OUR PROGRAMS FOCUS ON FAMILY SERVICE, CHILD WELFARE, WOMEN EMPOWERMENT, AND HEALTH AND EDUCATION. WE ARE COMMITTED TO SERVING HUMANITY IRRESPECTIVE OF RACE, COLOR, GENDER OR NATIONALITY. ONE OF WHICH WAS THE LARGEST AND BUSIEST, SERVING ALL 6000 RUNNERS AND WE DISTRIBUTED SNACKS AS WELL. WE ALSO ENGAGE IN A VARIETY OF ACTIVITIES. WE MANAGE PARKING FOR THE CONCERT SERIES, ASSISTING AT LOCAL FOOD BANKS AND CONTRIBUTING TO MANY MORE OTHER EVENTS ALL

[00:05:01]

THROUGHOUT THE YEAR. AS HELEN KELLER SAID, ALONE WE CAN DO SO LITTLE, BUT TOGETHER WE CAN DO SO MUCH. SEWA BELIEVES THAT BY UNITING OUR EFFORTS WE CAN ACHIEVE GREAT THINGS AND BRING POSITIVE CHANGES TO OUR COMMUNITY. THIS BELIEF DRIVES US TO BE ACTIVE IN MANY COMMUNITY SERVICES, SO YOU WILL SEE US EVERYWHERE. NOW WE WILL TALK ABOUT THE UPPING --

UPCOMING 5K EVENT IN AUGUST. >> HI, I AM A JUNIOR AT CARMEL HIGH SCHOOL AND A PROUD VOLUNTEER OF THE INDIANA DIVISION. PLANNED ON AUGUST 3RD, AT PRATHER PARK, FORMALLY KNOWN AS THE RIVER ROAD PARK. >> THANK YOU. MOVING ONTO ITEM NUMBER 7. COMMENTS AND

[7. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS]

OBSERVATIONS. ANY COMMENTS? >> I JUST HAVE A SHORT STATEMENT I WANT TO SHARE. I WOULD LIKE TO TAKE A MOMENT TO THANK YOU, MAYOR, FOR THE RECENT ACTIONS YOU TOOK IN DEFENDING THE RESIDENTS IN CHESWICK PLACE. BY TAKING LEGAL ACTION LAST FRIDAY AGAINST THE ILLEGAL SHORT-TERM RENTAL YOU HAVE STOOD UP FOR THE COMMUNITY AND I APPRECIATE IT. AS YOU KNOW, OVER THE PAST FOUR MONTHS I'VE WORKED ALONG WITH MY COUNSEL PARTNERS WITH THE H AWAY PRESIDENTS, ADVOCATING FOR THEM ALONGSIDE CODE ENFORCEMENT. MY PASSIONATE EFFORTS MAY HAVE BEEN CONFUSED WITH BEING PERCEIVED AS ADVERSARIAL BUT I AM PASSIONATE ABOUT PROTECTING OUR NEIGHBORHOOD. SO I AM PLEASED THAT THE MAYOR TOOK THE ACTION

AND IT GOT A STRONG RESPONSE. >> AS MANY OF YOU KNOW, I'VE BEEN PROMOTING A CULTURE OF CIVILITY IN CARMEL AND IT IS ONE OF MY TOP PRIORITIES. IN LIGHT OF RECENT EVENTS I URGE US ALL TO LEAD BY EXAMPLE. LET US NOT VIEW THOSE WITH WHOM WE DISAGREE AS ENEMIES OR ADVERSARIES. INDIVIDUALS WITH DIFFERENT PERSPECTIVES WHO DESERVE THE RESPECT TO SHARE THEM PROPERLY. WE SHOULD ALL BE ABLE TO SHARE OUR VIEWPOINTS WITHOUT FEAR OF PENALTY, JUDGMENT, EMBARRASSMENT OR BEING SIDELINED. COLLEGIAL DISAGREEMENT WHEN DONE CORRECTLY IS HEALTHY AND I BELIEVE IT WILL SERVE OUR CITIZENS BETTER IN THE LONG TERM.

>> THANK YOU. ANY OTHER COMMENTS OR OBSERVATIONS? I WOULD JUST ASK THAT WE TAKE A MOMENT OF SILENCE, KIND OF IN A MOVE OF SOLIDARITY AND UNITY FOR WHAT HAPPENED THIS PAST WEEKEND, FOR THE FIREFIGHTER AND THOSE VERTICALLY INJURED.

PLEASE, A MOMENT OF SILENCE. THANK YOU. MAYOR, OBSERVATIONS

OR COMMENTS? >> I AM ARIA WILLIAMSON. I WAS A FIFTH GRADER AT MOHAWK TRAILS ELEMENTARY AND I AM HAPPY TO PRESENT THE MAYOR'S REPORT TONIGHT. THE MAYOR WOULD LIKE TO UPDATE YOU ON OUR FIRE CHIEF SEARCH. THE MAYOR HAS FORMED A COMMITTEE MADE UP OF FIREFIGHTERS AND COMMUNITY MEMBERS. THE CITY HAD 43 CANDIDATES AND 22 REMAINED IN THE PROCESS. THEY ARE WORKING TO NARROW THE LIST TO DO IN

[00:10:05]

PERSON INTERVIEWS AT THE END OF JULY. THEY WILL THEN RECOMMEND FINALISTS FOR THE MAYOR TO INTERVIEW. THEY ARE ALL FOCUSED ON FINDING OUR NEXT GREAT FIRE LEADER. THE MAYOR WOULD LIKE TO THANK THE CARMEL CITY COUNCIL FOR LOOKING AT THE NEW PROJECT PROPOSED FOR RANGELINE ROAD. IT IS A TRUE MIXED-USE PROJECT AND WILL PROVIDE US WITH 63,000 SQUARE FEET OF OFFICE SPACE, WHICH WE DESPERAELY NEED MORE OF IN OUR CITY. FOR HOMEPLACE RESIDENTS WHO MAY BE LISTENING, PLEASE WORK WITH US ON HELPING TO DETERMINE THE OVERLAY ZONE FOR HOMEPLACE. THIS WAS A PROMISE THAT THE COUNCIL PRESIDENT TONY GREEN AND THE MAYOR MADE LAST FALL AND THE MAYOR IS PLEASED TO SEE IT PROGRESSING. THIS THURSDAY IS FOR SOLELY COMMUNITY INPUT. IT WILL BE HELD HERE AT 7:30 A.M. IF YOU CANNOT MAKE IT, WE WELCOME EMAILS WITH YOUR THOUGHTS. THANK YOU.

>> YOU DID A GREAT JOB. >> ANYTHING ELSE, MAYOR? THANK

[10. COMMITTEE REPORTS]

THE AGENDA. MOVING ON TO ITEM 10, FINANCE, UTILITIES AND

THAT'S IF THE RESOLUTION THAT IS BEFORE US COMES TO COMMITTEE, EXCUSE ME, THE ORDINANCE. WE ALSO HAVE BEEN SCHEDULED WITH ENGINEERING THAT THEY WILL HAVE THEIR FINAL SPEED STUDY INFORMATION FOR US FOR THE SEPTEMBER MEETING. I'VE NOTIFIED THE COMMITTEE THAT WE ARE GOOD FOR SEPTEMBER. AND I BET I HAD THE DATE WRONG, IT'S

AUGUST 13TH. THANK YOU. >> MOVING ON TO THE SPECIAL

AND GOT PUT BACK INTO COMMITTEE AND I THINK YOU WILL TAKE ACTION ON THAT. WE GAVE A PRELIMINARY OVERVIEW OF WHAT IT WAS, AND SPECIFICALLY AND OUR NEXT MEETING WILL BE THIS WEDNESDAY AT 5:30 WHERE WE WILL BE DISCUSSING THE TWO ORDINANCES THAT WERE BROUGHT UP AT THE LAST MEETING AND CONTINUING OUR DISCUSSION OF THE UGO.

[11. OTHER REPORTS ]

>> THANK YOU. MOVING ON TO ITEM 11, OTHER REPORTS IN THE CARMEL

REDEVELOPMENT COMMISSION. >> GOOD EVENING. EXECUTIVE DIRECTOR FOR THE CARMEL REDEVELOPMENT COMMISSION. IF I COULD SEE MY PRESENTATION ON THE SCREEN PLEASE. SOMETHING IS HAPPENING. I WILL JUST GO QUICK. I KNOW WE HAVE A FULL AGENDA WITH OTHER ITEMS TO GET TO. BUSY JULY. OUR ATTENDEES AT THE CARMEL'S FARMERS MARKET GOT TO SEE ALL SORTS OF

[00:15:03]

CONSTRUCTION. IT CONTINUES TO BE AMAZING. THAT IS A PROJECT DONE BY TONY THAT YOU WILL HEAR FROM LATER. THERE WILL BE A FINAL PLAZA OPENING CEREMONY WITH THE ROTARY CLOCK. I HOPE EVERY PERSON LISTENING HAS HAD A CHANCE TO CHECK OUT THAT PLAZA AND SIT NEXT TO THE SIR JOHNSON THE STATUE. THAT OFFICE BUILDING IS NOW FULL, FULLY LEASED BY HEADQUARTERS.

MAGNOLIA CONTINUES, LOTS OF PROGRESS ON THE SIGNATURE, MOVING FORWARD. I TALKED ABOUT WHERE THE MAYOR'S COURTYARD IS LOCATED. THE HEADQUARTERS FOR REPUBLIC CONTINUES TO GO UP.

THAT IS ACTUALLY AN OUTDATED PICTURE. THERE HAS BEEN MORE WORK DONE ON THOSE HEADQUARTERS. I CANNOT WAIT FOR IT TO BE OPEN. THE EXTERIOR ARCHITECTURE OF THIS PICTURE IS ALSO OLD BECAUSE NOW WE HAVE BRICK WRAPPED AROUND THE ENTIRE BUILDING EXTERIOR. IT IS REALLY LOOKING GOOD ON THIS PROJECT.

MOVING ALONG REALLY FAST AND I LOOK FORWARD TO HEARING WHAT PERSONAL RETAILERS WILL COME. THAT IS ANOTHER PROJECT DONE BY TONY BROOKLYN AND WE WILL HEAR MORE FROM HIM LATER. THAT IS WHERE THE 1933 LOUNGE IS GOING AND THAT OFFICE BUILDING IS NOW FULLY LEASED BY CORPORATE HEADQUARTERS. AS SOON AS WE HAVE SOMEONE BUILD AN OFFICE BUILDING, IT WILL IMMEDIATELY BE LEASED OUT. WE WANT TO TRY TO ENCOURAGE THAT. I WAS ON FACEBOOK OVER THE WEEKEND AND SAW SOME COMMENTS ON SOCIAL MEDIA WONDERING IF THAT LARGE CEMENT STRUCTURE IS WHAT THE FINAL VERSION OF THAT BUILDING WILL LOOK LIKE. I WANT TO CAUTION EVERYONE THAT NO, THAT IS NOT WHAT THE BUILDING WILL LOOK LIKE. IT WILL HAVE BEAUTIFUL ARCHITECTURE AND A PUBLIC PLAZA AND IT WILL NOT BE A GIANT CONCRETE MONOLITH AS SOME PEOPLE ON FACEBOOK THOUGHT. LOTS OF PROGRESS HAPPENING ALONG THIRD STREET. MOST OF US CAN'T DRIVE THERE, SO WE DON'T KNOW. BUT THIRD IS LOOKING GOOD AND THE CHIEF INFRASTRUCTURE OFFICER IS IN CHARGE OF THAT PROJECT. THIRD AVENUE IS LOOKING AMAZING AND THIS WILL BE ONE OF THE FIRST BUILDINGS ALONG THIRD, ON THE WEST SIDE. THE MERCHANTS BANK EXPANSION AND A MULTI FAMILY BUILDING IS MOVING RIGHT ALONG.

THE TOWNSHIPS PROJECT IS ALSO MOVING FORWARD. THEY ARE WORKING ON THE EXTERIOR ARCHITECTURE NOW AND THE NEXT TIME YOU WALK BY THE BUILDING I URGE YOU TO CHECK IT OUT. IT LOOKS BEAUTIFUL. THIS WILL REALLY BE A LONG TIME ICONIC BUILDING FOR OUR CITY. THANK YOU TO THE TOWNSHIP FOR LEADING THE WAY ON THAT. I HOPE YOU'VE HAD A CHANCE TO CHECK OUT THE NEW TRAILHEAD OR INTERURBAN INTO CENTRAL PARK. THAT IS SOMETHING THAT THE REDEVELOPMENT COMMISSION BUILT FOR THE PARKS DEPARTMENT. NEXT, HOT OFF THE PRESS, YOU ARE THE FIRST TO SEE THIS, THE FARMERS MARKET HAD AN ARTIST COME OUT TODAY AND PAINT SOME BUTTERFLIES AND SUNFLOWERS ON THE CURRENT AND FOR NEXT YEAR'S HOME OF THE CARMEL WINTER'S FARMERS MARKET. NOW PEOPLE KNOW THAT IS THE BUILDING IT IS IN. THE BUTTERFLIES LOOK BEAUTIFUL. I WOULD ENCOURAGE EVERYONE TO CONTINUE ATTENDING OUR PROJECTIONS SHOW THAT RENTS IN THE EVENINGS. IT'S ON THE WEEKENDS AND I THINK IT IS THURSDAY AND FRIDAY. SO PLEASE MAKE SURE YOU GO OUT TO DINNER BEFORE AND SPEND SOME MONEY CARMEL. I AM HAPPY TO ANSWER ANY QUESTIONS AND I LOOK FORWARD TO COMING BACK UP TO TALK ABOUT PROSCENIUM 3 IN A

BIT. >> JUST A QUESTION, I WENT OUT THERE ACTUALLY AND THERE IS NO MUSIC, HAS THAT BEEN CHANGED

NOW? >> I UNDERSTAND THAT THE FOURTH

OF JULY SHOW DID NOT HAVE -- >> THIS WAS A FEW DAYS AGO.

>> IT SHOULD HAVE MUSIC. LET ME TALK TO SOME PEOPLE AND GET

THAT FIXED. >> LAST WEDNESDAY I TOOK PEOPLE OUT THERE AT 10:15 AND THERE WAS NO SHOW.

[00:20:03]

>> LET ME CHECK WITH THOSE SAME SMART PEOPLE. THEY ARE PROBABLY

WATCHING THIS RIGHT NOW. >> I CAN SPEAK TO THAT. THERE WAS A CHANGE, NOT FOR THE FOURTH OF JULY BUT THE REGULAR PALLADISCOPE WHERE THEY WERE RUNNING IT THURSDAY THROUGH SUNDAY IN ORDER TO GIVE THE RESIDENTS IN THE CITY CENTER A BREAK FROM THAT SAME MUSIC. WHAT I WAS GOING TO ASK, I ALSO HEARD THAT THE CITY MODIFY THE HOURS TO BEGIN AT 10:30 INSTEAD OF 11:00. BUT I'M NOT SURE IF THAT IS ACCURATE. YEAH,

THURSDAY THROUGH SUNDAY. >> I WOULD DEFER TO OUR CHIEF OF STAFF, WHO IS A LITTLE CLOSER TO THESE ISSUES THEN I

AM. >> ANY OTHER QUESTIONS?

>> REGARDING THE MUSE, WHAT DOES THE RETAIL, WHAT DOES THAT LOOK LIKE RIGHT NOW? IS IT FULL, HOW MANY SPACES ARE OPEN?

>> I WAS TOLD THAT THE DEVELOPER IS TAKING A NUMBER OF RETAILS, A NUMBER OF RETAILERS TO ITS INTERNAL FINANCE APPROVAL COMMITTEE. I SUSPECT IN THE NEXT FEW WEEKS WE WILL HEAR SOME ANNOUNCEMENTS ABOUT WHO THE RETAILERS ARE.

>> THANK YOU. >> AS 1933 AND LOWER STARTS TO GET CLOSER AND CLOSER, WE WERE ORIGINALLY TALKING ABOUT SOME OF THE ISSUES LIKE THE VALET PARKING. WHERE THEY WOULD PARK, HOW MANY SPACES. EARLIER ON I THINK WHAT YOU TOLD ME IS THAT IT WAS TOO EARLY TO GIVE ANSWERS ON THAT. DO YOU KNOW OR COULD YOU FIND OUT THEIR STRATEGY FOR VALET PARKING AND WHAT IMPACT IT MIGHT HAVE ON THE NEIGHBORS?

>> THE ANSWER IS YES, I WILL. I THINK THIS WILL BE A CONVERSATION. AND GENERALLY THESE KIND OF CONVERSATIONS TAKE PLACE WITH PLANNING, ZONING AND MOST IMPORTANTLY THE ENGINEERING DEPARTMENT AND THE CHIEF OF INFRASTRUCTURE OFFICER. I SUSPECT AS THEY GET CLOSER TO OPENING WE WILL HAVE SEVERAL OF THESE CONVERSATIONS TO MAKE SURE IT WORKS RIGHT FROM THE BEGINNING. AT THIS POINT I DON'T HAVE A BETTER

ANSWER FOR YOU. >> THANK YOU. MOVING ONTO THE NEXT REPORT. THE CARMEL HISTORIC PRESERVATION AND

COMMISSION. >> GOOD EVENING. I AM THE ADMINISTRATOR FOR THE CARMEL PRESERVATION COMMISSION. JUST A FEW THINGS I WILL COVER. THE SPRING FACADE GRANTS PROGRAM, THAT ROUND HAS BEEN SUCCESSFULLY APPROVED FOR SIX HOMEOWNERS HERE IN THE CITY THAT WERE ELIGIBLE FOR APPLYING FOR THE PROGRAM THROUGH THE HISTORIC ARCHITECTURE SURVEY.

THAT AMOUNT TOTAL WAS $22,127. THAT WAS AWARDED TO PROPERTY OWNERS THAT ARE MAKING IMPROVEMENTS. THERE WERE 10 ELIGIBLE AND TOTAL BUT SOME DID NOT GET APPROVED FOR NOT MEETING THE STANDARDS OR GUIDELINES OF THE PROGRAM. JUST TO MAKE YOU ALL AWARE, AT THEIR MEETING LAST THURSDAY, THE COMMISSION APPROVED ADDITIONAL FUNDING FOR A SECOND ROND OF FACADE GRANTS , AND THAT IS OUR SUMMER ROUND AND THOSE WILL BE DUE SEPTEMBER 1ST. IF YOU HAVE ANY CONSTITUENTS THAT ARE INDEED ELIGIBLE, WE WOULD WELCOME APPLICATIONS. YOU GET BIDS THROUGH CONTRACTORS AND MAKE IT A PART OF THOSE APPLICATIONS. WE ARE HAPPY TO ANSWER ANY QUESTIONS. THE COMMISSION IS, I THINK I'VE TALKED ABOUT THIS BEFORE, A CERTIFIED LOCAL GOVERNMENT THAT WAS CERTIFIED BY THE NATIONAL PARKS SERVICE. AS SUCH, WE HAVE TO CONDUCT AN AUDIT WITH THE STATE EVERY TWO YEARS. WHICH WE JUST COMPLETED THIS SPRING.

EVERYTHING WAS FOUND TO BE COMPLIANT ON THEIR PART EXCEPT ONE THING THEY SAID THEY WANTED TO SEE US DOING A BETTER JOB OF, WHICH WAS EDUCATIONAL TRAINING FOR OUR COMMISSIONERS.

WE'VE ALREADY DONE TWO EDUCATIONAL TRAININGS IN 2024.

THIS WAS FOR THE 2023 YEAR. SO WE HAVE ALREADY, BEFORE WE EVEN

[00:25:02]

GOT THE AUDIT BACK, WE'VE STEPPED THAT UP AND ARE DOING TRAINING. WE ALSO ARE ENCOURAGING OUR COMMISSIONERS TO ATTEND THE STATE, PRESERVING HISTORIC PLACES CONFERENCE WHERE THEY CAN GET ADDITIONAL TRAINING. THAT HELPS TO MEET TRAINING REQUIREMENTS AS WELL. THEY WERE ALL OPEN TO THAT.

ANOTHER COMPONENT OF BEING A CERTIFIED LOCAL GOVERNMENT IS THAT THE COMMISSION REVIEWS ANY NOMINATIONS THAT ARE MADE FROM PROPERTIES WITHIN THE CITY OF CARMEL TO THE REGISTRAR OF HISTORIC PLACES. ABOUT A YEAR AND A HALF AGO WE DID REVIEW ONE FOR A PROPERTY CALLED THE APPLEGATE JOHNSON FARMSTEAD.

THAT IS ON HOEVER STICK ROAD IN ABOUT THE 9600 BLOCK. IT IS A SMALL SORT OF CIRCA 1850 HOUSE. AND SO WE HAD APPROVED THAT. WE WENT OVER TO THE STATE AND THE STATE IS REVIEWING IT AT THEIR QUARTERLY REVIEW BOARD MEETING ON WEDNESDAY. SO I ANTICIPATE THAT BEING APPROVED AND THE OWNERS MADE THE APPLICATION AND THEY ARE THRILLED THAT IT WILL BE MOVING FORWARD. WE DID, THE ORGANIZATION I WORK FOR DURING THE DAY, WE HAVE SIGNED A PURCHASE AGREEMENT FOR THE WILKINSON HOUSE, WHICH IS THAT 1850S PROPERTY AT THE NORTHEAST CORNER OF KEYSTONE PARKWAY AND SMOKY ROW. THAT WAS DEVELOPED MOSTLY FOR THE COURTYARDS OF CARMEL AND THE HOUSE WAS RETAINED. SOME NEIGHBORS IN THE SUBDIVISION TO THE EAST ARE PURCHASING THE PROPERTY AND PLAN TO RESTORE IT . WE REVIEWED ALL THEIR FINANCIALS AND EVERYTHING AND THEY ARE IN A GREAT POSITION AND SO WE ARE LOOKING FORWARD TO CLOSING WITH THEM ON AUGUST 30TH. ANOTHER PROPERTY SAVED. THAT WAS TARGETED FOR DEMOLITION ORIGINALLY BY THE FIRST DEVELOPER WHO LOOKED AT DOING THE COURTYARDS OF CARMEL AND IT BECAME THE COURTYARDS OF CARMEL DEVELOPMENT. SO I THINK WE ARE REALLY HAPPY THAT WE ARE HAVING A POSITIVE END RESULT WITH THAT PROPERTY. WITH THAT, I'LL END, DOES ANYBODY HAVE ANY QUESTIONS?

>> HOW MANY PROPERTIES DO WE HAVE CURRENTLY THROUGHOUT

CARMEL ON THIS REGISTRY? >> ON THE NATIONAL REGISTER, ABOUT SEVEN OR EIGHT. INDIVIDUALLY LISTED. AND THEN THERE IS AN INDIVIDUAL LISTING FOR THE NEIGHBORHOOD ON WEST MAIN STREET THAT IS COMPRISED OF ABOUT 35 PROPERTIES WITHIN.AS A HISTORIC DISTRICT.

>> AS THE COMMISSION DONE A SURVEY OF POSSIBLE HOMES THAT COULD POSSIBLY QUALIFY AND BE DIRECTLY MARKETED TO TO GET

THEM LISTED? >> WE DO HAVE A SURVEY ALREADY.

AND THERE IS A TAB ON THEIR FOR ENDANGERED PROPERTIES.

OFTENTIMES, I THINK, ENDANGERED PROPERTIES SORT OF COME TO OUR ATTENTION WHEN AN APPLICANT APPLIES FOR A DEMOLITION PERMIT. WHICH, SOMETIMES IN THAT CASE IT IS TOO LATE BECAUSE THEY HAVE ALREADY FORMULATED PLANS, ET CETERA. I THINK THOUGH, BY KEEPING TABS ON THOSE AS WE DO, IF WE KNOW IT IS HEARD THROUGH THE GRAPEVINE THAT A DEVELOPER IS LOOKING AT IT OR SOMETHING, THEN WE WILL CERTAINLY LOOK AT IT AS SUCH, AS AN ENDANGERED PROPERTY.

>> I WONDER IF YOU HAD A SENSE OF SURVEY FOR HOMES THAT POSSIBLY WOULD QUALIFY. BECAUSE IF YOU ARE OFFERING GRANTS TO HELP THEM GO THROUGH THE PROCESS, THEY MAY NOT KNOW THAT THAT SUPPORT OR GRANT IS AVAILABLE TO THEM. IF YOU CAN MARKET DIRECTLY TO THEM, MAYBE YOU WE CAN PROTECT THOSE PROPERTIES BEFORE THEY EVEN GET TO THAT POINT.

>> I SKIPPED OVER THAT, THAT IS ONE THING I DID NOT VERBALLY REPORT ON. WE HAVE ACTUALLY SENT INDIVIDUAL LETTERS TO ALL OF THE PROPERTY OWNERS THAT ARE OUTSTANDING OR NOTABLY RATED ON OUR SURVEY THAT THE COUNCIL HAS ADOPTED. WE DIDN'T SEND THEM

[00:30:04]

TO DISTRICTS, BUT TO THE INDIVIDUAL PROPERTY OWNERS, AND THERE WERE ABOUT 50 ADDRESSES. I ALWAYS TRY TO REMIND PEOPLE, THERE ARE 31,000 PARCELS OF PROPERTY IN THE CITY OF CARMEL IN CLAY TOWNSHIP. THE SURVEY WE ADOPTED SO FAR HAS 547 PROPERTIES SO FAR AND WE ARE LOOKING TO EXPAND THAT WITH AN UPDATED SURVEY BASED ON OUR CERTIFIED LOCAL GOVERNMENT REQUIREMENTS. WE WILL BE BRINGING THAT BACK TO COUNCIL IN THE FUTURE. BUT WE ARE MEETING THE REQUIREMENT OF NOTIFICATION OF THE PROPERTY OWNERS FIRST.

>> THANK YOU. >> MOVING ON TO THE NEXT ITEM,

[12. OLD BUSINESS]

THE 14TH READING OF ORDINANCE OF THE COMMON COUNCIL, ADDING CHAPTER 8, ARTICLE FOUR, TO THE CARMEL CITY CODE. MOVING ON TO THE NEXT ITEM, THIRD READING OF ORDINANCE D-E- 24, THE SHORT-TERM RENTAL STANDARDS AND DEFINITIONS, SPONSORS WERE COUNSELORS OF MINNAAR AND WORRELL. AS COUNSELOR SNYDER SAID, THIS WAS BROUGHT BACK FROM THE LAND USE COMMITTEE AND WE SENT IT BACK TO CHECK ON A COUPLE OF ISSUES. I WILL PULL THAT FROM THE LAND-USE AND SPECIAL STUDIES COMMITTEE TONIGHT AND PUT IT BACK ON THE DAIS. SO CAN YOU KIND OF KICK OFF AND GIVE US AN UPDATE OF WHAT WAS DISCUSSED AT LAND-USE?

>> WE DISCUSSED THE MERITS OF THE ORDINANCE AND EVERYTHING IN GENERAL. AND THERE WERE NO MAJOR CONCERNS. THERE WERE SOME QUESTIONS ASKED BUT NO MAJOR CONCERNS RAISED. IT WAS UNTIL WE GOT BACK TO THE FULL COUNCIL THAT A CONCERN WAS BROUGHT UP, ADMITTEDLY, BY MYSELF ABOUT WHAT THIS WOULD DO FOR CHARITABLE ORGANIZATIONS AND WE PUT IT BACK INTO THE LAND-USE AND WE HAVE CONSULTED WITH LEGAL COUNSEL'S IN THIS ORGANIST VERY -- ORDINANCE VERY SPECIFICALLY PERTAINS TO PROPERTIES ADVERTISED ON THE INTERNET. AND IF SOMEBODY IS TRULY ALTRUISTIC AND THEY HAVE A PROPERTY THEY ARE DOING NOT FOR PROFITS AND THE GOOD OF THE COMMUNITY, THEN THEY ARE NOT ADVERTISING ON THE INTERNET. IF THEY ARE, 80 THEIR MOTIVES SHOULD BE QUESTIONED. MY INITIAL CONCERN HAS SINCE BEEN PROVEN UNFOUNDED. THOSE THAT ARE DOING GOOD FOR THE COMMUNITY CAN CONTINUE TO DO GOOD AND THIS DOES PROVIDE THE PROTECTIONS THAT ARE NEEDED AND THAT HAVE BEEN ASKED FOR AND

DESIRED BY THE COMMUNITY. >> THANK YOU. SINCE THIS WAS BROUGHT TO THE COUNCIL IN THE LAST MEETING, IT WAS READY FOR A VOTE AND SHOWING PRUDENCE WE SENT IT BACK INTO COMMITTEE TO CHECK ON THAT AND IT HAS RETURNED. DOES ANYBODY HAVE ANY QUESTIONS FOR COUNCIL MEMBER SNYDER? IF NOT, LOOKING FOR A

MOTION. >> MOVED TO APPROVE.

>> SECOND. >> DISCUSSION? PLEASE VOTE.

APPROVED, 9-0. MOVING ONTO THE NEXT ITEM, SECOND READING OF ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL , THE CARMEL CITY CODES SPONSORS REMAINS IN THE LNU SPECIAL STUDIES COMMITTEE. NEXT ITEM, SECOND READING OF ORDINANCE OF THE COMMON COUNCIL, THE CITY OF CARMEL INDIANA ESTABLISHING OUTDOOR REFRESHMENT AREA. THIS REMAINS IN THE LAND-USE AND

[13. NEW BUSINESS]

SPECIAL STUDIES COMMITTEE. ITEM NUMBER 13, NEW BUSINESS.

RESOLUTION IN THE COMMON COUNCIL OF THE CITY OF CARMEL, APPROVING THE TRANSFERRING OF FUNDS IN THE INFORMATION AND COMMUNICATIONS SYSTEM DEPARTMENT BUDGET. THE SPONSORS ARE COUNSELOR GREEN, AT THIS POINT I WILL AND THE GAVEL, POWER AND AUTHORITY OVER TO THE COUNSELOR. MOTION TO INTRODUCE.

[00:35:08]

>> THE SYNOPSIS. TRANSFERS OF $49,000 TO COVER EXPENSES INCURRED IN THE COUNCIL CONSULTING FEES, WITHIN THE INFORMATION SYSTEM DEPARTMENT BUDGET. THANK YOU. GO AHEAD AND APPROACH THE PODIUM AND EXPLAINED THE $49,000. THERE WERE SOME QUESTIONS ABOUT THE CONTENT.

>> GOOD EVENING. I RESPECTFULLY REQUEST YOUR ATTENTION ON THE RESOLUTION. IT IS NOT ADDING FUNDS BUT TRANSFERRING FUNDS THAT ARE ALREADY IN THE ICS DEPARTMENT TO PAY FOR THE PHASE TWO OF THE CITY'S 311 PROJECT. IT IS THE NONEMERGENCY WAY TO CONTACT THE CITY FOR SERVICES. RIGHT NOW WE HAVE THE MY CARMEL APP WHICH IS FAIRLY DATED. THIS IS ACTUALLY A NEW SYSTEM AND WILL EVENTUALLY ALLOW TEXTING AND THINGS LIKE THAT TO PROVIDE A BETTER LEVEL OF SERVICE FOR RESIDENTS AND VISITORS.

>> ANY QUESTIONS? >> COULD YOU CONFIRM THE

AMOUNT? >> 49,000.

>> SORRY, THAT WAS MY MISTAKE. I JUST WANT TO BE SURE WE ARE ALL TALKINGABOUT THE SAME NUMBER. ANY OTHER QUESTIONS?

LOOKING FOR A MOTION. >> MOVED TO APPROVE.

>> DISCUSSION? PLEASE VOTE. RESOLUTION CARRIES 9-0. MOVING ON TO THE NEXT ITEM. THANK YOU, TIMOTHY. MOVING ON TO THE NEXT ITEM, ORDINANCE IN THE CITY OF CARMEL, AUTHORIZING THE ISSUANCE OF THE ECONOMIC DEVELOPMENT TAX TO SUPPORT THE

PROSCENIUM 3 PROJECT. >> MOVED TO INTRODUCE.

>> ALL RIGHT, PLEASE READ THE ORDINANCE.

>> THIS IS BY THE CITY OF CARMEL TO SUPPORT THE DEVELOPMENT OF THE PROSCENIUM 3 PROJECT.

>> GOOD EVENING, COUNCIL. SCREEN, PLEASE. BEFORE I CALL TONY BROOKLYN APPEAR I WOULD LIKE TO SPEND A MINUTE ON MY FAVORITE TOPIC. THERE ARE RESIDENTS LISTENING AND PRESS LISTENING, SO IT IS IMPORTANT THAT WE ARE CLEAR ABOUT THIS SPECIFIC SUBJECT TODAY WHICH IS THE BOND YOU ARE LOOKING AT RIGHT NOW IS WHAT WE TERM A DEVELOPER BOND. DEVELOPER BONDS POSE NO RISKS TO TAXPAYERS AND HAVE NO IMPACT ON THE TAX RATE.

IT IS TRUE THAT THE CITY ACTS AS AN ISSUER BUT THE BOND IS BACKED ONLY BY TAXES GENERATED BY THE NEW PROJECT. THE INCREASE IN THIS VALUE GENERATES NEW TAXES AND THAT IS WHAT PAYS BACK THE BOND. THE DEVELOPER GETS THE BOND AN INVEST THAT MONEY INTO THE PROJECT. THERE IS NO TAXPAYER BACKUP ON THIS. IT DOES NOT AFFECT OUR TAX RATE. ALL THE RISK IS ON THE DEVELOPER. IF THIS PROJECT DOES NOT GENERATE THE TAX REVENUE THAT THE DEVELOPER IS PROJECTING AND DEPENDING ON, THE DEVELOPER HOLDS THE BOND, TAKES THAT RISK THAT ITS BONDS WILL RECEIVE LESS OF THAT REVENUE THAN WAS PROJECTED. WHILE GATEWAY AND THE INDIANA DEPARTMENT OF LOCAL GOVERNMENT AND FINANCE ON ITS WEBSITES WILL INDICATE THAT THIS IS A CARMEL BOND, IT IS NOT A BOND THAT THE CITY OF CARMEL OR TAXPAYERS HAVE ANY OBLIGATION FOR. WE ARE SOLELY ACTING AS AN ISSUER WHICH MAKES US ESSENTIALLY A PASS-THROUGH.

NEVER TAXES LOW INTO THIS ALLOCATION AREA, FLOW BACK OUT AND THE CITY HAS NO OBLIGATION ON THIS DEVELOPMENT. THIS IS A DEVELOPER INVESTING AND WE ARE ASSISTING IN THE INVESTMENT WITH THE DEVELOPERS OWN FUTURE TAXES AND THERE IS NO LIABILITY TO THE TAXPAYERS OR CITY AT ALL ON A PROJECT LIKE THIS.

>> THANK YOU. I LIKE YOU DOING THIS EVERY TIME THERE IS A DEVELOPER BOND. BUT ONE QUESTION, WHO DOES OUR BOND

[00:40:02]

REVIEWS? >> I BELIEVE WE ARE USING SMP.

>> TODAY TAKEN DEVELOPER BONDS WHEN THEY LOOK AT SMP, YOU

KNOW, THE OVERALL RATING? >> I DON'T BELIEVE THEY LOOK AT THOSE BACKED BONDS BECAUSE IT ADDS NO RISK TO THE CITY.

>> I WOULD LIKE TO CALL UP TONY, LONGTIME CARMEL DEVELOPER, TO INTRODUCE A PROJECT THAT WAS PROMPTED BY OUR YOUNG REPORT READER TODAY, WHICH I APPRECIATE. AND I WILL INTRODUCE YOU TO TONY WHO WILL DISCUSS THE PROSCENIUM 3

PROJECT. >> THANK YOU VERY MUCH. I'M EXCITED TO INTRODUCE PROSCENIUM THREE. BEFORE I TALK ABOUT MY COMPANY AND WHO I AM AND MY INTERACTION WITH CARMEL OVER THE LAST FEW YEARS, I WANT TO INTRODUCE PHIL AND JUDY STEWART WHO OWNED LOTS OF PROPERTY ALONG RANCH LINE AND THEY OWN THE THREE HOMES THAT THIS PROJECT WILL BE A PART OF. SO I APPRECIATE THEM COMING TONIGHT TO SEE THIS. THE SLIDES YOU HAVE UP SHOWS IN THE RED WHAT THE LAND WOULD BE ENCOMPASSED ON PROSCENIUM 3. JUST TO THE RIGHT IS PROSCENIUM 1 AND TO THE NORTH IS THE CONSTRUCTION ON PROSCENIUM 2. CLEARLY LOFT DEVELOPED THEIR OFFICE BUILDINGS. THE SUCCESS OF THAT PROJECT WAS VERY WELL RECEIVED. THE OFFICE IS SITTING AT ABOUT 100% OCCUPANCY AND THE RESIDENTIAL IS DOING VERY WELL.

WE WERE THE FIRST TO REALLY LOOK AT THE DEVELOPMENT AND WE DEVELOPED 22 CONDOS IN THAT PROJECT. ACROSS THE STREET THE INVESTMENT GROUP, WHICH IS MY COMPANY, WHO BY THE WAY IS OUR OFFICES, WE ARE IN THE PROCESS OF DEVELOPING THAT PROJECT WHICH CONSISTS OF 48 APARTMENTS, SEVEN CONDOS AND ABOUT 15,000 SQUARE FEET OF RETAIL. AND IF YOU REMEMBER, HUNTINGTON BANK OWNED THIS SITE AND WE HELPED MOVE THEM FROM THEIR CURRENT LOCATION WHERE THE COURTHOUSE IS NOW TO PROSCENIUM II, AND THEY ARE LOOKING FORWARD TO GETTING STARTED ON THAT PROJECT. HERE IS AN OVERVIEW OF PROSCENIUM III . THE PROJECT CONSISTS OF 151 APARTMENTS. 125 KEY HOTEL AND ROUGHLY 63,000 SQUARE FEET OF OFFICE IN ADDITION TO ANCILLARY RETAIL, ABOUT 15,000 SQUARE FEET. ON THE LOWER LEFT-HAND SIDE YOU CAN SEE THAT THIS IS A PODIUM GARAGE. THE GRAY BOXES IN THE GARAGE ARE THE ELEVATORS THAT GO UP TO THE BUILDINGS ABOVE. THIS IS BELOW GRADE PARKING, FAIRLY EXPENSIVE BUT WELL RECEIVED GARAGE FOR OFFICE TENANTS, BOOKING HOTEL GUESTS AND RESIDENTIAL USES AS WELL. THIS IS AN AERIAL VIEW LOOKING NORTH AND WEST. THE BUILDING ON THE CORNER IS THE HOTEL. WE'VE IDENTIFIED TWO FLAGS WE ARE INTERESTED IN PROCEEDING WITH. YOU CAN SEE THE TWO OFFICE BUILDINGS SITTING ALONG RANGELINE AND RESIDENTIAL IS JUST BEHIND THAT. THIS IS A VIEW LOOKING FROM WHERE WE ARE TODAY, BACK AT THE DEVELOPMENT. WE TRIED TO ENGAGE VETERANS WITH AN OUTDOOR PLAZA THAT WOULD WALK DOWN ONTO THE PARKING LOT. AND JUST BEYOND IN WHITE IS PROSCENIUM II IN FRONT OF KROGER. I SPENT A LOT OF TIME ON THE ARCHITECTURE AND THIS IS WHAT REALLY DROVE THE ARCHITECTURE FOR THE OFFICE AND THEN PICKING UP ON THE ARCHITECTURE FOR THE RESIDENTIAL AS WELL. WITH THAT,

HENRY? >> I WANT TO MENTION A COUPLE OF MORE THINGS. FIRST, THIS IS WORTH SAYING, THIS IS A PROJECT THAT IS PRIMARILY AN OFFICE AND LUXURY HOTEL PROJECT. IT HAS

[00:45:02]

151 APARTMENT UNITS WHICH IS THE BARE MINIMUM TO FACILITATE THIS PROJECT BUT THIS IS NOT AN APARTMENTS FIRST KIND OF PROJECT. THIS IS WHAT IS DESPERATELY NEEDED IN THE CORE, OR WALKABLE OFFICE AND UPSCALE HOTEL. I WANT TO BRIEFLY MENTION THAT IF COUNCIL CHOOSES TO, AFTER REVIEWING THIS PROJECT, IF YOU CHOOSE TO APPROVE THE BONDS, THE REDEVELOPMENT WILL COME BACK THIS YEAR TO HAVE ONE VOTE TO CREATE A VOCATION OR HE AND A SECOND VOTE AT CITY COUNCIL LEVEL TO VACATE WHAT IS LABELED THE CITY PARCEL AREA SO THAT IT IS PUT INTO THE PROJECT. A COUPLE OF OTHER THINGS I WANTED TO MENTION. FIRST, ALMOST ALL OF OUR PARKING FOR THE LAST 15 YEARS THAT WE'VE DONE WITH PRIVATE PARTNERSHIPS ALWAYS HAS 75% OF THE PARKING USABLE FOR THE PUBLIC. 25% OF THE PARKING IS RESERVED. THIS ESSENTIALLY GOVERNS EVERY GARAGE WE HAVE BUILT. THIS CRUSH IS DIFFERENT BECAUSE IT IS 80% OPEN TO THE PUBLIC. THAT IS PARTLY TO ACCOUNT FOR ALL THE CITY CARS THAT PARK IN THE CITY PARCEL. THIS GARAGE HAS A LARGER SALE -- SHARE A PARKING, IT HELPS MAKE UP FOR SOME OF THE CARS IN THE CITY PARCEL. ANOTHER THING WORTH MENTIONING, IF YOU REMEMBER A FEW YEARS AGO, COUNCIL AUTHORIZED A BOND AS PART OF THAT CONVERSATION THERE WAS A PARKING CONSULTANT AND HER DETERMINATION WAS AFTER YOU MOVE THE COURT'S OFFICE AND THE COURT TO ITS NEW HOME, THAT THE PARKING REQUIREMENTS ON THE CURRENT CITY LOT WOULD BE GREATLY LESSENED. THE OTHER THING I'M EXCITED ABOUT IS THAT IT WILL HAVE THE SAME KIND OF PARKING TECHNOLOGY THAT YOU CAN SEE AT THE CIVIC GARAGE.

AND AT SOME POINT I.T. WILL SEND THAT INFORMATION TO YOUR PHONES. YOU WILL NOT ESCAPE TODAY WITHOUT ME QUOTING MY FAVORITE FINANCIAL NUMBERS. CURRENTLY, AS THE LAND STANDS TODAY, IT ALL PAYS ABOUT $47,000 A YEAR IN PROPERTY TAXES AS THEY ARE SPLIT AMONGST THE CITY, SCHOOLS AND OTHER TAXES. IT WILL GENERATE ESSENTIALLY $800,000 A YEAR IN PROPERTY TAX. THE SCHOOLS WILL RECEIVE $112,000 EVERY YEAR JUST FROM THE FACT THAT THIS PROJECT OCCURRED. THAT IS A HUGE WIN FOR THE SCHOOLS. AND THIS NEXT AD IS SOMETHING I THINK THE REST OF THE STATE WOULD BE JEALOUS TO HEAR. WE ARE RAISING THE ASSESSED VALUE OF THIS PROJECT FROM ABOUT $560,000 PER ACRE TO $11.2 MILLION AN ACRE. THAT IS A HUGE JUMP IN VALUE AS WE ARE GETTING MORE VIBRANCY AND WALK ABILITY.

AS TONY MENTIONED, 63,000 SQUARE FEET OF HEADQUARTER STATE THAT WE ARE DESPERATE TO HAVE, THIS IS A PROJECT BEING DRIVEN BY THE NEED FOR OFFICE. WE KNOW THAT SOME OFFICE USERS ARE STILL MOVING INTO NEW HEADQUARTERS. AND FRANKLY FOR EVERY NEW OFFICE MOVE THAT EXISTS, WE NEED TO MAKE SURE THAT THEY PICK US. THE OTHER THING I WANT TO MENTION, OF THE 50,000 SQUARE FEET OF RETAIL, 4000 OF THAT WILL BE LEASED TO WOMEN AND MINORITY AND VETERAN OWNED BUSINESSES. THAT IS SOMETHING THAT WAS PUSHED HARD FOR BY THE MAYOR. AND I WANT TO NOTE, FINALLY EMMA AS PART OF THIS PROJECT, IT DOES HAVE A PUBLIC SPACE COMPONENT ALONG VETERANS WAY. THIS IS ONE OF THOSE PROJECTS THAT, GOING BACK, IT WAS APPROVED LAST YEAR FOR. WE WILL CONTINUE SPENDING TIME ON THIS SPACE TO MAKE SURE IT IS EXACTLY WHAT OUR PARKS DIRECTOR WANTS TO SEE. BUT GENERALLY HE IS IN AGREEMENT THAT IT IS THE RIGHT USE. WE CAN ALL IMAGINE THE NEXT TIME WE HAVE CARMEL FEST, WE CAN ACTIVATE IT EVEN MORE WITH A LOVELY PARK SPACE WHERE ALL THE KIDS PLAY THE MIDWEEK GAMES. WITH THAT, THAT IS A PRETTY GOOD SUMMARY OF THE PROJECT. BEFORE THIS GETS SENT, IT'S A

[00:50:01]

95-5 IS SPLIT, WE WOULD LOVE TO ANSWER ANY QUESTIONS YOU MAY

HAVE. >> FIRST OF ALL, WE HAD HEARD EARLIER IN OUR SESSIONS, THE PRESENTATION FROM HOTEL CARMICHAEL ON HOW SUCCESSFUL THAT HOTEL HAS BEEN AND HOW PROFITABLE IT NOW IS. WE ARE ALSO HEARING ABOUT THE INTENSE NEED OF OFFICE SPACE AND THE FACT THAT YOU MENTIONED MANY TIMES THAT OFFICE SPACE IS OCCUPIED BEFORE THE PROJECT IS EVEN COMPLETED. I JUST HAVE A HARD TIME UNDERSTANDING HOW, WHEN WE HAVE SO MUCH OF THIS ALREADY BAKED IN, THIS IS PROOF OF CONCEPT PROVEN, THIS IS NOT NEW PROJECTS WHERE WE ARE TRYING TO PROVE CONCEPT. TONY HAS BEEN DOING PROJECTS IN CARMEL, I'M JUST NOT UNDERSTANDING THE SPLIT OF 95-5. IT JUST SEEMS TO BE A LOT OF INCENTIVE VISITATION, SO I'M JUST ASKING THE QUESTION BECAUSE --

>> JUST FOR COMPARISON, PROSCENIUM I RECEIVED BASICALLY ALL THE LAND AND 100% AND THIS IS THE EXACT SAME STRUCTURES, THE EXACT SAME EXPANSIVE ONE LEVEL GARAGE WITH TONY PAYING FOR MOST OF THE LAND WITH ONLY 95% SPLIT. I THINK IT IS ACTUALLY IMPROVING IN THE CITY'S FAVOR COMPARED TO PREVIOUS PROJECTS. I THINK THE CITY SHOULD STRIVE FOR WHERE THE TOPOGRAPHY OF THE LAND MAKES IT POSSIBLE TO HAVE AN UNDERGROUND GARAGE EVERY SINGLE TIME. INSTEAD OF STRUCTURE PARKING THAT REALLY GETS IN THE WAY AND IS MORE EXPENSIVE. THIS IS A BETTER DEAL FOR THE CITY FOR PROSCENIUM I OR PROSCENIUM

II WAS. >> ANY MORE QUESTIONS?

COUNCILMEMBERS LATER. >> I JUST WANT TO TAKE A SECOND FOR CONCERNS, THE 95-5 SEEMS LIKE IT OUGHT TO BE SOMETHING SPECIFIC. IF THE PROJECT NEEDS A NUMBER, IT ALWAYS ENDS UP BEING 95%. WHY AREN'T WE LOOKING AT STEPPING THIS DOWN, WHY ARE WE GIVING IT 100% FOR THE FIRST FIVE OR 10 YEARS AND THEN DRASTICALLY STEPPING IT DOWN FOR THE ENTIRE DURATION OF

THE BOND? >> A BOND WILL VALUE THAT BOND AND HOWEVER YOU WANT TO STAIRSTEP THE PAYMENTS IN 25 YEARS, BUT ULTIMATELY, IF THE MONEY IS NOT ENOUGH, THE PROJECT WON'T EVER START. THERE IS PRECEDENT IN THIS CITY, THERE IS A PROJECT ALONG OLD MERIDIAN THAT HAD A 75 HONEY ---25 TIFF SPLIT AND IT NEVER STARTED AND WILL NEVER HAPPEN. AND SO WHILE I TAKE SERIOUSLY AND NEGOTIATE THE BEST POSSIBLE DEAL FOR THE CITY, I ALSO KNOW THAT IF WE ENTER THE WORLD OF FANTASY WE ARE JUST WASTING A LOT OF PEOPLE'S TIME. IT IS OUR JOB TO TURN WHAT IS THERE TODAY INTO THE FUTURE. AND IT IS MY BELIEF THAT IT WILL INVOLVE 95%

TIFF TO GET IT DONE. >> ARE YOU BLAMING THE LACK OF THE PROJECT ON A TIF? SO WHY EVEN GET INTO IT?

>> THAT PROJECT IS NOT FEASIBLE TODAY. AT A 75-25% TIFF SPLIT MEANS IT IS NOT FEASIBLE AND AS LONG AS WE ARE DISCUSSING PROJECTS, WE SHOULD BE IN THE REALM OF FEASIBILITY. AND THIS

PROJECT IS. >> SO OVER THERE, LET'S FIND A PROJECT THAT WORKS. BECAUSE SITTING VACANT WON'T WORK

EITHER. >> THE ADMINISTRATION IS TRYING HER BEST TO FIND A PROJECT THAT WORKS BUT IT WILL FRANKLY RAPIDLY INVOLVE GOING BACK TO COUNCIL AND TO GET A HIGHER

TIFF SPLIT. >> THE PUBLIC ART, IS THAT PAID FOR BY THE CITY BUDGET? WHO IS PAYING FOR THAT?

>> IT IS JUST ADDITIONAL FUNDING FOR PUBLIC ART OUT OF THE PROJECT AND IT WAS IN THE $150,000 RANGE.

[00:55:02]

>> SO THE DEVELOPER IS PAYING FOR THE ART?

>> YES. >> DOES IT STILL GO TO THE ART

COMMISSION? >> IT WILL FOLLOW THE PROCEDURES THAT THE MAYOR WANTED TO FOLLOW AND THAT THE

COUNCIL WANTED TO FOLLOW . >> WE TALKED ABOUT THIS A LITTLE BIT, BUT I WANT TO GET BETTER CLARIFICATION. THE 80-20 SPLIT FOR THE GARAGE AND THEN YOU HAVE CONDUCTED PARKING STUDIES RELATED AND HE HAS DONE A STUDY RELATED ON THIS, DURING THE PEAK TIME, HOW MANY OF THOSE ARE UNRESERVED, NOT TO MEAN THEY WILL NOT BE SERVED BY THE DEVELOPING, HOW MANY OF THOSE 80% YOU EXPECT TO BE ABLE TO BE OPEN TO PUBLIC USERS WHO ARE NOT TENANTS IF YOU ARE ONLY RESERVING 25%. DOES THAT COVER EVERY POSSIBLE TENANT IN THIS PROJECT?

>> 20% RESERVE DOES NOT COVER EVERY POSSIBLE TENANT IN THIS PROJECT. THAT WILL BE IMPOSSIBLE. WE ALSO HAVE NOT BUILT GARAGES TO COVER EVERY SINGLE POSSIBLE USER.

>> THAT IS WHAT I'M GETTING TWO. OF THE 406 NOT RESERVED, HOW MANY OF THOSE WILL TYPICALLY BE AVAILABLE TO THE PUBLIC? VERSUS WHO WILL BE USING OFFICE SPACE OR WHO WILL BE LEAVING IN THE MULTI FAMILY AND WHO WILL BE USING THE

HOTEL. >> STEP ONE ON ANY PROJECT IS TO MAKE SURE THAT WE CAN FINANCE THE PROJECT. SO AT A COST OF $30,000, IT JUST DOESN'T MAKE SENSE. IT JUST DOESN'T MAKE SENSE FOR ANYONE TO BUILD EXTRA PARKING SPACES.

THE WAY OUR CITY FUNCTIONS ON THE 15+ GARAGES THAT WE HAVE, IT'S A FIRST,, FIRST SERVE BASIS. SOMEONE GOING TO CITY HALL IS MORE THAN WELCOME TO PARK IN THE GARAGE. AND IF THAT FOR A SPLIT MOMENT SLIGHTLY INCONVENIENCES A RESIDENT, THEY WILL FIND ANOTHER PARKING SPOT. AND LET'S SAY A TUESDAY AT LUNCH TIME WHEN ALL THE WORKERS ARE IN THE OFFICE AND MAYBE PEOPLE HAVE NOT LEFT YET AND SOMETHING ELSE IS GOING ON AND ALL THE RETAIL IS FULL, IT WILL BE A FULL PARKING GARAGE. BUT THAT IS AT PEAK TIMES. OTHER TIMES, IT WON'T. WHEN WE ARE HAVING A GAZEBO CONCERT FOR EXAMPLE, I SUSPECT MOST OF THE OFFICE WILL BE EMPTY. THERE WILL BE EXTRA PARKING AVAILABLE DURING THOSE MOMENTS, FOR EXAMPLE. BUT WE NEVER

OVERBILLED THE GARAGE. >> OF THE SPACES THAT ARE ON

THE CITY PARCEL -- >> IT IS ABOUT 25 SPACES, AND BY SHIFTING BY 75 TO 80% IT IS THAT SAME 25 SPACES.

>> BUT BY ELIMINATING THAT PARKING THERE, BASED ON THE NEW STUDY IN THE CLERK'S OFFICE, THERE IS AMPLE PARKING FOR CITY

STAFF? >> YES, COUNSELOR.

>> SO, ON VETERANS WAY, IT REALLY FEELS LIKE YOU ARE DRIVING THROUGH A PARKING LOT ONCE YOU EXIT, AS YOU COME FROM THE SOUTH TO NORTH FROM CITY HALL. IS THERE ADDITIONAL PLANS AND IMPROVEMENTS ALONG VETERANS WAY LEADING FROM THIS PROJECT AND AS YOU GO PAST THE POLICE STATION, STATION 41, HEADING NORTH. EVENTUALLY THIS WILL BE USED AS A THOROUGHFARE AND IT STILL FEELS LIKE YOU'RE DRIVING THROUGH A PARKING LOT AND I'M A LITTLE CONCERNED ABOUT PEDESTRIAN SAFETY.

>> I CERTAINLY UNDERSTAND WHERE YOU'RE COMING FROM. I WOULD SAY FOR THE PURPOSES OF THIS, THIS IS A PROJECT SPECIFIC CONVERSATION. BUT A LARGER CONVERSATION CAN CERTAINLY BE HAD WITH OUR NEW CITY ENGINEER AND OUR CHIEF INFRASTRUCTURE OFFICER. THEY DEAL WITH JUST GENERAL TRAFFIC AND THESE KIND OF ISSUES ALL THE TIME. ANOTHER THING WE CAN SAY, THIS IS VERY CONCEPTUAL AS IT IS TODAY. IF IT IS APPROVED, THERE WILL BE 1000 CONVERSATIONS TAKING PLACE BETWEEN THE CITY, STAFF, TO GET THIS JUST RIGHT. RIGHT NOW WE ARE LOOKING AT RENDERINGS FROM ARCHITECTS BECAUSE THAT IS JUST THE STAGE WE ARE IN.

[01:00:02]

>> AS YOU SAID, AT A PEAK TIME THE GARAGE POSSIBLY BEING FULL WITH 508 CARS, THAT WOULD MEAN 508 CARS TRAVELING ALONG VETERANS WAY. THAT'S WHY I BRING IT UP. I MENTIONED BEFORE, BOTH OF THOSE ENTRANCES ARE OFF OF VETERANS WAY.

>> I'M NOT SURE THAT A GARAGE HAVING 508 CARS IN IT MEANS THAT THEY ARE TRAVELING ON THE ROAD AT THE SAME TIME, BUT YOUR

POINT IS WELL TAKEN. >> THAT AT THE SAME TIME, BUT THEY HAVE TO TRAVEL ON THE ROAD TO GET THERE.

>> THIS QUESTION MIGHT BE BETTER SERVED BY BRAD OR JEREMY. I GET IT, IT IS RENDERINGS. BUT IT IS PART OF A LITTLE BIT WHAT COUNSELOR TAYLOR IS TALKING ABOUT. A, WHERE IS ALL OF THIS WATER GOING AND FIVE YEARS AGO WHEN A DIFFERENT PROJECT WAS STARTED HERE, THEY TALKED ABOUT MAYBE ELIMINATING THE CITY HALL PARKING LOT. THAT MIGHT BE SOMETHING STILL ON THE TABLE. SO THEY ARE OUR OPPORTUNITIES TO DO THIS GLOBALLY AND THE CITY HALL PARKING LOT IS ALREADY LOSING SPACES, YOU ARE TAKING SPACES AWAY AND ACCOUNTED FOR THAT. SO WHEN YOU SAY YOU ARE JUST LOSING THAT STRIP BETWEEN THE BUILDINGS, THAT IS NOT ENTIRELY ACCURATE BECAUSE THERE ARE ALSO PARKING SPOTS GOING AWAY AND WILL BE TAKEN DOWN IN OUR PARKING LOT HERE. WILL THAT BE ABLE TO BE

ACCOUNTED FOR? >> WE HAVE NOT ACCOUNTED FOR THE PARKING SPACES BEING TAKEN AWAY FROM THAT PARKING LOT BY THE TOWNSHIP PROJECT OF EXPANDING THE JAPANESE GARDEN.

WE ARE FOCUSING ON THE SITE-SPECIFIC PROJECT AND ACCOMMODATING SPACES ON THE DRIVE THAT ARE BEING TAKEN AWAY. I THINK IN ANY SCENARIO, A NEW 506 SPACE ADJACENT PARKING OF WHICH 80% IS OPEN, ONLY BENEFITS THIS AREA FROM A

PARKING SITUATION. >> YOU SAY YOU ARE ONLY DEALING WITH SITE-SPECIFIC DETAILS, WHEN YOU ARE BUILDING A PROJECT NEXT TO CITY HALL, DOES NOT SEEM TO BE GLOBALLY THOUGHT OUT. I AM LOOKING AT THIS AND I ALREADY KNOW HOW MUCH WATER SOME OF THIS WILL TAKE. I JUST DON'T THINK THAT SHOWING US A PRETTY PICTURE AND THEN SAYING THAT WE'VE GOT, WHICH IS BEAUTIFUL, I LOVE IT AND I LOVE THE CONCEPT AND THE BREAKDOWN OF USAGES, BUT ASKING US, AND IT DOESN'T JUST MEAN THIS PROJECT, IT SEEMS TO BE EVERY PROJECT, ASKING US TO MAKE DECISIONS WHEN ALL WE HAVE IS A PICTURE AND NOTHING ELSE, IT IS

GETTING TIRESOME. >> I CONCUR. WE DO LOOK AT PROJECT BY PROJECT, WHETHER IT IS TRAFFIC, PARKING, WHATEVER THE CASE IS. AND THE IMPACT OF THAT SPECIFIC PROJECT. BUT I'D LIKE TO SEE SOMETHING MORE AGGREGATE. THE OVERALL IMPACT OF STEP AFTER STEP AFTER STEP.

>> I WAS JUST GOING, I ASSUME THIS IS GOING TO COMMITTEE, I

DON'T KNOW IF LAND-USE FIRST. >> WE WILL SEND IT TO FINANCE COMMITTEE, THAT IS THE BIG PROPONENT RIGHT NOW. SO WE WILL TALK ABOUT WHETHER IT NEEDS TO GO TO LAND-USE AFTER.

>> MY COMMENTS WERE GOING TO BE, I HEARD SOME COMMENTS ABOUT THE AMOUNT OF THE TIF SPLIT. WE JUST LAST MEETING VOTED AND GAVE 98% TO THE TIF TO BASICALLY WHAT I WOULD CALL AN APARTMENT PROJECT. 1012 APARTMENTS. WHAT I WOULD LIKE TO DO IN FINANCE IS KIND OF SEE IF I CAN GET A FEEL FOR WHAT COUNSELOR'S WANTS, WHAT IS APPROPRIATE AND HOW DO YOU MAKE THIS DECISION? I VOTED AGAINST THE APARTMENT TIF BUT I MIGHT BE INCLINED TO VOTE FOR THIS WITH A HOTEL AND OFFICE SPACE WE NEED. TO ME IT IS NOT JUST ABOUT NECESSARILY THE SPLIT BUT WHAT THE COMMUNITY IS GETTING FOR IT. COUNCIL MEMBER ADAM AASEN IS ON THE COMMITTEE, SO I WOULD LIKE TO SPEND SOME TIME TALKING ABOUT THAT AND TAKING INTO THAT A LITTLE DEEPER.

>> TWO COUNSELOR SNYDER'S COMMENT, AND THIS IS NOT SOMETHING THAT IS TONY'S RESPONSIBILITY, BUT I THINK WHAT THE COUNCIL KNOWS IS THAT THERE WILL BE OTHER PROJECTS.

[01:05:06]

THEY KNOW THAT THERE WILL BE OTHER PROJECTS WITHIN WALKING DISTANCE OF THIS, WITHIN THE NEXT YEAR, AT LEAST WITHIN THIS TERM FOR MAYOR FINKAM. SO WHEN IT COMES TO THINGS LIKE STORMWATER, BUT ALSO PARKING AND AN OVERALL LOOK AT HOW THINGS WILL COME TOGETHER, I DON'T KNOW HOW YOU DEAL WITH THAT AND IF IT WOULD BE SOMETHING, YOU DON'T WANT TO TALK ABOUT PROJECTS THAT WERE NOT ANNOUNCED OR FINALIZED YET.

BUT I THINK THAT IS WHAT SOME OTHERS ARE GETTING AT, SEEING HOW THIS FITS IN THE OVERALL PUZZLE OF THE URBAN CORE. AM I CORRECT IN SAYING THAT? YEAH, OKAY. AS FOR THE PARKING, IT IS NOT YOUR RESPONSIBILITY TO PARK IN OTHER AREAS BUT I DO ASSUME THAT BETWEEN PROSCENIUM II AND PROSCENIUM III, THERE WILL BE A LOT OF CO-MINGLING AND IF YOU GET THE RIGHT RETAIL TENANTS THAT HAVE THAT MORE NIGHTTIME ATMOSPHERE AS OPPOSED TO BREAKFAST PLACES, I COULD SEE THAT WHEN THE OFFICE WORKERS ARE GOING OUT, SOME WILL COME HOME, SOME WILL GO OUT, THERE COULD BE QUITE A FEW SPACES ON A SATURDAY NIGHT BETWEEN THOSE THREE GARAGES. SUDDENLY THERE'S A LOT OF USE. I DO AGREE WITH COUNCIL MEMBER TAYLOR THAT YOU CAN'T PREDICT HOW MANY PEOPLE LIVE IN APARTMENTS WILL WORK FROM HOME BUT JUST SAY THAT A LOT DO AND THEN YOU HAVE A TENANT ON THE OFFICE SPACE THAT REALLY INSISTS PEOPLE COME INTO THE OFFICE. AND SAY YOU HAVE A REAL HOPPING LUNCH RESTAURANT, YOU COULD START TO GET INTO A CRUNCH DURING THE DAYTIME. BUT IN THE EVENINGS AND ON THE WEEKENDS I DO THINK THAT WOULD

PROBABLY BE FINE. >> ANY OTHER QUESTIONS?

>> ONE OR TWO COMMENTS. I LIKE HOW YOU HAVE THE BOND COUNCIL HIGHLIGHT WHICH SPECIFICALLY LAYS OUT THAT THIS IS NOT AN OBLIGATION OF THE CITY OF CARMEL. SO FOR THOSE WATCHING, WHEN THEY PULL UP THESE DOCUMENTS AND THEY LOOK AT PAGE SIX OF THE TRUST INDENTURE, IF THEY CAN UNDERSTAND, AND I CAN UNDERSTAND, READING ABOUT HOW THE CITY IS NOT ON THE HOOK TO PAY BACK THIS DEBT. I DO WANT TO CALL OUT A CLARIFICATION.

BECAUSE CALLING IT AN APARTMENT PROJECT, AGAIN, IF WE ARE GOING TO DEMAND FOR PURCHASE RESIDENCES IN OUR DEVELOPMENTS LIKE THE GRAMERCY PROJECT, IT REDUCES THE TAX INCREMENT WHICH WILL THEN INCREASE THE AMOUNT, THAT WILL DECREASE THE AMOUNT OF TIF AVAILABLE FOR THE PROJECT, WHICH MEANS IT WILL INCREASE THE TIF SPLIT IN ORDER TO MAKE THE DEVELOPMENT WORK.

SO YOU CANNOT TIF IT UP AT THE 2% LEVEL AND THE AGE RESTRICTED APARTMENTS I THINK WERE VERY IMPORTANT AND NEEDED FOR SENIORS. IT IS A VERY IMPORTANT FOR THE PUBLIC TO UNDERSTAND.

IF WE ARE GOING TO SHIFT FROM MULTI FAMILY DEVELOPMENT AND REQUIRE FOR PURCHASE PRODUCT IN OUR DEVELOPMENT, YOU CANNOT TIF FOR PURCHASE PRODUCT LIKE YOU CAN FOR MULTIFAMILY OR

COMMERCIAL OFFICE. >> THANK YOU FOR THAT CLARIFICATION. IF THERE ARE NO MORE QUESTIONS OR COMMENTS THIS WILL GO TO THE FINANCE COMMITTEE. THAT NEXT MEETING IS

AUGUST 13TH. >> THANK YOU SO MUCH.

>> MOVING ONTO THE NEXT ITEM. FIRST READING OF ORDINANCE IN THE COMMON COUNCIL IN THE CITY OF CARMEL, AUTHORIZING IN THE INVESTMENT OF PUBLIC FUNDS AND THE SPONSOR IS COUNSELOR TAYLOR. CAN I GET A MOTION TO INTRODUCE? ALL RIGHT, COUNSELOR TAYLOR, READ THE SYNOPSIS. THIS ADOPTS A CITY INVESTMENT POLICY, MORE SPECIFICALLY, MORE RENEWS OUR EXISTING POLICY. SO WHEN OUR NEW CFO WAS HIRED, BECAUSE OUR POLICY EXPIRED EARLIER THIS YEAR, HE WANTED TO REVIEW IT AS IT PERTAINS TO OUR

[01:10:03]

INVESTMENT UNDER INDIANA STATE LAW, WHICH ARE VERY RESTRICTIVE. UPON HIS REVIEW HE NOTICED THAT WE ARE TAKING THE MAXIMUM ADVANTAGE OF OUR INVESTMENT POLICY ALLOWED BY INDIANA CODE. SO WE DISCUSSED POLICY, AND NO CHANGES TO THE EXISTING POLICY BECAUSE OF HOW WELL IT WAS ALREADY WRITTEN.

BUT EVERY FEW YEARS THIS POLICY MUST BE ADOPTED. ACTUALLY, EVERY FOUR YEARS. IT IS RE-ADOPTING OUR EXISTING

INVESTMENT POLICY. >> ANY QUESTIONS? WITH NO QUESTIONS, LOOKING FOR A MOTION.

>> MOVED TO APPROVE. >> MOVED TO SUSPEND THE RULES

AND ACT ON THIS THIS EVENING. >> DISCUSSION, PLEASE VOTE. THE RULES ARE SUSPENDED BY VOTE. ANOTHER MOTION. ALL RIGHT, DISCUSSION? IT IS APPROVED, 9-0. MOVING ON TO THE NEXT ITEM, ORDINANCE OF THE COMMON COUNCIL IN THE CITY OF NORMAL INDIANA, AMENDING THE 2024 SALARY ORDINANCE, MOTION TO

INTRODUCE. >> ALL RIGHT, PLEASE READ THE

ORDINANCE. >> IT AMENDS THE 2024 SALARY TO THE SYSTEMS COORDINATOR TO THE 2024 SALARY BUDGET, ADJUSTING THE SALARY OF THE CHIEF INFRASTRUCTURE OFFICER.

>> GOOD EVENING, COUNSELOR'S. AS STATED, THIS IS ANOTHER SALARY ORDINANCE AMENDMENT. WE ARE NOT ACTUALLY ADDING A POSITION WITHIN THE ENGINEERING DEPARTMENT. THE PERSON WHO IS CURRENTLY THERE IS FUNCTIONING MORE IN THE ASSETS MANAGEMENT SYSTEMS ROLE. JEREMY IS HERE AND CAN PROBABLY SPEAK TO THAT MORE THAN I CAN. BUT IT IS SIMPLY CHANGING THAT PERSON'S TITLE AND I BELIEVE THERE IS AN ADDITIONAL PAY THAT GOES WITH THAT. WITH REGARD TO JEREMY'S SALARY, IT IS NOT AN ACTUAL CHANGE IN WHAT HE IS BEING PAID BUT INSTEAD HOW IT IS BEING PAID. WE WERE INTENDING FOR HIM TO SIT ON THE BP W BUT UNFORTUNATELY THAT DID NOT WORK OUT AND SO WE ARE REALLOCATING THE MONEY WITHIN HIS BASE SALARY.

>> QUESTIONS? WITH NO QUESTIONS, I'LL GO AHEAD AND

LOOK FOR A MOTION. >> SECOND.

>> DISCUSSION? PLEASE VOTE. 9-02 SUSPEND THE RULES. ANOTHER

MOTION? >> MOVED TO APPROVE.

>> DISCUSSION? PLEASE VOTE. OH, IS THERE DISCUSSION? ALL RIGHT,

[14. AGENDA ADD-ON ITEMS]

IT HAS BEEN APPROVED, 9-0. MOVING ON TO ITEM 14. ADD-ON ITEMS. IS THERE ANY OTHER BUSINESS THAT SHOULD COME

BEFORE THE COUNCIL? >> I'D LIKE TO MAKE A MOTION THAT WE ADD, I'LL JUST READ THAT NUMBER ABOVE IT. THE INTERLOCAL AGREEMENT CONCERNING REIMBURSEMENT OF POTENTIAL COSTS FOR PORTIONS OF THE DRAIN LOCATED AT THE INTERSECTION OF COLLEGE AVENUE AND 106TH STREET IN CARMEL, INDIANA.

>> PLEASE VOTE. FOR ADD-ONS THERE IS NO DISCUSSION. IT HAS BEEN ADDED, 9-0. JEREMY, CAN YOU COME UP TO EXPLAIN THAT

[01:15:01]

THIS AGREEMENT? >> WITH THE COLLEGE AVENUE RECONSTRUCTION PROJECT WE COORDINATED UTILITIES AND THE ENGINEER TEAM HAS DONE A FANTASTIC JOB OF GETTING A LOT OF THE COMMUNICATIONS, ALL THE TELECOMMUNICATIONS LINES TO BE RELOCATED IN A JOINT FORMAT SO WE CAN CONTROL WHERE THEY ARE GOING AND MINIMIZE CONFLICTS. WE WERE JUST GETTING READY TO GO WHEN IT CAME UP THAT SOME OF THESE UTILITIES ARE GOING WITHIN A REGULATED DRAIN EASEMENT. SO WHEN THAT GOT BROUGHT BEFORE THE DRAINAGE BOARD, THEY WERE ACTUALLY SEEKING REIMBURSEMENT AGREEMENTS WITH EVERY SINGLE UTILITY, WHICH WOULD HAVE CAUSED A TREMENDOUS DELAY, EVEN IF THAT WERE TO BE POSSIBLE. SO WHAT THEY CAME UP WITH WAS TO SIGN A LOCAL AGREEMENT THAT SAYS THEY WOULD SEEK REIMBURSEMENT FROM US BUT WE ALSO RESERVE THE RIGHTS TO SEEK REIMBURSEMENT FROM THE UTILITIES. THAT IS WHAT THE DRAINAGE BOARD CAME UP WITH TO ALLOW THE PROJECT.

>> ANY QUESTIONS? >> DO WE HAVE AN IDEA OF THE

POSSIBLE COST OF THAT REPAIR? >> I THINK THE RISK IN THIS IS FAIRLY MINIMAL. THE UTILITIES ARE BEING RELOCATED WITHIN THE RIGHT AWAY. SO I FEEL LIKE WE HAVE THE AUTHORITY TO HAVE THE UTILITIES MOVED. THEN THE DRAINAGE EASEMENT OVERLAPS AT THE RIGHT AWAY. PART OF THE ISSUE IS THE DRAINAGE PROJECT HAS BEEN VERY SLOW GOING IN MY OPINION DUE TO LACK OF UTILITY COORDINATION. SO GOING FORWARD IN THE FUTURE, THIS WORKS FOR

US. >> I JUST HAD A QUESTION, I DIDN'T UNDERSTAND HER THE INTERLOCAL AGREEMENT. TRANSPORT OBVIOUSLY HAS THE AUTHORITY TO REQUEST REIMBURSEMENT OF DAMAGE FROM UTILITIES AS THEY ARE STATUTORILY REQUIRED TO MANAGE DRAINS THROUGHOUT THE COUNTY. HOW DOES THIS INTERLOCAL AGREEMENT SHIFT THAT ABILITY FOR US TO SEEK THOSE REIMBURSEMENTS AS THE DRAINAGE BOARD WOULD?

>> THE PART OF THE REIMBURSEMENT THAT IS ODD OR AT LEAST MINIMAL RISK TO THE CITY, IF WE WERE TO TRY TO GO PULL THE FIBER OUT, I THINK WHAT THEY THINK IS, IF YOU DON'T MOVE WITHIN A CERTAIN PERIOD OF TIME, IF YOU DON'T MOVE IT, YOU COULDN'T GET ANYONE TO MOVE IT FOR YOU. I DON'T THINK WE COULD HIRE A COMPANY THAT WOULD GO AND CUT AT&T'S FIBER LINES. THAT'S WHY I THINK THIS IS MINIMAL RISK TO US. I DON'T THINK YOU COULD GET ANYBODY TO MOVE THE UTILITIES FOR THEM. I WAS A LITTLE BIT PERPLEXED THAT THAT THEY WERE ASKING FOR THE REIMBURSEMENT. PART OF IT WAS THE SURVEYOR'S OFFICE, THEY DON'T HAVE TO LEGALLY ALLOW UTILITIES INTO THE EASEMENT EITHER. THAT WAS THE BIG HURDLE WITH WHAT WE CAME UP WITH THAT WE COULD GRADUALLY RELOCATE THE EASEMENT.

>> ANY OTHER QUESTIONS? COUNSELOR TAYLOR, ANYTHING

ELSE? >> THE CORPORATION COUNSEL REVIEW THIS? AND YOU ARE FINE WITH THE ABILITY FOR US TO PURSUE REIMBURSEMENT FOR THE UTILITIES?

>> WE HAVE REVIEWED IT AND WE ARE COMFORTABLE WITH IT. THIS IS A MORE FORMAL AGREEMENT THAN WHAT WE WOULD GENERALLY SEE FOR THIS TYPE OF THING. AT THIS POINT OUR FEELING IS IF WE WOULD GO THROUGH THAT ROUTE AND USE THE REIMBURSEMENT PROCESS, IT WOULD ACTUALLY EXTEND THE TIME PERIOD AND PUT US FURTHER

BEHIND IN THE PROJECT. >> I THINK WHAT RICH IS SPECIFICALLY ASKING, WE HAVE THE AUTHORITY TO SEEK REIMBURSEMENT. WE CANNOT DO THAT AND YOU DON'T SEE ANY ISSUE? DOES THAT HARBOR A YES TO THAT QUESTION?

>> I BELIEVE THAT IS CORRECT. WE'VE BEEN WORKING ALONGSIDE

THE TOWNSHIP. >> SO WE HAVE THE SAME RECOVERY AUTHORITY AS THE DRAINAGE BOARD? JUST BY VIRTUE OF WHERE

[01:20:03]

IT IS LOCATED? >> WE CAN ASK FOR THAT

REIMBURSEMENT REGARDLESS. >> THANK YOU.

>> ANY OTHER QUESTIONS? LOOKING FOR A MOTION.

>> MOVED TO APPROVE. >> SECOND.

>> DISCUSSION? PLEASE VOTE. ALL RIGHT, THAT IS APPROVED 9-0.

[16. ANNOUNCEMENTS]

ITEM NUMBER 15, OTHER BUSINESS, THERE IS NONE. ANNOUNCEMENTS, ITEM NUMBER 16, ANY ANNOUNCEMENTS?

>> IN THE LAST MEETING WE TALKED A LOT ABOUT JIMMY CASHMAN AND HELP EXCITED WE WERE TO HAVE HIM IN THE NEW POSITION, WOULD YOU MIND INTRODUCING THE NEW CITY ENGINEER SINCE HE HAPPENS TO BE HERE?

>> OUR NEW CITY ENGINEER IS BRADLEY PEASE. HE LOOKS A LOT LIKE OUR OLD STAFF ENGINEER BECAUSE WE BROUGHT HIM BACK.

>> I WAS VERY SAD WHEN BRAD LEFT US A FEW MONTHS AGO AND VERY EXCITED WHEN HE CAME BACK. ONE THING I LOVE ABOUT BRAD IS THAT HE IS A VERY COMPETENT ENGINEER AND ALSO WELL A LOT OF PEOPLE GOT LAZY DURING COVID, HE HAS A VERY UNIQUE UNDERSTANDING FROM THE TECHNICAL AND PRACTICAL SIDE.

NO ONE BETTER TO FILL YOUR SHOES. I AM VERY HAPPY TO SEE

YOU HERE. >> THANK YOU.
