>> NUMBER FIVE RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS. WE HAVE THE HONOR OF HAVING THE INDIANA DONOR NETWORK WITH US THIS EVENING AND COUNSILOR FINKAM HAS AFFILIATION WITH THE NETWORK AND I WILL LET HER TAKE
THIS FROM HERE. >> IT IS MY PLEASURE TO INTRODUCE KARINA FROM INDIANA DONOR NETWORK AND DONATE LIGHT INDIANA TO DO A SPECIAL RECOGNITION.
I SPENT FIVE AND HAVE GREAT YEARS WITH INDIANA DONOR NETWORK AND DURING THAT TIME IT WAS LIFE-CHANGING BECAUSE OF THE STORIES THAT WERE TOLD ABOUT DONORS, PEOPLE, WHO MADE WHAT THEY OFTEN SAY IT IS THE AVERAGE DECISION BUT HAD OUTSTANDING EXTRAORDINARY RESULTS BY SAVING LIVES.
WE HAVE A LOCAL STORY HERE THAT KARINA WILL SHARE AND THEN WE WILL DO A PHOTO AFTERWARDS. KAREN?
>> THANK YOU GUYS FOR HAVING ME AS SUE MENTIONED WE HAD THE PLEASURE OF WORKING TOGETHER AND EXPERIENCING THE ROSE PARADE FLOAT DURING TIME IN CALIFORNIA.
TONIGHT I'M HERE TO SHARE OUR GRAPH WHICH IS ON THE TABLE UP FRONT. AND A LITTLE ABOUT OUR 2023 GRAPH POTTERY AND THAT YOUNG MAN YOU SEE IS MCKENZIE LICHTMAN. HE IS A GRATEFUL RECIPIENT OF A HEART TRANSPLANT AND ALSO BECAME A TISSUE DONOR HERO.
KEN'S AS HE WAS LOVELY CALL BY HIS FAMILY RECEIVED A TRANSPLANT AT 13 DAYS OLD. AT RILEY HOSPITAL.
HE HAS GOTTEN THE BENEFIT OF WHAT THAT GIFT MADE FOR HIM.
HE WAS A FAN OF ALL DIFFERENT SPORTS, ESPECIALLY GOLF AND HAD THE OPPORTUNITY BECAUSE OF HIS GIFT OF LIFE TO ATTEND 1/32
[00:05:04]
SUPER BOWL AND ATTEND THE WORLD SERIES FOR THE BOSTON RED SOX WHICH HE ODDLY WAS A FAN OF EVEN THOUGH HE'S FROM INDIANA.HE ALSO WAS A TIRELESS DEFENDER OF UNDERDOGS AND I THINK THAT SPEAKS TO HIS STORY HE GRADUATED FROM CARMEL HIGH SCHOOL HERE IN 2009 AND WENT ON AND GOT HIS ASSOCIATES AT UNIVERSITY I WAS VERY MUCH LOOKING FORWARD TO PURSUING HIS BACHELORS AT INDIANA UNIVERSITY.
UNFORTUNATELY HE DID NOT GET THE OPPORTUNITY.
HE DIED PEACEFULLY IN HIS SLEEP AND BECAME A TISSUE DONOR HERO BECAUSE OF THAT. HIS STORY CAME FULL CIRCLE.
HIS SISTER WORKS FOR OUR ORGANIZATION AND HELPS WITHIN OUR HOSPITAL DEVELOPMENT PROVIDE EDUCATION TO OUR HOSPITAL PARTNERS AND CONTINUING TO MAKE SURE THE GIFT OF LIFE CAN HAPPEN BECAUSE WE HAVE AN EDUCATED HOSPITAL STAFF. HIS LEGACY THAT CARRIED ON THROUGH THE GIFT OF DONATION IS ALSO GOING TO BE HONORED ON THE 23RD. DONATE FLOAT WOULD YOU SEE ON THE SCREEN THE THING IS LIFTING EACH OTHER UP AND YOU SEE THE BEAUTIFUL DESIGN OF THE FLOAT UP THERE.
IF YOU ARE NOT FAMILIAR WITH THE ROSE PARADE IN GENERAL THOSE FLOATS ARE CREATED OF ORGANIC MATERIAL SO FLOWER PETALS AND FLOWERS AND SEEDS AND SPICES AND SLICES OF FRUIT AND THEY ARE PAINSTAKINGLY AND I'M TALKING PADDLE BIPEDAL GLUED ON BY VOLUNTEERS AND FAMILY MEMBERS THAT ALSO HAVE A CONNECTION TO DONATION. WE ARE HONORED TO BE ABLE TO SEND HIS FAMILY OUT THERE AND THAT PORTRAIT UP AT THE FRONT YOU CAN TAKE A LOOK AT IF YOU WOULD LIKE BUT THEY ARE CALLED FLOOR GRAPHS AND THEY ARE PRIMARILY CREATED IN CALIFORNIA. THEY ARE SHIPPED TO US SO THAT THE FAMILY WILL HAVE THE HONOR OF PLACING FINISHING TOUCHES ON THAT. YOU WILL SEE WHEN YOU LOOK CLOSELY THAT THE EYEBROWS ARE BLANK AND IS SOMETHING THE FAMILY WILL BE ABLE TO FILL IN DURING A SPECIAL EVENT WITH THEIR LOVED ONES. WE ARE THANKFUL FOR THIS OPPORTUNITY TO SHARE THIS WITH YOU.
I'M HUMBLED TO SHARE A MESSAGE AND ENCOURAGE PEOPLE TO CONSIDER HOW IMPORTANT DONATION IS IN ITS IMPACTED ME PERSONALLY IN MY FAMILY. MY MOM WAS THE RECIPIENT AND I'M GRATEFUL FOR PEOPLE LIKE HANS WHO MADE THAT GIFT.
WITH THAT I WANTED TO SHARE WE ARE GOING TO BE PLACING A ROSE ON THE FLOAT IN CALIFORNIA AT THE END OF DECEMBER IN HONOR OF THE CITY OF CARMEL. WE WILL BE HAVING OUR STAFF AND TEAM HEADING DOWN THERE WHO WILL ACTUALLY PHYSICALLY PUT THAT ON THE BASE OF THE FLOAT SO WHEN YOU'RE WATCHING THE PARADE NOT ON NEW YEAR'S DAY BUT ON JANUARY 2, WHEN YOU ARE WATCHING THE PARADE KNOW THAT THERE SOMETHING THAT IS REPRESENTING ALL THAT YOU GUYS DO TO SUPPORT DONATIONS AS WELL. I THANK YOU FOR LETTING ME BE HERE. HAVE A GREAT HOLIDAY.
NOTHING ENCOMPASSES THE GIVING NATURE OF THANKSGIVING THAN THE GIFT OF LIFE PEOPLE CONTINUING TO GIVE THROUGHOUT OUR STATE.
[APPLAUSE] >> PLEASE JOIN US AND GRAB WHATEVER YOU WANT TO GRAB AND GET RIGHT IN FRONT OF US.
>> WELL SHE IS DOING THAT DON'T FORGET IF YOU DON'T HAVE THE HEART ON YOUR LICENSE OR REGISTER ONLINE GO TO DONNC)E INDIANA.ORG OR AT YOUR LOCAL DMV AND GET THAT DONE.
ONE DONOR CAN SAVE EIGHT LIVES AND HELPS ONLY FIVE PEOPLE OR MORE THROUGH TISSUE DONATION. KAREN THANK YOU SO MUCH FOR
BEING HERE. >> THANK YOU VERY MUCH.
NEXT WE HAVE RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE
[7. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS]
I HAVE NO BLUE CARDS IN FRONT OF ME.[00:10:04]
COUNCIL AND MAYORAL COMMENTS AND OBSERVATIONS COUNSELORGREEN? >> THANK YOU MR. PRESIDENT I WANT TO MAKE SURE EVERYBODY'S AWARE I'VE BEEN GETTING LOTS OF EMAILS SPECIFICALLY ON 106 AND COLLEGE.
PART OF IT IS THE SUPPLY CHAIN PROBLEM WITH CEMENT.
ORIGINALLY THE PROJECT, THE ROUNDABOUT, WAS SUPPOSED TO GO IN IN JULY AND BE DONE IN 60 DAYS AND IT WAS PUSHED TO SEPTEMBER 6 SHOULD BE FINISHED AROUND NOVEMBER 6.
IF ANYONE HAS DRIVEN BY THE ITS NOWHERE NEAR.
WITH THE SUPPLY CHAIN WHICH NO ONE CAN COUNT ON AND FIX, ALSO WITH THE CONTRACTOR. I KNOW THE CITY IS PURSUING LIQUIDATED DAMAGES IS PUTTING A LOT OF BUSINESSES BEHIND WHO ARE HAVING PROBLEMS GETTING ACCESS AND ALSO ON 108 AND BELLEFONTE THERE HAVE IMPACTS WITHIN THE NEIGHBORHOODS BECAUSE THERE'S SEMI TRUCKS HAVING TO GO THROUGH NEIGHBORHOODS WHERE THERE'S KIDS WAITING.
THERE'S NO SIDEWALKS AND THEY ARE WAITING FOR THE SCHOOL BUSES. EVEN THE IT IS NOT IN ANYBODY ELSE'S DISTRICT I WANT TO MAKE SURE EVERYBODY IS AWARE THERE ARE ISSUES THERE. ESPECIALLY THE MAIN THOROUGHFARE OF HOME PLACES THAT HAVE BEEN SHUT DOWN.
I KNOW THE CITY HAS TAKEN STEPS TO MITIGATE THE IMPACT ON THE BUSINESSES IN THE NEIGHBORHOOD BUT IT IS PROBABLY GOING TO TAKE A LONGER TIME AND I WANTED TO MAKE SURE ANYBODY WATCHING KNOWS WE ARE AWARE OF IT AND TRYING TO FIGURE OUT HOW TO MITIGATE. THANK YOU MR. PRESIDENT.
>> THANK YOU SIR. COUNSELOR NELSON.
>> I WOULD LIKE TO TAKE A MOMENT TO ACKNOWLEDGE THE LIVES LOST AND THOSE INDIVIDUALS THAT WERE INJURED IN THE RECENT MURDERS AND HATE CRIMES IN COLORADO SPRINGS.

>> GOOD EATING CITY COUNCIL HENRY CARMEL REDIRECT THAT DEVELOPER. I WILL GO TO ACTIVITIES OF THE PRIOR MONTH. WE ENDED SEPTEMBER WITH $6.6 MILLION OF UNRESTRICTED FUNDS AND GENERALLY 50 AND A HALF MILLION DOLLARS. DESPITE THE WEATHER IS A BUSY CONSTRUCTION SEASON. THE RENT CONTINUES RISING.
WE EXPECT STEEL GOING UP IN THE NEXT MONTH.

PRESIDIUM IS ESSENTIALLY DONE ALTHOUGH THE PICTURE IS NOW OUT OF DATE. MILAN CONSTRUCTION CONTINUES AS WELL. THEY ARE WORKING ON THE CONDOS, THE CONDO BUILDING NOW. FIRST ON MAINE IS HAVING SOME INCREDIBLE PROGRESS. IT IS NICE TO SEE THIS DEAL UP ON MAIN STREET TO LET PEOPLE KNOW THE NEW URBAN FORM THAT THE MINISTRY IS GOING TO HAVE AT THAT INTERSECTION.

>> COUNSELOR HANAN? >> THANK YOU MR. PRESIDENT DIRECTOR THE FIRST AND MAIN HAVE HAD A CLOSURE FOR QUITE A WHILE OFF ONE OF THE LANES OF RANGE LINE.
WHEN THAT FIRST HAPPENED I THINK JOSH KIRSCH PUT OUT SOMETHING THAT APPLIED IT WOULD BE A COUPLE WEEKS BUT IT HAS NOW BEEN SEVERAL WEEKS OR MORE. WHEN IS THAT EXPECTED THAT TRAFFIC CAN RESUME ON RANGE LINE?
>> I WILL CHECK ON THAT FOR YOU COUNSELOR.
ENGINEERING DEPARTMENT HANDLES TRAFFIC ISSUES DURING CONSTRUCTION. WE WILL GET BACK TO YOU ON
THAT.> THANK YOU. >> ANY OTHER QUESTIONS?
[12. OLD BUSINESS (Part 1 of 2)]
>> THANK YOU SIR. >> OLD BUSINESS RESOLUTION CC.
RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING RESOLUTION CC-12-21-20-04; SPONSOR(S): COUNCILOR(S) AASEN, CAMPBELL, FINKAM, RIDER, AND WORRELL. RESOLUTION AMENDS PRIOR COUNCIL RESOLUTION APPROVING 2021 REDEVELOPMENT DISTRICT BONDS TO ADD CERTAIN PALLADIUM PROJECTS TO THE ELIGIBLE PROJECT LIST. B. SECOND READING OF ORDINANCE Z-677-22; AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, REZONING 4 PARCELS LOCATED ALONG 1ST AVENUE SE TO THE C2/MIXED USE DISTRICT; > THIS COMES BACK WITH A FOUR ÃZERO POSITIVE RECOMMENDATION. PARKING DOMINATED THE DISCUSSION OVERALL BY THE END OF THE MEETING WE DID MAKE ANY AMENDMENTS REGARDING PARKING. I WOULD MOVE THAT WE APPROVE
THIS ORDINANCE. >> COUNSILOR AASEN?
>> BEFORE WE VOTE I WANT TO HAVE A COMMENT ON THE PARKING I'M NOT GOING TO MAKE ANY AMENDMENTS BUT WE HAD CONVERSATIONS ABOUT RESIDENTS PARKING IN THE AREA.
VALET PARKING AND WHERE IT WOULD GO IN WHICH LOT CAUSING LETTER TRAFFIC TO THE RESIDENCE.
FOR ANY NEIGHBORS IN HERE WE CAN ADDRESS THE PARKING RESTRICTIONS LATER ON. WE WILL KEEP AN EYE ON THAT.
I DON'T THINK THE LIONS CLUB PARKING LOT IS APPROPRIATE FOR THE VALET PARKING FOR THIS AREA.
I DON'T THINK THEY ARE GOING TO USE THAT.
IT DOESN'T MAKE SENSE BUT IF WE WILL KEEP AN EYE ON THIS PLEASE LET US KNOW HOW THE PARKING IS HAPPENING AND IF WE NEED TO TAKE ADDITIONAL ACTION TO RESTRICT PARKING IN THE AREA WE WILL DO THAT. I WILL SAY TO MY FELLOW COUNSELORS HERE, WE WILL PROBABLY RUN INTO A SIMILAR SITUATION WITH HIGH SCHOOLERS PARKING IN THIS BUSINESS PARKING LOT. WE ARE PROBABLY GOING TO HAVE TO DEAL WITH THAT DOWN THE ROAD, SOMETHING TO KEEP AN EYE ON FOR THAT I WILL SUPPORT THIS TONIGHT BUT I WANT US TO KEEP AN EYE DOWN THE ROAD BECAUSE IF PARKING BECOMES A PROBLEM WE
ARE GOING TO HAVE TO ACT. >> WILL THAT PARKING LOT NOT BE PRIVATE PROPERTY? THEY CAN RESTRICT THAT ON THEIR
OWN? >> THEY WILL BE ABLE TO RESTRICT IT. IT IS GOING TO BE A PRIVATE LAW WITH A DECLARATION RECORDED TO KEEP A PORTION OF IT PUBLIC.
WHICH IS DIFFERENT THAN THE LAW THE COUNCIL CAN JUST MAKE ANY RULE REGARDING. IT IS SLIGHTLY DIFFERENT.
>> IT MEANS THEY CAN'T RESERVE A CERTAIN NUMBER OF SPACES?
>> ANYONE IN THE PUBLIC COULD PARK WITHOUT A RESTRICTION.
[00:20:07]
WE ASKED THE MEETING ABOUT THAT.>> THE DEVELOPER IS ALLOWED TO HAVE REASONABLE RULES IN PLACE RELATED TO THE PARKING LOT. SUNDAY FIVE PERCENT WILL BE OPEN TO THE GENERAL PUBLIC ON A FIRST-COME FIRST-SERVED BASIS.
>> THE DEVELOPER CAN MAKE RULES WHEN IT COMES HIGHSCHOOLER PARKING WITHOUT PASSING AN ORDINANCE.
WE CAN DEAL WITH IT THAT WAY. >> YES.
>> I HAVE NOT HEARD A SECOND YET.
>> I HAVE MULTIPLE ANY OTHER DISCUSSION?
COUNSILOR FINKAM? >> I KNOW THERE WAS ONGOING DISCUSSION ABOUT PARKING AND I THINK THERE ARE CONVERSATIONS THAT CONTINUE AND WE CAN DO THAT WITH ENGINEERS AS WELL.
I COMMEND THE COMMITTEE GETTING THIS BACK TO US TO VOTE ON AND
I'M IN SUPPORT OF IT TONIGHT. >> ANY OTHER?
[14. NEW BUSINESS (Part 1 of 2)]
PLEASE VOTE THAT IS EIGHT Ã ZERO.MOVING ON AS I FIND 14 A. RESOLUTION CC 11 Ã21 FEBRUARY 2, 2002 RESOLUTION OF COMMON COUNCIL OF THE CITY OF CARMEL INDIANA TO LIMIT THE RATE FOR TAXES PAYABLE IN 2022 AND AUTHORIZED NECESSARY TEMPORARY BORROWING AMONG CITY FUNDS SPONSORS ARE COUNSILOR WORRELL, COUNSILOR AASEN AND COUNSILOR
FINKAM. >> THIS IS A RESOLUTION FINDING THE CITIES 2023 CAPRI TAX RATE SHOULD NOT EXCEED 0.7877 WHICH IS THE SAME AS 2022 RATE RECOMMENDING HOW THE DEAL JEFF SHOULD ALLOCATE THE 2023 PROPERTY LEVY AMONG CITY BONDS AND PERMITTING TEMPORARY BORROWING AMONG FUNDS DURING 2023. THIS WAS REORDERED BASED ON THE DISCUSSON AT COMMITTEE REGARDING THE LEVY APPEAL THAT IS NEXT ON OUR AGENDA. AND THE COMMITTEE WORKED ON THIS AND HER TESTIMONY FROM KURT COONROD WHICH IS OUR FISCAL CONSULTANT ABOUT A $420,000 BENEFIT BY REQUESTING THE LEVY APPEAL. IN ESSENCE DON'T KNOW IF WE HAVE ANYONE HERE. I GUESS THEY ARE NOT HERE SO I DON'T HAVE TO KEEP GOING. IN ESSENCE WE CAN RECEIVE THE BENEFIT BUT THE COMMITTEE AND THANK YOU TO COUNSILOR FINKAM MADE IT A REQUIREMENT. PART OF THE DISCUSSION THAT WE ABSOLUTELY FREEZE OR HOLD STUDY THE TAX RATE.
THE AMENDMENT WAS MADE TO AMEND THE LEVY APPEAL AND I WILL GET INTO THAT WHEN WE DO WHAT THAT THIS IS ABOUT THE TAX CAP, KEEPING IT AT 77 SEVEN. I DON'T SEE ANYONE TO SPEAK TO THAT DO YOU HAVE ANY COMMENTS COUNSILOR FINKAM?
>> NO. THANK YOU YOU DID A GREAT JOB.
>> IT IS STRAIGHTFORWARD. WE WILL KEEP THE RATE AT THE SAME AMOUNT AND IF WE DO SO THAT MAKES THE NEXT ONE WOULD
TAKE MUCH EASIER. >> WHEN WE MAKE A MOTION THAT SHOULD BE AS AMENDED IN COMMITTEE.
>> FOR THAT ONE YES. THIS ONE WE ARE GOING TO VOTE ON THIS RESOLUTION. I WOULD MAKE A MOTION WE ACCEPT RESOLUTION CC Ã11 Ã211 Ã22 Ã 02.
>> SECOND. >> ANANY DISCUSSION?
[12. OLD BUSINESS (Part 2 of 2)]
THAT IS A ÃZERO AS I JUMP AROUND IN ORDER.NEXT WE HAVE ÃTHIS IS WHERE WE HAD THE DISCUSSION ABOUT THE LEVY APPEAL WHICH IS FOR THE UNDERPAYMENT OF TAXES AND THE FOREIGN $20,000 THAT WOULD COME IF WE DEALT WITH THIS AND WERE SUCCESSFUL WITH THE DEAL JEFF WHICH ARE CONSULTANTS BELIEVE WE WOULD BE. HOWEVER THERE WAS THE ORIGINAL
[00:25:06]
PROPOSAL THAT WAS BASED ON THE AMOUNT OF 1.8 MILLION.THE COMMITTEE WAS DEFINITELY NOT IN FAVOR OF THAT.
THE AMENDMENT WAS PROPOSED THAT WE REDUCED THE AMOUNT OF THIS LEVY APPEAL FROM 1.8 MILLION DOWN TO 420,000.
WITH THE UNDERSTANDING THAT THE SEPARATE RATE RESOLUTION WOULD BE CREATED TO CAP THE RATE AT .7877.
WE HAVE NOW DONE THAT. THIS RETURNS TO THE COUNCIL WITH A POSITIVE RECOMMENDATION ON A VOTE OF THREE ÃONE.
>> DID I HEAR A MOTION? >> I WOULD MAKE A MOTION WE ACCEPT THE AMENDED, THE AMENDMENT AS RED.
>> I SECOND. >> ANY DISCUSSION? PLEASE VOTE. I HAVE EIGHT ÃZERO.
>> NOW I WOULD MOVE WE ACCEPT CC 10 Ã17 Ã22 Ã02.
[13. PUBLIC HEARINGS]
WE ARE MOVING ON. PUBLIX HEARINGS.I DON'T KNOW IF YOU CAN MOVE AND GIVE ME MORE OF MY MAPS.
BEFORE THE COMMITTEE MET TO APPROVE THIS MAP AND I'VE SHOWED YOU THIS PUBLICLY ON TWO DIFFERENT OCCASIONS.
I ALSO HAVE THE PREVIOUS MAP WHICH WE CAN COMPARE TO.
IN ESSENCE THIS MAP MET ALL THE QUALIFICATIONS CRITERIA WE ESTABLISHED INCLUDING A DEVIATION OF FIVE PERCENT.
KEEPING THE DISTRICTS AS CLOSE TO THE ORIGINAL MAP AS POSSIBLE MAKING THEM AS EVEN AS POSSIBLE BUT AS WE KNOW THERE WAS DISCUSSION ABOUT THE SOUTH-CENTRAL DISTRICT.
THERE WERE TWO ISSUES THAT CAME UP IN THE SOUTH-CENTRAL, THAT WAS THE FACT THAT COUNCIL GREEN WAS LOSING TO PRECINCTS HE PREVIOUSLY REPRESENTED AND COUNSELOR GREEN AND I HAVE CONVERSATIONS PRIVATELY AS WELL AS IN COMMITTEE AND I APPRECIATE HIS ACKNOWLEDGMENT ABOUT THE NUMBERS ARE WHAT THE NUMBERS ARE. I BELIEVE HE IS GOING TO ASK QUESTIONS TONIGHT BUT ALSO TO RESIDENTS ALONG WITH SPOKE AT THE COMMITTEE MEETING REGARDING THE NAME OF THE SOUTH-CENTRAL.
JUST WANTED TO SPEND A MOMENT TO EXPLAIN WHAT WE WERE TRYING TO DO. TYPICALLY IN INDIANA, THE DISTRICTS ARE NUMBERS. WHICH IS NOT VERY HELPFUL WHEN YOU'RE TRYING TO DESCRIBE SOMEONE WHAT AREA YOU REPRESENT OR WHOSE DISTRICT THEY ARE IN. WE MADE IT A POINT TO COME UP WITH DESCRIPTIVE NAMES. THERE WAS NO ILL WILL.
ABOUT CALLING COUNSILOR GREEN'S DISTRICT SOUTH-CENTRAL BUT ONE ID TAKE, DID NOT LIKE THAT NAME FOR NEGATIVE REASONS AND THEN A COUPLE OTHER RESIDENTS SPOKE ABOUT THE FACT THAT SOUTH-CENTRAL WAS NOT DESCRIPTIVE ENOUGH OF THE AREA. MIKE COMMENTED THAT IS, AND I SAID THEN GIVE ME SOMETHING ELSE.
WHAT WOULD YOU CALL IT? I HAVE RECEIVED NOTHING AND I DON'T KNOW HOW WE WOULD DESCRIBE THIS AREA ANY DIFFERENTLY. I WOULD ALSO SAY THAT THE DESCRIPTION OF MY COUNSEL DISTRICT HAS NOTHING TO DO WITH THE COMPREHENSIVE PLAN. WITH PLANNING ZONING.
THIS IS A POLITICAL DESCRIPTION TO TRY AND HELP AND WE HAVE SPECIAL COUNSELOR BOSMA WHO WILL CORRECT ANYTHING I SAY.
MY UNDERSTANDING IS WE ARE TRYING TO BE AS DESCRIPTIVE ABOUT THE LOCATION OF WHERE THE SPECIFIC COUNSELOR REPRESENTS.
[00:30:07]
IT DOES STRADDLE TWO DIFFERENT AREAS OF OUR COMMUNITY.I UNDERSTAND THAT BUT THERE IS REALLY NO VALUE TO THE NAME OTHER THAN HELPING PEOPLE UNDERSTAND WHERE THEY LIVE AND WHAT DISTRICT THEY FALL IN. WITH THAT I KNOW WE HAVE TO HAVE A PUBLIC HEARING AT THE CLOTHES OF THE PUBLIC HEARING I WOULD LIKE TO MAKE A MOTION TO APPROVE.
I DON'T KNOW IF ANYONE HAS ANY QUESTIONS FOR ME BEFORE I SIT DOWN. IF WE ARE GOING TO HAVE SPEAKERS I WILL LEAVE THIS UP HERE TO HELP ANY OF OUR
SPEAKERS. >> I'M GOING TO OPEN THE PUBLIC HEARING AT 6:31:50. ANYBODY WISHING TO SPEAK PLEASE JOIN US AT THE MICROPHONE. DON'T ALL RUSH THERE AT ONCE.
I'M GOING TO CLOSE THE PUBLIC HEARING AT 631 AND 15 SECONDS.
>> MR. PRESIDENT I WOULD MAKE A MOTION, IS THERE A DISCUSSION?
>> MR. BOSMA WOULD YOU JOIN US AT THE MICROPHONE?
>> I MAKE MY MOTION WE CAN HAVE A DISCUSSION.
>> YOUR MOTION IS MADE. >> COUNSILOR GREEN?
>> THANK YOU MR. PRESIDENT I WANTED TO FOLLOW UP ON SOME QUESTIONS. THIS DISTRICT PLAN MEETS THE CRITERIA THAT THE COUNCIL VOTED ON WITHIN THE GUIDELINES.
WITH THE NEW DISTRICTS. CAN YOU WALK ME THROUGH THE 10 PERCENT REQUIREMENT FOR DEVIATION? THE IMPORTANCE OF THE 10 PERCENT AND THE IMPORTANCE OF
THE FIVE PERCENT RULE? >> YES HAPPY TO DO SO BRIAN BOSMA WITH LAW FIRM WE WERE ENGAGED AS SPECIAL COUNSEL WHICH COUNSILOR WORRELL SPECIAL COUNSEL TO ASSIST AND MAPMAKING FOR YOUR DISTRICTS AS WE WERE IN 2018.
IT'S BEEN MY PLEASURE TO WORK WITH THE REDISTRICTING COORDINATOR AND A LOT OF YOU TO PUT THE PROPOSAL BEFORE YOU TONIGHT. COUNSILOR GREEN THE 10 PERCENT RULE SHOULD BE ENCLOSED. THAT IS REALLY A BURDEN OF PROOF EVIDENTIARY RULE. IF SOMEONE CONTESTS A MAP AND SAYS THIS POPULATION IS NOT AS EQUAL AS IS POSSIBLE IN THE POPULATION DEVIATION IS LESS THAN 10 PERCENT, THE COURT WILL PRESUME THAT IT IS AS EQUAL BUT IT IS A REBUTTABLE PRESUMPTION.
IT IS INCUMBENT ON THE PERSON BRINGING ACTION TO OVERCOME THAT PRESUMPTION. IT'S LIKE A PRESUMPTION OF INNOCENCE THAT HAS TO BE OVERCOME BY EVIDENCE ALTHOUGH IT IS NOT BEYOND A REASONABLE DOUBT.
IT IS A SCINTILLA OF EVIDENCE IN FAVOR OR AGAINST SO 10 PERCENT, PEOPLE HEAR THE 10 PERCENT AND I GET THIS ALL THE TIME. I THINK I SHARED AT THE COMMITTEE, WROTE AN ARTICLE A FEW YEARS AGO FOR THE NOTICEABLE LAWYERS ASSOCIATION ABOUT REDISTRICTING AND THERE'S A SECTION CALLED BEWARE OF THE 10 PERCENT RULE.
THE 10 PERCENT RULE DOES NOT MAKE A MAP LEGAL.
THE FIVE PERCENT IS NOT IN MAGIC NUMBER EITHER.
IT IS A NUMBER THAT WE HAVE ESTABLISHED AS A RULE OF THUMB TO TRY TO MEET YOU CAN'T ALWAYS MEET IT WITHOUT SPLITTING PRECINCTS. THIS YEAR WE'VE HAD, WE'VE BEEN SUCCESSFUL WITH NEARLY 20 COMMUNITIES WE'VE WORKED WITH BRINGING THE TOTAL DEVIATION WHICH IS ADDITION OF THE HIGHEST NUMBER DISTRICT BY PERCENT AND THE LOWEST NUMBER DISTRICT IN THE VICINITY OF FIVE.
ONLY NOT MEETING THE ON ONE MAP AND THEY DID NOT WANT TO SPLIT PRECINCTS. COUNSILOR WORRELL DID A GOOD JOB OF MENTIONING THE ADDITIONAL GOALS HE ESTABLISHED FOR THE DRAWING OF THIS MAP. I WILL ADD ONE AND THAT WAS ATTEMPTING IF POSSIBLE TO LEAVE EVERY INCUMBENT IN A DISTRICT WITHOUT TWO TOGETHER. THERE WAS A CHANCE LENT BECAUSE COUNSELORS GREEN AND CAMPBELL CAN THROW SOFTBALLS BETWEEN OUR HOUSES AND COUNSELOR NELSON IS WEST OF COUNSELOR GREEN.
THE MAP BEFORE YOU MEETS ALL THOSE GOALS MAINTAIN THE CORE DISTRICTS AND THE PURPOSE IF THAT IS TO PROMOTE COME TO ATTEMPT TO DETER CONFUSION BY BOTH COUNSELORS AND BY YOUR CONSTITUENTS. I WHOLE NEW DISTRICT GRANTED
[00:35:02]
COUNSELOR GREEN YOU LOST TO PRECINCTS.THE GENERAL CORE OF YOUR DISTRICT IS KEPT TOGETHER SO THE THOUGHT BEHIND THAT IS TO TRY TO LIMIT CONFUSION BOTH OF WHO THE HECK IS MY COUNSELOR NOW AND WHY AM I OVER HERE? ALSO COUNSELORS ARE ABLE TO EXPLAIN THEIR DISTRICTS AS THEY HISTORICALLY ARE. DURING MY 35 YEARS OF SERVICE I HAD TO COME I WASN'T ALWAYS ON TOP OF A CHANGE IN THE DISTRICT AS TO WHETHER I REPRESENTED A NEIGHBORHOOD OR NOT SO I HAD TO BE ON TOP OF THAT AS YOU DO. NOT PLEASING TO COUNSELORS IN THE SAME DISTRICT AND NOT SPLITTING PRECINCTS WHICH IS A GOOD THING AND HAVING A DEVIATION NO GREATER THAN FIVE PERCENT THAT'S ACHIEVED BY THIS MAP.
I'M HAPPY TO ANSWER ANY OTHER QUESTIONS.
>> THANK YOU FOR THAT EXPLANATION.
I THINK I SHARED IN THE COMMITTEE I WAS LOOKING AT TRYING TO FIGURE OUT HOW TO MAKE THE MATH WORK BELOW FIVE PERCENT THE ONLY WAY I COULD GET THERE IS MASSIVE RESTRUCTURING OF THE ENTIRE WHICH IS TOUGH TO DO ONSHORE-TERM. AND HAVE IT IMPACT THE REST OF THE COUNSELORS. THE ONLY PLAN I SAW WITH MINIMAL IMPACT TO ANYBODY WAS THE PLAN OR PROPOSAL SHARED AT THE COMMITTEE AND I THINK DURING THE FIRST COUNCIL MEETING OF SOMEWHERE AROUND 7.3 PERCENT.
7.26 PERCENT. WHEN WE TALK ABOUT THE STANDARDS, NOT NECESSARILY LAW BUT THE RULE OF THUMB 10 PERCENT AND FIVE PERCENT, HOW DOES 7.26 COMPARED TO FIVE PERCENT? THE RISK? IS IT A RISK CALCULATION BY THE CITY COUNCIL? CAN YOU SHARE WHAT THE DIFFERENCE IS BETWEEN THE TWO?
>> I THINK THAT'S A FAIR WAY TO STATE IT COUNSILOR GREEN IT IS A RISK DETERMINATION IF YOU WERE TO ADOPT A 7.6 IT CERTAINLY WOULD NOT BE IMMEDIATELY SOMETHING THAT WE MADE A HORRIBLE MISTAKE HERE. IT WOULD HOWEVER, PROVE THE FIRST ELEMENT THAT SOMEONE WOULD HAVE TO PROVE TO OVERTURN A MAP WHICH IS IT IS NOT AS EQUAL AS IS POSSIBLE BECAUSE YOU PUBLICLY SHARED AND PUT ON THE RECORD A MAP WITH A LOWER PERCENTAGE DEVIATION THAN THE ONE THAT WAS PRESENTED.
YOU COULD DO THAT IN ESTABLISHED REASONS IN THE ORDINANCE AND THAT'S WHAT THE RECITAL CLAUSE IS AND THEREFORE COULD SOMEONE FROM THE PUBLIC SUBMITTED IN A TIMELY FASHION A LOWER DEVIATION MAP AND THE COUNSELOR WANTS TO PROCEED WITH THE ONE BEFORE YOU NOW, WE WOULD HAVE ADDED SOME ADDITIONAL CONFIRMATORY LANGUAGE AS TO CONCISELY WHY THAT WAS BEING DONE. THE GENERAL LANGUAGE IS PRESENT KEEPING THIS DISTRICT TOGETHER. IN THE ORIGINAL DISTRICT
TOGETHER. >> I HAVE A MOTION AND I'M
LOOKING FOR A SECOND. >> SECOND.
>> ANY DISCUSSION? PLEASE VOTE.
THAT IS SEVEN ÃONE. >> NEXT WE HAVE FIRST READING OF ORDINANCE D 2650 22 ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL INDIANA VACATING THE EASEMENT WITHIN THE OLD MERIDIAN AND REDEVELOPMENT PROJECT.

>> MOVED TO INTRODUCE. THIS ORDINANCE UPDATES REFERENCES TO CERTAIN STREET TYPES AND RELATED DEFINITIONS IN THE UNIFIED DEVELOPMENT ORDINANCE TO MATCH THE STREET TYPOLOGIES AND THOROUGHFARE PLAN PRESCRIBED IN THE UPDATED CARMEL COMPREHENSIVE PLAN. WE HAVE ADRIAN TO PROVIDE SOME DETAILS.
>> THANK YOU COUNSELORS I'M ADRIAN KEELING WITH THE DEPARTMENT OF COMMUNITY SERVICES.
I SENT YOU A 12+ PAGE DOCUMENT THAT IS REALLY SIMPLER THAN A 12 OR SO PAGE DOCUMENT. WHAT WE NEED TO DO NOW THAT THE COMPREHENSIVE PLAN IS MOSTLY ALMOST SETTLED IS TO MAKE SOME COMPANION AMENDMENTS AND THE UNIFIED ORDINANCE BASED ON THE THOROUGHFARE PLAN STREET TYPE CHANGES.
YOU MAY RECALL THAT IN THE C3 PLAN WE HAD ABOUT 10 DIFFERENT ST. TYPES MAPPED ON THE C3 PLANTS THOROUGHFARE PLAN MAP.
AND WITH THIS NEW PLAN WE HAVE CONSOLIDATED THAT DOWN TO 5 DIFFERENT ST. TYPES LISTED ON THE MAP WITH A FEW OTHERS THAT ARE ADDITIONAL DEVELOPMENT OPTIONS BUT ARE NOT MAPPED.
PIN THE UNIFIED DEVELOPMENT ORDINANCE AND YOU WILL SEE SEVERAL PAGES AND I WON'T READ ALL OF THESE, I WILL GIVE YOU A COUPLE EXAMPLES. IN VARIOUS SECTIONS THROUGHOUT THE DOCUMENT THERE ARE INSTANCES WHERE SPECIFIC STREET TYPES ARE EITHER REFERENCED OR DIFFERENTIATED WITH DIFFERENT DEVELOPMENT STANDARDS BASED ON THE STREET TYPE.
WHETHER IT IS THE KILLER TRANSLOCATION AND THE HOMEPLACE OVERLAY DISTRICT OR STANCES WHERE PRIMARY RY PARKWAY WHICH IS NOW KNOWN AS KEYSTONE PARKWAY IS REFERENCED IN THE ORDINANCE, WE NEED TO CLEAN UP THOSE REFERENCES AND DEFINE THE DEVELOPMENT ORDINANCE TO MAKE SURE WE ARE CARING AT THE SAME STANDARDS WE HAD UNDER THE PREVIOUS MAP.
I WOULD BE HAPPY TO TAKE SPECIFIC QUESTIONS ABOUT HOW ANY OF THIS AFFECTS DEVELOPMENT STANDARDS HOWEVER THE INTENT IS THAT THOSE DEVELOPMENT STANDARDS CARRYFORWARD.
WE'VE GOT TO CLEAN UP THOSE DISCREPANCIES BETWEEN THE NAMES AND UNIFIED DEVELOPMENT ORDINANCE AND THE NEW THOROUGHFARE PLAN MAP. THIS COMES TO YOU WITH A FAVORABLE RECOMMENDATION FROM THE CARMEL PLAN COMMISSION.
>> ANY QUESTIONS? WHAT IS THE DESIRE OF THE COUNCIL? COMMITTEE OR SUSPENSION OF THE

>> I BELIEVE WE HAVE JUST DONE THAT.
WE HAVE A MOTION AND A SECOND TO SUSPEND THE RULES.

THIS EVENING. >> ANY DISCUSSION?
>> MR. PRESIDENT, THESE FUNDS WILL STILL BE CONSIDERED AND USED IN 2022 AND THEN WE WILL HAVE A NEW FUND IN 23 OR HOW
DOES THAT WORK? >> THIS FUND IS A NONREPORTING ONE SO THE 50,000 CARRIES OVER AND DOES NOT GO AWAY.
IT WILL BE 50,000 IN THE BOND UNTIL WE ADD MORE TO IT OR TAKE
FROM IT. >> WHEN WE STARTED THIS I REMEMBERED OUR TARGET WAS 50 A YEAR.
WHAT I'M TRYING TO UNDERSTAND IS WE MUST HAVE USED ALL OF THAT. MY BETTER QUESTION IS DID WE USE 50 IN 2022 OR WAS THERE SOME LEFT OVER FROM THE
PREVIOUS YEAR? >> THERE WAS SOME LEFT OVER.
WE ARE FUNDING IT FOR NEXT YEAR AND PERHAPS BEYOND.
THE FIRST YEAR THAT WASN'T AS MUCH ACTIVITY AROUND THE SECOND YEAR THERE'S MUCH MORE. I DON'T HAVE THE EXACT NUMBERS

EIGHT ÃZERO AND WE ARE MOVING ON.
FIRST READING OF ORDINANCE D-2646-22; AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 8, ARTICLE 2, SECTION 8-8 OF THE CARMEL CITY CODE; SPONSOR(S): COUNCILOR(S) WORRELL AND FINKAM.
>> MOVED TO INTRODUCE. ORDINANCE AMENDING THE SETTING
OF STREET SIGNS STANDARDS. >> COUNSELOR BENJAMIN THANK YOU. THIS IS A MAN'S CITY CODE EIGHT ÃEIGHT IT IS UNUSUAL TYPE OF CODE.
BASICALLY IT SETS THE STANDARDS FOR STREET SIGNS WHEN STREETS ARE BEING DEDICATED. AND WHAT THE SIGNS ARE TO CONFORM WITH OR IF THE SIGNS ARE BEING MAINTAINED BY A ENTITY OR ORGANIZATION THAT IS NOT THE CITY.
THIS IS A OLDER ORDINANCE AND THE STANDARDS THAT MAINTAINED BY THE CITY HAVE CHANGED. IN THAT TIMEFRAME.
THIS WAS BROUGHT TO THE CITY'S ATTENTION BY ENGINEERING TO HAVE AN UPDATE TO THE STANDARDS SO THEY REFLECT THE CURRENT STANDARDS WE HAVE IN PLACE FOR ALL THE STREETS.
WHAT THIS AMENDMENT PROPOSES TO DO IS TO SET A STANDARD THAT IS OBVIOUSLY ONE THAT EVOLVES. TO KEEP COMING BACK TO THE COUNCIL TO CHANGE IT IS TO SET THE STANDARD THAT IS CURRENTLY IN PLACE AS WAS AMENDED FROM TIME TO TIME.
BY THE CITY ENGINEER WITH THE GUIDANCE OF THE INDIANA MANUAL UNIFORM TRAFFIC CONTROL DEVICES FOR THIS COUNSEL TO AMEND THE ORDINANCE SO IT DOESN'T HAVE TO COME BACK.
>> ANY QUESTIONS? ANY DESIRES?
>> MR. PRESIDENT? >> COUNSILOR FINKAM? WE SUSPEND THE RULES AND ACT THIS EVENING.
>> MOVED TO APPROVE. >> ANY DISCUSSION? PLEASE VOTE. BENJAMIN YOU CAN JOIN US AGAIN.

WORRELL AND FINKAM. >> MOVED TO INTRODUCE? ORDINANCE AMENDING SPEED LIMIT(S) ON CITY STREET(S), SPECIFICALLY IVY RIDGE DRIVE, KINGS GREAT JOB, NEW CASTLE DOCTOR AND WOOLFORD WAY. BENJAMIN?
>> THANK YOU COUNSEL. THIS ADDS FOR STREETS 28 Ã20 WHICH IS 25 MILE AN HOUR LIMITS.
IT WAS DETERMINED BY THE ENGINEERING DEPARTMENT THAT WE DID NOT HAVE SIGNS ON THE STREETS AND THEY WERE NOT
[00:55:02]
INCLUDED UNDER CITY CODE SO THEY WERE DEFAULTED TO THE STATE STATUE. IT WAS THE DEPARTMENTS RECOMMENDATION THESE BE 25 MPH STREETS TO BE INSTALLED AND THEREFORE WE ARE REQUESTING THEY BE ADDED TO THE EIGHT Ã20CITY CODE THIS EVENING. >> COUNSELOR HANAN?
>> QUESTION? IF THERE IS NO POSTED SPEED LIMIT WHAT WOULD IT BE IF IT WAS NOT DESIGNATED BACK.

>> MOVED TO INTRODUCE. >> SECOND.
AMENDS THE DEFINITION OF B THAT ONLY PERMANENT PUBLIC ART ACQUISITIONS WILL BE SUBJECT TO REVIEW BY THE CARMEL PUBLIC ART ADVISORY COMMITTEE.
>> I WANT TO MAKE SURE THAT I CREDIT COUNSILOR CAMPBELL WHO IS A SPONSOR ON THIS ALSO. I WAS ASLEEP AT THE SWITCH AND I NEED TO PULL IT UP QUICKLY. THIS IS A TIGHTENING UP OF THE ORDINANCE AND TRYING TO GET A LITTLE MORE DIRECTION PER REQUEST BY THE COMMITTEE. THE LEGAL TEAM HAS ADDED SOME LANGUAGE WHICH IS PRETTY DARN SIMPLE.
I'M GOING TO READ IT TO YOU IF I CAN GET TO IT QUICKLY.
BUT MAYBE NOT. IN ESSENCE CREATING LANGUAGE THAT DEFINES ART AS BEING PERMANENT.
AND DOES NOT INCLUDE ART THAT IS GUIDED BY OR DISPLAYED BY TV OR SPEAKERS OR THAT KIND OF THING.
THAT IS REALLY WHAT THIS IS ALL ABOUT.
I RECOMMEND WE SEND THIS TO COMMITTEE.
>> IT IS HEADED TO FINANCE. NEXT WE HAVE RESOLUTION CC-11-21-22-03: A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, APPROVING A TRANSFER OF FUNDS BETWEEN THE 2022 COMMON COUNCIL BUDGET AND THE NON-REVERTING SIDEWALK PROGRAM FUND (FUND #925); SPONSOR(S): OUNCILOR(S) RIDER AND FINKAM.
>> MOVED TO INTRODUCE. >> COUNSILOR FINKAM?
>> THE TITLE EXPLAINS THAT THIS IS THE OTHER HALF OF THE PROCEDURE THAT HAS TO MOVE THE MONEY FROM THE COUNCIL BUDGET TO THE PROGRAM FUNDS. TRANSFERS $50,000 FROM LINE ITEM 4122000 ÃCITYB HEALTH INSURANCE WITHIN THE 2022 COMMON COUNCIL BUDGET INTO THE NON-REVERTING SIDEWALK PROGRAM FUND (FUND #925) IN ORDER TO FUND THE CARMEL SIDEWALK GRANT PROGRAM. >> I WOULD MOVE WE ACT THIS EVENING.
>> IS THAT I MOVED TO APPROVE? >> SECOND.
>> ANY DISCUSSION? PLEASE VOTE.
THAT IS EIGHT ÃZERO. AGENDA ADD-ON ITEMS.
[16. OTHER BUSINESS]
NONE OF THEIR BUSINESS. APPROVAL OF CRC PURCHASE OF 311[01:00:03]
W MAIN STREET. >> GOOD EVENING CITY COUNCIL HENRY THE DEVELOPMENT DIRECTOR. THE PROPERTY WE ARE TALKING ABOUT IS HIGHLIGHTED IN RED ON THE SCREEN.
IT IS BEING PURCHASED FOR THREE AND 46,000 WHICH IS THE AVERAGE OF TWO APPRAISALS. I HUMBLY REQUEST THIS COUNSEL WISHES TO VOTE POTENTIALLY ON THIS GHT.
THE PURCHASE AGREEMENT WAS D OCTOBER 11.
A LOT OF TIME HAS PASSED. THIS IS CLEARLY A PROPERTY THAT IS IMPORTANT TO A CONTINUATION OF ART AND DESIGN DISTRICT.
THIS IS ALSO ONE OF THOSE THINGS A PRIVATE DEVELOPER IS NOT LIKELY SPENDING THE EFFORT AND TIME IT TAKES TO AGGREGATE MULTIPLE PARCELS THIS IS THE KIND OF THING THE REDEVELOPMENT COMMISSION COULD DO. THERE IS NOT A PLAN FOR THIS TODAY. BUT IT MAKES SENSE FOR US TO CONTINUE AGGREGATING SOME OF THESE UNDERUSED PARCELS RIGHT ON MAIN STREET. THE ROUNDABOUT IS THE ENTRANCE TO THE ARTS AND DESIGN DISTRICT ESSENTIALLY.
ALL AROUND THE PARCEL IS FIRST FLOOR COMMERCIAL RETAIL.
THAT IS A BLOCK THAT IS SOME OF THE OLDER HOMES.
I'M HAPPY TO ANSWER ANY QUESTIONS THE COUNCIL WOULD
COUNSILOR WORRELL? >> MAY BE AN OBVIOUS QUESTION.
WHEN YOU ARE AGGREGATING ALL OF THESE OWNERS ARE WILLING TO SELL OR WANT TO SELL? THERE'S NO IMMINENT DOMAIN INVOLVED HERE? THERE IS NO GOVERNMENT OVERREACH. YOU SIMPLY HAVE WORKED OUT A
DEAL WITH EACH OF THESE OWNERS? >> THAT IS CORRECT.
>> ANY OTHER COMMENTS OR QUESTIONS?
>> AGAIN, PER THE RULES OR ORDINANCE OR STATUTE, TELL EVERYONE WHY THIS IS AT THE END OF OUR AGENDA AND THERE'S NO ORDINANCE OR RESOLUTION. WHAT IS GOING ON HERE?
>> YOU ARE RIGHT EYE APOLOGIZE FOR NOT STATING THAT GENERALLY IF A PROPERTY IS BEING PURCHASED AT THE AVERAGE OF TWO APPRAISALS WHICH NEVER HAPPENS, I JUST WANT TO SAY THAT, VERY RARELY DOES THE DEAL GET STRUCK AT THAT TWO APPRAISALS.
USUALLY IT IS A VOTE AT THE REDEVELOPMENT COMMISSION LEVEL.
THE FUNDS FOR THIS COME FROM ITS 121 TO BOND IN THE COUNCIL PUT IN A REQUIREMENT THAT ANY PROPERTY ACQUISITION OVER $50,000 ALSO COME BEFORE THE COUNCIL FOR APPROVAL AS WELL.
IT IS A REALLY GOOD DEAL FOR THE CITY TO BE PRODUCING THIS AT THE AVERAGE OF TWO APPRAISALS.
WHETHER IT IS SOONER OR LATER, THIS IS A CONTINUATION OF OUR MAIN STREET, THE SPECIFIC PIECE OF PROPERTY.
>> COUNSILOR AASEN? >> THANK YOU R. PRESIDENT I JUST WANT TO MAKE ONE MMENT. I UNDERSTAND IT IS DIFFICULT WHEN YOU'RE TRYING TO STRIKE DEALS TO HAVE THESE IN PUBLIC BUT I THANK YOU FOR DOING THIS AND I THINK IT'S BEST FOR PUBLIC TRANSPARENCY FOR EVERYONE TO KNOW WHAT THE CITIES VISION IS TO EXTEND THE AREA.
I SUPPORT THE PURCHASE OF THIS, NOT ONLY IS IT IMPORTANT ASSET BUT ASSET THAT RETAINS THE VALUE IF FOR SOME REASON PLANS CHANGE THE CITY WERE TO SELL IT.
NOT SAYING YOU WOULD BUT THERE IS NO RISK TO THE TAXPAYERS THIS WILL HOLD THE VALUE SO IT IS A POSITIVE ALL-AROUND TO PURCHASE THIS. I SUPPORT THIS EVENING AND
THANK YOU FOR BRINGING IT HERE. >> COUNSEL HANNAH?
>> DIRECTOR WHAT IS THE PLANS BECAUSE THIS IS PART OF THE AGGREGATION IN THE INTERIM IS THIS A RESIDENCE RIGHT NOW? WILL IT BE LEASED OR KNOCKED DOWN? WHAT WILL HAPPEN IN THE MEANTIME? YOU SAID THERE IS NO PLAN SPECIFICALLY TODAY FOR THIS
PARCEL. >> THERE IS A TENANT IN THERE
[01:05:02]
RIGHT NOW. ONE OF THE THINGS WE WORK DOWN IS, IF COUNCIL APPROVES THE PURCHASE, THE TENANT WILL GET THE STATE FOR HALF A YEAR AT ESSENTIALLY A DOLLAR.THERE ARE NOT PLANS TODAY BEYOND THAT.
AS FAR AS YOUR SPECIFIC QUESTION.
I CAN'T ANSWER WHAT IS GOING TO HAPPEN.
IS IT GOING TO STAY AS IS OR GET KNOCKED OUT? I DON'T HAVE AN ANSWER TODAY BUT WE KNOW THIS IS AN IMPORTANT PROPERTY TO GRAB WE ALSO WANT TO BE, DO THE RIGHT THING AND NOT KICK ANYBODY OUT ON THE STREET.
>> THANK YOU. >> ANY OTHER COMMENTS OR
QUESTIONS OR DESIRES? >> EVERYBODY RECEIVED DETAILS ABOUT THIS? ABOUT THE AMOUNT AND EVERYTHING
IN THEIR EMAIL. >> THAT'S CORRECT INCLUDING THE PURCHASE AGREEMENT ITSELF. ASK ALL COUNSELORS HAVE THE INFORMATION AND HAVING SAID ALL THAT AND IS A MEMBER OF THE REDEVELOPMENT COMMISSION I WILL ASK THAT WE APPROVE THIS
PURCHASE OF 311 W. MAIN ST.. >> SECOND.
>> ANY DISCUSSION? PLEASE VOTE.
THAT WAS EIGHT ÃZERO. NEXT WE ARE LOOKING FOR SOMEBODY FOR THE AUDIT COMMITTEE.
UNTIL THE PERSON IS FOUND HAMISH CONTINUES TO SERVE UNTIL
