATEVER THE TIF IS OBLIGATED FOR.

>> THIS IS A MOMENT WHERE A PLAN COMMISSION KIND OF INTERACTS WITH A FINANCIAL PROCESS BECAUSE UNDER STATE CODE FOR AN ALLOCATION AREA TO BE CREATED IT FIRST HAS TO PASS AT THREE DEVELOPMENT COMMISSION STAGE AND THEN IS GOES HERE TO THE PLAN COMMISSION AND THEN IT GOES TO COUNCIL WHICH IS REALLY THE POINT AT WHICH A DECISION IS MADE TO CREATE THE ALLOCATION AREA BECAUSE THAT'S THE BIG VOTE AND PROCEDURALLY GOES BACK TO THE REDEVELOPMENT COALITION.

SO TRADITIONALLY ACCIDENTALCATION AREAS COME UP TO THE PLAN COMMISSION AND ALMOST UNIVERSALLY ARE ADMINISTRATIVELY VOTED ON AND GET SENT TO CITY COUNCIL.

SO THAT'S ALLOCATION AREAS GENERALLY.

SO I WANT TO TALK FOR A SECOND ABOUT THIS SPECIFIC, TWO SPECIFIC UPCOMING ALLOCATION AREAS.

THESE ARE RELATED TO, YOU MIGHT HAVE READ IN THE NEWS, BETWEEN THE CITY AND THE COUNTY RELATED TO CLAY TERRACE. CLAY TERRACE ORIGINALLY, THESE ARE ALLOCATION AREAS THAT WERE ESTABLISHED IN 2000.

BACK THEN THE WEST SIDE WAS IN THE CITY OF CARMEL WHERE CLAY TERRACE IS TODAY AND THE EAST SIDE WHERE LOWE'S IS TODAY WAS UNINCORPORATED HAMLIN COUNTY AND THIS IS ALL SUBJECT TO AN INTERLOCAL AGREEMENT. THAT INTERLOCAL AGREEMENT ESSENTIALLY CONTROL THESE TWO TIF AREAS. THERE IS A LAW IN THE STATE THAT DOES NOT ALLOW, NOW THAT THIS IS ALL THE CITY, THERE IS A LAW IN THE STATE THAT DOES NOT ALLOW A LOCAL ENTITY TO FORM A TIF AREA OVER ANOTHER TIF AREA FORMED BY ANOTHER AREA.

SO THE CITY CANNOT HAVE A PANCAKE TIF OVER THE COUNTY. THOSE COUNTY ALLOCATION AREAS WOULD HAVE GONE THROUGH 2030 WHICH MADE IT TOUGHER TO DO A PROJECT.

SO THE INTERLOCAL AGREEMENT WHICH HAS ALREADY BEEN APPROVED BY THE COUNTY AT THEIR COMMISSIONER'S COUNCIL LEVEL AND BY OUR CITY COUNCIL AND REDEVELOPMENT COMMISSION ESSENTIALLY CUTS OUT TWO NEW AREAS AND A SMALL AREA PART OF THE WEST AND THIS IS THE CLAY TERRACE ALLOCATION AREA THAT IS UP BEFORE YOU, AND A SMALL PORTION OF THE EAST. THIS IS THE B. J. 'S WHOLESALE ALLOCATION AREA THAT IS IN FRONT OF YOU TODAY AND THE REDEVELOPMENT COMMISSION AFTER WARD WILL PASS A RESOLUTION THAT DEDICATES FOR THE INTERLOCAL 5% OF ANYTHING FROM THE WEST SIDE AND 100% OF ANYTHING FROM THE EAST SIDE TO THE COUNTY.

THIS WILL ENABLE OUR CITY TO DO A PROJECT THERE WITH 95% OF THE TIF AS A STARTING POINT. SO THIS HAS GONE THROUGH EVERY STEP AND THE ALLOCATION AREAS ARE HERE BEFORE YOU, BEFORE THEY GO HOPEFULLY WITH YOUR AGREEMENT TO THE EARLY FEBRUARY COUNCIL MEETING. WITH THAT I AM HAPPY TO ANSWER QUESTIONS ABOUT THE ALLOCATION AREAS OR THESE SPECIFICALLY.

A COUPLE OF ADJUSTMENTS THAT YOU WOULDN'T PICK OUT ON THE PLAN THAT DOC ASKED US TO INCORPORATE, WHICH WE ARE.

IN ADDITION, THEY MET WITH REPRESENTATIVES OF THE JACKSON'S GRANT HOA AND IT'S JACKSON'S GRANT HOA AND THE BIGGER NEIGHBOR TO THE NORTH AND ALSO INDIVIDUAL RESIDENTS THAT ARE IN JACKSON'S GRANT VILLAGE WHICH IS THE INTERNAL SPACE SURROUNDING THIS AREA.

THEY HAD GOOD CONVERSATIONS WITH THEM, AND OUR UNDERSTANDING IS THAT NEITHER THE HOA OR JACKSON'S GRANT OR ADJOINING OWNERS HAD PROVIDED COMMENTS TO THE COMMISSION. IT WAS A GOOD EXCHANGE OF INFORMATION AND IT DIDN'T APPEAR THAT THERE WAS SIGNIFICANT OBJECTION TO THE REQUEST.
