SO WE HAVE JUST RECENTLY RECEIVED AN EMAIL FROM CORPORATE COUNSELOR. MR. JOHN OBERLANDER.

I'LL JUST READ THE EMAIL ITSELF.

IT SAYS GOOD AFTERNOON COUNSELORS.

THE ATTACHED LETTER WAS SENT BY EMAIL AND REGULAR MAIL TO THE APPLICANT FOR THE WESTCLAY GAS STATION PROJECT THIS AFTERNOON.

AS YOU CAN SEE, THE DEPARTMENT HAS MADE TH DETERMINATION THAT THE UNIFIED DEVELOPMENT ORDINANCES 500 FOOT GAS STATION SETBACK DOES APPLY FOR THE WESTCLAY PUD.

THEREFORE, THE PROJECT WILL NOT MOVE FORWARD WITH THE TECH REVIEW MEETING FOR THE PROJECT THAT WAS SCHEDULED ON THE 15TH.

THAT HAS BEEN CANCELED. AS STATED IN THE LETTER, THE NEXT STEP IF THE APPLICANT CHOOSES TO TAKE IT IS TO APPEAL

ITEM NUMBER 2, ORDINANCE Z672-21 AND ORDINANCE REZONING FIVE ACRE PARCEL LOCATED AT 20 140 E. 116TH STREET IN THE MERCHANTS SQUARE SHOPPING CENTER FROM BA BUSINESS DISTRICT TO SEE TWO MIXED USE DISTRICT.

ANY POTENTIAL DEVELOPMENT? >> THE REVIEW PROCESS IS ESSENTIALLY THE SAME. THE ONLY DIFFERENCE IN HOW WE LOOK AT THEM IS THE ACTUAL END HEARING.

WHICH IS CONDUCTED BY THE PLANNING COMMISSION HEARING OFFICER. BUT THERE IS STILL A PUBLIC HEARING. SO EVERYTHING IS ACCORDING TO THE RULES OF THE PLAN COMMISSION.

INCLUDING NOTICE, TECH REVIEW AND ULTIMATELY PUBLIC HEARING.
