PLACEMENT UNDER THIS CATEGORY. WE HAVE DONE. FIRST UP IS 11 A CARMEL DEVELOPMET COMMISSION'S[00:05:03]
MONTHLY MEETING. DIRECTOR ÃIS WITH US. >>GOOD EVENING COUNSELORS THANK YOU FOR HAVING US. HENRY MUST ASK A PRETTY EXECUTIVE DIRECTOR OF THE CARMEL REDEVELOPMENT COMMISSION. WE WILL QUICKLY OUTLINE 3 DEVELOPMENT COMMISSION FOR THE LAST MONTH OF DECEMBER. WE FINISHED THE MONTH WITH 13 MILLION IN FUNDS WITHOUT RESTRICTED FUNDS IT WAS 5.7 MILLION. SOME PROJECTS THAT ARE GOING ON RIGHT NOW. Ã HOLLAND IS ALMOST FINISHED.
INDUSTRIOUS IS OPEN ON THE FIRST FLOOR AND THERE FINISHING OUT SOME OF THOSE APARTMENT UNITS ON THE TOP 4 FLOORS ARE GETTING OCCUPANCY PERMITS SO THAT IS MOVING FORWARD. THE PRESIDIUM CONSTRUCTION CONTINUES ON MULTI FAMILY PORTION. I BELIEVE THAT THEY ARE ALMOST DONE FLEET LEASING OUT THE OFFICE BUILDING WHICH IS AN 80,000 SQUARE-FOOT OFFICE BUILDING. THE LOOKING FOR SOME FINAL TENANTS. FULL SPEED AHEAD ON THE LAUNCH PROJECTS.
NORTH OF WHERE WE ARE NOW. SOME OF THE TOWNHOMES AS YOU CAN SEE ARE UNDER CONSTRUCTION.
AND SALES ARE GOING WELL IS WHAT I HEAR. AS RECENTLY INTRODUCED, FIRST ON MAIN PROJECT AT RANGE LINE AND MAIN STREET IS MOVING FORWARD. THAT SITE IS NOT FENCED. THEY'VE COMPLETED THE DEMO OF ALL THE BUILDINGS YOU SEE IN THE BOTTOM LEFT OUTLINE IN THE BLUE OUTLINE. THE PROJECT IS MOVING FORWARD. MAGLIO, GOT PROJECT HAS THE FIRST FEW BUILDINGS OF THOSE STACKED FLATS CONCEPTS HAVE RECEIVED PERMITS. SO THAT SITE WORK IS ONGOING NOW. WE SHOULD SEE GO VERTICAL SOON. IF YOU DRIVEN BY 1/16 RANGE LINE YOU'VE SEEN THE SOUTHWEST PARCEL IS FULLY FENCED AND SITE WORK IS GOING ON RIGHT NOW. LOTS OF CONSTRUCTION VEHICLES ON THAT SITE. WE WILL SOON SEE A BEAUTIFUL BUILDING GOING UP. FRANCISCAN ORTHOPEDIC CENTER OF EXCELLENCE IS ALMOST FINISHED. THEY GET A FEW MINUTES WE WILL SEE AN OPENING CEREMONY. ZONE TAX IS GENERALLY DONE I BELIEVE EMPLOYEES ARE IN. IT'S A BEAUTIFUL, BEAUTIFUL HEADQUARTERS. WERE LUCKY TO HAVE THEM HERE IN OUR CITY. WE RECENTLY HAD A GROUNDBREAKING CEREMONY FOR THE SIGNATURE PROJECT. AT ALL READING AND MAIN WERE FORMER OLD ANIMAL HOSPITAL USED TO BE THAT HAS CLOSED DOWN. IT WAS NOT THE BEST LOOKING INTERSECTION THE UNIVERSE AND IT WILL SOON BE IMPAIRED THAT PROJECT HAS THEIR BUILDING PERMITS AND THEY ARE UNDER CONSTRUCTION AS WELL. FINALLY, THE PLANS FOR THE CIVIC SQUARE PARKING GARAGE ARE MAKING THEIR WAY THROUGH THE CITY NOW. CONSTRUCTION IS EXPECTED TO BEGIN IN JANUARY.
LATE LAST WEEK WE HELD A MEETING WITH ALL OF THE NEIGHBORS THERE. TO DISCUSS WHERE THEY WOULD PARK WHICH IS A TEMPORARY PARKING SITE ACROSS THE STREET ON RIDGELINE IF YOU DRIVEN BY THEIR RECENTLY. YOU SEEN A CROSSWALK AND ADA ACCESSIBLE RAMPS THAT HAVE BEEN ADDED. SO PEOPLE CAN SAFELY COST FROM TEMPORARY PARKING LOT TO ACROSS THE STREET TO THE BUSINESSES. THIS SHOULD BE A QUICK BUILD. 5 MONTHS, 6 MONTHS. THAT WILL BE, THAT GARAGE WILL BE OPEN. FINALLY, DESIGN IS ONGOING ON THE HIT NEW HISTORICAL SOCIETY BUILDING. THE NEW COMMISSION IS TEAMING UP WITH THE TOWNSHIP POND. THE PRESIDIUM TO PROJECT
[00:10:05]
IS MAKING ITS WAY THROUGH THE CITY NOW FOR PERMITS. AND HAMLIN ACROSS LANCASTER NOT AS SMALL AS A MAJOR, MAJOR ANNOUNCEMENT OF REPUBLIC AIRWAYS COMING TO THE CITY OFCARMEL. WITHOUT COUNSELORS I'M HAPPY TO ANSWER ANY QUESTIONS. >> WHAT IS A TIME LIMIT ON GETTING PRESIDIUM ONE DONE. YOU SAID THEY WERE BLITZING FINAL CORNER OF IT. FROM ALL
THE SUB PARCELS AND WHAT IS THE TIMELINE? >> I KNOW THAT THEY'RE WORKING ON THE LAST PIECE IS NOW WHICH IS THE MULTI FAMILY THAT FACES THE NEW POND OR PARK. I WOULD
GUESS 6 MONTHS. I CAN DOUBLE CHECK IT AND GET IT FOR YOU. >> THAT WOULD BE HELPFUL.
COUNCIL ANYTHING ELSE FOR HENRY? COUNCILMAN WORRELL. >> I BELIEVE THERE WAS AN ARTICLE IN THE CURRENT ABOUT THE MARSH AT CLAY TERRACE, EXCUSE ME NAUTICALLY AT MERCHANT SQUARE. FIRST OF ALL I LIKE TO SEE YOU ABOUT YOUR REPORT IS ONGOING PROJECT.
HEARD SOME CONVERSATION ABOUT WHAT WAS HAPPENING. THERE WAS A LOT OF SPECULATION. CAN YOU CLARIFY WHAT WE KNOW ABOUT THAT SPOT AND WHAT SUPPOSED TO HAPPEN AND ETC.
>> THAT ARTICLE WAS JUST PURELY ABOUT THE RESUME THAT IS IN FRONT OF THE COMPLAINANT COMMISSION NOW. IT'S BEEN REZONED TO SEE ZONING. AND WE ARE WORKING ON A PROJECT THERE.
THAT WE WILL BE BRINGING TO COUNCIL PROBABLY LATER THIS YEAR.
>> YEAH, I THINK THE CLARIFICATION LOOKING FOR IS REALLY THE MARSH SITE. I
DIDN'T ASK MY QUESTION THE RIGHT WAY. >> THAT'S RIGHT. THAT SITE IS MOSTLY OWNED BY A SINGLE OWNER WHICH IS THE MALL AND THEN THE MARSH PARCEL IS A SEPARATE PARCEL. SO ANY REDEVELOPMENT PROJECT CURRENTLY OR AT LEAST WHAT THE RESULT IS IT'S JUST THE MARSH PARCEL IN THE PARKING LOT IN FRONT OF THE MARSH ITSELF. EVERYTHING ELSE IS OWNED BY A SEPARATE OWNER. PARKS COUNCIL ANYTHING ELSE FOR HENRY? ALL RIGHT, THANK YOU
SIR. I APPRECIATE IT. >> THANK YOU. >> ACCEPT IS DIRECTOR ÃWITH
THE PARKS DEPARTMENT. >>> OKAY. NOW THAT THE INTERESTING ELECTRONIC SHOW IS DONE. PRESIDENT FINKAM AND MEMBERS OF THE COUNSIL. I WILL PROVIDE MY COURTLY REPORT TO YOU. WE WILL BEGIN WITH SOME OF OUR CONSTRUCTION PROJECTS AND PROGRESS ON THAT. FIRST OF ALL METAL ART PARK WHICH IS OF COURSE JUST A LITTLE BIT WEST OF THE ART AND DESIGN DISTRICT OFF OF MAIN STREET. CONSTRUCTION CONTINUES ON THIS PROJECT. AS MUCH AS WE WERE HOPEFUL TO GET THIS PROJECT WRAPPED UP BEFORE THE END OF THE YEAR. THE REALITY IS GOING TO BE REOPENING THIS PARK THIS COMING SPRING. A FEW ITEMS HAVE TAKEN LONGER FOR US TO SECURE SUCH AS THE CENTRAL PIECE IN THIS PARK. WHEN IT OPENS IT WILL CERTAINLY BE WELL WORTH THEIR WEIGHT. THIS IS THE PIECE THAT WE WILL NOT BE RECEIVING UNTIL FEBRUARY. AS SOON AS IT GOES UP AND THERE WILL BE SOME ASPHALT WORK THAT NEEDS TO TRANSPIRE WE WILL BE ABLE TO GET THIS PARK OPEN. WE ANTICIPATE THAT OCCURRING LIKELY BEFORE MEMORIAL DAY.
JUST TO GIVE A LITTLE BIT OF WHERE WE ARE CURRENTLY. THIS WAS FOOTAGE WE TALK ON THURSDAY. YOU CAN SEE THAT THE NEW BOARDWALKS ARE INPLACE HERE AT THE BEGINNING. THE PRESTROOM, THE PICKLE BALL COURTS, FOR COURSE THERE. NEW PARKING NOT. THE NEW ACCESSIBLE FISHING PIER THAT'S IN THE POND. ALL OF THE TRAILS THAT ARE ASPHALT WILL BE REPAVED WHEN WE REOPEN. ALL OF THE TRIALS THAT GO AROUND THE POND WILL BE REFRESHED WITH AGGREGATE SIMILAR TO WHAT'S THERE NOW. MOVING ON TO LAWRENCE W MENLO PARK. THIS WAS ONE OF OUR EARLIEST SPLASH PANTS AND VERY POPULAR. IT WAS AN END OF LIFE. THIS PROJECT
[00:15:02]
IS REPLACING THAT SPLASH PAD WHICH USED TO BE HERE. WERE RELOCATING IT SO IT'S CLOSER TO THE EXISTING PLAYGROUND ADDING TO PICKLE BALL COURTS, NEW RESTROOM FACILITIES. LITTLE ILLUSTRATION OF WHAT THOSE NEW SPLASH PANTS WILL LOOK LIKE. WE SHARE THIS WITH YOU BEFORE.SORT OF NICE TO HAVE A REMINDER OF WHAT IT LOOKS LIKE. AGAIN ON THURSDAY THIS IS WHAT THAT SITE LOOK LIKE. THE NEW RESTROOM FACILITY IS HERE RIGHT IN FRONT OF IT IS WHERE THE NEW SPLASH PAD WILL BE LOCATED. THERE WILL BE SHELTERS ON EITHER SIDE HERE AND YOU CAN SEE THE PICKLE BALL COURTS STREET IN FRONT OF US. AND WEST PARK, THAT PARK WILL BE OPENING THIS COMING SPRING. WEST PARK WHICH IS OUR LARGEST PROJECT UNDER CONSTRUCTION RIGHT NOW. IT IS A $6.2 MILLION PROJECT. AND REALLY TRANSFORMING THE ORIGINAL PORTION OF THE PARK. THIS MORNING HAS BEEN UNDER CONSTRUCTION THE LONGEST BUT IT'S THE MOST COMPLEX PROJECT WE HAVE OUT THERE. AND, THIS VIEW HERE BASICALLY RIGHT HERE IS WHERE THE SPLASH PAD USED TO BE. YOU COULD SEE THE PARKING LOTS WHERE THEY'VE ALWAYS BEEN.
HUNDRED 16TH STREET IS IN THE FOREGROUND AS WELL AS Ã PAVILION. HERE'S A RENDITION OF WHAT THAT PLAYGROUND WILL LOOK LIKE WHEN IT'S FINISHED. THE NEW PLATE FEATURE THAT WILL BE UP ON THE HILL, THE SPLASH PAD WITH WATERFALLS AND A BRIDGE THAT GOES OVER APPEARED SMALLER KITTY FEATURES DOWN BELOW. AND AN EMBANKMENT SLIDE. IT WILL BE QUITE THE ATTRACTION JUST AS ALL OF OUR NEW PLAYGROUNDS ARE. ONE OF THE THINGS WE STRIVE FOR IS TO ENSURE THAT EVERY SINGLE PARK HAS A VERY UNIQUE IDENTITY AND EXPERIENCE. CERTAINLY THIS WILL BE A SPLASH PAD LIKE NONE OTHER AS WELL AS APPLY EXPERIENCE LIKE NONE OTHER.
WERE EXCITED ABOUT THAT. AGAIN, HERE'S WHAT IT LOOKED LIKE ON THURSDAY. NEW ROLE OF PARKING. THIS IS THE NEW ROAD IN FRONT THAT GOES CONNECTS TO WHERE THE ÃPAVILION'. HERE YOU CAN SEE IN THE BACKGROUND THE NEW HILL. ANTHONY SPLASH PAD. NOW, ONE OF THE THINGS THAT'S EXCITING FOR US IS THIS WAS TAKEN ON THURSDAY. ON FRIDAY THE NEW BILL RIDGE THAT GOES OVER THE SPLASH PAD WAS INSTALLED. ONE OTHER THING WAS WITH WEST PARK THAT HAS ALWAYS BEEN A SPECIAL EXPERIENCE IS THE CREEK THAT WAS THERE. THE SPLASH CONCRETE. AS MUCH AS EVERYONE LOVED IT, IF YOU WERE TRYING TO DESIGN THAT SITE WE WOULD PROBABLY NOT GET THAT APPROVED OF HEALTH DEPARTMENT. WE TRYING TO RESPECT THE HISTORY OF THAT CREEK AND LINEAR EXPERIENCE. NOT SO LITERALLY THAT YOU HAVE THE WATERBED THAT FLOWS THROUGH IT.
YOU CAN SEE THE CONCRETE RIBBON THAT REFLECTS THE CREEK. YOU'RE GOING TO HAVE WATERFALLS. YOU CAN HAVE A WHOLE BUNCH OF SPRAY GEYSERS AND OTHER FEATURES IN THERE.
ACTUALLY IT'S GOING TO BE A SPECIAL EXPERIENCE. KEEP THIS BRIDGE IN MIND. THIS IS IF YOU ARE LOOKING UNDERNEATH THE BRIDGE TOWARDS THE WATERFALL. SO THIS IS REALLY GOING TO BE QUITE POPULAR, I HAVE NO DOUBT. THEN MOVING ON TO A PROJECT WHERE IT WILL BE A FEW YEARS BEFORE WE START CONSTRUCTION. WE ARE IN THE PROCESS OF DEVELOPING A MASTER PLAN FOR ONE OF OUR NEWEST PARKS, BEAR CREEK PARK WHICH IS LOCATED AT THE SOUTHWEST CORNER OF SHELL BORN AND HUNDRED 46TH STREET. RADIO ONE ANNOUNCED FOR THE PUBLIC AS WELL AS FOR MEMBERS OF THE COUNCIL IS THAT WE INVITE PEOPLE TO COME OUT TO THE PARK ALREADY. IT IS OPEN ON WEEKENDS SO ON SATURDAY AND SUNDAY FROM 9:00 A.M. TO 5 PM PEOPLE ARE WELCOME TO COME OUT TO THE SPARK. OFFICIAL BORN THERE'S A LITTLE DRIVEWAY YOU WILL SEE A SIGN THAT SAYS FUTURE BEAR CREEK PARK. COULD DRIVE DOWN THAT LITTLE DRIVEWAY TO A LITTLE TRAILHEAD. THERE'S A FEW PARKING SPACES THERE. THERE IS A POOR LENGTH THERE. NOT THE MOST EXCITING. ED EVENTUALLY BEATEN MUCH NICER BUT WERE IN THE PLANNING STAGES. THERE'S ALSO 3 QUARTERS OF A MILE WORTH OF TRAILS, SEVERAL LOOPS INCLUDING ONE THAT GOES ACROSS THE BRIDGE AND TO THE NORTH PARK. WE ENCOURAGE PEOPLE TO DO IS FIRST, GET OUT THERE AND EXPERIENCE THIS PART. ONE THINK THIS ILLUSTRATION DOES NOT SHOW WAS A TOP BIOGRAPHY OUT THERE. THERE ACTUALLY IS A DECENT ROLE OUT THERE ESPECIALLY FOR CENTRAL INDIANA.
I THINK PEOPLE ARE PLEASANTLY SURPRISED WHEN THEY GET OUT THERE. DRIVING ON THE STREET YOU JUST DON'T SEE HOW BEAUTIFUL THIS PARK IS AND THE TOP BIOGRAPHY OUT THERE. WHEN PEOPLE LOOK OUT THERE. EXPERIENCE IT. WE HOPE IT HELPS INFORM US WE HAVE FUTURE PUBLIC INPUT MEETINGS WHAT THIS PARK CAN BE. WHEN YOU GET OUT THERE YOU REALIZE WHAT IT CAN BE MAY BE WHAT IT CAN'T BE AS WELL. SO, THE TRAILS OUT THERE ARE PRIMITIVE TRAILS. THEY'RE NOT PAVED. THERE JUST LONG TRAILS. THEY PROVIDE INCREDIBLE EXPERIENCE. GET YOUR FAMILIES OUT THERE, FIDO AND EVERYTHING. IT'S A GREAT PLACE TO EXPERIENCE AND ENCOURAGE EVERYONE TO GO OUT THERE. HERE ARE SOME PHOTOS WE HAD SOME ACTUAL VISITORS THAT
[00:20:02]
HAVE SHARED THEIR EXPERIENCES AND THE EXPERIENCE. THIS WAS WARMER AND IT BEFORE GOD AS COLD AS IT IS TODAY. AGAIN, IT'S ALREADY A BEAUTIFUL SITE AND PROVIDES A GREAT NATURAL ESCAPE HERE IN CARMEL. HOPEFULLY PEOPLE WILL CONTINUE TO GO OUT THERE. WE HAD OUR FIRST ROUND OF PUBLIC MEETINGS IN SEPTEMBER. THE LAST MONTH WE HAD OUR SECOND ROUND INCLUDING A NUMBER OF FOCUS GROUPS. THESE ARE MY MOST FAVORITE FOCUS GROUPS WE FOUND SO FAR. DID MEET WITH THEM NUMBER OF YOUTH IN THE COMMUNITY INCLUDING AT CREEKSIDE MIDDLE SCHOOL WHICH IS THE LARGER PHOTO TO THE RIGHT. THESE ARE THE KIDS THAT WILL CLOSEST TO THE PARK. WANT TO MAKE SURE WERE GETTING THEIR INPUT AS TO WHAT THIS PARK CAN BE. THE UPPER PHOTO IN THE UPPER LEFT IS FROM COLLEGE WHAT ELEMENTARY SCHOOL FROM OUR BEFORE AND AFTER SCHOOL PROGRAM. THE LOWER LEFT IS SOME STUDENTS THAT ARE PART OF THAT MIRRORS YOU COUNSEL. AN INCREDIBLE GROUP TO WORK WITH. , THE OTHER GROUPS GETTING IDEAS FROM WE ACTUALLY TURNED OVER AND GAVE THEM TRACE PAPER THEY WERE STARTING TO DEVELOP DESIGNS FOR US. ONE OF THEM AFTERWARDS HAPPENED TO MENTION THAT SHE PLANS TO BE AN ARCHITECT AND I HAVE NO DOUBT SHE WILL BE INCREDIBLY SUCCESSFUL. GREAT FEEDBACK.NEXT MONDAY PUBLIC INPUT WILL BE IN JANUARY 25 WHICH IS A TUESDAY. IT'S OPEN TO THE GENERAL PUBLIC AT 6 PM AT WEST PARK GENERAL PRO-MEN PAVILION. WE INVITE PEOPLE TO COME OUT AND GIVE US FEEDBACK. THIS MEETING IS WHEN IT STARTS GETTING EXCITING. THE DESIGNERS WILL HAVE 2 TO 3 CONCEPTS OF WHAT THE PARK COULD BE. AND PEOPLE WILL BE ABLE TO VISUALIZE A LITTLE BIT MORE WHAT WE ARE THINKING AND WE WILL ALSO BE ABLE TO GIVE US FEEDBACK ON IT. STILL VERY MUCH IN THE PLANNING STAGES. THIS IS WHERE IT STARTS GETTING EXCITING. AN INVITE EVERYONE TO COME. WE WILL HAVE A NUMBER FOCUS GROUPS AS WELL. SOME OF THE NEIGHBORS AND WE WILL GO BACK TO ALL THE SCHOOLS TO TALK TO THE SAME KIDDOS. FIRST WE GOT THERE IDEAS OF WHAT THEY WANTED AND WE WILL SEE HOW WELL WE CAPTURE THAT. VERY EXCITED ABOUT THE JANUARY UPCOMING MEETINGS. AND THEN, TO CONCLUDE WITH. I ALWAYS KNEW FLOWING WELL WITH PEOPLE COMING FROM WAY FAR AWAY. NOW WE HAVE VALIDATION THAT WE HAVE PEOPLE COMING FROM AS FAR AS THE NORTH POLE. YOU KNOW, SANTA OF COURSE KNOWS IF YOU'VE BEEN NAUGHTY OR NICE. ALL I CAN SAY IS SO DO WE. WITH THAT I BE HAPPY TO ADDRESS ANY QUESTIONS
YOU MAY HAVE. >> ANY QUESTIONS FROM COUNCIL FOR MICHAEL? COUNSELOR RIDER AND I WERE WONDERING IF THERE WAS AGE LIMIT FOR THE NEW PARK?
>> ACTUALLY THERE WON'T BE. YOU KNOW, ALL I HAVE TO SAY IS ONE OF THE GREAT PRIVILEGES OF BEING DIRECTOR OF PARKS AND RECREATION IS THAT SOMEONE HAS TO TEST ON THIS EQIPMENT
PBEFORE THE KIDDOS GET ON IT. >> IF YOU EVER NEED ANY HELP LET ME KNOW.
>> ABSOLUTELY WE WILL HAVE A COUNCIL DAY OUT THERE. >> GREAT, THANK YOU VERY MUCH
AND APPRECIATED AS ALWAYS. >> MY PLEASURE. >> NEXT UP ON THE AGENDA IS IDABEL AND THAT'S ALL REPORT DESIGNATED BY THE CHAIR TO QUALIFY FOR PLACEMENT UNDER THIS CATEGORY. I'VE ASKED JEFF MCDERMOTT FOR THE CENTER OF THE PERFORMING ARTS, PROVIDE MORE INFORMATION ON INFORMATION THAT CAME OUT ABOUT POTENTIAL NEW MUSEUM. JEFF, WELCOME.
>> THANK YOU MADAM PRESIDENT. I APPRECIATE THE OPPORTUNITY TO ADDRESS YOU COUNSEL MEMBERS IN THE COMMUNITY. I THINK I FIRST WANT TO CONGRATULATE THE CITY OF CARMEL, THE CITY COUNCIL, THE MAYOR. EN MONEY.COM NAMING CARMEL LAST WEEK IS THE NUMBER ONE PLACE TO RETIRE IN THE UNITED STATES. WAS FRANKLY VERY PROUD AND PLEASED TO SEE THE MENTION FOR THE CENTER FOR THE PERFORMING ARTS. THE COMMITMENT TO THE ARTS THAT THIS COMMUNITY HAS ACTUALLY THE NUMBER OF MUSEUMS THAT THE CITY HAS. I THOUGHT THAT WAS A NICE SEGUE INTO WHAT I WANTED TO TALK TO ABOUT A LITTLE BIT THIS EVENING. FIRST FOR THOSE WHO MAY NOT BE AS FAMILIAR WITH THE GREAT AMERICAN SONGBOOK FOUNDATION. I SERVE AS A PRESIDENT AND CEO OF BOTH THE CENTER FOR THE PERFORMING ARTS AND THE GREAT AMERICAN SONGBOOK FOUNDATION. IT'S DEDICATED TO THE MUSIC OF AMERICA. UNITED STATES. MUSIC THAT IS MADE THIS NATION GREAT. SOMETIMES PEOPLE WONDER WHAT THE SONGBOOK IS. IT'S NOT ACTUALLY A BOOK. THERE'S NO BOOK THAT CONTAINS ALL OF THE MUSIC OF THE SONGS. IT'S THE MUSIC OF ALL OF OUR LIVES. IT'S CONTINUING BEING WRITTEN. WE HAVE A HALL OF FAME THAT HAS INDUCTED DOZENS OF PEOPLE ALREADY OVER THE LAST 10 YEARS. IT INCLUDES PEOPLE LIKE COLE PARGO, WHO GAVE PARKER, NIZAM MULLALLY, FRANK
[00:25:02]
SINATRA, PARAMOUNT LOW, RITA MORENO AND OTHERS. WHILE A LOT OF THOSE ARE OLDER OR POSTHUMOUS INDUCTEES THE SONGBOOK IS A MENTION IS ALWAYS BEING WRITTEN. I COULD IMAGINE PEOPLE LIKE BILLY JOEL, ELTON JOHN, JOHN MELLENCAMP, TWITTER SWIFT, WHO KNOWS THERE WILL BE INDUCTED INTO OUR RESUME EVENTUALLY. THE SONGBOOK FOUNDATION ACTUALLY IS A FOUNDATION THAT WAS FOUNDED BY MICHAEL FEINSTEIN AND EXISTED IN LOS ANGELES. ABOUT 10 YEARS AGO OR SO MAYOR BRAINARD WAS INSTRUMENTAL IN CONVINCING THE SONGBOOK FOUNDATION TO RELOCATE HERE TO CARMEL. AT THE TIME IT WAS COMPETING WITH PLACES LIKE NEW YORK CITY, LAS VEGAS, WHO JUST BUILT A NEW SMITH CENTER OUT THERE. CITIES IN SOUTH FLORIDA. WE WERE FORTUNATE TO ATTRACT THE FOUNDATION HEREAFTER CARMEL. IT IS SENSE FORMERLY AFFILIATED WITH THE CENTER FOR THE PERFORMING ARTS. REALLY HAS BECOME AN EXTREMELY VIBRANT NATIONAL ORGANIZATION WITH A NATIONAL BOARD. WE HAVE A LOW NUMBER OF LOCAL BOARD MEMBERS AND BOARD MEMBERS IN LAS VEGAS, IN CALIFORNIA, INTERNATIONAL AND ELSEWHERE AROUND THE COUNTRY. I'M PLEASED TO TELL YOU THAT THE SONGBOOK FOUNDATION IS ONE OF ONLY 8 AFFILIATES OF THE GRAMMY MUSEUM FOUNDATION OR GRAMMY MUSEUM IN LOS ANGELES. GRAMMY AS YOU KNOW IS THE GOLD STAR WHEN IT COMES TO ANYTHING MUSIC. WE ARE PLEASED TO BECOME THE FIFTH AFFILIATE A FEW YEARS AGO. THERE ARE NOW 8. IT IS OUR INTENTION WITH THE BUILDING OF MUSEUM EVENTUALLY, IN THIS COMMUNITY TO WORK EXTREMELY CLOSELY WITH THE GRAMMY MUSEUM. THEY HAVE WORKED WITH OTHER CITIES AROUND THE WORLD ACTUALLY TO BUILD OTHER MUSEUM, MUSIC THEMED MUSEUMS. A FEW OF THOSE I MIGHT MENTION THE NATIONAL BLUES MUSEUM IN ST. LOUIS MISSOURI. THE BEATLES STORY IN LIVERPOOL ENGLAND. THE INDIAN MUSIC EXPERIENCE IN BENGALURU INDIA. AND EVEN THE BOB MARLEY MUSEUM IN KINGSTON JAMAICA. IT'S THE GRAMMY MUSEUM FOUNDATION THAT WILL BE WORKING WITH US AS A LEAD AND EVERYTHING RELATED TO THE MUSEUM WE INTEND TO BUILD. THEY WILL WORK WITH US, SOUP TO NUTS IN TERMS OF HELPING US RAISE THE MONIES FOR THIS. ENVISIONING THE MUSEUM. THE ARCHITECTURAL RENDERINGS OF THE MUSEUM. EVERYTHING FROM HOW TO RUN A MUSEUM, HOW TO SUSTAIN IT. AND ACTUALLY COLLABORATING WITH US ON EXHIBITS THAT WOULD ROTATE IN AND OUT OF THE MUSEUM. THE ORGANIZATION THAT'S DONE THIS THROUGHOUT THE WORLD AND WERE LOOKING FORWARD TO COLLABORATING WITH THEM HERE. I WANT TO MENTION THERE WAS AN ARTICLE IN OUR CURRENT ABOUT LAND FOR THE MUSEUM AND OUR GOALS. I THINK IT DID CREATE A LITTLE BIT OF CONFUSION WITHIN ITS READERSHIP AS TO WHO WOULD BE BUILDING THIS MUSEUM. I WANTED TO EMPHASIZE THAT WE WOULD VIEW THIS AS A PUBLIC PRIVATE PARTNERSHIP. THE PUBLIC PORTION OF THIS WOULD BE OUR HOPE THAT THERE WOULD BE A LAND GRANT LEASE OF LONG-TERM NATURE. HOPEFULLY IN THE MIDTOWN AREA THAT COULD BE USED BY THE FOUNDATION TO CONSTRUCT ITS MUSEUM. HE MENTIONED WE HAVE A NATIONAL BOARD. WE HAVE NATIONAL DONORS. MOST OF THE MONEY FOR OUR FOUNDATION COMES FROM OUT OF STATE. IT WOULD BE OUR PLAN TO CONDUCT A NATIONAL IF NOT INTERNATIONAL CAPITAL CAMPAIGN WITH SIGNIFICANT DONORS FROM AROUND THE WORLD THAT WOULD RAISE THE MONIES TO BUILD THIS MUSEUM. I WANT TO EMPHASIZE THAT WE ARE EXTREMELY GRATEFUL TO MAYOR FINKAM, TO THE CITY COUNCIL, TO THE CRC THAT ARE BEING MADE TO IDENTIFY AND SECURE LAND ON WHICH THIS MUSEUM WOULD BE BUILT. THEN RUN BY THE GREAT AMERICAN SONGBOOK FOUNDATION. WERE EXTREMELY EXCITED ABOUT IT. THERE'S A NUMBER OF YEARS BEFORE WE BRING A SHOVEL TO BREAK DOWN. WITH EACH PASSING DAY IT WOULD BE CLOSER TO THE REALITY. THE GOAL WOULD BE IN THE MIDTOWN AREA. WE WOULD MAKE SURE IT FITS THE DESIGN, THE FEATURES, THE QUALITY OF THE MIDTOWN AREA AND CONTINUE AN EXPANSION IN THERE. WE SINCERELY BELIEVE THAT WILL ATTRACT NATIONAL ATTENTION FOR THE CITY OF CARMEL AND TO BE QUITE AN ECONOMIC DRIVER FORUS. I'LL BE HAPPY TO ENTERTAIN ANY QUESTIONS YOU MAY HAVE. >> COUNCIL? COUNSELOR AASEN.
>> BESIDES THE LAND GRANT DO YOU ANTICIPATE YOU WOULD COME TO THE CITY OF CARMEL AT SOME
POINT FOR ANY OTHER ON IT FOR THIS MUSEUM? >> WE HAVE NO INTENTION OF DOING THAT COUNSELOR. WE BELIEVE WITH THE SIGNIFICANT DONOR BASE WE HAVE NATIONALLY AND INTERNATIONALLY THAT WE WOULD RAISE, WHAT WOULD BE THE TENS OF MILLIONS OF DOLLARS TO
[00:30:04]
NOT ONLY BUILD THIS BUT OPERATED AND SUSTAIN IT. >> YOU DID HAVE SOME ON IT YOU
WERE STARTING WITH BECAUSE OF THE SIMON PROPERTY. >> WE DID SELL THE SIMON PROPERTY WHICH WAS AN EXTREMELY GENEROUS GIFT FOR MRS. BRENT SIMON. ABOUT ALMOST 4 YEARS AGO NOW. THAT WAS SOLD AND THAT IS SOME SIGNIFICANT SEED MONEY THAT WILL HELP US GET
STARTED, YES. >> THANK YOU. >> COUNSELOR HANNON.
>> MADAM PRESIDENT, THANK YOU FOR BEING WITH US JEFF. ARE THERE ANY DETAILS FED UP AND WORKED OUT YET ON THE PROPOSED LAND LEASE? ALL I SAID THAT THE CITY INTENDS TO PURCHASE THIS PROPERTY FOR $4.8 MILLION. THEN IT WOULD BE GRANTED AT NO COST? IS THERE GOING TO BE A LEASE FOR PAYMENT? DO YOU KNOW ANYTHING ABOUT THOSE DETAILS RIGHT NOW?
>> WERE NOT INVOLVED IN SECURING THE LAND. UNFAMILIAR WITH THE LAND THAT IS BEING FOCUSED UPON RIGHT NOW TO TRACTS OF LAND. ABOUT BEEN INVOLVED IN THOSE DISCUSSIONS.
IT'S BEEN A BELIEF BETWEEN THE CRC AND THE LAND OWNERS. IN TERMS OF A LAND GRANT LEASE,
WE'VE NOT DISCUSSED THOSE TERMS YET. NO. >> OKAY. THANK YOU.
>> SO NORMALLY WHEN A PROJECT LIKE THIS IS AN OUNCE IT'S THE CAPITAL CAMPAIGN IS ALSO AN OUNCE AT THE SAME TIME. SO IT SEEMS A LITTLE DISJOINTED. CAN YOU EXPAND UPON THAT A LITTLE
BIT? >> WE WERE NOT AWARE THE CURRENT WAS GOING TO MOVE FORWARD. WERE APPRECIATIVE OF THAT INTEREST AND COVERAGE. BUT YOU'RE RIGHT, I BELIEVE IT WAS SOMEWHAT PREMATURE BECAUSE THERE ARE A NUMBER OF DETAILS THAT HAVE NOT BEEN WORKED OUT YET. CRYSTAL NEGOTIATION PROCESS WITH THE GRAMMY RESUME OF WHAT THEIR ROLE WILL BE.
HAVE A PROPOSAL FROM THEM THAT WE ARE STUDYING COUNT WE WOULD EXPECT PROBABLY TO ENTER INTO THAT FAIRLY SOON. AS COUNSELOR AASEN NOTED. WE DID SELL THE ASHWOOD PROPERTY PROXIMALLY A YEAR AGO. THAT MONEY WILL SERVE AS SOME OF THE SEED MONEY WE WILL USE TO DO SOME OF THE STUDIES THAT WE NEED TO DO TO DO SOME OF THE ARCHITECTURAL RENDERINGS AND THINGS OF THAT NATURE. I HAD VIEWED THIS AS A SEVERAL STEP PROCESS AND WERE BEING DELIBERATIVE ABOUT IT.
WE HAVE RECENTLY APPOINTED A MUSEUM OVERSIGHT COMMITTEE FROM THE FOUNDATION IS A COMMITTEE THAT WE WILL CONTINUE TO ADD PEOPLE TO FROM THE INDUSTRY FROM AROUND THE COUNTRY. WE HAVE THE INITIAL SEED MONEY ON SITE MENTIONED WITH LAND ONCE IT IS IDENTIFIED AND SECURE SO WE CAN SPECIFICALLY SAY THIS IS THE SITE OF THE MUSEUM WILL BE BUILT ON. WE WILL PREPARE, WORK WITH ARCHITECTS TO PREPARE REAL RENDERINGS BASED UPON THAT FOOTPRINT. THOSE RENDERINGS WILL BE INTERIOR AND EXTERIOR AND WILL INCLUDE EVERYTHING FROM THE TECHNOLOGY TO THE ARCHIVAL SPACE, TO THEATERS, TO OUTDOOR EVENT SPACE. EVERYTHING YOU NEED TO KNOW TO HAVE SUSTAINABLE MUSEUM. ONCE RENDERINGS ARE DONE WE WILL DETERMINE WHAT THE CROSS ARE GOING TO BE TO BUILD THIS. IT'S NOT REALLY UNTIL THEN ONCE WE HAVE LAND, IDENTIFIED, HAVE ARCHITECTURAL RENDERINGS THAT ARE SOLIDIFIED AND HAVE ACTUAL COST THAT WE KNOW WILL BE ASSOCIATED WITH THIS THAT WE WOULD EMBARK UPON THE CAPITAL CAMPAIGN.
[12. OLD BUSINESS]
>> ANY OF THE QUESTIONS COUNCIL? THANK YOU FOR COMING TONIGHT FOR THE CLARIFICATION.
WE APPRECIATE YOUR TIME. >> I APPRECIATE YOUR TIME. >> OKAY NEXT UP ON THE AGENDA IS ITEM 12 WHICH IS OLD BUSINESS. 12 A IS 1/4 RATING ABORTED STEVE Ã2605 Ã21. AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL INDIANA ADDING SECTION 3 Ã48 TO CHAPTER 3, ARTICLE 1, DIVISION 2 OF THE CARMEL CITY CODE. THIS IS RETURNING FOR THE FINANCE UTILITIES AND RULES COMMITTEE. CANCEL WORRELL I THINK THERE'S AN UPDATE.
>> THINK ABOUT A PRESIDENT. WE ARE RETURNING THIS WITH A RECOMMENDATION FOR APPROVAL ON A VOTE OF 3 ÃZERO VOTE FROM THE FINANCE COMMITTEE. WE MADE ONE CHANGE IN COMMITTEE THAT COUNCIL, THAT IS DIFFERENT FROM THE ORIGINAL. I WILL GO AHEAD AND READ THE MEAT OF THE ORDINANCE. SECTION A WILL BE THE COMMON COUNCIL SHALL HAVE THE POWER TO EXPEL ANY OF ITS MEMBERS FOR VIOLATION OF AN OFFICIAL DUTY OR DECLARED THE SEED OF ANY MEMBER VACANT. IF A MEMBER IS UNABLE TO PERFORM THE DUTIES OF THE MEMBER'S OFFICE. THE COUNCIL SHALL IN SUCH CASES FIRST BITE RESOLUTION DIRECT A CORPORATION COUNCIL TO DRAW UP A BILL OF IMPEACHMENT SETTING FORTH THE NATURE OF THE CHARGES AND THE FACTS SUPPORTING THEM. THEN THE CHANGE WE MADE FROM WHAT YOU PREVIOUSLY SAW IN COMMITTEE, THE BILL OF IMPEACHMENT SHALL BE FILED WITH THE CLERK AND DELIVERED TO THE MEMBERS IN WRITING. WE HAVE CORPORATION COUNCIL HERE.. GOOD DISCUSSION. IF THERE'S ANY QUESTIONS WERE READY TO ANSWER
[00:35:04]
THEM. >> COUNCIL? COUNSELOR GREEN. >> YEAH, JOHN, I'VE A QUESTION.
THEY KEEP MADAM PRESIDENT. OFFICIAL DUTY, OVERSIGHT WE'VE HAD LOTS OF DISCUSSIONS IN THE FINANCE COMMITTEE AND AMONG THE COUNCIL. WHENEVER A GOVERNING BODY IS GOING TO TAKE ACTION TO REMOVE ONE OF ITS OWN MEMBERS FROM AN ELECTION THERE'S ALWAYS KIND OF CONCERN THAT IT COULD BE TURNED INTO POLITICAL. THIS PROCESS COUNT OF LADIES SOMETHING THAT WE NEED FOR CERTAIN SITUATIONS. YOU KNOW, THE ONLY DEFINITION OR THE STANDARD IS OFFICIAL DUTY. CAN YOU REVIEW MORE TIME KIND OF WHAT IS NOT OFFICIAL DUTY OF EVER CAN BE REMOVED.
>> SURE, THANK YOU COUNSELOR GREEN. >> JOHN OVER LETTER. THE FINANCE COMMITTEE WE DISCUSSED IT. LATER COUPLE DIFFERENT WAYS YOU COULD LOOK AT IT RATHER THAN DEFINING IT. IT COULD BE AN ACTUAL CRIME SUCH AS AN OFFICIAL MISCONDUCT.
COULD ALSO BE SOMETHING THAT ISN'T NECESSARILY CRIMINAL IN NATURE. MAYBE SOMETHING ALONG THE LINES OF ETHICS VIOLATION. THAT WOULD VIOLATE OFFICIAL DUTY. THERE'S ETHICS ORDINANCE UNDER THE CITY CODE THAT COULD BE VIOLATED THAT THE COUNCIL DETERMINED YOU NO DOUBT VIOLATION ROSE TO THE VIOLATION OF OFFICIAL DUTY COULD IMPLEMENT PROCEEDINGS UNDER
THIS ORDINANCE. >> AND WE ALSO HAVE THIS QUESTION. THIS WAS DISCUSSED.
OTHER OTHER MUNICIPALITIES OR GOVERNING BODIES THAT HAVE SOMETHING SIMILAR IN PLACE IN
CASE YOU KNOW A SITUATION ARISES? >> YES. BLOOMINGTON HOUSE ONE AND EAST CHICAGO AS AN ORDINANCE SIMILAR TO THIS. ANNA BROOKS.
>> INTO THE ALSO RELY ON THE TERM OF OUR OFFICIAL DUTY? >> THEY DO. NEITHER OF THEM DEFINES THOUGHT. THAT'S WHAT'S ACTUALLY IN THE INDIANA CODE IS OFFICIAL DUTY.
>> COUNSELOR RIDER. HE. >> HE JUST KIND OF ANSWERED IF YOU COULD GO FURTHER. THIS PROPERTY IS IN INDIANA CODE. SO THIS IS AS PUTTING IN A PROCESS IN PLACE FOR THE CITY.
>> YES, THIS JUST PUT FLESH ON THE BONES WITH WHAT'S ON STATUTE. THE STATUTE STATES THE MEMBERS CAN REMOVE A MEMBER AND IT REQUIRES A 2 THIRDS VOTE. IT SAYS THE COUNCIL CAN
CREATE PROCEDURES FOR THE PROCESS. >> ANY OTHER QUESTIONS FOR JOHN
OR JEFF? >> MADAM PRESIDENT. >> YES COUNSIL WORRELL.
>> I WOULD MOVE THAT WE AMEND TO INCLUDE LENGTHY, THE BILL OF IMPEACHMENT SHALL BE FILED WITH
THE CLERK AND DELIVERED TO THE MEMBER IN WRITING. >> SECOND.
>> ANY DISCUSSION ON THE MOTION? SAINT NOT, PLEASE SIGNIFY YOUR VOTE. THANK YOU.
IT HAS PASSED AND WERE FREE TO ACT ON THIS. >> MADAM PRESIDENT?
>> HER? >> I MOVE THAT WE PASS ORDINANCE D Ã2605 Ã21 AS
AMENDED. >> SECOND. >> ANY DISCUSSION? SEEING NONE PLEASE VOTE. THANK YOU VERY MUCH FOR YOUR WORK ON THEM. ITEM 12 B IS THIRD RATING ABORTED STEVE Ã2606 Ã21. AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL INDIANA AMENDING CHAPTER 8, ARTICLE 5 SECTIONS 8 Ã45 8 Ã48 OF THE CARMEL CITY CODE. THIS IS RETURNING FOR THE FINANCE AND UTILITIES RULES COMMITTEE. GERMAN WORRELL QUICK EXIT THINKING MADAM PRESIDENT. THIS MORNING WE SPENT A LOT MORE TIME ON. THIS IS THE ORDINANCE TO DEAL WITH A SITUATION THAT HAS OCCURRED OVER TIME OR BEHALF STUDENTS AND A PARENT PICKUP ISSUE OCCURRING IN OUR NEIGHBORHOODS. SO, WE DID VOTE IN THE FINANCE COMMITTEE MEETING TO RETURN IT TO COUNCIL WITH A POSITIVE RECOMMENDATION THAT WAS ALSO 3 Ã0. HOWEVER, THERE WERE SOME OUTSTANDING ISSUES THAT WERE LEFT NEEDED FURTHER INFORMATION AND I DID MAKE A COMMITMENT TO THE FINANCE COMMITTEE THAT I WENT GO AHEAD AND ASK SOME MEMBERS OF THE SCHOOL CORPORATION TO PAPPEAR HERE TONIGHT TO ANSWER THOSE. LET ME THIS OUT REAL QUICK WHAT WERE TALKING ABOUT. THEN AT THE END WERE GOING TO SUGGEST SOME STREETS TO AUTOMATIC LEAK BE INCLUDED THAT WILL GO BEFORE THE BP W. I DID SEND OUT A MEMO TO ALL COUNSELORS BUT THERE HAVE BEEN SOME ADDITIONAL TO THAT. WE WILL COVER THAT. FIRST OF ALL WHAT WE ARE TALKING IT ABOUT IS DEALING WITH THE PARKING SITUATION AS WELL AS A PARENT PICKUP SITUATION. REALLY, PICKUP IS OCCURRING AT ALL OF OUR SCHOOLS, STUDENT PARKING
[00:40:09]
DOESN'T HAPPEN AT SOME OF HER OTHER SCHOOLS. AROUND THE HIGH SCHOOL SPECIFICALLY IN THE NEIGHBORHOODS. THERE'S A VARIETY OF REASONS WHY WE ARE WHERE WE ARE. I BELIEVE TIME FOR THE MEMBERS, REPRESENTATIVES OF THE SCHOOL TO ADDRESS THAT IF YOU CHOOSE TO. WHAT WE ARE DOING RIGHT NOW IS CREATING THE FRAMEWORK WHERE A RESIDENT ON A STREET THAT HAS A PROBLEM CAN PETITION THE CITY ENGINEER TO MAKE THAT STREET PARKING. THAT WOULD MEAN NO PARKING, STANDING OR STOPPING. WE WOULD STILL HAVE ABILITY FOR RESIDENTS JUST DON'T PARK ON THE STREET. WE HAVE BULLETIN PICKED IN THE ORDINANCE. GUEST PASSES. IN ESSENCE WE ARE TRYING TO DEAL WITH THE SITUATION THAT HAS MADE IT SO WE CAN NO LONGER GET A FIRE TRUCK DOWN SOME OF OUR STREETS AROUND THE HIGH SCHOOL DURING SCHOOL BECAUSE OF THE PARKING SITUATION AND THAT IS THEN COMPOUNDED BY PARENTS WISHING TO PICK UP THEIR STUDENTS. THE SCHOOLS HAVE DONE I THINK A GREAT JOB SHOULD BE COMMENDED FOR WHAT THEY HAVE TRYING TO DO TO BE GOOD NEIGHBORS. AND TO ALLEVIATE THE SITUATION BY FIRST GUARANTEEING THEIR WILLINGNESS TO WORK WITH US ON FINDING A SOLUTION. AND ALSO COMMUNICATING TO PARENTS AND CREATING A SITUATION WHERE THERE IS PARKING AT THE HIGH SCHOOL FOOTBALL STADIUM AND THERE IS A PICKUP SITUATION ON THE WEST SIDE OF THE FOOTBALL STADIUM AS WELL. MY UNDERSTANDING IS THAT THEY HAVE MADE SOME CHANGES. IT'S KIND OF AN EVOLVING SITUATION WHERE NOW I THINK IT FINANCE WE TALKED ABOUT THE PICKUP ALWAYS HAD TO GO WEST. THAT HAS CHANGED. WE DIDN'T REALIZE THAT IS CHANGED TO WHERE THEY COULD GO BOTH EAST AND WEST. UNLESS YOU HAVE ANY OTHER QUESTIONS FOR ME I'M GOING TO STOP SO WE CAN KEEP THIS MOVING ALONG AND FIND OUT IF IF I COULD ASK A REPRESENTATIVE FROM THE SCHOOL ORPORATION TO PLEASE APPROACH THE PODIUM AND WE WILL DEAL WITH A COUPLE OFISSUES THAT WERE LEFT HANGING IN FINANCE. GOOD. >> GOOD EVENING, MY NAME IS ROGER MCMICHAEL AND ASSOCIATES OVER TENANT FOR CARMEL CLAY SCHOOLS. ALSO HAVE TOBY STEEL, ONE OF THE ASSISTANT PRINCIPALS OF THE HIGH SCHOOL THAT COULD SPEAK MORE SPECIFICALLY TO THIS. AND THEN TODD FINALLY OUR DIRECTOR OF FACILITIES AND TRANSPORTATION. WE WILL ATTEMPT TO ANSWER QUESTIONS THAT YOU HAVE. MY PREFERENCE MY COMMENTS BY SAYING THE CHALLENGE WE HAVE IS WE HAVE ABOUT 5400 STUDENTS A CARMEL HIGH SCHOOL. BUT I THOUGHT OF OF THEM DRIVE. PROBABLY ANOTHER THOUSAND PICKED UP BY THEIR PARENTS. IT'S REALLY THE CARPOOLING WITH PICKING UP I THINK IS THE PRIMARY PROBLEM. AND WHILE WE WOULD ENCOURAGE THE PARENTS OF THE STUDENTS TO RIDE THE BUS, OF COURSE WE CAN'T REQUIRE THEM TO DO THAT.
AND THEREIN LIES THE PROBLEM. THERE IS SIMPLY NOT ENOUGH ROOM AROUND IMMEDIATELY AROUND CARMEL HIGH SCHOOL. ABOUT 75 BUSES AND HUNDREDS OF CARS. WE MADE THE DECISION EARLY IN THE YEAR AND IT HAS GOTTEN WORSE AT THE MOMENT BECAUSE WERE ALSO DOING CONSTRUCTION PROJECTS.
SO IF YOU'RE FAMILIAR WITH THE SCHOOL THE EAST DRIVE IS CLOSED DOWN AND SO WITHOUT AND IT'S REALLY STARTED WITH COVID. WE HAD MORE PARENTS TRANSPORTING THEIR CHILDREN RATHER THAN RUNNING THE BUS. AND TO SOME EXTENT I'M SURE THAT'S CONTINUED AS WELL. IT'S SIMPLY A MATTER THAT WE THOUGHT IT WAS SAFE TO TRY TO HAVE 75 BUSES AND HUNDREDS OF CARS ON THE SAME AREA OF THE HIGH SCHOOL. SO WE MADE A DECISION TO MOVE THE PICKUP AND DROP OFF WITH THE CARPAL ON THE WEST SIDE OF THE STADIUM. IT'S ABOUT AND A HALF MILE WALK. EACH WAY.
ONLY APPEAL ONE WAY. SO, OF COURSE THE STUDENTS TO CHOOSE TO DRIVE YOU KNOW THEY WALK UP AND DOWN THE TRAIL AS WELL. I THINK THERE'S BEEN SOME MISINFORMATION. IT IS A CHALLENGE JUST THE LOGISTICS OF ALL THIS. WE HAVE CAMERAS AT THE STADIUM OF COURSE. TOBY COULD SHARE THAT WITH YOU. I BELIEVE THE ENTIRE STADIUM IS EMPTIED OUT. THE BELL RINGS AT 405. WE LEFT 10 MINUTES TO WALK DOWN AND THE PARKING IS BASICALLY EMPTY BY 4:30 OR 4:35. THAT WASN'T THE CASE THE FIRST DAY OR 2. I HAVE A SENIOR IN HIGH SCHOOL MYSELF. I KNOW FIRSTHAND THAT IT TOOK A WHILE TO GET HOME. THAT'S MUCH IMPROVED. STILL, THERE IS THE
[00:45:05]
WALK. I SHOULD POINT OUT THE STUDENTS, OUR SCHOOL BOARD POLICY FOR BUS TRANSPORTATION IS UP TO HALF A MILE TO A BUS STOP. HAVING SAID THAT WE HAVE PVERY FEW STUDENTS OUT WALK AND A HALF MILE TO THE BUS. THAT IS OUR POLICY. THAT'S THE SITUATION. WE ABSOLUTELY KNEW THAT WHEN WE MOVED TO THE STADIUM WE WERE GOING TO HAVE THIS ISSUE. I SHOULD ALSO SHARE THAT AS YOU KNOW WE HAVE NUMEROUS SCHOOL RESOURCE OFFICERS, CARMEL CITY POLICE IN OUR SCHOOLS. THEY WERE VERY INVOLVED IN THIS PROCESS AND THE DECISION. IT CAME DOWN TO EITHER THE BUSES WERE GOING TO GO TO THE STADIUM OR THE CARS WERE GOING TO GO TO THE STADIUM. WE FELT THE CAR WAS THE MORE APPROPRIATE AND WE WOULD ENCOURAGE PARENTS PUT THEIR STUDENTS ON THE BUS. IF THEY ELECT TO PICK THEM UP THAT'S THE DESIGNATED AREA.ANOTHER SECONDARY PROBLEM OR SECOND PROBLEM HAS TO DO WITH THE STUDENT DRIVERS WHO PARK IN THE NEIGHBORHOODS AND WAS ALWAYS BEEN SOME OF THAT. SOME NEIGHBORS PRINT OUT THEIR DRIVEWAY TO STUDENTS. IN THAT WORKS OKAY I GUESS. WHEN A PARK ON THE STREET THAT BECOMES A PROBLEM. IT'S REALLY, ONCE THEY LEAVE THE SCHOOL PROPERTY IT'S PRETTY LIMITED IS WHAT WE CAN DO ABOUT IT AND WHAT OUR SCHOOL BOARD CAN DO ABOUT IT. OTHER THAN ENCOURAGE THEM TO RIDE THE BUS. WITHOUT I WILL RESPOND TO ANY QUESTIONS YOU MIGHT HAVE.
>> SO I THINK ONE OF THE QUESTIONS THAT CAME UP WAS THE LENGTH OF TIME FOR THE CARPAL STUDENTS TO GET OUT OF THE CARPAL LINE. COUNSELOR GREEN PRIVACY 30 MINUTES. ARE YOU COMFORTABLE WITHOUT EXPLANATION THAT YOU THINK THE LAW IS EMPTY BY WHEN?
>> KNOW FOR SURE. IT'S ABOUT 4:37 OR SOMETHING. SOMETHING LIKE THAT QUICK SKILL HAVE TO
COME UP HERE BECAUSE WE HAVE HUBRIS ON TV. >> IN ORDER TO HEAR YOU GOT A
GET A MICROPHONE. >> WHILE HE'S COMING UP HERE I WILL SAY WAS MUCH LONGER WHEN WE FIRST STARTED. AS YOU NOTED INITIALLY WE HAD ALL THE TRAFFIC GOING WEST. THAT'S BEEN CHANGED SO THEY COULD ACTUALLY GET OUT BOTH DIRECTIONS.
>> THANK YOU. WE TALK ABOUT THE PARKING LOT. TOBY STILL ASSISTANT PRINCIPAL CARMEL HIGH SCHOOL. WHEN WE TALK ABOUT THE PARKING LOT EMPTYING OR BEING TRAINED AS WE CALL IT. I WANT TO MAKE SURE I'M ANSWERING THE RIGHT, WE REALLY HAVE 2 SITES. WE HAVE A PARENT PICKUP SIDE WHERE THE STUDENT LOT SIDE. CURRENTLY WE ARE EMPTYING THE STUDENT LOT SIDE ON AN AVERAGE OF ABOUT 31 MINUTES FROM THE TIME THE STUDENT BELL RINGS 405. THAT TAKES INTO ACCOUNT THE WALK DOWN. THE PARENT PICKUP SIDE IS A LITTLE BIT FASTER. WE ACTUALLY MAKE THAT A LITTLE BIT OF A PRIORITY IN TERMS OF DRAINING THE PARENT PICKUP SIDE QUICKER. THE
AVERAGE ABOUT 29 MINUTES RIGHT NOW ON EMPTYING THAT SITE. >> ANY OTHER QUESTIONS FOR
EITHER ROGER OR ANYONE? JEFF? >> SO THEN, TO MAKE SURE COUNSELOR HANNON YOU TALKED ABOUT THE DECISIONS THAT WERE MADE OR HOW WE GOT HERE AND WHAT FUTURE THINGS WE NEED TO WORK ON. DO YOU HAVE ANY QUESTIONS SPEAKING OF THAT BASED ON WHAT WERE DOING HERE
WITH US OR DENTS? >> YES. THANK YOU. THEY WERE JUST MORE COMMENTS AND I THINK COUNSELOR GREEN AGREE WITH ME. OR PUTTING A PATCH ON THIS AND IT SEEMS LIKE IT'S GETTING BETTER. WHEN I CERTAINLY WOULD LIKE AS A PERSON WITH A SAFETY BACKGROUND IS MORE ABOUT LONG-TERM STRATEGIC PLAN WORKING WITH CITIES, STREETS, POLICE, THE CAMPUS AS WELL.
THAT WILL GO FOR ALL THE CAMPS IS TO MAKE SURE WE HAVE NOT JUST THE MOST EFFICIENT EXPERIENCE BUT THE SAFEST EXPERIENCE FOR STUDENTS AS WELL. AGAIN, IF THAT WORKGROUP DOES NOT EXIST I WOULD STRONGLY RECOMMEND THAT WE PUT THAT TOGETHER LOCATE MORE STRATEGICALLY ON LONG-TERM AND TO SAFETY AND MOBILITY ISSUES AROUND CAMPUS OR CAMPUSES.
>> THANK YOU GENTLEMEN. SO WALK OF SHAME OR, NO, THE TRAIL OF TEARS. THANK YOU.
[LAUGHTER]. SORRY. PTSD I GUESS FROM COLLEGE. I WANT TO ENSURE OR MAKE SURE THAT THE KIDS WALKING NOW THAT IT'S TORQUING STOMACH DARKER EARLIER. THAT THEY ARE SAFE WALKING IN THE DARK. EARLY IN THE ORNING WAL. IT'S AN ISSUE D WHAT IS THE SCHOOL DISTRICT
[00:50:11]
DOING TO ENSURE THAT THEY ARE SAFE? >> WELL, FIRST ABOUT 10 YEARS AGO WE LIT THE TRAILS SO THERE ARE LIGHTS ALL UP AND DOWN THE TRAIL. FOR MORE THAN ANY CITY STREET THAT HOUSE. SECONDLY, WITH OUR BELL TIME THE HIGH SCHOOL DOESN'T START UNTIL 9 O'CLOCK OR 9.5. PREVIOUSLY THEY'D BE LIKE 7:30. SO THAT'S CHANGED IN TERMS OF THE MORNING. THERE ARE STUDENTS, SWIMMERS FOR EXAMPLE THAT COME EARLIER, MUCH EARLIER THAN THAT. I THINK STATE MUCH LATER THAN THAT. IN THE EVENING OF COURSE WHEN SCHOOL IS OUT, THE STUDENTS CAN PARK BY THE SCHOOL. THERE ARE AN ATHLETE OR WITH OVER EVENING THAT'S ON A PROBLEM. IT CAN BE IN THE MORNING, IT WOULD BE IN THE MORNING IT WOULD CERTAINLY BE DARK WHEN THEY GO TO PRACTICE AT 5:30 IN THE MORNING. AND GENERALLY THE SWIMMERS HAVE A ROUTINE FOR THEM. THE OTHER, IN SOME CASES THEY WILL HAVE A PARENT HAT WILL TAKE TURNS THEY WILL DRIVE THEM DOWN OR AT THE VERY LEAST THEY WILL HAVE AN OPPORTUNITY TO WALK DOWN TOGETHER. MOST OF THEM DON'T WALK. MOST OF THEM DRIVE LIKE MY DAUGHTER WE DROP HER OFF AT 5:30 IN THE MORNING. I THINK THAT'S PRETTY WELL ADDRESSED BETWEEN THE FACT THAT THE TRAIL
IS LEFT. >> COUNSELOR GREEN. >> THANK YOU MADAM PRESIDENT.
I APPRECIATE THE CHANGE ALLOWING THE CARS TO EXIT THE FOOTBALL STADIUM PARKING LOT EAST AND WEST AND IT WILL LET IT FLOW EASIER. I ALSO HEARD ONE OF THE STUDENTS SAY THAT THE PROCESS AND MAYBE IT HAS IT IS THROUGH STUDENTS. THE PROCESS IN GETTING PERMITS TO PARK AS CHANGED. AS THAT PROCESS CHANGED AT ALL OF THE NUMBER PERMITS BEING ISSUED IS
CHANGED? >> NO, WE OPERATE THE SAME PROCESS THAT ANY STUDENT THAT WISHES TO DRIVE TO SCHOOL AS LONG AS THEY MEET THE SET REQUIREMENTS NEEDED TO DRIVE TO
SCHOOL WHICH HAS NOT CHANGED IN THE LAST SEVERAL YEARS. >> HAS A NUMBER OF PERMITS ISSUED CHANGED OR HAVE BEEN STEADILY THE SAME OF THE LAST YEAR OR SO?
>> I CAN'T THE NUMBERS EXACTLY. I DO NOT BELIEVE THERE'S BEEN A LARGE CHANGE IN THE NUMBER.
>> THANKS. >> DEFINITELY NOT LIMITED. >> ANY OTHER QUESTIONS? COMMENTS? THANK YOU GENTLEMEN. I APPRECIATE YOU BEING HERE FOR COMMENTS. CHAIRMAN WORRELL
ANYTHING YOU'D LIKE TO ADD? >> NOW I WOULD LIST OFF, THE WAY THE ORDINANCE IS WRITTEN, IF COUNCIL WOULD NOTICE, THERE WAS A PREVIOUS ORDINANCE IN PLACE FROM 2001. THE HAVE THE 8:30 TO 9:30. THAT BECAME RELEVANT WHEN THEY CHANGED OF ALL TIMES. SO ALTHOUGH STREETS HAVE BEEN MARKED OUT AND ARE NO LONGER PART OF THIS ORDINANCE IF YOU SAW THAT. WHAT I WOULD LIKE TO DO IS TO SUGGEST AND THE PROCESS IS THAT IF A STREET BECOMES ELIGIBLE FOR THAT NO PARKING THAT WOULD BE SIGNED AND NEW SIGNS WILL BE ADDED. THE GHOST OF THE DEPARTMENT OR THE BOARD OF PUBLIC WORKS. SO, I'VE MADE A SUGGESTION IN THE EMAIL TO YOU THAT WE INCLUDE AUTOMATICALLY FROM THE GECKO FOR A MEETING NEXT WEEK SO THAT THE BOARD OF PUBLIC WORKS CAN APPROVE IT, COULD GET THOSE SIGNS GOING FOR THIRD AVENUE NORTHEAST FROM FIRST STREET TO THE DETERMINATION OF THE CUL-DE-SAC, BHISHMA, OTTOMAN DRIVE, SYLVAN LANE, SECOND AVENUE NORTHEAST AND GOING TO SAY RANGE LINE TO 4TH. LEXINGTON, FIRST STREET NORTHEAST, WARBLER WAY NORTH AND AVIAN WAY. THESE ARE ALL STREETS THAT HAVE BEEN REQUESTED OR THAT THERE WAS A COMPLAINT LAUNCHED ABOUT THE PROBLEM. NOW, OFFICER MYERS ALSO ASKED ME TO INCLUDE SOME ADDITIONAL STREETS ARE CLEAN JUNIOR HIGH. TC STEEL, LUMBER LOST FROM 126 2 ROUGHLY HUNDRED 2800 BLOCK OF LUMBER LOST. I SENECA PLACEMENT. CARRINGTON CIRCLE AND CARRY TEMPLATES. SO HE WOULD LIKE TO ADD THIS TO THE LIST. YOU HAVE THAT.
OTHER THAN THAT IF ANYONE HAS ANY SPECIFIC QUESTIONS OR YOU WANT ME TO READ ANY OTHER
[00:55:01]
REDLINE THERE'S A LOT OF CHANGES. THIS WILL GO TO, THE $25 TO BE THE FIRST TIME.MAYBE WE BETTER TALK ABOUT THAT IF THERE'S ANYONE LISTENING WHAT'S IS GOING TO COST ME.
>> ÃÃASSISTANT CORPORATION COUNCIL. SO THERE ARE AMENDMENTS ALSO WITHIN THIS ORDINANCE TO THE ORDINANCE VIOLATION BUREAU SYSTEM WHICH IS A SYSTEM THAT SET UP TO BYPASS COST FOR LOW LEVEL ORDINANCE VIOLATIONS SUCH AS PARKING VIOLATIONS. SO WHAT IT DOES IS IT AMENDS IT SO THE FIRST POINT IS $25. FS PAID BEFORE THE DATE SET FORTH THE TICKET THE ORDINANCE VIOLATION BUREAU THEN, THAT ULTIMATELY DOES AWAY WITH IT. IT IS A GO TO COURT. IF THEY DON'T PAY IT AT THAT POINT IT GETS REFERRED TO THE OFFICER CORPORATION COUNCIL. WE FILE THAT MATTER IN COURT ON BEHALF OF THE CITY. IT TURNS INTO AN ORDINANCE VIOLATION. IF THERE'S A SECOND VIOLATION AFTER THE FIRST AND THEY HAD ONE VIOLATION ONE PMONTH AND THEY PAY THE $25 THA THEY HAVE ANOTHER TICKET THAT'S ISSUED THE NEXT MONTH. EACH SUBSEQUENT VIOLATION IS $125. SO THAT'S THE SET UP. IF THAT'S PAID BEFORE THE DATE SET FORTH ON THE TICKET THEN IT DOESN'T GO TO COURT AND DOES NOT INCUR THE COURT COST AND
FEES ASSOCIATED WITH OUT. >> THANK YOU. OU. >> FORGIVE ME $100. I WAS CONFLICTED THERE. 25 FOR THE FIRST, HUNDRED DOLLARS FOR THE NEXT. THERE IS A CHANGE IF YOU PARK IN A DISABLED SPOT. THEN THAT IS THE SECOND VIOLATION I BELIEVE IS $125.
>> COUNSELOR GREEN. >> THIS IS FOR COUNSELOR WORRELL. HE BROUGHT THIS UP AT THE FINANCE COMMITTEE MEETING AND I DON'T KNOW ATHLETE MANY PEOPLE ARE WATCHING TONIGHT DIDN'T SEE THE FINANCE COMMITTEE MEETING. THIS IS IT JUST THE COUNCIL. YOU MEET WITH SROS ABOUT WITH THE CHIEF OF POLICE AND THE POLICE DEPARTMENT TO TALK ABOUT THIS PROCESS WERE GOING THROUGH RIGHT NOW. FOR SAFETY REASONS AND ALSO WILL BE A BURDEN ON THE POLICE. CARMEL POLICE, NOW THERE'S A NUMBER OF STREETS OF GOING TO HAVE TO PATROL TO MAKE SURE PEOPLE ARE COMPLYING WITH THE LAW. DID YOU ADDRESS THAT? P
>> RIGHT. ABSOLUTELY. THANK YOU FOR BRINGING THAT UP BECAUSE THAT'S AN IMPORTANT PART OF THIS. INVOLVED IN CREATING THIS ORDINANCE WERE POLICE, FIRE, ENGINEERING AND LEGAL AS WELL AS CONVERSATIONS WITH THE SCHOOLS. SPECIFICALLY ON THE POLICE WITH THE FINANCE COMMITTEE WE HAVE THE CHIEF AND LIEUTENANT MYERS BUT ALSO WE HAD THE SROS WHO ARE IN THE WORKGROUP MEETINGS THAT WE HAD TO HASH OUT WHAT ABOUT THIS AND WHAT ABOUT THAT. WHEN I WAS OUT GETTING THESE CALLS AND WITNESSING WHAT WAS GOING ON, THE CONCERN FOR THE FIRE DEPARTMENT WAS THAT THEY COULDN'T GET THE FIRE TRUCK DOWN WE DID HAVE A SITUATION WHERE THERE WAS A RUN FOR AN AMBULANCE AND IT WAS A CHALLENGE. BUT, DURING THOSE COUPLE OF DAYS WHERE IT WAS MOST CHAOTIC WE ACTUALLY HAD OFFICERS WHO WERE TRYING TO REMOVE CARS FROM PARKING TO CLOSE TO THE STOP SIGN THERE WERE CARS PARKED IN FRONT OF THE FIRE HYDRANTS. AND SO THEY VIEW THIS I BELIEVE, I THINK THEY WILL BACK ME UP ON THIS.
THEY VIEW THIS AS A HELP NOT HINDRANCE. PLUS THE CALLS. THOSE CAME FROM RESIDENTS:SAYING HEY, THERE'S A CAR PARKED THE WRONG DIRECTION. SO SOMEONE HAS TO RUN OUT THERE, THEY ACTUALLY WENT THE EXTRA STEP OF TRYING TO FIND THE STUDENT, CALL THE PARENTS INSTEAD OF TOWING IT OR WHATEVER. THIS WOULD BE A LOT EASIER IF THE CAR WASN'T EVEN THERE TO BEGIN WITH. IF I UNDERSTAND YOUR QUESTION THAT'S MY COUNSEL ANSWER.
>> COUNSELOR WORRELL K-CHRISTIAN ALL THE WORK YOU'VE DONE WHETHER IT'S THE SCHOOL OF
PUBLIC SAFETY SECTOR. SO THANK YOU. >> SIR, YOU WANT TO ADD THOSE
ROWS IF WE NEEDED AMENDMENT? >> SO FOR CLARIFICATION AND I MAY HAVE WHATEVER IT WANTS TO IT. TECHNICALLY THE ROADS WILL NO LONGER BE IN ORDINANCE. THIS WILL NOT COME BEFORE US AGAIN IF HE WANTED TO ADD A ROAD. EVERYTHING WE'VE GIVEN THE PROCESS NOW FOR IT TO GO TO ENGINEERING WHO WILL THEN PETITION BOARD OF PUBLIC WORKS. THE ONLY QUESTION I FORGOT TO ASK WAS ARE WE TAKING ALL OF THE SIGNAGE FROM 2001 DOWN? BECAUSE THE SIGNAGE ALL GOES
[01:00:08]
OVER WEST OF RIDGELINE. >> THAT WILL HAVE TO BE REMEDIED.
>> OKAY. THAT WILL COME DOWN. I'M JUST TELLING YOU. CAN WE GET THAT DOWN?
>> YES. >> THAT'S ALL I NEED. >> NEW SIGNS ARE GOING UP THEN
FOR THOSE WITH THE BP W TAKES ACTION. >> IF THE BP W IMPROVES IT.
>> I WILL ADD TO THAT A RESOLUTION IS ALREADY IN THE WORKS FOR THAT TO BE ON THE
NEXT AGENDA. >> ANYTHING ELSE? THE CHART WITH LEVEL MOTION.
>> IF I MAY I WOULD LIKE TO MAKE A MOTION TO APPROVE ORDINANCE D ^ JEFF, JEFF, IF I
MAY. >> SORRY TO INTERRUPT. SEVERAL AMENDMENTS THAT WERE MADE OF THE FINANCE COMMITTEE. IF YOU WANT TO READ THOSE IN OR TAKE THOSE.
>> PLEASE.>> AM HAPPY TO GO THROUGH THOSE MY BYLINE IF YOU LIKE. SEVERAL OF HEM REALLY JUST ST CHANGED, THE ON STREET PARKING ON MAIN STREET EAST OF RIDGELINE. THOSE OF THE CHANGE FROM 3 PARKING TO 2 HOUR PARKING. SO IF YOU CAN SEE THAT'S WITH THE CHANGES ONLINE 90 THROUGH 106. HAD TO BE TAKEN OUT OF THE ORIGINAL 3-HOUR PARKING SECTION AND THAT WAS MOVED DOWN TO FIND 251. IF YOU LOOK ONLINE TO 51 WHICH IS ON PAGE, PAGE 6, THAT IS A 2 HOUR PARKING FOR MAIN STREET. THEN THERE WERE 2 PARKING LOTS THAT WERE ALSO CHANGED. THE FIRST ONE IS THE LOT BEHIND JUNIPER ON MAINEDOT WHICH IS JUST OFF OF MAIN STREET AND THAT WAS CHANGE FROM 2 HOUR TO ONE HOUR PARKING. AND I WAS LOOKING AT THE VERSION YOU HAVE. I APOLOGIZE THERE WAS A MISTAKE ON THE TIME ONLINE TO 25. INSTEAD OF 2 PM THAT SHOULD BE NOON, 12 PM WHICH IS WHAT IT ORIGINALLY WAS. AND THEN THE ONLY OTHER CHANGES ALSO FORCE THE LIONS CLUB. THIS IS ON THE LOBBY ON THE LIONS CLUB. THIS IS ON 228.
AND THAT IS ONE HOUR PARKING, 6 AM TO 5 PM. AND THEY WOULD ALSO BE ABLE TO GET A MERCHANT
STICKER FOR THAT LOT OR ANYBODY THAT WORKED NEARBY. >> MADAM PRESIDENT?
>> SIR. >> OBERLANDER I HAD AN EMPLOYEE, HIGH SCHOOL STUDENT ASKED ME TO GET THEM MERCHANT STICKER SO THEY COULD PARK THERE WHEN THEY WENT TO SCHOOL.
I OBVIOUSLY SAID NO. HOW DO WE STOP. WE CAN SOMEHOW WE DECLARE IF THERE USE OF THE
MERCHANT STICKER HAVE TO ACTUALLY BE WORKING. >> THAT'S IN THE COLD ALREADY COUNSELOR RIDER. IT DOES SAY IT'S VALID FOR 30 MINUTES AND BEFORE AND AFTER THEIR SHIFT.
THEY COULDN'T JUST USE IT DURING THE DAY WHILE THEY'RE IN SCHOOL.
>> THANK YOU VERY MUCH. >> MADAM PRESIDENT? >> THE SROS WERE ALL OVER THAT ONE. MAYBE I NEED TO JUST REINFORCE, IF THIS PASSES WE WOULD RELY ON THE SCHOOLS TO GET THE WORD OUT VERY STRONGLY BECAUSE WE ARE, JUST, REINFORCE IT. WERE NOT ONLY TALKING ABOUT PARKING BUT TALKING ABOUT PICKUP. I'VE HEARD FROM SEVERAL PARENTS WERE NOT GOING TO BE HAPPY BUT, I WANT TO MAKE SURE THEY DON'T GET AN OFFICER AND PROBABLY WE WILL HAVE A WARNING OR GRACE. OR WHATEVER. SO WE WILL RELY ON YOU TO GET THE WORD OUT.
>SO HAVING SAID THAT I THINK OF BEEN GIVEN PERMISSION TO MAKE A MOTION TO APPROVE THE
AMENDMENT. AS READ. >> SECOND. >> ANY DISCUSSION? OKAY PLEASE SIGNIFY YOUR VOTE TO AMEND AS PRESENTED. OKAY AMENDMENTS ARE PASSED.
>> MADAM PRESIDENT? >> SIR? >> I WENT ASK MY COUNSELORS TO
APPROVE ORDINANCE D Ã2606 Ã 21. AS AMENDED. >> SECOND.
>> ANY DISCUSSION? SEEING NONE, PLEASE VOTE. THANK YOU, THAT'S APPROVED. AGAIN COUNSEL WORRELL THANK YOU FOR ALL THE WORK YOU'VE DONE FOR THIS. THEY COULD FOR THE SCHOOLS THAT HAVE COME TONIGHT TO ANSWER ANY QUESTIONS THE COMMITTEE OR COUNCIL HAD. JOHN AND BENJAMIN
[13. PUBLIC HEARINGS]
THANK YOU FOR YOUR WORK ON THIS AS WELL. OKAY, MOVING ON TO ITEM 13. PUBLIC HEARINGS.[01:05:12]
ITEM 13 A IS FIRST READING OF ORDINANCE Z Ã670 Ã21. IN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL INDIANA, AMENDING THE WEST CLAY VILLAGE PLANT IN IT TO VELMA DISTRICTORDINANCE. THE SPONSORS COUNSELOR RIDER. >> MAY HAVE A MOTION TO
INTRODUCE. >> MOVED TO INTRODUCE. >> THANK YOU. COUNSELOR RIDER.
>> ORDINANCE ADMIN'S THE WEST CLAY VILLAGE PLANT UNIT DISTRICT IS AMENDED TO APPLY A 500 FOOT SETBACK FROM RESIDENTIAL USED PROPERTY FOR GAS STATION PUMPS, PUMP ISLANDS, VENT PIPES, SET FORTH IN ORDINANCE E, 669 Ã212 THE WEST CLAY PUD DISTRICT. MR.
OBERLANDER. >> THANK YOU COUNSELOR WRITER. I STATED THIS IS A PRETTY SIMPLE COMMITMENT TO THE WEST CLAY PUD. IT ADDS THE 500 FOOT SETBACK REQUIREMENT FOR GAS STATION PUMPS, PUMP ISLANDS AND PUMP FENCE FOR RESIDENTIAL USE PROPERTY FOR INSTANT æ
>> MADAM PRESIDENT? >> OR? >> DISCUSSIONS WITH A WIDE VARIETY OF PEOPLE SOME BEING THE BOARD IN THE WILL VILLAGE OF WEST CLAY. SOME OF THE HEARTBURN THEY GET FROM THE SITUATION IS THE PROTECTION OF THEIR PUD. AND WHAT I STATED HERE WAS AT ONE POINT IN TIME THIS RED TO TAKE OUT A USE WHICH TOOK OF THE USE OF GAS STATIONS. I WOULD'VE SUPPORTED. I THINK THAT IS GETTING INTO MURKY WATERS.
BUT, TO TAKE SOMETHING THAT WE FOUND OUT OVER 20 YEARS IS YOU KNOW, THE SCIENCE OF IT IS ACCEPTED BROAD. IT MADE SENSE TO ADD, THAT WAS MY PURPOSE BEHIND THIS. IT MADE SENSE TO ADD THAT IN. IT'S NOT CHANGING THE USE. IT'S GOING WITH UPDATED CURRENT INFORMATION
THAT ISN'T 20 YEARS OLD. THANK YOU. >> ANY OTHER QUESTIONS OR
COMMENTS FOR JOHN. COUNSELOR GREEN. >> JOHN, HOW LONG HAVE YOU BEEN
WITH THE CITY OF CARMEL TO. >> WILL BE 8 YEARS IN JULY. >> OKAY THE QUESTION CAN ASK AS
WELL BEFORE THAT. IT MAY BEAT SOMEONE UP HERE. >> HAS THE PUD EVER BEEN
AMENDED AFTER THE FACT AND MADE RETRO? DO YOU KNOW? >> THIS WOULD IT BE RETROACTIVE. BUT THE PUD HAS BEEN APPLIED. THE WEST CLAY PUGET WAS AMENDED IN 2005 AND AMENDED IN 2016. I CAN REMEMBER WE DID AN AMENDMENT OF THE LEGACY PUD FAIRLY RECENTLY
AS WELL. >> CANNOT COMMENT ON THAT? >> COUNSELOR RIDER.
>> THE REASON WE CAN MAKE THIS CHANGE BECAUSE ORIGINALLY THE WEST CLAY PUD WOULD TAKE UNANIMOUS CONSENT AVAILABLE LANDOWNERS TO TAKE A CHANGE. IT WAS BROUGHT TO THE COUNCIL, NOT QUITE AT ALL. IT WAS BROUGHT TO THE COUNCIL IN 2005. THAT WAS A CHANGE TO MAKE IT EASIER TO CHANGE. SO IT KIND OF WAS MY CAREFUL WHAT YOU ASK FOR. SO THAT IS THE ONLY REASON THIS CAN BE DONE. IF IT WASN'T FOR THAT WE WOULD BE ABLE TO DO THIS. IT IS
CORRECT? >> NOT MATTER THAT IS CORRECT. LANG WHICH OF THE YOU DEAL REQUIRES THE CONSENT OF ALL PROPERTY OWNERS WITHIN THE DISTRICT TO ASK FOR THE
INITIATION OF THE AMENDMENT. >> OKAY, THANK YOU. >> COUNSELOR NELSON?
>> THIS IS PROBABLY THE MOST CRITICAL MOST IMPORTANT ISSUE THAT I'VE BEEN ABLE TO DEAL WITH IN THE 2 YEARS I'VE BEEN ON COUNCIL. THIS IS IMPORTANT CLEARLY TO A LOT OF YOU AS WELL AND TO A LOT OF PEOPLE WHO'VE REACHED OUT TO ME. THIS IS ABOUT THE HEALTH OF OUR COMMUNITY. THIS IS ABOUT CLEAN WATER. THIS IS ABOUT CLEAN AIR. THIS IS ABOUT THE SAFETY OF OUR CHILDREN. THIS IS ABOUT THE SAFETY OF THE INDIVIDUALS WHO LIVED FOR STRAFFORD. THIS IS ABOUT THE SAFETY OF ALL THOSE PEOPLE WHO LIVED UP AND DOWN TOWN ROAD. THIS IS ABOUT OUR NEIGHBORS. THIS IS SOMETHING THAT ISN'T WANTED. I THINK WE SHOULD VOTE FOR THIS AMENDMENT. WE SHOULD VOTE FOR THE PUBLIC. THE PUBLIC WAS HERE. SO THANK YOU FOR COMING
TONIGHT. >> ANY OTHER COMMENTS? QUESTIONS? COUNSELOR HANNON.
P>> THANK YOU MADAM PRESIDENT. SO THE PRACTICAL EFFECT OF THIS MR. OBERLANDER, IF WE PASS THIS, AGAIN IS THIS GOING TO GO TO COMMITTEE? SO AFTER GOING TO COMMITTEE, IT AFFECTS ANY
[01:10:04]
NEW DEVELOPMENT THAT HAS NOT YET STARTED OR HAVE BEEN FILED FOR BUT WOULD NOT HAVE ANY IMPACT ON ANYTHING ALREADY FILED OR IN PROCESS. IS THAT CORRECT? X YES. THAT'S CORRECT COUNSELOR HANNON. IF THERE'S A DEVELOPER THAT HAS FILED A COMPLETE APPLICATION.THERE'S A STATUTORY SECTION UNDER 30 674. THAT GOVERNS THAT ALONG WITH SOME CASE LAW.
SO THIS ORDINANCE WOULD BE PERSPECTIVE. ANY DEVELOPMENT, ANY APPLICATION FILED AFTER THIS IS ADOPTED, THESE SETBACK REQUIREMENTS WOULD APPLY TO THAT.
>> THANK YOU. >> ANY OTHER QUESTIONS OR COMMENTS BEFORE THE PUBLIC HEARING? OKAY. I'M GOOD OVER THE PUBLIC HEARING AT 7:13. THE 2 INDIVIDUALS THAT WANTED TO SPEAK AND MAKE YOUR WAY TO THE PODIUM. ANYONE ELSE WOULD LIKE TO SPEAK FOR OR AGAINST THIS ITEMM. FOR THOSE NOT FAMILIAR WITH OUR TIMING PROCEDURES. THERE'S A BOX UP THERE WITH RED, YELLOW AND GREEN BUTTONS ON IT. WHEN YOU START TALKING THE GREENN LIGHT FOR THE GREEN BUTTON WILL LIGHT UP. IN ABOUT 30 SECONDS OF YOUR TIME LEFT THE YELLOW ONE WILL COME ON AND THEN WHEN YOUR TIMES UP THE RED ONE WILL COME ON. IF YOU'RE STILL TALKING ABOUT POINT WE ASK YOU VERY QUICKLY GET TO AN ENDING POINT. AND SECEDE YOUR TIME. SO, WITHOUT MERCY WE

ASKED FOR EXTRA 45 SECONDS. >> I WOULD KEEP IT TO CLOSE TO 3 MINUTES AS YOU CAN BECAUSE IT WOULD VIOLATE OUR ROLES CREDIBLY WE VIOLATE THEM ALL THE TIME.
>> I AGREE. >> THANK YOU. >> THE CHAIRMAN GETS ONE OF THOSE. THANK YOU COUNCILMEMBERS. MY NAME IS JACKIE PHILLIPS. I'M WITH THE CARMEL HEALTHY FOR ALLIANCE OF RESIN VILLAGE OF WEST CLAY. I WILL TRY NOT TO PARTY WITH STUDIES AND STATISTICS THAT HAVE BEEN PREVIOUSLY SHARED. I BELIEVE PLACING GAS STATION ISN'T WHERE PEOPLE LIVING CHILDREN PLAY AS A RESPONSIBLE AND DANGEROUS. IF YOU ARGUMENTS WERE BROUGHT I'VE BEEN WORK I LIKE TO ADDRESS. FIRST ARE OPERATING UNDER THE FAULTY PREMISE ONE MUST CHOOSE BETWEEN DISTANCE AND TECHNOLOGY. AS IF THEY CANNOT COEXIST. ONE MUST NOT CHOOSE BETWEEN THE 2 BUT UTILIZABLE. NOT TALKING ABOUT MATERIAL DEBATE WHERE ONE MUST CHOOSE BETWEEN A HYPOTHETICAL BEST. THESE ARE REAL-LIFE PEOPLE.
OUR NEIGHBORS. THESE DECISIONS IMPACT WHAT'S IMPORTANT WHICH IS HER HEALTH. WHY CHOOSE HALF MEASURES? WE CERTAINLY DO NOT JUST COMPANY FOR VAPOR RECOVERY SYSTEMS. WE ADVOCATE FOR THEM.
UNFORTUNATELY VAPOR RECOVERY SYSTEMS ARE NOT ENOUGH. MR. GORDON AND ARCHITECT RIGHTLY DESCRIBES HOW FEVER SYSTEMS WORK. THE EFFECT OF THE SCRIPT 95 TO 99 PERCENT OF PAPERS.
THIS MAY BE TRUE THE SYSTEMS OPERATE UNDER CONTROLLED CONDITIONS IN A LAB. HOWEVER, UPON SCIENTIFIC EXAMINATION OF THE SYSTEMS AND REAL-WORLD VARMINTS THIS IS PROVEN NOT TO BE THE CASE. MR. GORDON REFERENCE AN ONBOARD RECOVERY SYSTEM ASSERTED THAT KAMC PRIVATE VEHICLES ARE NOW SO EFFICIENT VIRTUALLY NO HARMFUL PAPERS THAT OCCUR IN YOUR ACTUAL VEHICLE SNORT IN THE AIR ABOVE THE CANOPY OR NEAR THE BUILDING. A RECENT STUDY PUBLISHED IN 2020 WHICH YOU SHOULD NOT HAVE AN INFRARED CAMERA CALIBRATED TO DETECT GUZZLING PAPERS WAS USED TO ANALYZE THE EFFICACY OF THESE ONBOARD RECOVERY SYSTEMS. 87 PERCENT OF VEHICLES AND WE SHOWED RELEASE OF VAPORS THAT WERE SUPPOSEDLY BEING CAPTURED.
THIS IS DOCUMENTATION OF THAT. IN ADDITION THE FIGURES GIVEN TO NOT ACCOUNT FOR USER AIR, EQUIPMENT OF FUNCTION OR INNOCENTLY POPPING OF THE TANK WHICH DAMAGED THE SYSTEM.
BROWSING THE PILES OF KITTY LITTER OF THE GAS STATION FROM ACCIDENTAL SPELL OR WE OURSELVES DROP A FEW AMOUNTS TO THE FUEL PUMP IN THE CAR. THESE SMALL SEEMINGLY INSIGNIFICANT TRIPS CREATE ESPECIALLY HIGH VAPOR EMISSIONS SPILLING JUST ONE OUNCE OF GASOLINE PRODUCES THE SAME VOLATILE CONNECT COMPOUND ADMISSIONS WAS A CAR DRIVING 56 MILES. FURTHER EVIDENCE OF THIS IS A 2018 STUDY THAT SHOWED US TO VENT PIPE EMISSIONS BE 10 TIMES HIGHER AS PREVIOUSLY ESTIMATED. STATED NO HARMFUL VAPORS AT A GAS STATION ASININE. WE APPLAUD THE USE AND PROLIFERATION OF VAPOR RECOVERY SYSTEMS FORTUNATELY THE NOT AS EFFECTIVE AS ADVERTISED. THE ONLY WAY TO TRULY PROTECT THE HEALTH AND RESIDENTS INTO PLACE FILLING STATIONS WHETHER NOT DIRECTLY WERE PEOPLE OF.
[INAUDIBLE] WE HAVE THE STUDIES THAT SHOW BUSY LEVELS OF GAS STATIONS EVEN WHEN THERE VAPOR

RECOVERY SYSTEMS IN PLACE EXCEED PEOPLE SHOULD BE EXPOSED TO. AS I MENTIONED BEFORE, IF YOU HAVE ANY QUESTIONS OR WANT ANY MORE SCIENTIFIC DATA I'D BE HAPPY TO ARRANGE A MEETING BETWEEN DOCTOR MARCUS HALBERT AT COLUMBIA. LASTLY, AS I MENTIONED BEFORE THE PUD ALLOWS USE OF A GAS STATION 20+ YEARS AGO MAYBE WE HAVE THAT NEED AS COUNCILMEMBER RYDER SAID. WE DIDN'T HAVE THE STUDIES AND STATISTICS WE HAVE NOW. MOVE TOWARDS ELECTRIC WE NO LONGER HAVE THAT NEED. I WISH I WASN'T FIGHTING THIS TODAY. HOWEVER THERE'S BEEN LITTLE MENTION AT VILLAGE WESTLAKE MEETINGS. MUSCLE PUBLIC WHEN PTHIS LAND WAS RESULTED 2015 THEY TOLD THE RESIDENTS THINK PEDIATRIC OFFICE. I GUESS YOU COULD SAY RESIDENTS FELT CITED.PUN INTENDED. THOUSAND RESIDENTS VOTED AGAINSTUS ON ASKING FR YOU TO PLEASE
SUPPORT THIS AMENDMENT. THANK YOU. >> THANK YOU JACKIE. NEXT.
REX. >> GOOD EVENING COUNSELORS. MY NAME IS HEATHER MISHRA AND I WANT TO START BY THANKING YOU SO MUCH FOR PASSING THE AMENDMENTS BACK IN SEPTEMBER.
THE 500 FEET IN THAT MOMENT WILL GO A LONG WAY TO PROTECT MANY CARMEL RESIDENTS AND SERVE AS AN EXCELLENT EXAMPLE FOR OTHER CITIES AROUND THE COUNTRY. AS YOU ARE AWARE THE RESIDENTS OF WEST CARMEL ARE AGAIN FACING THE PROPOSAL OF ANOTHER GAS STATION WITHIN THE VILLAGE OF WEST KATE PUD AND TO DATE THE APPLICATION OF THE AMENDMENT TO THE UTO REQUIRING A 500 FOOT SETBACK HAS NOT BEEN APPLIED TO RRPD. DUE TO A PERCEIVED LOOPHOLE THE VILLAGE OF WEST CLAY PUD IS REPORTEDLY EXEMPT FROM THE NEW 500 FOOT SETBACK AMENDMENT. TO REMIND EVERYONE AT THE PROPOSED SITE IS IMMEDIATELY ADJACENT TO THE STRATFORD SENIOR CARE COMPLEX WITH MULTIPLE INDEPENDENT LIVING COTTAGES ONLY 10 FEET FROM THE LOT LINE OF THE PROPOSED GAS STATION SITE. IT IS ALSO WITHIN 500 FEET OF NUMEROUS PRIVATE RESIDENCES INCLUDING MINE. ALL OF THE INDEPENDENT LIVING COTTAGES OF THE STRATFORD AND OTHER PARTS OF THE STRATFORD COMPLEX. AS A CITY, 500 FOOT SETBACK HAS BEEN DEEMED TO BE THE SAFEST BASED ON BEST IN SCIENCE TO DATE. AS IT APPEARS THE 500 FOOT ORDINANCE WILL NOT BE APPLIED TO THE VILLAGE OF WEST CLAY PUD. HERE THIS EVENING TO ASK YOU CITY COUNSELORS TO SAFEGUARD AS MANY PEOPLE AS POSSIBLE AND PARTICULARLY THE MULTIPLE RESIDENTS OF THE STRATFORD FROM THE DANGEROUS HEALTH EFFECTS POSED BIKES FRIENDS EXPOSURE TO BENZENE OTHER COMPOUNDS GASOLINE AND PETROLEUM PRODUCTS BY CLOSING THE LOOPHOLE IN THE VILLAGE OF WEST CLAY PUD. EFFECTIVELY PREVENTING GASOLINE PETROLEUM SALES IN THE PUD ONCE AND FOR ALL. THANK YOU AGAIN FOR YOUR GRACIOUS CARE AND CONSIDERATION.
>> THANK YOU VERY MUCH. >> HELLO ALL. MY NAME IS SASHA DOSH. I'M A SENIOR AT CARMEL HIGH SCHOOL RESIDENT OF THE VILLAGE OF WEST CLAY. WAS BORN CARMEL IN 2004. SOON AFTER MY FAMILY DECIDED TO MOVE TO INDIANAPOLIS AND THEN DECIDED TO COME BACK TO CARMEL IN 2014.
WE MOVED BACK AS WE REALIZE THAT IT WAS A CITY THAT WAS FORWARD THINKING AND SET A PERFECT EXAMPLE FOR OTHER CITIES TO FOLLOW. OPPORTUNITIES IN THE CITY ARE LIKE THAT OF NOR WHERE ELSE. MERE GYM BRAINARD HAVE MEET USER FORWARD THINKING TO MAKE IT WHAT IT IS TODAY. WHY IS THE GAS STATION NECESSARY WHEN NOT NEEDED? OUR FAMILY HAS RECENTLY CHANGED TO ELECTRIC LAWN CARE EQUIPMENT AND WILL NEVER MISS THE SMELLS, THE SOUNDS AND MAINTENANCE OF GAS POWER COUNTERPARTS. OUR FAMILY IS WITTY FOR ALL NEW TVS TO HIT THE MARKET SO WE CAN SWITCH OUR CURRENT VEHICLES TO ELECTRIC ONES. I'M VERY CERTAIN THAT CARMEL RESIDENTS WILL ALSO BE DOING THE SAME. NO RECENT ERIC TIMES ARTICLE CARMEL BOASTS ABOUT BEING A CLIMATE FORWARD CITY? THE HUNDRED 40 ROUNDABOUTS, REDUCING CARBON EMISSIONS BY SAVING 2.8 MILLION GALLONS OF FUEL ANNUALLY. WE ALL KNOW GAS STATIONS POLLUTE.
IT ONLY TAKES 10 GALLONS OF FUEL TO CONTAMINATE 12 MILLION GALLONS OF GROUNDWATER. OF ALL PLACES TO PUT A GAS STATION WHY IN THE NEIGHBORHOOD NEAR SENIOR LIVING HOME? IF CARMEL CARES ABOUT BEING AN EXAMPLE FOR PROGRESSIVE, SAFE GREEN CITY WHEN NOT INSTALL IN EV CHARGING STATION? WHY MOVE BACKWARD WHEN CARMEL MISS WARD? THANK YOU. [APPLAUSE]
>> THANK YOU. PLEASE HOLD YOUR APPLAUSE. IT'S ONE OF THE THINGS WE DON'T ALLOW HERE.
IT'S MORE OF A BUSINESS MEETING THAN A RALLY. EVEN THOUGH HIS COMMENTS WERE WELL-PLACED.
THANK YOU. >> GOOD EVENING MY NAME IS SEBASTIAN ÃI'M A RESIDENT OF WEST CLAY. I'M A PEDIATRIC SPECIALIST AND FATHER OF 3 YOUNG CHILDREN. HERE TO TESTIFY THAT GAS STATION IS NOT A PEDIATRIC OFFICE OBVIOUSLY. WITH THAT BEING SAID I HAVE TO
[01:20:03]
MAKE A CONFESSION WHEN I FIRST TURNABOUT GAS STATION POSSIBLY BEING BUILT. I DID NOT KNOW ALL OF THE NEGATIVE IMPLICATIONS. I THINK THAT'S THE CASE WITH MANY OTHER RESIDENTS. I FELT AS EVERYONE IS LEARNING ABOUT IT AND THE MAJORITY IS AGAINST GAS STATION IN GENERAL BEING DEVELOPED IN THE VILLAGE OF WEST CLAY. OUR NEIGHBORHOOD IS WALKABLE NEIGHBORHOOD. DESIGNED FOR CHILDREN TO PLAY IN DIFFERENT PLACES AND HAS LENTY OF PLAYGROUNDS AND ENCOURAGES OUTDOOR ACTIVITY. A GAS STATION IS INCOMPATIBLE WITH CHILDREN PLAYING AROUND. THERE IS A DOCUMENT THAT IS 440 PAGE DOCUMENT BY THE EPA AND DEPARTMENT OF HEALTH AND HUMAN SERVICES. THAT OUTLINES THE TOXICOLOGICAL PROFILE OF BENZENE AND OTHER HEALTH DANGERS THAT IMPOSES AND MAKES RECOMMENDATIONS AS TO HOW TO AVOID EXPOSURE. AND WHAT THE DANGER MAY BE TO CHILDREN. IT TALKS ABOUT PROBLEMS LIKE INFECTIONS, CANCERS, SPECIFICALLY LEUKEMIA. ADVISES AGAINST CHILDREN PLAYING AROUND A GAS STATION OR LIVING NEXT TO A GAS STATION. I KNOW THERE'S BEEN DISCUSSION ABOUT ALL THE MEDICATION MEASURES LIVING IN THE 21ST CENTURY AND HOW TECHNOLOGY CAN SAVE US FROM ALL EVILS. THIS IS NOT HUNDRED PERCENT. IT'S GREAT TO HAVE TECHNOLOGY THAT DIMINISHES ADMISSIONS BUT IT'S NOT HUNDRED PERCENT REDUCTION. I THINK THE 500 FOOT SETBACK IS A MINIMUM THAT OUR VILLAGE SHOULD ABIDE BY. NOT IDEAL MY OPINION WOULD PROBABLY NEED SOMETHING MORE THOROUGHLY ABOUT THE GAS STATION. IT IS A MINIMUM. THERE ARE MORE IMPLICATIONS AS A PEDIATRICIAN I HAVE 2 OF THESE BRUSH ON THOSE OTHER CONCERNS. I WAS NAC/VE ABOUT THOSE ISSUES AS WELL. I DON'T FREQUENT CONVENIENCE STORE THAT IS ASSOCIATED WITH A GAS STATION. I TYPICALLY PAY AT THE PUMP. HOWEVER THERE ARE DANGEROUS DRUGS THAT ARE SOLD AT GAS STATIONS THROUGHOUT THE COUNTRY. THERE IS A DRUG CALLED TIFTON WHICH HAS BEEN NAMED, NICKNAMED GAS STATION HEROIN. THAT IS SOLD AS A SUPPLEMENT, UNCONTROLLED, UNREGULATED, CAN BE SOLD TO CHILDREN AND IT HAS BEEN SOLD THROUGHOUT THE COUNTRY. TILTED IN THE VILLAGE OF WESTLAKE AND HAVE ACCESS TO THAT OR OTHER SUBSTANCES SOLD SUPPLEMENTS.THANK YOU FOR CONSIDERING THIS COMMITMENT AND I HOPE THIS WILL BE MINIMUM STANDARD WE WILL
HAVE. THANK YOU. >> THANK YOU VERY MUCH FOR COMING TONIGHT. HI.
>> GOOD EVENING MY NAME IS ALLISON BROWN AND I HAVE LIVED IN MY HOUSE ON THE HUNDRED SIXTH STREET SINCE IT WAS BUILT IN 1965. OBVIOUSLY I DO NOT LIVED IN THE VILLAGE OF WEST CLAY BUT I AM MOST CONCERNED ABOUT AIR QUALITY AND MY NEIGHBORS TO THE NORTH ARE DESERVING OF EVERY CONSIDERATION. I CAME TO SUPPORT THIS ORDINANCE AND HAVE A COURSE MOST DISAPPOINTED TO HEAR THAT BECAUSE OF A BUREAUCRATIC RIDDLE THAT WE'VE HEARD ABOUT THAT THIS WILL NOT ACTUALLY PROTECT THE PEOPLE THAT COUNSELOR NIELSEN VENTURED. PEOPLE OF THE STRATFORD AND THE CHILDREN'S DAY CARE CENTER AND THE NEIGHBORS BECAUSE THOSE, THE GAS STATION THAT HAS BEEN APPROVED HAS BEEN APPROVED WITH THE STANDARD OF KNOWLEDGE FROM 20 YEARS AGO RATHER THAN WHAT WE NOW KNOW. SO THEREFORE IF IT GOES FORWARD WITHOUT ELIMINATING ANY GAS STATIONS IN THE VILLAGE OF WEST CLAY THE
JOB HAS NOT REALLY BEEN DONE. THANK YOU SO MUCH. >> SIR?
>> AND A PRESIDENT. MEMBERS. MY NAME IS BRUCE FLEMING. MY WIFE AND I HAVE LIVED IN THE VILLAGE AT WEST CLAY FOR 6 YEARS NOW. I'M POSSIBLY A PRETTY JUNIOR NEIGHBOR HERE. I DO APPRECIATE THE CONVERSATION AND BY CHANCE TO WITNESS THIS MEETING. I'VE BEEN CONTROL YOUR REFINER MY PROFESSIONAL CAREER WHICH IS OVER 40 YEARS NOW. A MANUFACTURER OF THIS STUFF THAT WERE TALKING ABOUT. I THINK A LOT OF FOLKS HAVE TRIED VERY HARD TO PUT IN A GOOD EFFORT TO BECOME INFORMED TO GET UP TO SPEED. I THINK THIS COUNCIL HAS AS WELL. I VALUE THAT AND APPRECIATE THAT. I JUST WANT TO MAKE SURE THAT A COUPLE OF THINGS ARE CLEAR. AS FACTS. A LOT OF PEOPLE DON'T UNDERSTAND THIS ABOUT OUR INDUSTRY. FIRST RING AND MAYBE
[01:25:01]
THE SMALLER POINT, I DID SEE A LETTER THAT HAD BEEN SUBMITTED TO COUNCIL THAT CONTINUALLY REFER TO THIS AS THE BP SERVICE STATION. BP ISN'T GOING TO ON THIS. THEY'RE NOT GOING TO SUPERVISE ITS DESIGN. ITS CONSTRUCTION, ITS MAINTENANCE OR PERFORMANCE. THEY WILL HAVE NO LIABILITY. IF ANYBODY HERE THANKS A CORPORATION IS STANDING BEHIND ANY OF THIS, THINK TWICE. THAT'S NOT THE CASE. SECOND THING IS THE CONVERSATION ON BENZENE WHICH IS PRETTY INTERESTING. MY PINDUSTRY IS HEAVILY REGULATED REGARDLESS OF WHAT YOU THINK ABOUT THE EPA. THEY WILL EVENTUALLY OPERATE ON FACTS AND SCIENCE. EVENTUALLY USUALLY MEANS 10 YEARS OR SO. THEY TOOK LEAD ON COUNSELING. IT TOOK THEM 10 YEARS TO DO IT BUT IT'S OUT. THEY TOOK MTBE OUT OF GASOLINE. I DANGEROUS CHEMICAL, IT WASN'T APPRECIATED BUT IT MIGRATES GROUNDWATER. THEY CAN'T TAKE BENZENE OUT. IT'S NOT POSSIBLE TO GET IT OUT. IT'S STILL IN THERE. IT WOULD BE OUT. THEY'VE GOT IT LEGISLATED DOWN TO THE MINIMUM LEVEL THAT IS OPERATIONALLY POSSIBLE. THAT'S A GASOLINE. THAT LEAVES YOU WITH IS WHAT'S IN THE AIR. THERE'S 3 GOOD WAYS TO DIE OF LEUKEMIA. SMOKE, GET A BUNCH OF BENZENE THAT WAY. BE OVEREXPOSED BY THE AIR AT AN INDUSTRIAL SITE. AND LIVED REALLY CLOSE TO A GAS STATION. SO, IT'S TIME AND EXPOSURE. LET'S TALK ABOUT TIME BRIEFLY. THE SECONDHAND SMOKE PROBLEM HAS BEEN DEALT WITH. TOOK A LONG TIME. GOING TO HAVE THAT PROBLEM BY GOING INTO A RESTAURANT. INDUSTRIAL EXPOSURE HAS BEEN DEALT WITH. THE FENCE ON A MISSION STANDARD IS 2.8 PARTS PER BILLION. THAT'S NOT THE ONE DROP MY NEIGHBOR WAS TALKING ABOUT.THAT'S FAR LESS THAN THAT. IF AN INDUSTRIAL FACILITY HAS MORE BENZENE THAN THAT THE EPA'S GOING TO GET THEM CLOSED. THE SERVICE STATION FENCE LINE HAS THAT LEVEL. IF YOU'RE STANDING RIGHT THERE YOU STAND THERE LONG ENOUGH YOU'RE IN THE AT-RISK GROUP. THAT'S OVER TALKING ABOUT. NOT TALKING ABOUT THE MOTORIST LEVELS UP, FUELS AND PULLS AWAY. TALK
ABOUT THE PEOPLE WHO LIVED WITH IT EVERY DAY. THANK YOU. >> HELLO CITY COUNCIL. MY NAME IS BARRY DOSH. I DON'T LIVED IN THE VILLAGE OF WEST CLAY. AS OF IMMEDIATELY SOUTH. ON THE PRESIDENT OF THE LAUREL LAKES HOMEOWNERS ASSOCIATION. WORK HUNDRED 26 AND TOWN ROAD.
I WANT TO REMIND YOU FOR WHAT YOU DO FOR NEIGHBORHOODS HAS A RIPPLE EFFECT. THIS IS THE FIRST TIME IEEN TO A CITY COUNCIL MEETING. I KNOW GOING FORWARD NO ONE ELSE IN THE CITY IS GOING TO GET A GAS STATION WITHIN 500 FEET OF THEIR HOUSE. IF WE DON'T DO SOMETHING THE PEOPLE WHO LIVED IN THE VILLAGE OF WEST CLAY WILL BE DISCRIMINATED AGAINST IN THE WAY AND ALLOWED BECAUSE OF A 1999 PUD TO HAVE A GAS STATION CLOSER THAN ANYBODY ELSE IN THE CITY OF CARMEL IS ALLOWED TO. AND THAT JUST DOESN'T SEEM RIGHT TO ME. I WANT TO THANK THE PREVIOUS SPEAKER AS A RETIRED ONCOLOGY NURSE WILL NEVER FORGET IN THE EARLY 80S TAKING CARE OF THE PATIENT WAS DYING OF ACUTE MODULE ARMAMENTS LEUKEMIA AML.
WHO HAD BEEN A PILOT AND TOLD ME HOW HE LOVED TO TINKER ON JET ENGINES AND HE WAS CONVINCED THAT HAD CAUSED HIS AML. I'M VERY WELL AWARE PERSONALLY OF THE DANGERS OF BENZENE AND THIRDLY, JUST TO EMPHASIZE MY POINT ABOUT WHAT YOU DO FOR ONE NEIGHBORHOOD.
EVEN THOUGH I DON'T LIVED IN THE VILLAGE. MY MOM DOES LIVED IN THE STRATFORD AND SEVERAL OF US LIVING LAUREL LAKES APPEARANCE OF THE STRATFORD AND IT'S TERRIFYING TO THINK OF MY 98-YEAR-OLD MOM BEING CLOSE TO A GAS STATION WHEN IT SOUNDS AS IF GOING FORWARD NOBODY ELSE IN CARMEL IS GOING TO HAVE A GAS STATION PLANTED 500 FEET WITHIN THEIR HOME OR THAT RETIREMENT COMMUNITY. I WOULD JUST ASK YOU, PLEASE TO LOOK OUT FOR ALL OF THE CITIZENS OF CARMEL BECAUSE WHAT YOU DO WHEN ONE NEIGHBORHOOD DOES HAVE A RIPPLE EFFECT. SO THANK YOU FOR WHAT YOU'RE DOING. SPECIFICALLY THANK WHITE REPRESENTATIVE, MILES NELSON I KNOW YOU BEEN VERY HEAVILY INVOLVED IN THIS FIGHT. I APPRECIATE YOUR EFFORTS. SO THANK YOU ALL.
>> THANK YOU VERY MUCH. I WANT TO ADDRESS ONE THING PERHAPS JOHN CAN DD COLOR TO IT AS WELL. OR IS IT MRS. BROWN. I BELIEVE THAT SMOKE WAS A BUREAUCRATIC HURDLE. WHEN I GUARANTEE YOU IF THIS WAS A BUREAUCRATIC ISSUE OF SOMEONE NOT TAKING ACTION WHEN THEY HAD FULL AUTHORITY TO DO SO THAT WE WOULD BE JUMPING ALL OVER THAT. THIS IS MORE OF A LEGAL HURDLE
[01:30:04]
AND JOHN IF YOU COULD GIVE MORE COLOR FROM YOUR STANDPOINT ON THAT I WOULD APPRECIATE IT.>> SURE. THIS INVOLVES PROPERTY RIGHTS. WHICH AS WE ALL KNOW IS EXTREMELY IMPORTANT. IN AMERICA AND ESPECIALLY INDIANA. SO, WHAT A COURT IS GOOD-LOOKING THERE'S LITIGATION OVER THIS IS WHEN TO THE PROPERTY RIGHTS VEST TO BUILD THIS GAS STATION ACCORDING TO YOU KNOW, THE REQUIREMENTS THAT WERE IN PLACE WHEN THE APPLICATION WAS FILED.
SO, IT'S NOT BUREAUCRATIC ISSUE. IT REALLY IS A LEGAL ISSUE.
>VESTED RIGHTS IS MOST HEAVILY LITIGATED IN COURTS. >> THANK YOU. I WANT TO MAKE SURE EVERYBODY HERE KNEW IF IT WAS ON TOOK TO THE COUNCIL TO MAKE A CHANGE TO NOT MAKE THIS POSSIBLE GOING OUT ON A LIMB I THINK IT WOULD PASS UNANIMOUSLY OR CLOSE TO IT. BUT WERE FACED WITH SOME COMPETING OBJECTIVES AND COMPETING LAWS. SO WE DO EVERYTHING WE CAN TO DO WHAT'S WITHIN OUR POWER. TO MAKE THIS THE BEST SITUATION WE CAN FOR RESIDENTS. WERE FACED WITH SOME LEGAL HURDLE'S FOR SURE. COUNSELOR RIDER AND COUNSELOR AASEN I SEE YOUR HANDS UP.
COUNSELOR AASEN COULD. >> THINK ABOUT A PRESIDENT. JOHN WANT TO CLARIFY. DIVORCE THIS MAY NOT STOP THAT GAS STATION THAT'S ALREADY FILED THEIR PERMITS. I UNDERSTAND THAT. BUT WERE HOPING TO DO HERE WILL MAKE A DIFFERENCE AT LEAST IN THE VILLAGE OF WESTLAKE BECAUSE OF ANY REASON THIS GAS STATION DOESN'T GET BUILT, THIS WOULD PREVENT THAT NEVER FROM HAPPENING IN THE FUTURE. SO COULD YOU SPELL IT OUT FOR EVERYBODY?
>> THAT'S MOSTLY CORRECT COUNSELOR AASEN. WHAT THIS WILL DO IS ANY APPLICATION THAT'S FILED AFTER THIS ORDINANCE IS ADOPTED, THEY WOULD BE SUBJECT TO THE 500 FOOT GAS STATION SETBACK. THEY WOULD HAVE TO COMPLY WITH THAT REQUIREMENT.
>> WHAT IS IT TAKE FOR THEM TO LOSE THEIR VESTED PROPERTY RIGHTS? YOU MEAN FOR THE APPLICATION IF THERE'S ALREADY ONE ON FILE? I MEAN THEY COULD WITHDRAW IT. I MEAN, YOU KNOW THEY COULD CHOOSE TO WITHDRAWAL IT. WHEN RIGHTS VEST IS USUALLY AN ISSUE FOR A COURT TO DECIDE. IF IT'S SOMETHING THAT'S GOING TO BE CHALLENGED BUT, FOR THEM TO LOSE IT THEY COULD WITHDRAW THEIR APPLICATION OR. IF A PERMIT WAS DENIED THAT WOULD BE MOST LIKELY LITIGATED. AND IT DEPENDS ON HOW THE COURT RULES AS TO WHETHER THE RIGHTS WENT
VESTED. >> IT'S A COMP LOCATED QUESTION SOUNDS LIKE. CONCERNING
TIMELINE OR SOMETHING WHERE THEY HAVE TO DO SOMETHING BY? >> WELL, THERE IS A STATUTORY SECTION IN INDIANA CODE THAT STATES THAT THE COMPLETE APPLICATION IS FOR A PERMANENT IS FILED BY LAW, BY STATUTE THE PROPERT RIGHTS VEST FOR 3 YEARS. THERE 3 YEARS TO CONSTRUCT THAT NEVER WAS ON THE APPLICATION. ESSENTIALLY YOU KNOW THE YOU DEAL REQUIREMENTS ARE FROZEN AT THAT TIME OF THEIR COMPLETE APPLICATION. AND, FOR A PERMIT. PERMITS ARE PRETTY BROADLY DEFINED. IT COULD BE IN IOP LIKE A BUILDING PERMIT. DEVELOPMENT PLAN.
IT'S A PRETTY BROAD DEFINITION OF WHAT A PERMIT IS. SO, THAT'S JUST BY STATUTE. CASE LAW WE HAVE TO TAKE INTO ACCOUNT. THERE ARE SOME DECISIONS THAT HAVE ACTUALLY EXPANDED VESTED RIGHTS. THEY LOOK AT IS HOW MUCH DOES THE DEVELOPER EXPAND ON PUTTING ALL THE APPLICATION, DOCUMENTS TOGETHER. IF YOU HAVE SPENT MAYBE HALF $1 MILLION, COURT MIGHT FIND FABRICS VESTED EVEN THOUGH THEY HAVE A FILED A COMPLETE APPLICATION. FAST INQUIRY AT THAT POINT. COUNSELOR RIDER JOHN ENGEL? WOULD YOU WANT ME GOING TO
CANCEL WORRELL? COUNSELOR WORRELL. >> TRY TO FIGURE OUT HOW TO ASK
THIS QUESTION. KEEPING US FROM GOING TO COURT ON THIS? >> OUR BROTHER NOT DISCUSS THE POTENTIAL LITIGATION OF A COUNCIL MEETING. I'M HAPPY TO APPRISE YOU OF THAT. IN AN
EXECUTIVE SESSION IF IT COMES TO LITIGATION. >> OKAY. THANK YOU.
>> WHICH IS THE FIRST MEETING OF JUNE? OR JANUARY. WHATEVER MONTH IT IS.
>> I THINK IT'S ON THE BOOKS FOR JANUARY. >> YES.
>> ANYTHING ELSE BEFORE I SEND THIS TO COMMITTEE? AND ACTUALLY BEFORE CLOSE THE PUBLIC HEARING AT 7:37. SO, HAVING CLOSE THE PUBLIC HEARING I WILL SEND THIS TO LAND USE COMMITTEE. THANK YOU EVERYBODY. IF THIS IS THE ONLY ISSUE YOU CAN FOR ANY WOULD

LIKE TO LEAVE SO YOU'RE NOT HERE UNTIL GOD KNOWS WHAT TIME WE ARE DONE. FEEL FREE TO LEAVE. I'LL WRITE NEXT UP ON OUR AGENDA IS ITEMS ARE TO BE PAID FOR SPREADING OF HORNETS Z Ã672 Ã21. NOTICE OF THE COMMON COUNCIL OF THE CITY A MANTLE REZONING A 5 ACRE PARCEL LOOK AT IT 214 E. HUNDRED 16 STREET IN THE MERCHANT SQUARE SHOPPING CENTER FROM THE B Ã8 DISTRICT TO THE SEAT TO MIXED DISTRICT. THE SPONSOR IS COUNSELOR RIDER.>> MOVED TO INTRODUCE. >> SECOND. >> SIR?
>> THIS ORDINANCE RESUMES THE FORMER MARSHALL GROCERY STORE PROPERTY MERCHANT SQUARE 2140 E. HUNDRED 16 STREET CARMEL TO SEE TO MIXED USED DISTRICT. GO FOR IT.
>> ADRIAN, HELLO, THANK YOU FOR JOINING US. >> GOOD EVENING. I WILL PUT A GRAPHIC ON THE SCREEN. FOR THE RECORD MY NAME IS ADRIAN KEELING WITH THE DEPARTMENT OF COMMUNITY SERVICES. I'M HERE THIS EVENING WITH A PROPOSAL THAT'S COMING TO YOU WITH A FAVORABLE RECOMMENDATION FROM THE CARMEL PLAN COMMISSION TO REZONE APPROXIMATELY 5 ACRES IN MERCHANT SQUARE. THERE WAS A QUESTION ABOUT THIS EARLIER. THIS IS A FORMER MARSHALL PROPERTY WHICH IS CURRENTLY AS I MENTIONED ABOUT 5 ACRES. IT CONSISTS OF AN APPROXIMATELY 87,000 SQUARE-FOOT BUILDING. AND THE PARCEL ALSO INCLUDES ABOUT 3 ACRES OF PARKING AND ACCESS BEHIND THE BUILDING TO A LOADING AREA. OF COURSE YOU'RE ALL FAMILIAR PROPERTIES CURRENTLY TEMPORARILY HOME TO THE CARMEL CLAY PUBLIC LIBRARY. WE ARE PROPOSING TO REZONE THIS FROM THE B Ã8 DISTRICT WHICH IS LIMITED TO THE MERCHANT SQUARE AREA TO THE C2 DISTRICT TO POSITION THE PROPERTY FOR A FUTURE REDEVELOPMENT DESIGNED TO BE CONSISTENT WITH A PLAN ALMOST 10 YEARS AGO THAT WE WORKED WITH JEFF SPECK TO DESIGN. HOWEVER, AS WAS MENTIONED PREVIOUSLY THIS DOES NOT INCLUDE THE ENTIRE MERCHANT SQUARE AREA. THIS IS SIMPLY THE FORMER MARSH PROPERTY ONLY. THE PLAN COMMISSION CONDUCTED A PUBLIC HEARING IN NOVEMBER ON THE 15TH. THERE WERE NO SPEAKERS FOR OR AGAINST THE PROPERTY. OR FOR OR AGAINST THE REZONING. WE HAVE BEEN WORKING WITH THE PROPERTY OWNER AS WELL AS A CURRENT TENANT, OR BOTH AWARE OF THE PROPOSAL AND ARE SUPPORTIVE OF THE PROPOSAL. THERE'S NO SITE PLAN OR TIMELINE FOR THE REDEVELOPMENT. HOWEVER ONCE SOMETHING IS PROPOSED THAT WE GO THROUGH THE PUBLIC HEARING PROCESS THROUGH THE PLANNING COMMISSION HEARING OFFICER. IT WILL BE SUBJECT TO THE ADVISORY COMMITTEE PROCESS IN A CARMEL DEVELOPMENT COMMISSION APPROVAL. SO THIS IS A GRAPHIC OF, SHOWING MERCHANT SQUARE. HUNDRED 16TH STREET. HERE ON THE SOUTH SIDE OF THE PROPERTY. OF COURSE KEYSTONE PARKWAY ON THE MAP IN THIS BLUE PARCEL OUTLINES WHERE THE PROPOSED REZONING WOULD TAKE PLACE. I'M HAPPY TO TAKE ANY QUESTIONS THIS EVENING. OR IF THIS WERE TO GO TO COMMITTEE I COULD BE READY WITH SOME ANSWERS I THOUGHT COMMITTEE
MEETING AS WELL. >> COUNCIL ANY QUESTIONS ON THIS ITEM? COUNSELOR HANNON?

THANK YOU. >> THANK YOU ADRIAN. SO, TONIGHT'S AGENDA BOOK SEVERAL THINGS THAT ARE SOMEWHAT PROCEDURAL AND VERY TEDIOUS FRANKLY. THEY ARE REQUIRED SO I WANT TO EXPLAIN A LITTLE BIT ABOUT WHAT WE ARE DOING. THE NEXT SEVERAL ITEMS ARE REQUEST FOR A PERFECT ADDITIONAL APPROPRIATIONS. THOSE ARE FOR PUBLIC HEARING IN EVERY CASE WILL BE VOTING TO SUSPEND THE RULES BECAUSE NORMALLY THIS BUSINESS REQUIRES 2 READINGS.
BEFORE WE CAN ACT UPON THEM. YOU'RE GONNA HEAR SEVERAL PROCEDURAL VOTES OVER AND OVER AND OVER AGAIN. IN THE SECTION. THEN THE SAME THING YOU WILL HEAR A LITTLE BIT OF THAT UNDER THE NEW BUSINESS SECTION. BEAR WITH US A LITTLE BIT. WE CANNOT. WE LOOKED INTO MAKING A MOTION TO SUSPEND THE RULES ON ALL OF THEM. IN OUR ATTORNEY DID NOT PLAY NICE AND HE IS NOT SITTING OUT SO I CAN TALK FAIRLY ABOUT HIM. OUR ATTORNEY DISAGREED. VERY IS.
HE DISAGREED A BAPTIST EXPENDABLES ONLY AFTER WE'VE INTRODUCED AND HAD A FIRST READING. SO, JOHN IS GOING TO MAKE THIS MEETING A LOT LONGER THAN IT NEEDS TO BE.

[16. OTHER BUSINESS]
. A STUDY GUIDE FOR TINA'S AGENDA ITEM ON ITEMS WE HAVE DONE. ITEM 16 IS OTHER BUSINESS. TUESDAY APRIL ARE THE CRC PURCHASE OF 611 THIRD AVENUE SOUTHWEST. WEST. IN DIRECTOR MRS. DUSKY IS HERE TO PRESENT THIS TO US THIS EVENING.>> GOOD EVENING COUNCIL. I PREPARED A 15 MINUTE PRESENTATION.
>> HE WOULD BE ALLOTTED 60 SECONDS. S. [LAUGHTER] COULDD TAKE WITH TINY NEED D TAKE WITH TINY OR AFTER THE PURCHASE OF ONE ON SQUARE YEARS AGO THIS WHICH IS A 2 AND A HALF OR ACRE PARCEL REMAINS THE RGEST LARGEST PARCEL THAT'S NOT CONTROLLED BY THE REDEVELOPMENT COMMISSION OR ONE OF ITS ARTMENTS BASICALLY THE ENTIRE CORE. ESPECIALLY BETWEEN OUR MIDTOWN AND OUR CITY CENTER AREAS. IT IS ON THE TRAIL. IT IS DIRECTLY ADJACENT TO MOAN ON SQUARE. IF YOU'RE LOOKING AT THE PARCELS, ONE ON SQUARE IS OWNED BY THE REDEVELOPING COMMISSION. THAT IS TO THE EAST OF THE SPECIFIC PARCEL. THAT IS WHAT'S WIRED DIRECTLY TO THE NORTH OF THE SPECIFIC PARCEL WHICH IS OWNED BY PAT CORE, FREQUENT PUBLIC-PRIVATE PARTNER OF THE REDEVELOPING COMMISSION. WE HAVE 2 APPRAISALS FOR THIS PROPERTY.
ONE IS 4.25 MILLION AND THE OTHER IS 5 MILLION. I'VE SENT EACH OF YOU COPIES OF THOSE APPRAISALS. WE HAVE THIS LAND UNDER CONTRACT FOR 4.8 MILLION. THE REDEVELOPING COMMISSION VOTED TO PURCHASE THIS PARCEL AT ITS PREVIOUS MEETING. SO PER THE 2021 TIF BOND THIS NOW GOES BEFORE YOU TO WEIGH IN ON IT AS HE WOULD LIKE. WE BELIEVE THAT THE PURCHASE PARCEL BREAKER FOR THIS PARCEL WHICH IS 1.9 MILLION AND ACRE IS SIGNIFICANTLY LESS THAN SOME OF THE PURCHASES WE'VE SEEN HAPPEN IN THE AREA RECENTLY. EVEN AS AN INSTANCE, ALL THE LAND FOR THE PNC PROPERTY AND THE ADJACENT LAND WAS COVERED AT 2 AND A HALF MILLION DOLLARS AN ACRE. THAT WAS SEVERAL YEARS AGO BEFORE REAL ESTATE PRICES KIND OF WENT THROUGH THE ROOF. WE, IF YOU REMEMBER A FEW YEARS AGO WE PURCHASED MOAN ON SQUARE. THE PURCHASE PRICE OF THAT WAS 15 MILLION. RECENT APPRAISAL OF THE PROPERTY PUTS IT AT 21.9 MILLION. SO, AS WE'VE ALL HEARD THE COST OF REAL ESTATE CONTINUES TO GO UP. THIS MORNING HAPPENS TO BE EVEN LESS THAN SOME OF THE APPRAISALS WE HAVE ON THIS PROPERTY. WE BELIEVE IT IS IMPORTANT FOR THE CITY'S LONG-TERM GROWTH AND IT IS A GOOD PRICE AND NOW IS THE TIME TO STRIKE. THE ONE CAVEAT HERE IS WE ARE WORKING WITH THE CURRENT BUILDING OWNER AND THE BUILDING OWNER WILL BE ALLOWED TO STAY IN THE BUILDING FOR ABOUT 2 YEARS, A DOLLAR A YEAR LEASE AS THEY BUILD THE NEW LOCATION WHERE THEY ARE GOING. SO THIS WAS A VERY CORDIAL RELATIONSHIP AND AMICABLE RELATIONSHIP WITH US AND THE OWNER THAT CURRENTLY HAS THE
PROPERTY. HAPPY TO ANSWER ANY QUESTIONS. >> COUNSELOR 10-ÁCUSTOMÁ MADAM PRESIDENT. DOCTOR THANK YOU FOR BEING HERE. ALSO THE INFORMATION THAT CAME TO US.
[02:05:01]
WE APPRECIATE THE ESTIMATES WERE IN LINE OR THE PRICE OFFERS ARE IN LINE. MY CONCERN WAS BASED UPON THE CURRENT CARMEL ARTICLE THAT WHETHER IT'S BEEN INKED OR NOT THAT THIS 4.8 UTAH PROPERTY WITH AND BE GIFTED TO THE SONGBOOK FOUNDATION. I GUESS THE QUESTION IS, IS THAT THE PLAN AND IF SO WILL THAT LEASE FOR THOSE TERMS COME BACK TO COUNCIL OR ONCE WE APPROVE THIS MONEY DECISION IS COMPLETELY UP TO CRC?>> I THINK MR. MCDERMOTT PUT IT PRETTY ELOQUENTLY EARLIER. FOCUSING ON THIS MORNING STEP AT A TIME. EVERYTHING ELSE I THINK DETAILS ARE YET TO BE DETERMINED. JUST HAVE THE PURCHASE AGREEMENT OF THIS MOMENT AND I DON'T HAVE ANYTHING ELSE ON WHAT'S GOING
TO HAPPEN IN THE FUTURE WITH THIS PROPERTY. >> SO I GUESS MAYBE I WILL REPHRASE. IF THE DECISION IS MADE TO GIFT THIS TO ANYONE INCLUDING SONGBOOK FOUNDATION WITH A BACK TO COUNCIL FOR INFORMATION OR VOTING OR WITHOUT LEAVE TO BE DONE
DEPENDING ON THE CRC? >> DISPOSITION OF THE PROPERTY?
>>AT OUR LAST MEETING THE REDEVELOPING ING COMMISSION ENTERED INTO A CONTRACT TO PURCHASE THIS PERTY NOT SURE HOW THE MAYOR WOULD PACKAGE WHATEVER FUTURE AND FUTURE PROJECTS THAT WOULD EXIST WITH THE SONGBOOK IN MIND. RIGHT NOW THIS IS JUST A PURCHASE OF THIS PROPERTY. THERE ARE TIMES WHEN GENERALLY DOES THE REDEVELOPMENT COMMISSION, 3 TO MOMENT COMMISSION DOES NOT REQUIRE TO CONSULT ABOUT RONNIE WHEN DISPOSING OF PROPERTY UNDER THE REDEVELOPMENT STATUTE. THAT WAS THE QUESTION YOU ARE ASKING.
>> THINKING. >> NEXT COUNSELOR AASEN THEN COUNSELOR CAMPBELL.
>> THINK IT MADAM PRESIDENT. I HINTED THIS BEFORE. ANOTHER COUPLE OF DIFFERENT, YOU TALKED PABOUT SOMEWHERE ALONG THE MOAN ON MIDTOWN WOULD BE AN IDEA FOR THE SONG MUSEUM. THIS PROPERTY, THIS IS ON OUR AGENDA. I WILL STATE WHERE I AM OUT. PROPERTY FOR THE MUSEUM MAY BE SOMETHING I'M IN FAVOR OF IF WE DO THAT. THEN THERE WERE MORE MANIC COMING TO COUNCIL SAINT, OKAY WE NEED MORE MINUTE FOR THIS MUSEUM FOR THIS. NOW THAT WE HAVE THIS GOING. I KNOW YOU SAID WE WOULD NEED MORE MONEY. TO MAKE IT CLEAR THAT WOULD BE A HARD SELL FOR ME. IF THAT WERE THE CASE. WE'VE TALKED ABOUT THIS PROPERTY. I THINK ACQUIRING STUFF ON THE MOAN ON AND MIDTOWN MAKES A LOT OF SENSE. I WOULD ENCOURAGE A LOT OF PUBLIC SPACES. I THINK MIDTOWN PLAZA HAS BEEN A HUGE HEAD. WITH ANY OF THESE PROJECTS WE HAVE, I THINK WE WILL LOOK BACK IN THE PAST AND IF WE DON'T HAVE PUBLIC SPACES OR PUBLIC USES ALONG THE MOAN ON A PER CREDIT. WE WILL RUN OUT ONE DAY. DOING ALL THESE PROJECTS, EVERY CHANCE WE GET WE NEED TO MAKE SURE THERE IS A PUBLIC SPACE. SINCE THIS IS A LOT OF MONEY, IS THERE A REASON WHY WE COULDN'T SEND THIS TO COMMITTEE?
>> PER THE ORDINANCE BE APPROVED YOU CAN SEND THIS TO COMMITTEE. YOU CAN DO WHATEVER
YOU WANT WITH IT. >> OKAY. YOU HAVE A CONTRACT RIGHT WITH THEM?
>> IVA CONTRACT, YES. >> SENDING IT TO COMMITTEE WILL NOT MESS THAT UP BOOKS AND WILL
NOT. >> I THINK SINCE THERE SOUNDS LIKE THERE ARE SOME QUESTIONS.
I'D LIKE TO SEE IT GO TO COMMITTEE. DOES ANYONE ELSE HAVE ANY QUESTIONS HERE?
>> COUNSELOR CAMPBELL. >> THINK IT MADAM PRESIDENT. I WAS GONNA ASK THE SAME THING.
I THINK THIS SHOULD GO TO COMMITTEE. I FEEL LIKE THERE IS A DISCONNECT BETWEEN THE SONG BOOK FOUNDATION AND THIS PURCHASE. WE HEARD FROM MR. MCDERMOTT THAT HE WASN'T IN ON THE CONVERSATIONS BUT, CRC WANTS TO PURCHASE THIS PROPERTY. I FEEL LIKE I'M MISSING SOMETHING AND I DON'T KNOW WHAT IT IS. I FEEL LIKE WE NEED TO DISCUSS THIS
FURTHER. >> IF I COULD RESPOND TO THAT. MR. MCDERMOTT AGAIN SPOKE ELOQUENTLY ABOUT SOMETHING THAT COULD HAPPEN IN THE FUTURE. LOCKING UP THIS PROPERTY STANDS ON ITS OWN MERITS REGARDLESS OF WHAT HAPPENS IN THE FUTURE WITH THE SONGBOOK MUSEUM. PROPERTY IS PART OF THE INITIAL SPEC PLANT THAT HE PUT TOGETHER FOR THE MIDTOWN AREA. THIS IS THE LARGEST REMAINING PIECE BETWEEN MIDTOWN AND CITY CENTER. WHETHER THIS PARCEL CONTAINS IN THE FUTURE THE MUSEUM OR AN OFFICE BUILDING OR A PUBLIC SPACE. LOCKING UP THIS LAST
[02:10:03]
LARGE PIECE OF LAND IN THIS AREA STANDS ON ITS OWN MERIT REGARDLESS OF WHAT THE FUTUREWILL BRING. >> STILL ASKED THAT IT GO TO COMMITTEE.
>> COUNSELOR 7. >> MADAM PRESIDENT. JUST MAIN PART OF MY POINT. IT'S IRONIC THAT I'M GONNA SAY WHAT I'M GONNA SAY. I AT THE TIME OF THE PURCHASE OF THAT MOAN ON THE PROPERTY AND NEXT TO IT I VOTED AGAINST IT. AS I'VE SAID IN ALL THE TIME SERVED, YOU FIGHT YOUR FIGHTS WHEN YOU LOSE YOU SUPPORT IT AND MOVE ON. REGARDLESS OF THE AMERICAN SONGBOOK, WE WOULD LOOK TO PURCHASE THIS PROPERTY. IT MAKES SENSE TO PURCHASE THIS PROPERTY. TO ADD IT TO WHAT WE HAVE. SO THAT'S ME PLAYING ALONG WITH HOW I'VE ALWAYS PREACHED THAT WE SHOULD DO OUR JOB. ALSO I WANT TO POINT OUT THAT I DON'T THINK THAT WE WOULD BE LOOKING AT THIS IS A GRANT OF LAND IF IT ENDED UP IN THIS PARCEL. IT WOULD BE A GRANT OF LAND IT WOULD PROBABLY BE A LONG-TERM LAND LEASE. THAT'S A HUGE DIFFERENCE IN TERMS. SO WE WOULD NOT BE GRANTING THE LAND TO THEM IF WE DID THIS. IF IT ENDED UP HERE.
>> COUNSELOR HANNON COUNSEL RIDER SAYING IT IF IT WAS FACT. IT SOUNDS LIKE IT'S UP TO THE CRC WITH THE TERMS WOULD BE. WE COULD CERTAINLY SAY WE AS A COUNCIL PREFER TO BE A LEASE TO AT LEAST PARTIALLY RECOVER THE COST OF THE LAND. AGAIN, MY POINT IN ALL OF THIS IS ONCE WE APPROVE THE SALE IT SOUNDS LIKE WE AS COUNCIL HAVE LITTLE OR NOTHING TO SAY ABOUT THE USE OF
THE PROPERTY. >> COUNSELOR AASEN. >> I WILL SAY WE WILL HAVE SOME SAY IF THERE'S SOMETHING BESIDES A SOUND BOOK. IF THERE'S ANY KIND OF DEVELOPMENT LIKELY A PUBLIC-PRIVATE PARTNERSHIP THERE PROBABLY BEATIFIC INVOLVED AND IT WOULD COME BACK TO US. YOU'RE RIGHT, IF IT'S A SONGBOOK FOUNDATION THERE'S A LOT LESS SAY WE HAVE THERE. WHICH AGAIN, I WANT TO MAKE IT CLEAR, I REQUEST A SENATE COMMITTEE IS NOT IN OPPOSITION TO THIS IDEA. IT'S NOT IN A POSITION OF SONGBOOK FOUNDATION. SOUNDS LIKE IT WON'T MESS UP THE DEAL TO TAKE A LITTLE BIT MORE TIME. JUST, THAT'S IT.
>> YEAH, I'D BE IN FAVOR OF IT GOING TO COMMITTEE. IT'S KIND OF LATE NIGHT. IT WAS ON THE AGENDA BUT KIND OF AT THE VERY END. I'D LIKE THE PUBLIC TO HAVE A FULL OPPORTUNITY HERE TO
DISCUSS THIS IN FURTHER DETAIL. >> COUNSELOR NELSON, COUNSELOR WORRELL? ANY QUESTIONS. STRIP MCDERMOTT DID NOT SAY ANYTHING ABOUT THIS SINCE IT'S AFFECTED YOUR SONGBOOK FOUNDATION. YOU'RE WELCOME TO MAKE A FEW COMMENTS IF YOU WANT. THIS IS
A PUBLIC HEARING. WE WELCOME YOU BACK TO THE PODIUM. >> THINK IT MADAM PRESIDENT. I THINK THE ONLY THING I WOULD WANT TO CLARIFY AS WHAT WAS STATED BY COUNSELOR RIDER.
THAT IS ANY DISCUSSIONS WE HAVE HAD ABOUT ANY LAND WITH THE CITY WOULD BE A LONG-TERM LEASE. WHERE THE LAND WOULD BE PROVIDED IN A LEASE FORM, NOT A GRANT OF THE LAMB. NOT LOOKING FOR THAT. LOOKING FOR LONG-TERM LEASE OPPORTUNITY WITHIN THE SONGBOOK FOUNDATION WOULD RAISE THE TENS OF MILLIONS OF DOLLARS TO DESIGN, TO BUILD, TO OPERATE AND TO
SUSTAIN WORLD-CLASS MUSEUM HERE IN OUR COMMUNITY. >> THANK YOU. DOCTOR SAID SKI ANY CLOSING COMMENTS BEFORE FOR YOU IF I SEND THIS TO COMMITTEE?
>> NO. EVERYONE SHOULD GO HOME TO THEIR FAMILIES. [LAUGHTER] >> ALL RIGHT. WITHOUT FURTHER OBJECT WE WILL SEND THIS TO LAND USE COMMITTEE AND YOU HAVE A VERY BUSY. I SAY LAND-USE WOULD YOU RATHER HAVE IT FINANCE. TECHNICALLY IT'S A PURCHASE. I'M JUST ON THE LAND-USE MODE OF MAC. WELL, WITHOUT KIND OF INTEREST WE WILL SEND IT TO FINANCE. THANK YOU VERY MUCH. ITEM 17 IS ANNOUNCEMENTS.
